Voting from abroad The Union government has agreed, “in letter and spirit”, to implement the Supreme Court direction and the Election Commission’s recommendation to allow Non-Resident Indians to vote from overseas through postal ballots. Given the large NRI community dispersed globally, this move will undoubtedly have an impact on the country’s electoral politics in significant ways. Parliament passed the Representation of the People (Amendment) Act in 2010 to introduce Section 20A that enables a person who is a citizen of India, and is away from her ordinary residence in India for employment, education or other reasons, to be eligible to be registered as a voter in the constituency mentioned in her Indian passport: before that amendment, only “ordinary residents” could cast their vote. Although the 2010 amendment intended to include NRI participation in national politics, Section 20A had required NRIs to be physically present in their respective constituencies at the time of elections. Making it impractical for voters, this requirement defeated the intention of the legislature. A petition was filed in the Supreme Court praying that Section 20A of the Act be read down so as to allow NRIs to vote from abroad without having to be present in India. The petition argued that the provision was in violation of Article 14 of the Constitution to the extent that it impliedly treated persons on a different footing based on economic classifications. The Supreme Court and the government agreed with this contention without hesitation. The traditional argument against such external voting has been that only citizens who are present in the territory and affected by the consequences of their vote should be entitled to vote. As per this argument, since NRIs lacked sound knowledge about domestic conditions, they would be irresponsible in their electoral choices. But this argument is fast being disproved by empirical evidence. With the rapid increase in cross-border migrations, the concept of nationhood and political membership is increasingly being decoupled from territorial locations. India’s move towards enabling voting from overseas is an instance of a larger global trend towards increased citizen participation. The International Institute for Democracy and Electoral Assistance, an intergovernmental organisation, lists different voting methods that can be employed, such as “personal voting”, where voters can cast their vote at diplomatic missions abroad; “postal ballot method”, where votes are sent by regular post; “proxy vote” and “electronic voting”. From amongst these alternatives, the government has decided to employ the postal ballot route that the electoral system already uses for absentee-voters on official duty.

Killings of key witnesses won’t affect case: Police Ahmedabad, Jan16, 2015 More than a year after two sisters had accused Asaram Bapu and son Narayan Sai of rape, the police had filed a chargesheet in the case. A year later, charges are yet to be framed against the accused. In the chargesheet filed on January 9, 2014, before Chief Judicial Magistrate, Gandhinagar, the Gujarat Police had named Asaram, his wife Lakshmi, daughter Bharti and four of his followers, Dhruvben, Nirmala, Jassi and Meera, for “hatching a conspiracy”, “illegal confinement” and “rape”. The Ahmedabad police listed 101 witnesses, of whom two, Akhil Gupta and Amrut Prajapati, are now dead. Three others related to the case have survived attacks. SIT officials claim that since the murders took place after the chargesheet was filed, these would not affect the case. Said a senior SIT official, “Gupta and Prajapati were key witnesses and made shocking revelations that led to strong evidence against Asaram. Our case stands at the same point: that Asaram raped the sisters and that several women were sexually abused at his ashram. The evidence submitted in court of abortions, medical check-ups and witness statements are all there.” However, the SIT acknowledges that the murders of Gupta and Prajapati have left the other witnesses scared. The third incident took place six days later. Dinesh Balchandani, a resident of Surat, had acid thrown on him by an unknown person. B M Gupta, the defence lawyer for Asaram, points out that barring the “godman” and Narayan Sai, all the accused have been granted anticipatory bail. Asaram’s wife Lakshmi has filed a discharge application claiming innocence, and the court is likely to decide on the matter on February 19. Public prosecutor R C Kodekar said the framing of charges is pending since Asaram is being tried in a Jodhpur court in a separate rape case. “If he is brought

here, the case in Jodhpur will be delayed. Therefore, the court is of the opinion that his examination in Jodhpur should be finished first,” Kodekar said. The sisters, who belong to Surat and are now married and settled there, had been followers of Asaram for 15 years. The younger of the two filed a complaint against Narayan Sai while the elder one accused Asaram of raping her. As per the younger sister, Narayan Sai raped her from 2002 to 2005 at Surat, Bihar and other places. While the case against Sai is being tried in Surat, Asaram’s case was transferred to Ahmedabad since the incidents allegedly happened there. Incidentally, on December 14, 2014, the elder of the two sisters went “missing” while on a visit to Amroli in Surat for a “social function”. She reportedly asked her police escort to stay back. The “disappearance” coincided with her application before the Gandhinagar district court that she wanted to record a fresh statement in the rape case. The plea was dismissed by the court.

Some missionaries even tried to induce me and my associate to embrace Christianity. When we rebuffed their overtures they tried to evict us from the house where our office was located in the mission area in Ahwa”. It was Ghelubhai Nayak who then stood by the facts. Having served in Dang for over 50 years, Ghelubhai(then he was 75) keeping the record straight spoke truth about the situation on ground and neutralized the debate. As he was a Gandhian and selfless servant of tribals beyond doubt with proven record, his opinion helped Gujarat state and innocent Hindu tribals who were defamed by biased English media nationally. In his testimony before India’s National Human Right Commission, Ghelubhai Nayak said that the

conflict at Dangs was rooted in the work of Christian missionaries. In the preceding three years, Nayak stated, there had been at least fifteen instances in which Christian converts, “under the influence of their preachers,” desecrated idols of the Hindu saint Hanuman, who has been venerated as an incarnation of the Hindu god Siva, a servant of Vishnu, by the Dangs tribals for generations. In one incident, he said, the converts urinated on a statue of Hanuman; in another they “crushed H a n u m a n ’s i d o l t o pieces and threw it away in the river.” In addition to the desecration, Nayak testified, converts had raised the ire of their Hindu neighbors by repeatedly, publicly denouncing Hindu saints as shaitans, or “Satans.” This was done, again “under the influence of their preachers.” The native clergy, it seems, were themselves ex-Hindus afflicted with the Naipaulian “neurosis.” Below is full text of what Ghelubhai put down in black and white on January 7, 1999 in his address to the National Minorities Commission:
