SUNVILLA SAMACHAR Disruption Of Proceedings By Opposition Is Nothing New In Indian Parliament

Political experts and academics are feeling bad at the disruption replacing discussion as the foundation of our legislative functioning and believe the best panacea is to increase the working days of Parliament. It is not that the Parliaments of developed countries sit on the365 days of the year. The experts feel proud in saying that parliaments in other countries onan average meets for 100 days. If the figures furnished by the PRS Legislative Research areto be relied the Lok Sabha has been meeting for nearly 127 days in a year and Rajya Sabha for 93 days.This decreased to 73 days for both houses in 2011, according to the PRS document on thechanging trends in the working of parliament over the past 60 years. The one man who hasbeen primarily responsible for disrupting the Parliamentary proceeding is the patriarch of theBJP L K Advani. After the BJP lost the 2009 Lok Sabha election, for which Advani was projected as the prime ministerial candidate of BJP, he resorted to the tactics of disrupting the proceedings of the house.In fact disruption had acquired such a major dimension and the number of sittings of both houses of the Indian parliament had gone down drastically to such a level that none otherthan but the then Prime Minister Manmohan Singh had expressed concern over the efficacyof the pillar of democracy that celebrated the 60th year of its existence in 2010.. It is not that Parliamentary proceedings were not disrupted during the fifties, sixties,seventies and eighties, precisely during the Congress rule. The house had many opposition stalwarts like Rajnarayan, Madhu Limaye, Ram Manohar Lohia, Piloo Modi, A K Gopalan, Hiren Mukherjee, Nath Pai and others but they did not believe in the politics of disrupting the proceeding of the house to give a bad name to the prime minister. Ironically the BJP useddisruption as the tool to malign the image of the prime minister and denigrate him in public eyes. Veteran politicians and political commentators have noted that debates during the 1950s and1960s used to be livelier and parliamentary disruption was not used for expressing dissent or opposition. It is corroborated by official statistics that the proportion of time lost to disruptionhas been increasing. The loss of time, just below 10 per cent during the 10th Lok Sabha(1991-1996), reached a record high of 40 per cent during the 15th Lok Sabha (2009-2014).By this time the BJP has emerged as the main opposition party. Parliamentary disruptions have been defended by the opposition; as a means to counterarrogance of the ruling dispensation (referring to the “tyranny of the majority and as ameans to highlight matters of public interest. It is worth mentioning that in January 2011, the senior BJP leader and then Leader of Opposition in Rajya Sabha Arun Jaitley had said, “Parliament’s job is to conduct discussions.But many a time, Parliament is used [by the government] to ignore issues and in such situations, obstruction of Parliament is in the favour of democracy. Therefore, parliamentaryobstruction is not undemocratic.” Now, when both houses of Parliament are witnessing disruptions, the Prime MinisterNarendra Modi has been showing his anger. Only yesterday he criticised the opposition for disrupting the house proceeding, tearing papers and making derogatory remarks on theway bills have been passed, as he also accused them of insulting the legislature and the Constitution.This posture certainly does not behove to his stature. Being the leader of the house heshould have behaved more in a rationale manner. The idea of introspection is alien to Modi,which is why it would be naïve to expect that he would do some amount of introspection asto why the opposition was not allowing the house to function. Modi’s anger is more for public consumption and to bolster the moral of his cadres andpartymen. He is not worried at all of the disruption. It is a fact ever since he became primeminister, he has not allowed the house to discharge its duties in a rational manner. He hasbeen unresponsive to the opposition voice. True speaking he has no moral right to accusethe opposition of disrupting the house.Let us confine ourselves to two issues. First, the passage of the three farm - Kapilkumar M. Hirpara bills by the Parliament.

More than a year after three activists from Jharkhand were arrested on sedition charges from different districts in Gujarat over an alleged campaign to support the “Pathalgadi movement”, the Gujarat High Court on Tuesday granted bail to one of the accused — Babita Kachhap. Considering her bail plea, the court took into account that no “actual violence or breach of peace” occurred at any time and more particularly during her presence in Gujarat, and the FIR in question was

registered on account of “other similar offences registered in Jharkhand”. It also took note that the state did not respond to the fact that the Jhar-khand FIRs now stand withdrawn. Kachhap, who hails from Ranchi in Jharkhand, was arrested from Mahisagar district in July last year in an FIR lodged by ATS police station in Ahmedabad for waging a war against state (IPC section 121 (A)), sedition (IPC section 124 (A)) and wanton vilification upon religion (IPC section 153 (A)). She moved the Gujarat HC in January this year seeking regular bail.As

per the prosecution’s case, Kachhap and the other two co-accused, who already had offences pertaining to “antinational activities, abduction, murder, rape, waging war against India” registered against them at various police stations in Jharkhand, had entered Gujarat in tribal areas of Kevadiya, Dahod, Chhota Udepur and Vyara (Tapi) to allegedly instigate “the followers of Sati-Pati Cult of tribal to take violent means by wrong interpretation of the Fifth Schedule of Constitution of India and wage war against India”. However, Kachhap’s

advocate submitted before the court that the prosecution has failed to prove the offences as alleged in the Gujarat FIR and so far as the Jharkhand FIRs are involved in relation to the Pathalgadi movement, the cases now stand withdrawn owing to a Jharkhand government order. Kachhap submitted that the chargesheet indicated that the prosecution relied upon “Facebook posts and criticism of policy of the Government

on non-implementation of constitutional provisions for the benefit of scheduled tribes”, and the same cannot be considered as sedition under Section 124(A) of the IPC. To constitute an offence under Section 124 (A) of the IPC, there must be actual incitement to violence and mere involvement in the Pathalgadi movement cannot amount to commission of offence, Kachhap submitted before the court.
