Short News Centre seeks ban on female genital mutilation, SC gives nod New Delhi: With the Centre seeking ban on female genital mutilation (FGM) on Monday, the Supreme Court also indicated that it was opposed to FMG or circumcision as no one can use the religious practices to touch a female’s body and violate integrity of her body part. FMG or ‘khatna’ is a practice prevalent among the Dawoodi Bohra religious community of Shia sect, as it is a crime and punishable offence. This practice is an age-old tradition in this community to mark the arrival of womanhood. Attorney General KK Venugopal, appearing for the Centre told a Bench of Chief Justice Dipak Misra and Justices AM Kanwilkar and DY Chandrachud the government was in favour of a ban on religious practices that force girl child to undergo genital mutilation or circumcision.

‘Jihadis behind rape, murder of 8-yr-old in Kathua’, says defence lawyer Jammu: A lawyer defending some of the accused in the Kathua rape-and-murder case on Sunday claimed that “jihadis” are behind the gruesome incident and that the body of the eight-year-old girl had been planted to change the religious demography of the Jammu and Kashmir. The allegation, for which Ankur Sharma had no substantial evidence to support, came a day after the complainant in the case finished recording his statement before the district and sessions court at Pathankot, during which he said Sanji Ram, one of the main accused, had been targeting the nomadic community so that they don’t settle in the village. Ankur Sharma, one of the lawyers defending the accused in the Kathua rape-and-murder case, asked Governor N N Vohra to immediately order a CBI enquiry into the case. However, judicial experts expressed surprise at the claims and demands from the lawyer as the case had been entrusted to the district and sessions court on the directions of the Supreme Court and the trial court had already framed charges against the accused.

New Delhi: The Supreme Court on Monday rejected an appeal for a reduced sentence and reaffirmed the death penalty for the accused in the rape and murder of a medical student in Delhi in 2012. The four convicts will hang to death. The apex court was hearing the review petition filed by three of the four convicts seeking reduction of their death sentence to a life term. They were sentenced earlier by the court for the brutal gangrape of a 23-year-old medical student on a moving bus in Delhi on December 16, 2012. How can you be selective in accepting SC verdict: Kejriwal to L-G Anil Baijal New Delhi: Chief Minister Arvind Kejriwal on Monday wrote to Lt Governor Anil Baijal wondering how he can be “selective” in accepting the Supreme Court judgement on power tussle between the Delhi government and the Centre. In the letter, Kejriwal urged Baijal to implement the apex court’s order in letter and spirit and asserted that the Ministry of Home Affairs does not have powers to interpret the order. He also urged the L-G to approach the Supreme Court immediately for clarification, in case of any confusion while saying “but kindly don’t violate the order of the apex court”. “But how can you be selective in accepting the judgement? Either you should take a position that all the matters now would be placed before regular bench and therefore, you would not implement any part of the order. Or you should accept the whole order and implement it. How can you say that you will accept this para of the order but not accept that para of the same order?” Kejriwal said in his letter. NCLT rejects Cyrus Mistry’s plea, rules in favour of Tata Sons

Mumbai: The National Company Law Tribunal on Monday dismissed Cyrus Mistry’s petition challenging his illegal removal as chairman of Tata Sons. The Mumbai Bench of the NCLT ruled in favour of Tata Sons saying the board of directors are competent to remove executive directors. The tribunal did not find any merit in legacy issues raised by Cyrus Mistry against Tata Sons. NCLT said Cyrus Mistry was removed because Tata Sons Board and its members lost confidence in him. The tribunal said it was not accepting Mistry’s contentions that his removal was due to the result of mismanagement by the board

