Marital Rape As Crime Will Hit Institution Of Marriage: Centre To Court Agency | New Delhi Making marital rape a criminal offence will make men vulnerable to harassment by their wives, the Central government told the Delhi High Court today in response to a clutch of petitions by women’s organisations who want marital rape to be legally recognized and penalized. The Centre said in an affidavit that marital rape may become an easy tool for harassing the husband and that there can be no lasting evidence in the case of sexual acts between a man and his own wife. It has argued for status quo, also saying that making criminalising marital rape would “destabilise the institution of marriage”. Women’s

organisations have sought that Section 375 of the Indian Penal Code, the law that defines rape, should be declared unconstitutional, arguing that it discriminates against married women being sexually assaulted by their husbands. Section 375 has an “exception provision” which states that the rape law will not apply to assault or sexual intercourse by a husband on his wife who is above the age of 15 years. The exception

Only days ago, the Delhi-bound Kaifiyat Express had derailed in Uttar Pradesh’s Auraiya district on 23 August, leaving at least 81 people injured. On 19 August, the Kalinga Utkal Express also derailed in Muzaffarnagar, again in Uttar Pradesh, killing 22 people and injuring over 200. In India estimated that around 238 persons to have lost their lives in “consequential train accidents” during the year 2016-17. Of these, 193 deaths were from derailments alone, the highest-ever number of deaths from such a cause in the 17 years for which data is available. Before we get carried away by the data, let’s remind ourselves of the plain truth: Indians have been dying in droves for years now, or getting grievously injured, because the State is unable to deliver a safe public transport network, one that is, ironically, funded by the taxpayers’ money. The reasons for such abysmal failure are well-rehearsed. Much noise is made about decades-old tracks that need replacing, faulty signalling system and unmanned level crossings every time an accident happens. But everything goes back to business as usual before the dust on the wreckage has fully settled.

SC questions Gujarat Govt over slow trial in rape case against Asaram Bapu

The Supreme Court today questioned the Gujarat government over the slow pace of trial in the rape case involving self-styled godman Asaram Bapu. A bench comprising justices N V Ramanna and Amitava Roy asked the state government why the victim has not been examined till now. It asked the state government to file an affidavit in this regard and posted the matter for further hearing after Diwali. The apex court had on April 12 asked the trial court in Gujarat to expedite the recording of evidence of prosecution witnesses in a sexual assault case lodged by two Surat-based sisters against the selfstyled godman. The court had asked the Surat trial court to re-

cord the testimonies of 46 remaining prosecution witnesses including the alleged rape victims. Earlier, the top court had refused to grant bail to Asaram on various grounds including his poor health in two separate sexual assault cases lodged in Rajasthan and Gujarat. The apex court, while dismissing his bail plea on January 30, had observed that Asaram had placed a “fictitious document” to persuade the court to grant him bail and had ordered registration of an FIR against those responsible for preparing and filing the alleged fake papers. The Supreme Court today set aside the Gujarat High Court order asking the state government to rebuild and repair mosques and shrines damaged during the statewide communal carnage in 2002. A bench comprising Chief Justice Dipak Misra and Justice PC Pant allowed the Gujarat government’s appeal challenging the High Court verdict that it should pay for reconstruction and repair works of the religious structures. Additional Solicitor General Tushar Mehta, who had repre-

sented the state government, said that “our plea has been allowed”. Moreover, he said, the state government had told the court that it was willing to pay from ex-gratia amount for repair and reconstruction works of various structures, shops and houses which were damaged. “This scheme (of the government) has been accepted,” Mehta said.
