Quota in promotions: Five-judge bench to decide whether 2006 order needs to be revisited

Agency | New Delhi

A Constitution Bench of the Supreme Court will examine whether its 2006 judgment on the reservation for Scheduled Castes and Scheduled Tribes in promotions needs to be revisited. The matter was referred to the Constitution Bench Wednesday by a three-judge bench comprising Chief Justice of India Dipak Misra and Justices A K Sikri and Ashok Bhushan. The Constitution Bench has to decide on the limited issue whether the order in

The local Devi Ahilya Bai Holkar Airport will join the club of select airports in the country that remain busy 24 hours if everything goes as per the Airports Authority of India’s (AAI’s) plan, a senior official said today. “Our priority is to improve facilities for passengers at fast pace and increase cargo transport from the Indore airport,” AAI Regional Executive Director (Western Region) Keshav Sharma told reporters.. Mahadayi issue: ball in BJP’s court, Siddaramaiah Agency | Belagavi

Karnataka Chief Minister Siddaramaiah today said that the ball was now in the BJP’s court to settle the inter-state Mahadayi river water dispute. He was reacting to BJP’s protest by entering the well of the House in the Legislative Assembly against ministers being absent as the issue was being discussed. PWD Minister H C Mahadevappa and Bengaluru development minister K J George were the only two ministers present.

M Nagaraj vs Union of India needs to be looked at afresh. The Constitution Bench will not go into the merit of the matter. In 2006, a five-judge Constitution Bench had ruled that the state was not bound to provide reservation for SCs/STs in promotions. But in case any state wished to make such a provision, it was required to collect quantifiable data showing backwardness of the class as well as its inadequate representation in public employment. Additionally, the state was required to ensure that reservation does not breach the 50 per cent ceiling, adversely affect the

creamy layer or extend it indefinitely. Acting on a 2015 petition filed by the Tripura government which challenged an order of the Tripura High Court, a twojudge bench of Justices Kurian Joseph and R Banumathi referred the matter Tuesday to a Constitution Bench. “Having regard to the questions involved in this case, we are of the opinion that

this is a case to be heard by a bench as per the constitutional mandate under Article 145(3) of the Constitution of India. Ordered accordingly. Place the files before the Honourable Chief Justice of India immediately,” the two-judge bench said. Ryan murder case: Victim’s father says Haryana govt asked him not to insist on CBI probe Agency | New Delhi

Varun Thakur, the father of the Class II student who was murdered in Gurgaon’s Ryan International School on September 8, claimed the Haryana government asked him to refrain from seeking a CBI probe, said. Thakur on Wednesday said he was told by minister Rao Narbir Singh that a CBI inquiry would take time, and that the family should trust the state police’s

investigation. “Haryana minister Rao Narbir Singh came to us and asked not to insist on a CBI inquiry as it will take time, and trust a police probe. I said if CBI also comes to the same conclusion as the police then we will accept it, but we want a CBI probe first,” Thakur was quoted as saying said. In response to

Thakur’s statement to the media, Singh on Wednesday defended himself saying he told the victim’s family to give the police a week’s time before recommending a CBI probe. “I had just said that no government can recommend a CBI inquiry on same day of incident. I told the victim’s family let police probe for a week or so if you are not satisfied, then will recommend CBI,” Singh said.

Yashwant Sinha, Shatrughan Sinha should resign, says BJP leader Agency | Hyderabad

Telangana BJP spokesperson Krishna Saagar Rao on Wednesday said Yashwant Sinha and Shatrughan Sinha should resign from the party if they have “problems” on governance and are not finding enough opportunities to raise issues at party forums. The reference made by the bench of Justices Joseph and Banumathi was taken up by a three-judge bench headed by CJI Misra Wednesday. “Can a two-judge judge bench directly refer a matter to our Constitution Bench,” the CJI asked, adding that a Constitution Bench will first decode if the matter needs to be reconsidered at all.

