Short News NCLT invokes rare measure to gain control of real-estate giant Unitech

New Delhi : The National Company Law Tribunal on Friday allowed the government to appoint new management for real-estate giant Unitech Ltd. in a rare move, as the corporate affairs ministry sought to take control of the embattled company. The NCLT agreed on Friday to the government’s plea and issued notices to Unitech’s existing directors, who are now restrained from acting as board members. The two-member bench said the government can appoint 10 nominee directors, whose names it will examine on December 20. The petition hinges on allegations of fund diversion adversely affecting public interest and marks the second time that the ministry has taken control of a company, people with knowledge of the matter said, asking not to be identified as they are not authorized to speak publicly. Thousands of buyers across India have been left in the lurch by indebted developers such as Unitech and Jaypee Infratech Ltd. after a slump in sales forced them to slow or halt construction of projects. Unitech’s Managing Director Sanjay Chandra, part of the founding family, was arrested in April this year following a complaint by people who weren’t given possession of their flats.

Delhi’s Max hospital license cancelled, wrongly declaring newborn dead unacceptable: Satyendra Jain New Delhi : The Delhi government on Friday said that it has decided to cancel the licence of Max hospital, Shalimar Bagh with immediate effect. The decision comes after the hospital has been found guilty of medical negligence for erroneously declaring a new born as dead. The treatment of existing patients will continue and an option will be given to them to move to another hospital, Delhi Health Minister Satyendra Jain said. He added that the hospital cannot admit a new patient with immediate effect. The decision comes after the

three-member panel, set up by the government, found the hospital guilty of medical negligence. “We cannot tolerate any criminal negligence. What has happened is not acceptable. We have earlier also issued notices to hospital for violating EWS norms. The Delhi government has decided to cancel the licence of Max Hospital, Shalimar Bagh. Hospital has been found guilty. For action against the doctors the Delhi Medical Council are competent to take action,” Jain said. The hospital can carry out the treatment of existing patients.

Tax revenues need to stabilise before merger of GST rates: Sushil Modi Kolkata : GST Council member Sushil Kumar Modi Friday said he is in favour of letting the tax revenues stabilise before the panel considers merger or further rationalising of slabs. “Let revenue stabilise and tax buoyancy come, then the Council will look into rationalising or merging tax slabs of 12 and 18 per cent,” Modi, who is also

the Deputy Chief Minister of Bihar, said in his address to Bharat Chamber of Commerce members here. He said after the Council’s previous meeting at Guwahati last month, 90 per cent of the tax slabrelated issues have been resolved and the rest too will be sorted soon. He said only 50 items remained in the top 28 per cent tax slab now. However, he

remained bullish that revenue for both the Centre and states will grow and the Goods and Services Tax (GST) regime will stabilise. He acknowledged that most of the problems are being faced now by the micro, small and medium enterprises (MSME) and the textiles sector as they were exempted from paying taxes in the past under the valueadded tax (VAT) regime.

Enforcement Directorate attaches Lalu Prasad Yadav’s land in Patna

patna : The ED on Friday said it has attached a three-acre plot worth Rs 45 crore in the Bihar capital in connection with its money laundering probe in the IRCTC hotel allotment scam case involving RJD chief Lalu Prasad and his family. Agency sources said the land is allegedly in the name of the family members of Lalu Prasad and a mall was supposed to be constructed in Patna. The estimated market value of the plot is Rs 45 crore, they said. The property has been provisionally attached under the Prevention of Money Laundering Act (PMLA). The central probe had last week

questioned Lalu Prasad’s wife and former Bihar Chief Minister Rabri Devi in this case in Patna. It has earlier questioned Rabri Devi’s son Tejashwi Yadav, the former deputy chief minister of Bihar, twice in this case. In July, the agency registered a case against Lalu Prasad, his family members and others under the provisions of the Prevention of

Money Laundering Act (PMLA). Just before this, the Central Bureau of Investigation (CBI) registered a criminal first information report and conducted multiple searches on the properties of Lalu Prasad and others. The CBI FIR alleged that Lalu Prasad, during his tenure as the railway minister in UPA-I, handed over the maintenance of two Indian Railway Catering and Tourism Corporation hotels to a company in 2004 after receiving a bribe in the form of a prime land in Patna through a ‘benami’ company owned by Sarla Gupta, wife of Prem Chand Gupta, a former Union minister.

