Gujarat: History-sheeter shot dead by four men in Morbi

H I STO RY- SH E E T E R Mustak Mir of Morbi, who was allegedly associated with the gang of land-mafia Baldev Dangar alias Bali of Rajkot was allegedly shot dead by four scooter-brone men on Sanala road of Morbi town on Tuesday evening. Morbi police said that the four men on two scooters intercepted Mir near Umiya Steel on Sanala Road of Morbi at around 8 pm on Tuesday while he was on his way home from office on his scooter. The assailants fired around 10 rounds from a revolver on 36-year-old Mir from close range and then managed to speed away on their vehicles. An injured Mir was first taken to a hospital in Morbi town and from there, he was referred to civil hospital in Rajkot for further treatment. However, he succumbed to his inju-

ries while on being taken to Rajkot, police said. “Mir had sustained bullet wounds on his head, back and groin. He died while being taken to a hospital in Rajkot,” said Vijay Odedra, police inspector of A Division police in Morbi. Police said that Mir was a history-sheeter who had been facing cases of murders, attempt to murder, assaulting policemen, rioting, land-grabbing etc. He was also arrested by Detection of Crime Branch of Rajkot city police a few months ago for allegedly sheltering Bali and the latter’s other accomplices while they were on the run last year. However, he was released on bail later on. In his complaint filed with A Division police of Morbi, Mir’s younger brother Arif named Hitendrasinh Zala, his younger brother Dharmendrasinh Zala and two unidentified men as accused. Based on the complaint, A Division police have booked the Zala brothers, who are residents of Morbi and the two unidentified men for murder, criminal conspiracy and under Arms Act.

2 / Dt. 06-04-2017, Thursday Editors’ Picks THURSDAY, APRIL 06, 2017 The Supreme Court liquor ban may be a case of judicial overreach Article 47 of Indian constitution says that the state shall endeavour to bring about prohibition of consumption of intoxicating drinks, except for medicinal purposes . It may be noted that this ‘directive principle’ is talking about total prohibition and not just prohibition on national highways. Moreover the words used are ‘shall endeavour’; the same words that have been used in Article 44 about the Uniform Civil Code (UCC). How many states have implemented prohibition? Why did the BJP in 2014 not promise to implement the Gujrat model of prohibition across the country? Why is the media opposing the Supreme Court’s directive on limited prohibition that is applicable only on national and state highways. The court was right in saying that India, which is on the cusp of becoming an economic superpower, should not become the accident capital of the world. It is crystal clear that the media has double standards and its sympathies are with the powerful liquor lobby. The apex court order of December 15, 2016 in K. Balu’s case came in for review as all states and the Centre are sympathetic to the cause of liquor vendors on highways. The court modified its order on March 31 to give some relief; and has now prohibited the sale of liquor within 220 metres instead of 500 metres of national and state highways in towns with a population less than 20,000. Himachal Pradesh, Sikkim and Meghalaya have been exempted. In 2014, as many as 87,264 people died in accidents on national and state highways in some 2.37 lakh accidents injuring 2.59 lakh people. Accurate statistics of deaths due to liquor consumption, break up of marriages and even divorces including triple divorce are not available; and yet no one argues for prohibition with the same vehemence as for UCC. The court was right in at least taking the first step in the direction of implementing Article 47. But there is some merit in the criticism of this historic order. The order will not be able to prevent drunken driving and the apex court did acknowledge that people may now start their journey after stocking up enough intoxicating drinks. In fact those driving long distances would not mind covering an additional distance of 500 metres to purchase liquor. Some states are even denotifying state highways as municipal roads All directive principles of state policy are ‘policy issues’ which should be left to the government. It is not the job of the court to force the government to implement them. In fact at times such orders are against the spirit of ‘separation of powers’. This was certainly not a fit case to invoke the extraordinary powers of the court to do ‘complete justice’ under Article 142. But then, governmental intent (at least on paper) in this matter is clear from the 2004 directive of the National Road Safety Council established under the Motor Vehicle Act,1988 in which states have been repeatedly advised ‘not only to remove liquor shops from the national highways but also to immediately stop issuance of fresh licences to liquor vendors along with national highways’.

