New Delhi : The Antigua government Thursday said it would cooperate with India in the extradition of fugitive diamantaire Mehul Choksi, who is a prime accused along with his nephew Nirav Modi in the Rs 13,600-crore Punjab National Bank fraud case. The assurance was confirmed during a meeting between External Affairs Minister Sushma Swaraj and her Antigua counterpart E P Chet Greene on the sidelines of the 73rd session of the United Nations General Assembly. “Greene conveyed to the EAM the assurances of his Prime Minister for the fullest cooperation of their Government in the matter of extradition of Mehul Choksi to India,” Ministry of External Affairs spokesperson Raveesh Kumar said. Speaking to reporters, Kumar added that Greene said his government and Prime Minister were committed on the extradition.

Short News Srinagar : Three militants and a soldier were Thursday killed in two gunfights in Anantnag and Budgam districts of Jammu and Kashmir, the Army said. Security forces launched a cordon and search operation in Qazigund of Anantnag district after receiving information about the presence of militants in the area, an army official said. The search operation turned into an encounter when the militants opened fire at the security forces, he said. One militant has been killed so far. A soldier laid down his life fighting the ultras, the official said. In another operation in the Panzan area of Budgam district, security personnel killed two militants during an encounter, the official said. The identity and group affiliation of the slain militants were not immediately known.

SC Refuses to Revisit Judgment That ‘Namaz at Mosque is Not Integral to Islam’ New Delhi : In a 2:1 majority verdict, the Supreme Court on Thursday declared that there was no need for a larger bench to reexamine its 1994 judgement that a mosque is not integral to the practice of Islam, clearing the way for the apex court to hear the main Ayodhya title suit on October 29. The bench, headed by Chief Justice Dipak Misra, said the civil suit has to be decided on the basis of evidence and that the previous verdict has no relevance to it. Justice Ashok Bhushan, who read the judgement on behalf of himself and the CJI, said the bench must find out the context in which the five judges had delivered the 1994 verdict. Justice S Abdul Nazeer, however, disagreed with the two judges and said whether the mosque is integral to the practice of Islam requires detailed consideration by taking into account the belief of religion. Referring to the top court’s recent order on female genital mutilation, Justice Nazeer said the present case must be heard by a larger bench. The case whether the mosque is integral to the practice of Islam had cropped up when the threejudge bench, headed by CJI Misra, was hearing a batch of petitions against the Allahabad High Court’s 2010 verdict in which the disputed land on the Ram Janmabhoomi-Babri Masjid area was divided into three parts.

Congress: All sides should accept Supreme Court verdict on Ayodhya issue

The Congress on Thursday reacted cautiously to the Supreme Court’s decision declining to set up a larger bench for re-look at its 1994 verdict in the Ismail Faruqui case and stated that the party has always maintained that “all sides should accept the decision of Supreme Court in the Ayodhya templeBabri Masjid issue”. The government, it said, “should implement the decision”. Adultery no longer a crime, wife is not property of husband: Supreme Court

New Delhi : DESCRIBING THE law criminalising adultery as arbitrary, which treats the wife as chattel and deprives women of her sexual autonomy and dignity, the Supreme Court Thursday struck down as “unconstitutional” Indian Penal Code Section 497, which makes adultery a punishable offence only for men. Adultery will, however, continue to be a ground for any civil wrong, including a ground for divorce.In four separate but concurring judgments, a five-judge Constitution Bench of Chief Justice of India Dipak Misra and Justices R F Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra said the colonial-era provision violated Articles 14 (right to equality); 15(1) (prohibition of discrimination on grounds of religion, race, caste, sex or place of birth); and, 21 (protection of life and personal liberty). The bench also held as unconstitutional Section 198 of the Code of Criminal Procedure (CrPC) which provides for prosecution for offences against marriage. Time for Aadhaar to get back to basics

Retired Justice K.S. Puttaswamy has provided a rich vein of jurisprudence for future courts to mine. His petition in 2012 was the foundation of the Supreme Court’s (SC’s) recognizing a fundamental right to privacy last year and reading down Section 377 of the Indian Penal Code earlier this month. Now, it has led the SC—in what is in many ways is a sequel to the right to privacy judgement—to finally sign off on the Aadhaar programme, albeit a truncated version. Few issues have generated more heat and light in recent years. Writing the majority opinion, Justice A.K. Sikri has cut through the accusations and counteraccusations pithily: “Howsoever benevolent the scheme may be, it has to pass the muster of constitutionality.” The SC’s answer to this is a strange one in some ways. On the whole, the majority opinion arrives at the correct conclusion. But it makes missteps along the way. On the other hand, Justice D.Y. Chandrachud, writing the lone dissent, makes several telling points that should help guide future debates about Aadhaar’s implementation. This is unsurprising; he has racked up a series of impressive rulings. Aadhaar infringes the fundamental right to privacy. There can be no reasonable argument against this. Although there are several other aspects of Aadhaar that the judgement has examined, the core issue is thus one of proportionality: Is the extent of the infringement proportionate with the goal of the Aadhaar legislation? Among the different flavours of judicial review, the ‘strict scrutiny’ standard, originating in US courts, is the sternest. It is generally reserved for assessing legislation that is discriminatory—reservation laws, for instance. But it can also be used to assess other infringements of fundamental rights. Its recent high points notwithstanding, the SC has a patchy record when it comes to protecting these rights. Employing the strict scrutiny standard, which demands that compelling governmental interest be proved, would have established a healthy precedent. Instead, Sikri has gone with the most lenient standard, “just, fair and reasonable”. This is not surprising; the same standard was used in Justice K. S. Puttaswamy (Retd.) and Anr. vs Union Of India And Ors last year when reading the fundamental right to privacy into the Constitution. It is, however, disappointing. The ruling finds that Aadhaar passes the proportionality check—but only by lopping off chunks of it as it exists today and tightening its provisions to prevent misuse or unnecessary use of citizen data. This is to the good. This newspaper has supported Aadhaar but cautioned against its mission creep.

