Aadhaar will kill civil rights ofcitizens, says petition in Supreme Court

New Delhi: The verdict was given by a five-judge Constitution bench of the Supreme Court. The bench, headed by Chief Justice of India (CJI) Dipak Misra, and consisting four other judges Justices AM Khanwilkar, Adarsh Kumar Sikri, DY Chandrachud and Ashok Bhushan, were hearing the petitions challenging the validity of Aadhaar contending that it violates an individual’s fundamental right to privacy. Senior Supreme Court lawyer, Shyam Divan, appearing for petitioners, told the five-judge Constitution bench that Aadhaar may cause death of citizens’ civil rights. “A people’s Constitution is being sought to be converted into a State’s Constitution,” Divan told the apex court. In August, 2017, a nine-judge bench of SC had held that Right to Privacy was a Fundamental Right under the Constitution. Several petitioners challenging the validity of Aadhaar had also claimed it violated privacy rights. The issue regarding the validity of Aadhaar and possible leakage of data has surfaced time and again since the inception of the Unique Identification Authority of India (UIDAI) number. Besides, a recent report in The Tribune had exposed the fact that the Aadhaar database could be essentially bought on the internet only for Rs 500. UIDAI then filed an FIR against Tribune reporter Rachna Khaira for her report that unknown agents had provided her access to Aadhaar’s demographic database for Rs 500.

Medical college graft case: Former Odisha HC judge moves court for probe into leakage of tapes

New Delhi : Former Orissa High Court judge I M Quddusi, who is on bail after his arrest last year in connection with a medical college graft case, today moved a city court seeking a probe into the leakage of transcripts of telephone conversation between him and two other accused persons in the media. Taking note, Special Judge Manoj Jain sought response from the CBI by January 22 on the plea which alleged that the document was confidential and was not even supplied to the accused but given to people outside the probe agency. The application, filed on Quddusi’s behalf by advocate Vijay Aggarwal, said this gave rise to “grave suspicion and apprehension of interference of third parties into the investigation of the present matter”. Some major dailies had given out details of the purported transcript of the alleged conversation between three persons including Quddusi, claiming that their phones were tapped by the CBI. The reports had spoken of conversations between Quddusi, a middleman and B P Yadav, owner of UP-based medical college, Prasad Education Trust. Quddusi’s plea said that “monitoring of the investigation is essential to find out as to whether the alleged conversations and PE report has been leaked by someone within the CBI or they have been stolen.

India to be $5 trillion economy in 8-9 years: Suresh Prabhu

New Delhi : Commerce and Industries Minister Suresh Prabhu on Wednesday said India is expected to become a USD 5 trillion economy in the next 8-9 years with the manufacturing sector contributing 20 per cent to that. “India is going to be USD 5 trillion economy in 8-9 years. USD 1 trillion will come from manufacturing. Therefore we are preparing a detailed plan what will be going in that manufacturing,” Prabhu said at an event organised by internet firms body IAMAI. He said that experts who are involved into manufacturing are preparing the roadmap and including all sectors where manufacturing can be promoted. The minister said if manufacturing alone is digitised it will create huge opportunity for technology firms. “60 per cent of the USD 5 trillion will come from services. This includes various services which are not being even thought of at present. Like home care services have tremendous scope,” he said. The minister said that USD 3 trillion may be under statement as per the plan being worked out and there are empirical evidences to back it. Prabhu said as commerce and industries minister, he is working on a strategy for international trade which will contribute USD 2 trillion to the economy where contribution can come from both manufacturing and services. International trade should become a driving factor for the growth of GDP, he said. “India is not only bridging digital divide but also helping people scale up their income,” Prabhu said.

