Justice, law and change

The unforgettable line, “We are not asking you to change the country — that has already happened without any court’s permission — but we are asking you to protect the rights of the country to change”, is not the only reason that India’s judiciary, currently ruling on bankruptcy and the bad loan regime, should watch the spectacular new movie on the early life of US Supreme Court justice Ruth Bader Ginsburg. On the Basis of Sex not only chronicles using a tax case involving a man to create precedence and attack 178 laws that discriminated against women, but it is also a wonderful meditation on how courts can react to societies that are changing despite precedence, personal preference, and vested interests. I’d like to make the case that courts must reflect deeply on how their interventions are enabling frequent violations of the 270-day bankruptcy IBC deadline. These delays are raising the ambition of defaulters, and converting possible restructurings like Jet Airways into probable liquidations. This matters because India’s government, regulators and citizens have already changed their minds and broken with the past in letter and spirit in handling loan defaulters. As Ginsburg’s professor tells her in the movie “a court should not be affected by the weather of the day but ought to be by the climate of the era”. Bankruptcy is like ice cream; the more you wait, the more it melts. Starting today, Jet Airways will no longer be freely traded on stock exchanges. Shareholders aside, it’s often forgotten that the consequences for lenders are the same whether a bankruptcy arises from fraud, competition, unrealistic ambition, poor execution, flawed strategy, sectoral issues, or government policy. The concept of willful defaulter is a distinction without a difference, liquidation is the worst possible bankruptcy outcome, and flexible deadlines guarantee poor outcomes. I hope I am wrong, but Jet Airways may be India’s first liquidation that should have been a bankruptcy. This is sad because Jet was a textbook IBC case; an operationally viable entity that was financially unviable whose operations should have been unaffected as restructuring distributed the financial pain unevenly across lenders (Rs 9,000+ crore), operational creditors (Rs 4,000+crore), customers (500+ flights a day), shareholders (11 crore+ shares outstanding) and employees - Kapilkumar M. Richa Chadha reveals how her Bihar connect came in handy while shooting for Panga

Mumbai :Never the one to miss the opportunity to go the extra mile for her roles, actress Richa Chadha has given one impressive performance after another in the characters that she's portrayed so far. The actress has enjoyed a rare feat of having characters which have become iconic and sometimes she has even had the privilege of playing characters which have become her off screen identity. Richa is known by many names to her fans, Bholi Punjaban, Devi, Nagma - each representative of her on screen avatars. Richa is currently busy shooting for Ashwiny Iyer Tiwari's Panga which is based on the Indian sport of Kabbadi. The actress has been in the news for a variety for of prep work she has been doing for the past few months in bits between fitness and learning the sport. While her larger than life on screen avatar always precedes, very little is known about her background and her modest beginnings. These are the deep roots Richa looks forward to, in order to be influenced by and embody whenever give a chance. Panga gave her exactly that. Given that Richa’s on screen character required a Bihari influence to her role, especially her dialect, Richa used her roots from her maternal side being from Bihar, to embody that into her role and ace it naturally. Richa’s on screen efforts are always engraved into her personal life experiences, and this one too comes from there. Her upbringing from a middle class household in Delhi to stardom in Bollywood has been inspirational but she uses every bit of her traditions when she can on screen. Speaking about the same, Richa said, “Very few people know of my origins and where I come from. My maternal side of the family are Biharis and I have a huge extended family living in that belt. I have always been closely knitted to both my paternal and maternal cultures. Having grown up in a house where I was exposed to a variety of languages, customs and cultures, I’m fortunate I get to use these experiences as an actor, it really is a blessing. My part in Panga is very interesting and happens to be from that region and I was always familiar with the accent, words, language and an understating of a local dialect. I used this to the best of my capacity to bring authenticity to the character”.

Shahid Kapoor and brother Ishaan Khatter to share screen space in THIS film

Mumbai For the longest time, both Shahid Kapoor and Ishaan Khatter have been asked if they would like to do a film together. Now, it's finally happening.

Mumbai : Kangana Ranaut was papped just before she headed for the censor board meeting and while there's been a lot of talking about the film because of the title, looks like the decision has been made. Earlier, the meeting with censor board was fast-forwarded to come to a conclusion about the film soon and now, with the verdict out, fans might have their own side and arguments to make given the change

suggested. Kangana, when asked about the reaction from the board as she left from the meeting, revealed, "Well, there will be a mild change in the title of the film since they find it too harsh, so we are more than happy to do that. And, other than that there are absolutely no cutes and they were thrilled to see the film." So now, the next question that does arise in our minds is what will the title be and what is this change after all.

Mumbai :Fans have been demanding a second part of the movie since a long time and now their wish will finally be fulfilled. As soon as Karan Johar shared a video hinting towards Dostana 2 yesterday, people started speculating on what the interesting star cast would be. The expectations are high after looking at the trio of Priyanka, John and Abhishek rocking in the first installment.

Our first expectation is this should be corrected. We also expect a fairly large investment in infrastructure so that the capex cycle kicks off. We also want lending norms to be eased otherwise no capex will come from the private sector as the plants of a lot of entrepreneurs, who have the risk appetite, have been locked,” said the chief of the regional steel sector lobby body.

However, with Jugalji being selected for Rajya Sabha, the BJP leadership has effectively sidelined Alpesh. Moreover, about two months ago, Congress had asked Assembly Speaker Rajendra Trivedi to disqualify Alpesh as

has moved to High Court, which has asked the Speaker to decide on Congress' application. This has put Alpesh in a fix. The only way left for him is that he and his aides vote for BJP candidates during Rajya Sabha elections, which can put him in the good books of BJP and ensure that his political career does not come to an abrupt end.

SURAT : Experts of fire safety from Gujarat have condemned the handling of rescue operations during the Surat fire tragedy that claimed the lives of 22 students on Friday. They say the haphazard handling of the situation made things worse for the victims, who, in light of failures on multiple fronts, resorted to jumping from the fourth floor of Takshashila Arcade, leading to deaths and severe injuries. Investigation suggests that sparks were flying from the electrical transformer located behind the building since about 12.30 pm and trees right

next to it caught fire, in their stead, sending the fire to a hoarding through cables. This hoarding then set fire to Takshashila Arcade. Surat’s CFO Basant Pareek on Sunday said that the short circuit began in a hardware shop and then spread out. “The transformer was some distance away from the fire and the cables carried the fire to the hoarding,” said MF Dastoor, director of Gujarat State Fire Service, who was on site in Surat to investigate the matter. Meanwhile, no attempts were made to turn off power to the faulty machinery, leading to the power in the building

Gujarat High Court demands system to gauge lawyers' competency

AHMEDABAD: The Gujarat High Court on Tuesday directed the Bar Council of India (BCI) and Bar Council of Gujarat (BCG) to come up with a mechanism for ascertaining the competency of lawyers in conducting cases before the court. The direction came from the division bench of Acting Chief Justice AS Dave and Justice Biren Vaishnav, which clarified that the mechanism need not be penal in nature, but should be regulatory. Notably, the court was hearing a suo motu PIL instituted by the high court administration

after a judgment delivered by the single-judge bench of Justice Bela Trivedi against a lawyer Girish Das for the latter's failure to conduct his matter properly before her court. Justice Trivedi had directed the registry to place the matter before the Acting Chief Justice as a PIL. The PIL seeks a twofold solution to the problem of lack of competency of lawyers—one is to frame rules in this regard and the second is to organise regular training for lawyers on how to conduct matters, and the ethics and etiquette they need to follow in the courtroom.