As Adivasis ignored, rage is brewing

The Adivasi homelands are restive. From Palamau to Adilabad a new consciousness is making India’s original people ask questions. How long will Adivasis not only be denied what is their due, but exploitation by outsiders who not only oppress them but also ostracise them continue? Tribal people account for 8.2 per cent of India’s population. They are spread over all states and Union territories. They can be broadly classified into three groups. The first comprises those who predate the Indo-Aryan migrations — who are termed by many anthropologists as Austro-Asiaticspeaking Australoid people (including Central India Adivasis). The other two major groups are the Caucasoid tribes who migrated into northwestern India, and the Sino-Tibetan or Mongoloid tribal people of the Himalayan and northeastern regions who migrated more recently. Article 366 (25) of the Constitution defines Scheduled Tribes as “such tribes or tribal communities or part of or groups within such tribes or tribal communities as are deemed under Article 342 to be Scheduled Tribes (STs) for the purposes of this Constitution”. The criteria for classification being geographical isolation, backwardness and having distinctive culture, language, religion and “shyness of contact”. There are some 573 communities recognised by the government as STs, and therefore eligible to receive special benefits and to compete for reserved seats in legislatures, government jobs and educational institutions. The biggest tribal group, Gonds, number about 16 million, and are spread out in Maharashtra, Madhya Pradesh, Telangana, Chhattisgarh and Odisha, closely followed by Santhals, with about 14 million. Central India is home to the country’s largest Adivasi tribes, and, taken as a whole, roughly 75 per cent of the India’s tribal population lives here. The term Adivasi carries the specific meaning of being the original inhabitants of a given region and was specifically coined for that purpose in the 1930s. Clearly, all Scheduled Tribes are not Adivasis. Unlike Adivasis, the other two broad tribal groups have fared better in post-Independent India. Within them some, like the Meenas and Gujjars of Rajasthan, Lambadas of Maharashtra and Telangana, and Khasis, Mizos, Angami and Tangkhul Nagas, and the Meitei in the Northeast have done exceptionally well. Unlike the Northeast tribes, the Meenas and Gujjars don’t even meet the stipulated criteria of geographical isolation, backwardness, distinctive culture, language and religion. Forget “shyness of contact”! We all now know that big government, in the absence of a responsive nervous system, actually means little government, and whatever little interaction the people at the bottom have with the State is usually none too happy. In the vast Central India highlands, the occasional visit of an official invariably means extraction by coercion of what little the poor people have. It doesn’t just end with a chicken, goat or a bottle of mahua, it often includes all these and the modesty of the womenfolk.

The makers of Deepika, Irrfan starrer are fighting for the title Deepika Padukone and Irrfan Khan, the ‘Piku’ jodi, will be once again seen together in Sapna Didi biopic, produced by Vishal Bhardwaj. Vishal wants to title the film as ‘Rani’, but it seems like he is facing problems to get the ownership rights for the same from ‘Rang Rasiya’ director Ketan Mehta who previously planned a movie based on Rani Laxmibai with Kangana Ranaut in the lead. As reported by a leading tabloid, a source stated that Vishal and Ketan are fighting over the name Rani. The source stated, “Vishal has been asking for the title since the past six months. Deadline for PAN-Aadhaar linkage extended till March 31

