Fourteen years after 69 people including ex Congress Parliamentarian A hsan Jafri were burnt alive at Gulberg Society during 2002 post Godhra riots, a special designated court Thursday held 24 accused guilty and acquitted 36 from the case. Out of 24 convicts, 11 have been convicted for murder while 13 others held guilty of rioting, unlawful assembly and arson among other charges. The quantum of punishment will be pronounced on June 6. The judge did not uphold the conspiracy charge saying there was no proof.Pronouncing the judgment special judge P B Desai said, “the prosecution partially succeeds.” He read out the names of all the accused who were acquitted and convicted. He said that the theory of conspiracy behind the massacre has not been proved. He said, “I am extremely satisfied with the court proceedings
and will pronounce the quantum of the sentence on June 6.” Among those who have been convicted for murder are-Kailash Lalchand Dhobi, who has been absconding for the past three months and had been in jail since 2002, Yogendrasinh alias Lalo Mohansinh Shekhawat, Jayeshkumar alias Gabbar Madanlal Jinger, Krishna Kumar alias Krishna, Jayesh Ramji Parmar, Raju alias Mamo Ramavatar Tiwari, Naran Sitaram Tank alias Naran Channelwalo, Lakhansing alias Lakhiyo Lalubha Chudasama, Bharat alias Bharat Taili Shitalaprasad, Bharat Laxmansinh Goud Rajput and
Dinesh Prabhudas Sharma. These 11 accused have been convicted under various sections of Indian Penal Code (IPC) including 302 (murder), 153 (a) 1 (spreading communal disharmony), 143 (unlawful assembly), 147 (rioting), 452 (tress passing) among others. The 13 convicts have been charged for attempt to murder (307), spreading religious enmity, communal disharmony, unlawful assembly, rioting among others. Gulberg Society is the eighth case investigated by Supreme Court-appointed Special Investigation Team (SIT). With this judgment only Naroda Gam rioting case remains pending in which former BJP minister Maya Kodnani, Bajrang Dal leader Babubhai Patel alias Babu Bajrangi are also co-accused. Both Kodnani, out of bail, and Bajrangi have been sentenced to life imprisonment in Naroda Patiya massacre.

More than 14 years after the Gulbarg Housing Society massacre took place during the 2002 Gujarat riots, the case is likely to see a verdict. A special court will pronounce on June 2 its order in the case in which former Congress MP Ehsan Jafri and 68 others were killed in the post-Godhra riots. Gulberg massacre: A judgment that comes too little, too late
The bare facts relating to the court judgment on the Gulberg Society killing of 2002 cannot be flattering for our criminal justice system. First, the delay of 14 years has been rather inordinate and traumatic for the victims and their kin. The Supreme Court-appointed Special Investigation Team (SIT) for probing the case had submitted its final report in February 2011. That this is a high-profile case is borne out by the fact that in this Narendra Modi as chief minister of Gujarat had been questioned by the SIT and given a clean chit. Next, of all the theatres of disturbances in Gujarat in February-March 2002, the Gulberg killing, in which 69 persons, including former Congress MP Ehsan Jafri, died, was the second-worst in terms of the number of people killed, next to Naroda Patia. Finally this judgment has come after all the cases of the Gujarat riots barring one have been disposed of by various courts. There are some other questions that need to be answered also. First, it was initially reported that a crowd of about 400 people, including Vishva Hindu Parishad workers, attacked the society. If just 24 people are convicted, it may be legitimately asked how many people were involved in the killing and how many had provided them support. And on the conviction list the name of just one VHP leader figures. It is inconceivable how such an act of killing could take place without the rioters being mobilised organisationally. That such mobilisation had taken place in Naroda Patia is proved by the fact that former minister Maya Kodnani had been convicted in the case. Also, the conviction number is astounding when seen in the light of the fact that in the Mehsana incident of March 1, 2002, when 33 people died, a special trial court had convicted 31 for murder and other charges. Second, it was in the Gulbarga case that the Supreme Court had asked the SIT to look into the doubts raised by amicus curiae Raju Ramchandran, who had visited Ahmedabad and met witnesses and others to prepare his report on the SIT’s report. In July 2011, Mr Ramchandran submitted his report, in which he differed from some of the SIT’s findings. The Supreme Court had then decided to keep the report confidential and did not allow the Gujarat government or the SIT to access it. What action was taken on it is not known till now. The wheels of justice will not stop here, in the same way that they did not stop in all other cases relating to Gujarat 2002. In the Godhara train-burning case, in which 59 kar sevaks died, 11 of the accused were sentenced to death, but the matter has gone up to the higher courts.

In the backdrop of representations from various stake-holders and political parties, Governor of Gujarat O P Kohli today sought clarification from the state government on some of the key provisions of the Higher Education Council Bill passed by the Assembly in April. Kohli held a detailed meeting with Ministers and top officials of Education Department at Raj Bhavan in Gandhinagar and sought clarification on some of the provisions of the Bill sent to him for approval,
said a Raj Bhavan statement. “Various organisations, stake-holders as well as political parties have made oral and written representations about some of the provisions of the Bill after it was passed by the Assembly. Looking at the seriousness of the issue, the Governor held a meeting with Ministers and officials of Education Department,” it said. “The Governor held a detailed discussion with the Ministers and officials. He also sought clarification from the government about some of the provisions of the Bill,” the statement said.

2005. However, its first brush with infamy was a year earlier over the killings of Mumbai college student Ishrat Jahan along with three men. The team faced accusations of being “trigger-happy” and many of its top officers were jailed. Even Amit Shah, the then Gujarat home minister and now BJP chief — was implicated, jailed and banished from the state for a while before being exonerated. “Eventually our network of sources and informers dried up,” said an officer. “We became the ultimate fall guys, particularly after the Ishrat Jahan case was handed over to CBI in 2011.”

The letter states that allowing Muslims to move into the locality will “hamper the peace-loving nature here” as their “daily activity involves assaulting and abusing”. Kapurai is located about a kilometre from Hanuman Tekri, where the Best Bakery outlet run by a Muslim family was set ablaze during the 2002 Gujarat riots, resulting in 14 deaths.
