The defense and the prosecution in the case, on the point of quantum of punishment, argued for almost a week in a special court in Mumbai. Special Judge Yatin D Shinde had concluded hearing arguments on the quan-

tum of sentence when prosecution demanded death penalty for 8 of the 12 accused while it sought life imprisonment for the remaining four. On September 23, the Special MCOCA court had reserved its order on sentencing in the case for today, September 30. Earlier, on September 11, it had convicted 12 of the 13 accused, all allegedly having links with banned SIMI, while acquitting one. The accused were found guilty of charges under IPC, Explosives Act, Unlawful Activities Prevention Act, Prevention of Damage to Public

Property Act and Indian Railway Act and those under MCOCA. The court also found all the 12 accused guilty under Section 3 (1) (i) of MCOCA, which could also attract capital punishment. Those convicted are Kamal Ahamed Ansari (37), Tanvir Ahmed Ansari (37), Mohd Faisal Shaikh (36), Ehtesham Siddiqui (30), Mohammad Majid Shafi (32), Shaikh Alam Shaikh (41), Mohd Sajid Ansari (34),Muzzammil Shaikh (27), Soheil Mehmood Shaikh (43), Zamir Ahmad Shaikh (36), Naveed Hussain Khan (30) and Asif Khan

(38). After 12 accused were found guilty, Judge Shinde, later, allowed the defence lawyers to examine witnesses to bring out the mitigating circumstances in the case. Defence lawyers subsequently examined nine witnesses to show the court that the accused have undergone reformation and and thus may not be given capital punishment. The list of witnesses included the relatives of accused, doctors, teachers etc while one of the convicts examined another accused in Mumbai 2012 serial blasts.

Digital India vs Net Neutrality

Today, when you start up your computer or iPhone and open a web browser such as Chrome or Safari, you can access over 100 million domain names with a few clicks. Your data costs do not change depending on whether you go to Rediff or Flipkart, or whether you download an app to order pizza or post on Twitter or watch a YouTube video. Your data provider — be it Airtel or Reliance or BSNL — does not discriminate between different kinds of content, only how much data you use. This is the benefit of a neutral net, a system that has worked to the advantage of both internet users (who have enjoyed greater choice of content) and numerous start-ups (which have enjoyed unparalleled market access). But a shift is underway. When Prime Minister Narendra Modi visited California to drum up support for his Digital India initiative, he effectively endorsed Facebook founder Mark Zuckerberg’s vision of expanded access to a pared down internet. Expanded access is, after all, one of the three pillars of Digital India (the other two being e-governance and electronics manufacturing). Why not shift costs to content providers, who enter into exclusive contracts with data providers (such as Reliance), all enabled by Facebook’s Free Basics app? Such an arrangement could expand internet use rapidly in a country where some 80 per cent of the population does not have access, benefiting crores of people. It would also, naturally, benefit Facebook. Advocates of net neutrality — a vocal minority linked to NGOs and internet start-ups — are unhappy with such an arrangement, which they feel will disadvantage consumers by limiting choice. It could also discriminate against smaller content providers struggling to compete with established internet companies. Net neutrality advocates have argued that there are other ways to expand access and lower costs, such as subsidising data plans or through advertising. But this line of argument, too, has its critics. Some believe implicitly that net neutrality is an elitist concern, echoing Zuckerberg’s view that “It’s not an equal internet if the majority of people can’t participate.” Others contend that net neutrality requires unnecessary government intervention, a forcible levelling of the playing field. Why should the government prevent Facebook, Reliance and certain websites from entering into exclusive arrangements, particularly if it helps to expand access and deflect costs from consumers? The arguments against net neutrality, rather bizarrely, offer one area in which populists and free-market enthusiasts might find common cause.

The Sensex jumped 376.17 points or 1.46 percent to 26154.83 and the Nifty rallied 105.60 points or 1.35 percent to 7948.90. About 1668 shares have advanced, 988 shares declined, and 116 shares are unchanged on the BSE. Tata Steel, Bharti Airtel, BHEL, GAIL, Coal India, Idea Cellular, Cairn India and Asian Paints topped the buying list, up 4-7 percent. However, SBI, Axis Bank, Vedanta, Tech Mahindra and Bank of Baroda underperformed, down 1-2 percent. Post Reserve Bank’s 50 basis points (bps) repo rate cut on Tuesday, Axis Bank today cut its base rate by 35 bps to 9.5 percent effective from October 5. The bank has passed on 65 bps rate cut since April this year. Srinivasan Varadarajan, Executive Director Corporate Banking, Axis Bank told CNBC-TV18 that as bank’s cost of funds reduces, transmission of rate cuts will happen. “35 bps cut reflects our lower cost of funds,” he added. Varadarajan said that the bank would have cut rates even if RBI hadn’t cut repo rate in its monetary policy meet on Tuesday. Margins will not be impacted post this base rate cut, he said. The bank is awaiting RBI’s policy on marginal cost of funds, which is expected to be released next week. Equity benchmarks extended rally in late trade with the Sensex rising 352.38 points or 1.37 percent to 26131.04 and the Nifty climbing 103.25 points or 1.32 percent to 7946.55.

A group of engineering students created a ruckus at Gujarat University on Monday after officials refused to conduct a retest for over 100 students who failed to clear their examination. After the students made a representation to GU officials seeking a retest, vice-chancellor M N Patel said that they were given adequate chance as four tests were conducted, but these 100odd students failed to clear them. “The number of such students is not much.