New law to make customer king

C onsumers in India receive a raw deal, whether at the hands of sellers of goods and service providers, or advertisers, rather brand ambassadors, and even the so-called consumer protection agencies. So we have celebrities appearing on TV channels promoting everything from super glues to diamonds, least caring about the quality and propriety of what they are asking their fans to buy. Even infants are not spared from peddling stuff, with all discretion thrown to wind. Cut-throat competition has aided the exploitation of consumers through unfair and objectionable practices, with no effective mechanism in place for the redressal of grievances. Miss-selling is rampant in all spheres of life education, health, housing, banking, finance, and even politics is not excluded. The new consumer protection bill 2018, which has been presented in parliament, seeks to make a difference to all of this. The proposed new law will replace the archaic Consumer Protection Act of 1986, which has hitherto been taking care of whatever existed in this country by way of consumer protection. It is no rocket science to understand the change in the psyche of Indian consumer in the last 40 years, which a law framed in the 1980s can hardly be expected to handle. For, the preferences, expectations and behaviour of the Indian consumers, like their counterparts elsewhere in the world, have changed beyond recognition. And with globalisation shrinking the size of the world that we live in, the awareness and frustrations of the Indian consumer have also become boundless. Under the proposed new law, any manufacturer or service provider causing a false or misleading advertisement to be made, which is prejudicial to the interest of the consumers, shall be punished with imprisonment for a term extending to two years and with the fine going up to 10 lakh rupees. Repeat offences may lead to doubling of the jail term and a fine of up to Rs50 lakh. The law also seeks to reign in the tendency of manufacturers and marketing companies to engage celebrities to push their products, by holding those involved in misleading advertisements accountable for their act. A most salutary feature of the new law is that it provides for simplification of consumer disputes adjudication process for faster disposal of grievances. An aggrieved consumer will be able to file complaints from the comfort of home through e-filing, with hearings conducted through video conferencing. The bill also provides for product liability action, which means that a complaint filed by a person before a consumer court for claiming compensation for the harm caused on account of a defective product or service will be sustainable. The new law, therefore, brings a paradigm shift in the relations between the buyer and the seller, with the customer, as they say, virtually becoming king.

Afghanistan aim to be ‘competitive’ ahead of Test debut against India

New Delhi: The cricketing world knows Afghanistan by their exploits in limited-overs internationals and the performances of the likes of Rashid Khan and Mohammad Nabi in various Twenty20 leagues around the world, but as the newest full ICC member prepares for its first five-day examination, the board’s top officials are confident that the team can hold its own against the top Test side in the world. Afghanistan and Ireland gained Test status in June last year. While the Irish will make their debut in the longest format of the game against Pakistan at Malahide in May, the Afghans will do so against India in Bengaluru from June 14-18. And the top officials of the Afghanistan Cricket Board (ACB) believe they have enough talent coming through the ranks to become a competitive member of the international Test family before long.

gns, New Delhi: Two days after her upset win over Venus Williams, Belinda Bencic is out of the Australian Open. Bencic was on a high after beating 2017 finalist Williams on the center court in the first round, but started flatly on Hisense Arena on Wednesday and lost 6-1, 6-3 to powerful hitting Thai qualifier Luksika Kumkhum. The 20-year-old Swiss, who combined with Roger Federer to win the Hopman Cup in the lead-up to the season’s first major, saved three match points on her serve before netting a backhand to give No. 124th-ranked Kumkhum a spot in the third round for the first time.

“I tried to reset and focus on the next match,” Bencic said. “I think it was also a very tough second round, for me the toughest I could get. I played her a couple of times and it’s just very difficult for me to play her. “I’m pretty positive. … I made it here to the main draw, beat Venus. It was much better than I ever imagined, so there is no reason for me to be negative now.” Fifteen-year-old qualifier Marta Kostyuk and No. 4-seeded Elina Svitolina were among three Ukrainian women who had matches starting simultaneously on Day 3 – and all progressed to the third round.

Lungi Ngidi’s sensational debut led South Africa to a memorable 135-run victory in the second Test at Centurion Park on Thursday.

Lungi Ngidi’s 6/39 crushes India, gives South Africa unassailable 2-0 series lead gns, New Delhi: Lungi Ngidi’s sensational debut led South Africa to a memorable 135-run victory in the second Test at Centurion Park on Thursday. 21-year-old Ngidi’s figures of 6/39 in the second innings, which was also the sixth best for South Africa on debut, left the Indian batsmen gasping for breath as they succumbed for a paltry 151 in the fourth innings to help South Africa clinch the Freedom Series, courtesy of an unassailable 2-0 lead. With this India’s run of nine series win also came to a grinding halt and they have now lost their first series under the leadership of Kohli.