Kejriwal-Khattar meet: ‘Can’t control direction of wind, have to make joint efforts to control air pollution’

Haryana Chief Minister Manohar Lal greets his Delhi counterpart Arvind Kejriwal before a meeting in Chandigarh on Wednesday

Agency | Chandigarh

Haryana Chief Minister Manohar Lal Khattar and his Delhi counterpart Arvind Kejriwal on Wednesday convened a joint meeting in Chandigarh to discuss residue burning and vehicular pollution issues. In a joint statement issued after the meeting, both the chief ministers recognised their deep and shared concern over the recent episode of heavy smog in National Capital Region (NCR). They agreed upon the need for action on many measures aimed at preventing its re-occurrence in the winter of 2018. “We are happy to have had a very fruitful meeting at

Chandigarh. We recognize our deep and shared concern over the recent episode of heavy smog in our NCR. We agreed upon the need for action on many measures aimed at preventing its re-occurrence in the winter of 2018,” said the statement. “During discussions, we agreed that the serious health risk to which such episodes of smog expose one and all require concrete and quick action on a number of fronts.

“We covered crop residue burning and vehicular pollution issues. We resolve to put in sustained efforts in pursuance of the jointly identified action points in the coming days, weeks and months,” the statement added. “We look forward to covering other sources of air and water pollution in our future discussions,” it said. Speaking to the media after his meeting with Khattar, Kejriwal said.

Ram Temple issue: Muslim leaders doubt Sri Sri Ravi Shankar’s initiative, ask him to disclose his plan

Sri Sri Ravi Shankar had said in Delhi earlier this week he was involved as a mediator in the Ram Temple dispute of his own will and would visit Ayodhya on November 16 to meet all stakeholders. He said he did not have an agenda and would listen to everybody.

Agency | Lucknow Various Muslim organisations have expressed their reservations over Art of Living founder Sri Sri Ravi Shankar’s initiative to resolve the impending Ram Temple issue in Ayodhya, saying that the spiritual leader should first disclose his plan. “It is being

said that Sri Sri Ravi Shankar is talking to all the stakeholders in the case but he has not yet contacted the top leadership of the All India Muslims Personal Law Board (AIMPLB) which is leading the Muslim side,” AIMPLB general secretary Maulana Wali Rehmani was quoted as say-

ing by said. “About 12 years ago, Sri Sri had made a similar move and had concluded that the disputed site be handed over to Hindus… what new formula he has found this time should be disclosed,” he claimed. The AIMPLB general secretary also took a strong exception to the statements of Shia Central Waqf Board chairman Wasim Rizvi and termed them as unnecessary. Raising objection to the stand taken by Rizvi, who had said

that a temple be built on the disputed site, Rehmani stressed that the chairman of any board does not have the authority to hand over any disputed site to any party. “If Rizvi’s logic is that Mir Baqi, who got the Babri mosque constructed, was a Shia then also it (mosque) was made for all Muslims,” said Rehmani. Rizvi had claimed yesterday, “It was amicably decided that no new mosque would be built in Ayodhya or Faizabad.

want Sinha on Tuesday said countrymen can rightly demand he quit for the hardships caused and also felt that he is a “burden” on the people of Gujarat. Jaitley is a Rajya Sabha member from Gujarat. Actor-turned-politician Shatrughan Sinha, a Lok Sabha member, said recently that the BJP would be able to live up

to the expectations of the people only if it ceased to be “a one-man show and a two-man army.” The BJP views Yashwant Sinha’s outbursts against Finance Minister Jaitley as being “purely disgruntled remarks of an individual who seeks some participation in the government and he is not provided for,” Rao said.