Rich farmers will gain the most from MSP hikes

The common narrative about the government’s hike in minimum support prices (MSPs) for farm produce is that farmers will benefit. But the question is: which farmers? We have small farmers, marginal farmers, peasants and kulaks and landlords. Farmers in Punjab and Haryana are different from their brethren in Bihar and West Bengal or the north-east. There are farmers who plant paddy, those who cultivate coarse grains and those who cultivate cotton or sugarcane. Which farmers gain the most? A National Sample Survey Office (NSSO) report that mapped the income, expenditure and indebtedness of agricultural households in India in 2013 provides some clues. For households owning farms of less than 0.4 hectares, who are a third of all agricultural households, net receipts from cultivation account for less than a sixth of income. They will certainly not benefit from higher MSPs. For those holding between 0.4 and 1 hectare, net receipts from cultivation are around two-fifths of their earnings. This class constitutes another third of all farming households. They too won’t gain much. Taken together, farmers owning up to 1 hectare of land constitute 69.4% of total agricultural households. The report finds their monthly consumption expenditure is higher than their earnings from all sources, which means they are chronically in debt. Many rely on moneylenders, rich farmers and landlords to advance them the money needed for cultivation and they are often forced to sell their produce to these financiers at lower than market prices. In short, almost 70% of farming households are unlikely to be beneficiaries of the MSP hike. On the other hand, those having more than 4 hectares of land, a mere 4.1% of the farming population, get more than three quarters of their net income from cultivation. It is the rural rich, rural India’s ruling class, who pay no income taxes, who gain the maximum benefit from farm loan waivers, who will reap the bonanza from higher MSPs. The revelations of the Shanta Kumar Committee report underscored that fact. It found that a mere 5.8% of agricultural households in India had sold paddy or wheat to any procurement agency. Even these households sold only a part of their total sales, ranging from 14-35% for different crops, at MSP. Said the report, “The upshot of this entire evidence is that the direct benefits of procurement operations in wheat and rice, with which FCI (Food Corporation of India) is primarily entrusted, goes to a minuscule of agricultural households in the country. Obviously then, much of the procurement that government agencies undertake comes from larger farmers, and in a few selected states (Punjab, Haryana, Andhra Pradesh and lately from Madhya Pradesh and Chhattisgarh).”

Kolkata : The friction between the Indian cricket board office-bearers and the Committee of Administrators (CoA) continues, with the latest issue being the BCCI general manager for cricket operations, Saba Karim’s proposed visit to the UK. Karim’s DA allotment for a nine-day trip is $4,050 (Rs 2.7 lakh approx), but the BCCI treasurer Anirudh Chaudhry has requested for some information from the CoA before giving the goahead for the release of the forex. Chaudhry said he is “not aware of the reasons” for Karim’s proposed trip, as “no paper, document or communication other than the letter for me to affix my signature” has been sent to him. He also cited previous examples, wherein the CoA had restricted the BCCI acting secretary,

Karim is supposed to go to England to be alongside the India A and U-19 team coach Rahul Dravid, who has lined up meetings with the England and Wales Cricket Board (ECB) top brass next week. New Delhi: The income tax department has sold roughly 40 per cent of Cairn Energy plc’s shareholding in Vedanta to recover a part of the Rs 10,247 crore retrospective tax it had raised against the British firm. While an international arbitration tribunal is to begin final hearing in Cairn’s challenge to the tax imposed retrospectively, the I-T department realised USD 216 million from selling some of the firm’s residual holding in Vedanta. “As previously announced, the Indian Income Tax Department (IITD) has continued to enforce its retrospective tax claim against Cairn whilst the treaty arbitration has been ongoing. “To date the IITD has seized dividends due to Cairn from its shareholding in Vedanta Limited (VL) totalling USD 155 million

and it has offset a tax rebate of USD 234 million due to Cairn as a result of overpayment of capital gains tax on a separate matter,” Cairn Energy said in a statement. The firm said it has now been notified by the IITD that it has sold part of its shareholding in VL, realising and seizing proceeds of USD 216 million. “Following this sale, Cairn’s retained holding in VL is now approximately 3 per cent. It is possible that the IITD may make further sales,” it said. The income tax department had seized nearly 10 per cent of Cairn’s shareholding in its erstwhile subsidiary Cairn India after issuing a Rs 10,247 crore tax demand notice in January 2014 After Cairn India got merged with Vedanta, the shareholding came down to 5 per cent.

New Delhi: Gold prices went up by 0.20 per cent to Rs 30,622 per 10 grams in futures trade today as speculators built up fresh positions, tracking a firm trend overseas. At the Multi Commodity Exchange, gold for delivery in August moved up by Rs 62, or 0.20 per cent, to Rs 30,622 per ten grams in a business turnover of 167 lots. Mumbai: Market benchmark Sensex surged by around 277 points to close at more than five-month high of 35,934.72 today on heavy buying in energy, capital goods, power and banking stocks following positive leads from global markets and a strengthening rupee. The broad-based NSE Nifty too went past the 10,800-mark as investors shifted focus on corporate earnings from trade tensions. The BSE Sensex rallied for the second day by rising 276.86 points or 0.78 per cent to settle at 35,934.72, the highest closing level since January 31, when it had closed at 35,965.02. The NSE Nifty ended 80.25 points or 0.74 per cent higher at 10,852.90. Asian markets mostly closed higher and European stock markets advanced in opening trade, tracking gains on Wall Street on Friday after a strong jobs data for June allayed fears of impact of the USChina trade dispute. Appreciating rupee against the dollar and fresh buying by domestic institutional investors added to the momentum, brokers said. Investors were also looking forward to the

quarterly results of IT majors TCS and Infosys that will kick-start the earnings season later this week, they added. Infosys was up 1.14 per cent at Rs 1,299.15, while TCS was trading lower by 1.34 per cent at Rs 1,887.65. Other IT counters like HCL Technology, Tech Mahindra and Wipro gained up to 1.68 per cent. The 30-share BSE Sensex opened on a strong footing at 35,835.10 and maintained its upward trend to hit the day’s high of 35,977.37. It finally ended at 35,934.72, up 276.86 points, or 0.78 per cent. The gauge had gained 83.31 points in the previous session on Friday. The Nifty finished the day at 10,852.90, showing a gain of 80.25 points or 0.74 per cent after shuttling between 10,860.35 and 10,807.15. This is the highest closing since June 13, 2018 when it had closed at 10,856.70. DIIs bought shares worth a net of Rs 1,480.82 crore, while foreign portfolio investors (FPIs) sold equities to the tune of Rs 968.18 crore on Friday, provisional data showed.

Mumbai-Ahmedabad bullet train: Godrej Group moves HC against land acquisition Ahmedabad : The Godrej Group has moved the Bombay High Court challenging the proposed acquisition of its prime property in suburban Vikhroli to pave way for the government’s ambitious bullet train project between Ahmedabad and Mumbai.The conglomerate has sought a direction to authorities concerned to change the project’s alignment, so that it can get nearly 8.6 acres of land belonging to its infrastructure arm Godrej Construction out of the project’s map. As per the current alignment of the bullet train project, of the total 508.17 km of rail track between Mumbai and Ahemdabad, about 21 km is planned to be underground. One of the entry points to the underground tunnel falls on the land in Vikhroli. The petition, filed last month, is expected to be heard by a single judge bench of the high court on July 31. The bullet train project is also facing opposition from

farmers in Gujarat and Maharashtra. Four farmers from Gujarat have petitioned the high court in their state challenging land acquisition. The foundation stone for the project was laid by Prime Minister Narendra Modi and his Japanese counterpart Shinzo Abe in September last year in Ahmedabad. The country’s first bullet train will run at a maximum speed of 350 km per hour, covering the stretch in under three hours from the usual seven. The train will halt at 12 stations, out of which four will be in Maharashtra. Eralier it was reported that the Ministry of Rural Development of the central government became party in the petition in the Gujarat High Court pertaining to objections by farmers in the state against the bullet train, especially regarding the manner in which land is being acquired. The state government has been delaying the hearing, claimed the advocate representing the farmers.

SC seeks response on Ahmed Patel’s plea to stay proceedings against his election to RS

Ahmedabad : The Supreme Court on Monday sought a response from BJP leader Balwantsinh Rajput on a plea filed by veteran Congress leader Ahmed Patel seeking a stay in proceedings in the Gujarat High Court against his election to the Rajya Sabha. Rajput had moved the high court after he lost to Patel in the election to the Upper House in August last year. While the bench, headed by Chief Justice Dipak Misra allowed framing of issues, it directed the Gujarat High Court not to proceed in the case thereafter. Posting the matter after four weeks, the bench, which also comprised Justices A M Khanwilkar and D Y Chandrachud, asked both the parties to complete their pleadings by filing replies and rejoinder affidavits in the meantime. Challenging Patel’s election in the high court, Rajput had questioned the Election Commission’s decision to invalidate two votes by rebel Congress MLAs after the Congress party had objected. Rajput had also accused Patel of indulging in corrupt practices by allegedly holding 44

Bangkok : A Thai government minister on Monday blamed Chinese tour operators for the deaths of more than 40 people, most of them Chinese tourists, in a boat accident off a resort island last weekend, as divers searched for 11 people still missing. The boat, the Phoenix, went down in high seas on Thursday off the west-coast island of Phuket with 101 people on board, including 89 tourists, all but two of them from China, and 12 crew, during an outing to a small island for snorkelling. The death toll, which is likely to surpass 50, makes it the worst tourist-related disaster in Thailand in years and underscores long-standing concerns about its safety. The rainy season now underway can bring fierce squalls and high seas in southern Thailand, especially off its west coast, and questions have been raised about why the boat had set out to sea despite warnings of bad weather.

I won’t be encouraging people to do that, I think it’s the wrong thing to do.” He added that he would not run for the leadership of the Conservative Party in the future.