On the final day of the second Test, India began proceedings with the score on 35/3, needing another 252 to win. With skipper Virat Kohli already back in the hut on day 4, it was always going to be an uphill task for the Indian side on Day 5. However, to the dismay of Indian fans, disaster struck early as Cheteshwar Pujara was run-out for 19 leaving India tottering at 49/4. Pujara also became the first Indian to be dismissed run-out in both innings of a Test. From thereon it was a matter of time as wickets fell like nine pins. Only Rohit Sharma provided a futile resistance with a well-made 47.

153 means nothing right now… we lost the match, series: Virat New Delhi: Twice in the series, India were chasing a target and had their chance to register a win. Twice in the series, the batting unit let the team down and they staged a meek surrender. Set a 287run target in the second Test in Centurion, India failed to put up a fight and were bundled out for just 151. Apart from Rohit Sharma, who top scored with 47, all batsmen struggled. At

the post-match presser, Virat Kohli said the team should have capitalised in the first innings where South Africa lost wickets in quick succession. “Yeah (the wicket gave us our best chance). We thought the wicket was really flat. Quite surprising. I told the guys the wicket looks different to what it looked before toss. I thought it was our chance to put some runs on the board.

No case against 26/11 attacks mastermind ‘Sahab’ Hafiz Saeed: Pak PM Islamabad: Pakistan Prime Minister Shahid Khaqan Abbasi said that there is no case registered against Mumbai attack mastermind Hafiz Saeed in Islamabad and without it, action cannot be initiated against anyone. “There is no case against Hafiz Saeed sahab in Pakistan,” said Abbasi in an interview to a Pakistan TV channel. He added, “Action is taken when there is a case registered [against someone].” Earlier in November last year, Abbasi had claimed that India has provided “no evidence” against Saeed on the basis of which he can be prosecuted. “The court, a three-judge bench, has released him (Saeed) saying there are no charges against him, the country has a law you know,” he said. The Jamaat-ud-Dawa (JuD) chief is also looking to contest the 2018 general

elections in Pakistan and has, thereby, formed a party by the name of Milli Muslim League (MML). Pakistan has recently prohibited Saeed’s JuD and Falah-i-Insaniat Foundation (FIF) from collecting donations. Saeed was released from house arrest after a Pakistani court cited lack of evidence against him in the 26/11 Mumbai attack case. India has, time and again, protested against Pakistan for harbouring Saeed, who is wanted for plotting the Mumbai attacks.

Man arrested for unnatural sex with three cows

gns, VADODARA: The Varnama police arrested a ‘mentally challenged’ man from Por late on Monday night for allegedly having unnatural sex with three cows owned by a milkman. The incident happened sometime between Sunday night and Monday morning. One of the cows was found dead by the complainant Lalji Rabari on Monday morning. A complaint was registered at Varnama police station against Rathodiya for having unnatural sex, committing mischief by killing and injuring the cattle, outraging religious feeling and under Animal Cruelty Act. Police

said that when Rabari came to the cow shed on Monday morning, he found legs of three cows were tied with rope and one was lying dead.

When Rabari probed further, he suspected that somebody might have had unnatural sex with bovines. He suspected Rathodiya, who worked for him as a labourer as he had indulged in a similar act

with a calf two years back. Rabari picked him up from his house and handed him over to police. When cops asked Rathodiya if he had committed the act, he admitted to the crime. An investigating officer said that Rathodiya told them that his brother and two other persons were also there with him. However, on investigating they found that Rathodiya was only misleading them and giving dismissive answers. ”When we talked to the villagers, they told us that Rathodiya has psychological problems and he even blabbers when he is alone,” said the official.