New Delhi: The government on Friday extended the deadline for mandatory linking of PAN with Aadhaar by three months to March 31, 2018. This is the third extension given by the government to individuals to link the Permanent Account Number (PAN) with the biometric ID. The Centre had already informed the Supreme Court that it is willing to extend till March 31 the deadline fixed for mandatory linking of Aadhaar to avail various services and welfare schemes. “It has come to notice that some of the taxpayers have not yet completed

the linking of PAN with Aadhaar. “Therefore, to facilitate the process of linking, it has been decided to further extend the time for linking of Aadhaar with PAN till March 31, 2018,” the finance ministry said. As of November, 13.28 crore out of 33 crore PANs have been linked to the 12-digit biometric identifier Aadhaar. This year, the government made quoting of Aadhaar mandatory for filing income tax returns (ITRs) as well as obtaining a new PAN. Section 139 AA (2) of the Income Tax Act says that every person having PAN as on July 1, 2017, and eligible to obtain

Aadhaar, must intimate his Aadhaar number to the tax authorities. The government had in August extended by four months the deadline for linking PAN with Aadhaar till December 31, pending the Supreme Court verdict. The Supreme Court is hearing petitions challenging the government’s decision on Aadhaar. The apex court has said it may consider setting up of a constitution bench to hear pleas challenging the Centre’s move to make Aadhaar card mandatory for availing various services and benefits of welfare schemes.

New Delhi: Employees’ State Insurance Corporation (ESIC) is providing services to around 10 per cent of population in the country with its presence in over 461 districts, Labour Minister Santosh Gangwar has said. “ESI scheme has presence now in over 461 districts providing benefit to around 10 per cent of Indian population,” Gangwar said in a statement issued by Labour Ministry on Friday. The 172nd meeting of ESIC on Wednesday saw some important decisions towards improvement in its service delivery mechanism. Earlier also, ESIC had taken decision to form subsidiary Corporation/Society at state level. Based on the feedback and suggestions from states it was decided to revise the Memorandum of Association of the Employees State Insurance Society (ESIS) in the states who opt for it. The society thus formed will serve as a managerial and health care body for administration and management of medical benefits and medical establishments in the state, besides operating and maintaining ESIC dispensaries run by states, it said. Besides, in order to strengthen the primary care services and decongest hospitals, ESIC had earlier decided in-principle for upgradation of up to 1/3rd of ESI dispensaries into six- bedded hospitals. This upgradation will be done in a phased manner, the statement said. The ESIC also approved starting of 50-bedded medical facilities/hospital at Alwar, Rajasthan and 100-bedded medical facilities/ hospital at Bihta, Patna, Bihar. A policy for utilising the services of undergraduates and postgraduates from ESI Medical Colleges/ESI-PGIMSRs in ESI Hospitals/Dispensaries has been approved, it said.

Mumbai: Market benchmark Sensex surged 301 points to close at 33,250.30 on Friday on unabated buying by domestic institutional investors amid positive global leads. The wider NSE Nifty too went past the 10,250-level. The 30-share BSE Sensex opened on a strong footing at 33,034.20 and maintained its upward trend to hit the day’s high of 33,285.68 before ending at 33,250.30, up 301.09 points, or 0.91 per cent. The index had rallied 352.03 points in the previous session on valuebuying by investors in recently-battered blue-chip stocks. The Nifty finished the day at 10,265.65, a hefty gain of 98.95 points, or 0.97 per cent, after shuttling between 10,270.85 and 10,195.25. On a weekly basis, the Sensex gained 417.36 points, or 1.27 per cent, while the Nifty advanced 143.85 points, or 1.42 per cent. Most Asian and European markets rallied as investors awaited major economic data from China and the US amid overnight gains at Wall Street following reports that President Donald Trump is planning to unveil a big-spending public works plan.

Gujarat polls 2017: Narmada waters more in canals than in farms

Surendranagar : Thakarshibhai Dayabhai Patel does not deny that the Narmada river waters have reached Gujarat’s parched Saurashtra region. They are, indeed, irrigating his own and also other farmers’ fields in Malod village of Surendranagar district’s Wadhwan taluka. “The issue isn’t whether the water has come, but at what cost,” says this 30-acre farmer whose village is just a couple of kilometres from the Dhanki-Botad subbranch canal. There is enough water in this one as well as five other sub-branches — Vallabhipur, Maliya, Limbdi, Dhrangadhra and Morbi — of the Saurashtra Branch Canal (SBC), which, in turn, offtakes from the Narmada Main Canal (NMC) near Kadi in North Gujarat’s Mehsana district. According to Patel, the problem is not with water in the canals or sub-branches, but taking it further to the fields, “for which we have had to shell out money ourselves”. He is among the many farmers in Malod and adjoining villages who have installed diesel engines on the bunds of the Botad sub-branch canal, to “lift” and carry the Narmada waters.

