South-West monsoon weakening over Bihar
Agency | Patna South-West monsoon has become weak over Bihar even as light to moderate rainfall occurred at one or two places in the state, according to MeT office. Patna recorded 3.2 mm rainfall today while temple town of Gaya registered 45.6 mm rain, a MeT office bulletin said. Bhagalpur recorded the highest maximum temperature of 36.3 degrees Celsius, followed by 34.3 deg cel in Purnea, 32.5 deg cel in Gaya and 29.5 deg cel in capital Patna. The toll in the Uttar Pradesh floods today rose to 91 with reports of nine more deaths as the situation remained grim with 24 lakh people affected by the deluge in the state’s eastern districts. Nearly 57,000 people have taken shelter in relief camps in flood-affected districts of eastern Uttar Pradesh where there was no let up in the situation as waters of rivers emanating from Nepal caused havoc in vast swathes of human habitation, the relief commissioner’s office said citing a flood report compiled till yesterday.

Agency | New Delhi In a landmark verdict, the Supreme Court on Thursday held Right to Privacy as a fundamental right, guaranteed under Article 21 of the Constitution. “Privacy intrinsic to freedom of life and personal liberty guaranteed under Article 21 of Constitution,” the nine-judge bench unanimously observed. The bench overruled decisions in M P Sharma case and Kharak Singh case which had said right to privacy was not protected by
Constitution. “The decisions stand overruled”, it said. The verdict has significant consequences for the common man as it will empower him/her with a powerful tool to fight unlawful intrusions by the state into their personal lives. But the very fact that the court has traced it to part 3 would mean that the restrictions applicable to other fundamental rights will also apply to privacy. The judgement will also form the basis on which petitions challenging the Aadhaar Act will now proceed. The question about right to privacy was first raised before a bench which was hearing
a clutch of petitions challenging the Centre’s move to make Aadhaar mandatory to benefit from social and welfare schemes. The verdict was reserved after hearing marathon arguments for six days over a period of three weeks, during which submissions were advanced in favour and against the inclusion of the right to privacy as a fundamental right. During the sixday hearing, senior counsel Gopal Subramanium, who argued for declaring privacy a fundamental right, had said, “…privacy was embedded in the expressions liberty and dignity as appearing in the Preamble to the Constitution.
Liberty is inalienable… all choices are a part of the exercise of liberty… humans cannot exist without liberty… liberty is heart and soul of the Constitution.” Senior counsel Soli Sorabjee, who also argued for declaring privacy a fundamental right, had said, “Non-mentioning of privacy rights explicitly in the fundamental rights does not signify it does not exist. It can be deduced from other fundamental rights mentioned in Part III of the Constitution. Freedom of press too was not mentioned but deduced so.”

The finance ministry on Wednesday notified the issue of Rs 200 notes, making them legal tender and paving the way for their circulation. Introduction of a Rs 200 note will fill in the “missing middle”, State Bank of India (SBI) said in a report in July. The report had noted that though there has been a significant move towards

Right to privacy: Supreme Court judgment mirrors people’s aspirations
August 24, 2017 is a red-letter day in the history of India. In a landmark judgment, the Supreme Court of India has unanimously declared the right to privacy to be a fundamental right under Article 21 of the Constitution. The Supreme Court has categorically held that the right to privacy is protected as an intrinsic part of the right to life and personal liberty under Article 21 of the Constitution of India and as a part of the freedoms guaranteed by Part III of the Constitution. The judgment represents a quantum leap in the evolution of legal jurisprudence pertaining to privacy in India. Traditionally, Indian society has its roots in the joint family system. Consequently, sharing of information has been an integral part of Indian culture. It is pertinent to note that as on date, India does not have a dedicated law on privacy. The Indian Information Technology Act, 2000 is not a law that safeguards privacy in the digital and mobile ecosystem. The Aadhaar-based litigations in the Supreme Court gave rise to the issue as to whether the right to privacy was a fundamental right . Now, the Constitution Bench of the Supreme Court has delivered its historic judgment wherein it has unanimously declared that the Right to Privacy is a fundamental right, as an intrinsic element of Article 21 of the Constitution. Article 21 stipulates that no person shall be deprived of his life or personal liberty, except according to procedure established by law. The said judgment is extremely important as it recognises, for the first time, the current significance of privacy, both personal and data privacy. The judgment of the Supreme Court mirrors the hopes and aspirations of the people, as without privacy, the very notion of modern life is under threat. The path-breaking judgment states that the earlier decisions in the MP Sharma v. Satish Chandra and Kharak Singh v. State of UP cases have been overruled. The main ramification of the present judgment is that the Right To Privacy remains in Article 21. Therefore, it is safe to assume that the courts from now on will read more in the right to privacy under Article 21 of the Constitution of India. The interpretation provided by the Supreme Court is ingenious, topical, relevant and will withstand the test of time. This judgment empowers the hands of the citizen against the state.