New Delhi | The trailer of Thugs of Hindostan, starring Amitabh Bachchan, Aamir Khan, Fatima Sana Shaikh and Katrina Kaif, is out and it looks like an action-packed period drama. Thugs of Hindostan is set in the year 1795. We are told in the beginning of the trailer that the East India Company that came in for trade is now on its way to ruling India. We are then introduced to Amitabh Bachchan’s Azaad (earlier introduced as Khudabaksh in the motion poster) and Fatima Sana Shaikh’s Zafira. We see visuals that suggest that Zafira is an excellent archer. The British plan to target Azaad as he stands in the way of their rule.

Amitabh and Fatima are on the same team here. To capture Azaad, the British rope in Aamir Khan’s Firangi. Aamir’s character here is in cahoots with the British as they send him to infiltrate Azaad’s team. Lloyd Owen’s John Clive plays the evil British officer. Katrina Kaif also makes an appearance in the trailer but we aren’t told much about what she’s doing in the film. The trailer has some action sequences but those are bogged down by some mediocre CGI. Aamir’s dialect here is faintly Awadhi and it looks like he will also be responsible for the humour in the film. The visuals and background music will remind everyone of Pirates of the Caribbean.

Business RBI eases some cash reserve rules for banks

Mumbai: The Reserve Bank of India on Thursday allowed banks to dip further into statutory cash reserves in a bid to ease a liquidity squeeze afflicting the nation’s money markets. RBI in a statement said banks could ‘carve out’ up to 15 per cent of holdings under the statutory liquidity reserves to meet their liquidity coverage ratio (LCR) requirements as compared to 13 per cent now. This resulted from a rise in the facility to avail funds for LCR to 13 per cent from 11 per cent, effective October 1, RBI said in a statement. The move by the central bank follows concerns over tight liquidity conditions and banks’ unwillingness to lend to NBFCs. RBI said it “stands ready to meet the durable liquidity requirements of the system through various available instruments depending on its

RBI further announced the relaxation in statutory liquidity ratio (SLR) requirement with effect from October 1, 2018.

Yes Bank denies window dressing of corporate accounts to hide NPAs

Mumbai: Private sector lender Yes Bank on Thursday said it has not indulged in any window dressing of its corporate accounts to conceal non-performing assets (NPAs). The bank had reported a gross and net NPA of 1.3 per cent and 0.59 per cent respectively as on June 30, 2018. The bank said the NPA figures are “among the finest in the Indian banking industry”. “The bank has not entered into any transactions with the intent to do any window dressing of corporate accounts to conceal NPA status,” Yes Bank said in response to a query by the National Stock Exchange if the bank had indulged in window dressing to hide bad loans. The RBI recently curtailed the tenure of Yes Bank’s founder and CEO Rana Kapoor till January 2019.

US sanction on oil to hit PSU oil firms

New Delhi: US sanctions on Iranian crude oil are credit negative for Indian refiners, said global rating agency Moody’s. “We expect Indian refiners will either have to significantly reduce or completely stop importing crude oil from Iran over the next month or so. As a result, Indian refiners will increase dependence on the remaining Middle Eastern crude oil suppliers (mainly Saudi Arabia and Iraq), aside from Iran,” it said. The rating agency said that

Iranian crude is usually sold at a discount of up to $2-$4 per barrel to other Middle Eastern crude oil grades. Iran’s national oil company, National Iranian Oil Company, also subsidises the freight costs for crude oil delivery and offers extended payment terms to buyers, it said. The violence took place in protest of an alleged attack on two Bajrang Dal activists by a group from other community the previous night. This is the first time in recent history that Halvad town witnessed such violence, police officers said. Cash-starved Imran Khan govt auctions 8 buffaloes kept by Nawaz Sharif at PM House

Islamabad : The cash-strapped government of Pakistan Prime Minister Imran Khan Thursday garnered Rs 23 lakh when it auctioned eight buffaloes kept by his predecessor Nawaz Sharif at the PM House for his “gastronomic requirements”. Facing huge debts and liabilities, Prime Minister Khan has launched a massive austerity drive. Under the plan, the government auctioned 61 luxury cars last week, raising some Rs 200 million. The plan is to auction 102 surplus cars, including bullet proof vehicles, and four helicopters used by the Cabinet Division. The sale of three buffaloes and five calves belonging to the PM house fetched a total of Rs 2,302,000 in an auction held in Islamabad, Dawn newspaper reported. The buffaloes were sold within two hours. The bidders were told they could only pay in cash. Some reports said all the buffaloes were purchased by supporters of the three-time prime minister and they plan to gift them back to Sharif.

But the conservative jurist is facing allegations of sexual misconduct from other women as well, forcing Republican leaders to struggle to keep support for him from eroding.