Can’t direct Govt to appoint full-time DGP, EC tells High Court Ahmedabad : The Election Commission (EC) on Thursday told the Gujarat High Court that it cannot direct the state government to appoint a regular DGP considering the model code of conduct and added that “steps should have been taken much in advance”. The division bench of high court led by chief justice R Subhash Reddy had directed the ECI to file an affidavit on a public interest litigation (PIL) that sought appointment of full-time DGP. The EC in its affidavit stated, “The commission in their communication to chief electoral officer, Gujarat, observed that the post had been lying vacant for quite sometime and steps should have been taken much in advance for appointment of a regular DGP so that this kind of situation could not have arisen.” The EC was referring to its communication with the Gujarat chief electoral officer over choosing the next in-charge DGP after IPS officer Geetha Johri, who was holding the charge, retired on November 30. According to the EC’s affidavit to the High Court, it received a list of names of the IPS officers who could replace Johri from the state government on November 30.

A video showing Mehta making several remarks against the minority community went viral on Wednesday following which a complaint was filed by activist Nishant Verma, a resident of Ahmedabad, with the Election Commission on Thursday. international Going backwards: Trump govt moves to block transgender recruits to Pentagon Washington: President Donald Trump’s administration has asked a federal court to block the Pentagon from starting the hiring of transgender recruits in 2018. The filing by the Justice Department late on Wednesday is the latest in a series of legal measures that have unfolded since Trump sent out three tweets in July saying that transgender troops could not serve “in any capacity” in the military. Those tweets, later followed by a formal White House memorandum, set off a roar of protest -- with several service members and rights groups quick to sue. Two federal courts have since temporarily blocked Trump’s ban, and the Pentagon was due to start accepting transgender recruits on January 1. The government’s filing

calls for a partial delay, specifically that the Pentagon does not accept transgender recruits from that date. “Defendants request that the court stay the portion of its preliminary injunction requiring defendants to begin accessing transgender individuals into the military on January 1, 2018,” pending an

appeal decision, court documents state. The Pentagon declined to comment on the litigation. Under a new policy announced in 2016 by the Obama administration, the Pentagon was originally supposed to start accepting transgender recruits on July 1, 2017.

HC directs EC to allow polling agents from same constituency Ahmedabad : The Gujarat High Court on Thursday directed the Election Commission (EC) to allow candidates contesting the Assembly elections to appoint people who are voters of the constituency, and not necessarily from the same polling station, as polling agents at booths. Till now, the commission allows only those to be appointed as polling agents who are voters of the same polling station and not from anywhere from the constituency. Granting relief to the candidates, the Division Bench of Justice Akil Kureshi and Justice A Y Kogje directed the Election Commission to “permit a candidate to appoint a polling agent or substitute agent, any person who is the resident and the elector of the same constituency, of which, the polling booth in question

forms a part.” The court also issued notices to the Election Commission and Chief Electoral Officer of Gujarat, seeking replies by December 20. The order came on a set of two petitions moved by Arjun Khatariya, a Congress candidate contesting from Gondal Assembly seat in Rajkot district. Khatariya had alleged that due to fear of his BJP rival candidate Gitaba’s husband, Jayrajsinh Jadeja, no

one was ready to become his polling agent. He had therefore sought permission fromt the High Court to appoint polling agents from anywhere from the whole of constituencies. On Thursday, he was joined by state Congress challenging “the insistence of the Election Commission that the polling agent and the relief agents of every booth must be a voter of the area falling within the same polling station”.