The Shri Rajput Karni Sena today called for a nationwide bandh on December 1 against the release of Sanjay Leela Bhansali’s film ‘Padmavati’, which finds itself mired in a controversy. The founder of the organisation Lokendra Singh Kalvi said that not only the Rajput community or Hindu organisations but even Muslim leaders had came against the film, against which there was resentment across the country. He

demanded that Prime Minister Narendra Modi intervene in the issue saying that the central government had the powers, as per the provisions of the Cinematography Act, to stop the release of a film for three months. That provision should be invoked in case of Padmavati which is slated to be released on December 1, he said. “We are calling for a country-wide bandh on December 1 if the film is released. We have the support of all castes and com-

munities. We will hold public meetings and rallies in Gurgaon, Patna and Bhopal before that,” Kalvi told reporters. Kalvi said that the statement by actress Deepika Padukone, who plays the legendary queen in the movie, that nothing can stop the

release of the film was “provocative”. No effort to tarnish the image of “Rani Padmavati” will be tolerated, he said. Kalvi claimed that film hall owners’ association and distributors had refused to release the film in the state and leaders from political parties.

BJP ahead of Congress in Gujarat in terms of performance, perception

www.sunvillasamachar.com

Hollywood-Bollywood Alia Bhatt’s outfit is a beautiful blend of traditional and modern fashion

Indian elections are a psephologist’s nightmare. With the deep penetration of digital media and social media, the access to information that an average voter has is much more today than in the past. That has led to greater maturity in the electorate. There used to be a time when pundits would assume that politics is a group activity. It was easier to analyse voter behaviour then. All that the person had to do was to try and analyse the behaviour of the group and predict the outcome. This is no longer the case. Elections are no longer a group activity. The old school electoral analysis that a particular caste or group would vote in a predictable manner no longer holds water. The voter today is an enlightened citizen. Voting happens on the people’s assessment of the leader, his policies and, most importantly, his connect and traction with the masses. In other words the voters today look for performance or the ability to deliver. When performance becomes the benchmark, perception becomes the battleground. Performance doesn’t lie in the figures that one doles out or the publicity material that is put out. It boils down to how people perceive your performance. The ongoing assembly elections in Himachal Pradesh and Gujarat need to be seen from this perspective. The BJP hopes to perform well in both states. It enjoys a distinct advantage over its main rival – the Congress – on both counts viz. performance and perception. Prime Minister Modi continues to be massively popular across the country. He is one leader who has defied the conventional political logic of incumbency. After almost three-and-a-half years, his popularity doesn’t seem to have dipped at all. He has acquired a cult status among the masses, which will certainly help BJP at the hustings. In terms of its performance, while the Congress government in Himachal was seen as a corrupt and inefficient one, the BJP government in Gujarat has many things to its credit in terms of good governance and delivery. Over 40 months of excellent performance by the central government in various sectors too will favour of the BJP. The two parties are locked in a perception battle. Yet the immaturity of the Congress leadership, that comes out pronouncedly on many occasions, leaves it way behind in this battle too. Take the example of GST.

Alia Bhatt is on a roll with her series of blockbuster movies and string of upcoming projects. Social media adores this young talent and budding fashionistas look up to her for inspiration and why shouldn’t they? She does manage to pull off experimental looks with ease. Take the example of her latest appearance at the Lokmat Awards that took place last night in Mumbai. The beauty looked radiant in a beautiful outfit designed by Abu Jani and Sandeep Khosla. The ivory flared sleeve crop top and nude embroidered lehenga skirt made for a nice combo. We like how beautifully the modern top with that exaggerated lapel detail matched the timelessness of the traditional lehenga skirt. What we also like is

Mahira Khan starrer Verna faces censor heat for ‘objectionable’ content. Will it be banned?

Agency | New Delhi

Pakistani actor Mahira Khan is back in news. But this time it has nothing to do with Ranbir Kapoor and those viral pictures. Her much awaited film Verna has got into some serious trouble. This, despite Mahira hard-selling the film for some time now. Verna is struggling to get a clearance from Pakistan’s Censor Board. Owing to this, the movie’s big Lahore

premiere also got cancelled on Tuesday. Verna is director Shoaib Mansoor’s comeback project and was scheduled to release on November 17. Shoaib, better known for hard-hitting films like Khuda Ke Liye and Bol, has dealt with the subject of rape and how it is used for power in Verna, something that has allegedly become the point of contention for the Censor Board. As

reported by The Express Tribune, the Sindh Board of Film Censors (SBFC) general secretary Abdul Razzaq Khuhawar has said that Verna is objectionable on the basis of its subject. “The topic is rape, and the culprit is the governor’s son. The film doesn’t have to be banned, and can be tweaked and censored a bit to be deemed fit for release,” he said in the report.

