All Focus Is Now On Annoyed Bench’s Order Within Next Two/Three Days

The Narendra Modi Government on Monday refused to file a detailed affidavit on its standon the Pegasus snooping issue annoying the Supreme Court judges who reminded thesolicitor general Tushar Mehta that the Court had earlier given opportunities to the centre tofile affidavit twice but ‘ they don’t want to file”.The apex court in its crucial hearing wasaghast at the statement of the SG that “ Statements on this issue cannot be made throughaffidavits and filing and then making it it part of the public discourse is not possible’.Significantly at the last hearing on this issue in Supreme Court on September 7, SG soughttime for filing the affidavit and accordingly, the bench fixed September 13 today for hearingon the petitions demanding the setting up of an independent probe monitored by the SC to go into this controversial issue. That way, today’s position of SG was a reversal of his stanceof the last hearing. The bench now said that the orders would be given within next two/threedays but the centre could inform if it changed its position on the filing of the affidavit. It was clear from the deliberations at the Court hearing that the plea of national securitytaken by the SG to avoid the filing of the affidavit was not at all convincing to the bench. Justice Srya Kant reminded the centre that the judges understood the national securityargument but it was only interested in the centre responding to the claims of hacking of individual phones as claimed in the petitions.Last time also national security arose and we clarified nobody... is going to intervene in away that affects national security. We asked you there are claims of individual phones beinghacked... so file your affidavit on whether it was authorised, ustice Surya Kant said.We are only concerned with issues of phones of individuals (being) hacked. Which agencyhas powers and whether it authorised or not... There are individuals saying their right toprivacy has been violated,Justice Surya Kant said.. SG again repeated his earlier proposalthat the centre would form a committee of experts if the privacy was violated but JusticeSurya Kant was not impressed"The significance of the comment by the bench on September 13 lies in the fact that thebench has taken note of the tactics of the centre, especially its Solicitor General TusharMehta in avoiding answer to the real issue which is at the core of the main petitions. Thesimple question is did any central agency hire the Israeli company NSO for this software and if so who. Any national government has every right to hire a foreign organisation for securitypurposes, especially in relation to deal with terror and intelligence gathering. ModiGovernment is also entitled to do that, but in case of this Pegasus use, it was not forinformation gathering from the anti-India outfits but from the country’s own politicians, activists and journalists.Justice Kant made it clear that the bench would take full care of thenational security issue. But the issue was different, the snooping into the privacy ofindividuals which the petitions mentioned. The Pegasus spyware use is not just a case of violation of privacy, or illegal surveillance orsnooping by security agencies. It is much more. The Pegasus is military grade spywarewhich takes surveillance and hacking to a new level altogether. If this is used by the central agencies on the opposition leaders and the human rights activists, apart from journalists, thiscannot be done without the approval from the highest political authorities. That way, the buckstops at PMO and the Home Ministry. PM has to get cleared of the allegations if those are‘unfounded’ as the official sources are saying. The NSO itself has stated in its official website that the company “licenses its products only to government intelligence and law enforcement agencies for the sole purpose of preventingterror and serious crime”. It is also known that the licenses are given under the supervisionof the Defense Export Control Agency of the Israeli ministry of defence. And suchtransactions are done only at the inter-governmental level. Just as Indian Prime Ministersigned a deal on Rafale planes with the French President as a part of inter governmentagreement. So the question may be asked during PM’s visit in July 2017, was such an intergovernment agreement was done?More information has been coming from different countries of the world about the role of thecontroversial Pegasus spyware in snooping on prominent individuals. All these details willbe of importance to the learned judges in arriving at their observations. Media reports saythat the phone numbers - Kapilkumar M. Hirpara of fifteen French ministers.