US merit-based immigration: Admit people with ‘talent, English skills’ gns, Washington: The Trump administration wants to admit immigrants who have skills, talent and can speak English, a top official has said, giving insight into the proposed meritbased system that may benefit individuals from countries like India. President Donald Trump has been pushing for the meritbased immigration system to reduce overall immigration to the US. A merit-based immigration system, the Trump administration feels would admit the best and the brightest around the world while making it harder for people to come to the country illegally. The president also wants to scrap diversity lottery visa and chain migration to reform the current system. “..And so, our position, is that a system that prioritise individuals based on their individual skills and merit will certainly produce better results than the system we have now,” the senior administration official said on condition of anonymity. “We want to bring

in individuals, wherever they may be from, who love this country, who love its people, who have skills, who have talent, who have -- who speak English, who are committed to supporting our values and our very way of life,” said the official. Such individuals could be from any part of the world given that they fulfil the requirements, the official said. If such a policy is developed and implemented, it could benefit individuals from countries like India, the majority of whom meet the criterion. The Trump administration wants to reform the immigration

system to serve the US’ national interest, the official said. The official said some of the existing programmes for immigrants ignored such requirements which are important for individuals to succeed in the US. “So, what we have with the Diversity Lottery Program or through chain migration is that in these cases there are identified examples of individuals who were not selected to come to the US based on their love of this country, skills, merit, and individual attributes that will lead them to their success,” the official said.

What’s next for Catalonia and would-be leader Carles Puigdemont?

Madrid : Catalonia’s new parliament meets for the first time on Wednesday, a step towards choosing a president for Spain’s wealthiest region, a daunting challenge when the top candidate has fled abroad and other potentials are in jail. Here is a look at what lies ahead for Catalonia, a region which has been ruled by Madrid for the past three months after it held an illegal independence referendum: Carles Puigdemont, the 55-year old ex-Catalonia chief sacked by Spanish Prime Minister Mariano Rajoy for his role in organising the Oct. 1 independence referendum, is the separatists’ candidate to rule Catalonia. In theory, that should have been easy: the Dec. 21 regional election called by Rajoy in a bid to weaken the independence drive backfired and gave nationalists an absolute majority.

Australia offers cash for Great Barrier Reef rescue ideas gns, Beijing : A northern industrial city in China said its 2017 fiscal revenue was significantly less than it had earlier estimated partly due to “fake” additions, making a revision just days after reports of similar incidents fueled scepticism over official data. Baotou in China’s Inner Mongolia Autonomous Region revised its estimated fiscal revenue in 2017 lower by nearly 50 percent in an annual work report, a copy of which was published on the Baotou government’s website on Jan. 13. The Baotou city government said in

the report that the revision was due to factors including “fake additions”. It did not say how the additions came about or who was responsible. Days earlier, the governments of Inner Mongolia and Tianjin, a large port city in northern China, said their fiscal and economic numbers for 2016 had been overstated. “We have been trying to change our mindset and change the course of our development model,” the Baotou government said while pledging to tame government borrowings in part by halting debtburdened public projects.

gns, Sydney: Australia is calling on the world’s top scientific minds to help save the Great Barrier Reef, offering hundreds of thousands of dollars to fund research into protecting the world’s largest living structure. The UNESCO World Heritage-listed reef is reeling from significant coral bleaching due to warming sea temperatures linked to climate change. The 2,300-kilometre (1,400-mile) site is also under pressure from farming runoff, development and predatory crown-of-thorns starfish, with experts warning it could be

suffering irreparable damage. On Tuesday, the Australian government announced a Aus$2 million (US$1.6 million) funding pot available to people with bright ideas on how to save the reef. “The scale of the problem is big and big thinking

is needed, but it’s important to remember that solutions can come from anywhere,” said environment minister Josh Frydenberg. He said the money would be available to the world’s “greatest scientific minds,

industry and business leaders, innovators and entrepreneurs”. “Solutions could focus on anything from reducing the exposure of corals to physical stressors, to boosting coral regeneration rates by cultivating reefbuilding coral larvae that attract other important marine species,” Mr Frydenberg added. Up to Aus$2,50,000 is available for an initial feasibility stage, where researchers can test the technical and commercial viability of their proposals for up to six months.