Hardik Pandya miffed with rumours of leaving Mumbai Indians in IPL 2018 Agency | New Delhi

Hardik Pandya is suddenly the apple of everyone’s eyes after scintillating performances in the 2017 Champions Trophy final and the series against Sri Lanka, Australia and New Zealand. However, his claim to fame came much before he played for the Indian cricket team. He was a star in IPL, donning Mumbai Indians (MI) colours. He has already been part of two of MI’s three title victories after being included in 2015. However, recent rumours about Pandya’s willingness to shift base from MI camp for improved IPL contracts with other franchises have surfaced. An annoyed 24-year-old Pandya

came out in the open. “I was disappointed when I heard this news because this is false. This team has given me everything. Why would I leave it? My life changed when I got a chance to play for MI and then I never looked back. I had a small failure and that’s why I learned to be even more professional. You need to understand that some things are bad. That’s how you improve in life,” Pandya told News 18. In 2013, Pandya was purchased for a bargain price of INR 10 lakhs. MI increased his remuneration to INR 20 lakhs three seasons later. They also acquired his elder brother Krunal for a whopping INR 2 crore in the same season.

At Eden Gardens, India eye domination against winless Sri Lanka

SPORTS ROUNDUP

India begin a three-match Test series against Sri Lanka from Thursday with the first match at the Eden Gardens

India will take on Sri Lanka in the first Test at Eden Gardens beginning Thursday Agency | Kolkata

India last hosted Sri Lanka for a Test series eight years ago. MS Dhoni was the captain of the side but he not even part of the team now. Virat Kohli had no ODI centuries. He will captain the side when they take the field on Thursday. The transformation in the Indian side coincides with that of Sri Lanka only that the visitors have not risen to the level they should have by now. From that 2009 series, only Murali Vijay and Ishant Sharma are the

survivors and same is for Sri Lanka. Only two players, Angelo Mathews and Rangana Herath, will be in India this time. Despite that, India look the stronger unit. They have not lost a Test series at home in last five years and whitewashed Sri Lanka in Sri Lanka earlier this year. The visitors can boost of a whitewash over Pakistan recently but against India, they are yet to win a Test match in India. The Kolkata Test will be an opportunity for both India

and Sri Lanka. The home team would like to extend their stay at the top while Sri Lanka would like to break the jinx. But there are some issues to be resolved first. Kohli and his team need to answer one important question before the first Test against Sri Lanka. The Eden Gardens pitch has grass on it. While it does not look like the outfield, the pitch still has enough grass to assist the seamers. Now, India have some headache in selecting the playing XI on Thursday.

Sachin Tendulkar Test Debut: This Day, That Year Agency | Kolkata

Sachin Tendulkar became known to the international cricketing fraternity on this day, November 15, in 1989, when a short, curly-haired boy from India made his Test debut against Pakistan in Karachi. Tendulkar went on to rule the game for the next 22 years earning a demigod status in the process. There was palpable excitement whenever he came in to bat and equal sorrow when he got out. The little boy was rechristened and fondly called ‘Master Blaster’. He ended up amassing a whopping 15921 runs in record 200 Test matches at an impressive batting average of 53.79. He

broke records at will and is the only man in history to get to 100 international centuries. In his career spanning two decades, he has achieved everything including the 2011 ICC Cricket World Cup which India lifted on their home turf. Going back to his debut Test against the then-mighty Pakistan boasting the likes of Imran Khan, Wasim Akram and Waqar Younis, Tendulkar

came to bat at number 6 with India reeling at 41/4 in reply to Pakistan’s first innings score of 409. Another debutant, Pakistan’s Waqar Younis, sent Tendulkar back to the pavilion for 15 runs. His 32-run partnership with Mohammad Azharuddin stalled India’s fall of wickets. India were all-out for 262 in the first innings with pacers Wasim and Waqar taking four wickets each.