PM Modi to visit Gujarat on April 17 to inaugurate multiple projects

Prime Minister Narendra Modi would visit Gujarat on April 17 to inaugurate several projects, including a hospital in Surat and Sumul Dairy’s cattle feed plant in Tapi district, officials said. The PM is also scheduled to inaugurate Phase-I of the SAUNI (Saurashtra Narmada Avataran Irrigation) project. Providing details of Modi’s scheduled visit, BJP MP from Surat C R Patil said, “Modi would land at Surat airport in the evening of April 16, where we will give him a grand welcome. Next morning, he will inaugurate Kiran Hospital in Katargam area of Surat.” The hospital has been built at a cost of Rs 400 crore by a trust, he said. A survey conducted by the Centre for the Study of Developing Societies (CSDS) revealed that only 33 per cent Hindus count a Muslim among their close friends, whereas 74 per cent Muslims have a close friend from the Hindu community, the Times of India reported on Wednesday. Insights from the study, titled “society and politics between elections”, show that Indians primarily cultivate friendships with members from their own community. In states

such as Gujarat, Haryana, Karnataka and Odisha, an in depth analysis of the respondents to the survey highlights an “isolation of Muslims”. Similarly, only 13 per cent Hindus think that Muslims are “highly patriotic”, 20 per cent of them favoured Christians and 47 per cent for Sikhs. In contrast, at least 77 per cent Muslims consider themselves as “highly patriotic”. While just 26 per cent Christians have put Muslims in the same category. And, at 11 per cent, the Sikhs don’t rate Muslims highly. Surpris-

ingly, only 66 per cent Sikhs consider Hindus as “highly patriotic”. The responses to the questions such as “should the government punish those who don’t respect the cow; don’t say ‘bharat mata ki jai’ at public functions; eat beef or cow meat; do not stand up for national anthem; or engage in religious conversions?” were equally interesting. Based on the answers received, around 72 per cent were found to hold an “majoritarian” view, 17 per cent “weak liberal” and 6 per cent “liberal”.

The commission was formed to probe 15 of these allegations.

Opposition questions preparedness on new tax regime

Agency | New Delhi The Rajya Sabha today took up the four bills related to the GST, with the Opposition questioning the government’s preparedness to implement the indirect tax regime and urging for a mechanism to insulate taxpayers from harassment by tax authorities. Initiating a debate on the bills, Deputy Leader of Congress Anand Sharma said, “It is important that as you go for implementation, both the Centre and the state governments should create an institutional mechanism which protects or insulates the taxpayers from harassment.” He said the government should not create multiple windows of tax harassment, search, seizure and arrests which is “already happening”. “If it leads to that situation, then surely you will not be helping the economy and the industry nor the consumers,” the former Union Minister said

while speaking on the debate on The Central GST Bill, 2017; The Integrated GST Bill, 2017; The GST (Compensation to States) Bill, 2017; and The Union Territory GST Bill, 2017 which were passed by the Lok Sabha last week. Sharma urged Finance Minister Arun Jaitley and the GST Council to keep most of the goods, which are used by the common man, at the tax rate of 5 per cent. He said the government should “resist the temptation” to bring maximum goods and services under the rate of 18 per cent, cautioning that such a move will be inflationary. A moderate rate would facilitate compliance, he said. “Are we actually going to create an efficient tax structure, reduce the burden of compliance, ensuring that the final GST rate will not be too high? I have my doubts. It is because multiple GST rates have been introduced,” he said.

The Gujarat government had filed a detailed reply on the allegations before the commission, in which it stated that Tata Motors was invited by it to relocate the plant from West Bengal to Gujarat. It stated that many states were “wooing” the company, but Tata Motors eventually narrowed its list to Andhra Pradesh, Karnataka and Gujarat. The government stated that it had formed a committee of chief secretary and senior secretaries to deal with Tata Motors. “It is absolutely baseless to allege that the whole project was negotiated by Ms Neera (sic) Radia because the state government officers…carried out discussions about the issue of relocation of the project with the Tata Motors Ltd (TML) team and the state government support to be offered to the company. During such discussions, the officials of the company and senior officers of government of Gujarat participated in the discussion,” the government stated. The commission has stated, “Hence, considering the aforesaid facts, it will be difficult to accept the contention that there was any clandestine understanding between Tata Motors Ltd and the CM of Gujarat…” The panel has also given the Gujarat government a clean chit on other allegations related to the Nano project relocation.
