He earlier said: "Even as we evacuated 1,800 of our citizens from Yemen we also helped some from Bangladesh, Djibouti, Nepal, Pakistan and Uganda so far." He added that in the morning 322 Indians were evacuated by air from Yemen, while more

than 370 nationals were pulled out by sea in the afternoon. Over 300 Indian evacuated from Yemen are to reach Kochi late on Saturday. He said 978 Indians were evacuated in the last four days. The figure did not include the Indians who were expected to land in Kochi late on Saturday. Two Indian Air Force flights carrying 334 Indian nationals evacuated from Yemen had landed in Mumbai on Friday night. A total of 330 Indians had arrived on an Air India flight in Kochi early on Saturday.

Some prime judicial questions in India Conferences of chief justices of high courts and chief ministers are staid affairs. Judicial and executive leaders get together for chitchat and avoid saying anything controversial. There is some talk of pendency of cases in courts and the gathering disperses until the next such occasion. Judges don’t publicly say anything against politicians. The latter are in any case chary of criticizing judges. What happened at this forum on Sunday was very unusual. Prime Minister Narendra Modi touched upon one big taboo subject and stirred a hornet’s nest in the bargain. In his speech, Modi spoke on two interlinked topics. One, the difficulty in estimating the difference between perception and reality. Two, the possibility of “five-star activists” driving the judiciary. These are controversial remarks. They have been made against a certain background and this needs to be appreciated. In recent months, many decisions of the Union government have been subjected to judicial challenge. Now there is nothing new here and this has been so since the advent of judicial activism. In one set of decisions at least, the Modi government has upped the ante. For the first time in two decades, the Union government has shown activism in accepting/rejecting the names of people for appointment to the apex court. Not only that, the passage of a law ending the collegium system of appointment of judges, too, has proved controversial. To say that there is a confrontation between the judiciary and the executive will be too strong a claim. But these decisions have led to anxiety. On a different, non-institutional plane, activists of various hues have kept up the pressure on Modi since his time as chief minister of Gujarat. One way to look at Modi’s assertions will be to see them against a background of institutional imbalances in the Indian polity. This is a well-known theme. Another way to see them would be to look at the past two decades of judicial evolution. Under the original Constitution of 1950, the judiciary had wide-ranging powers of judicial review. These were seldom used beyond a point. Since 1974, judicial review of laws and executive actions has come to such a stage that one legal scholar, Upendra Baxi, has claimed that India’s higher judiciary now co-governs the country. If this question is posed to any Supreme Court or high court judge, he will reject it instantly. But that denial will not square with reality. The realm of plain vanilla judicial review has been left long behind. Today the Supreme Court is an active intervener in policy formulation. From deciding how natural resources will be allocated to something as mundane as the number of toilets in schools in some states, nothing is seemingly out of the purview of courts. This enlargement of domain has a corollary. By their very nature, public acts invite public scrutiny. If the apex court and high courts pronounce on matters that affect policymaking, sooner or later, judicial decisions and judicial conduct, too, will be subject to criticism and possibly partisan comment. That will be a dangerous development for many reasons. The judiciary as an institution is a very important safeguard for Indian democracy. - Kapilkumar M. Hirpara

Sebi mulls new norms for changes in Sensex, Nifty Agency : Mumbai Regulator Sebi will soon put in place new norms for changes in constituents of the key stock market indices, including Sensex and Nifty, as it frames a separate mechanism for regulating the index providers. The index operators, which include subsidiaries of stock exchanges and independent entities such as S&P, currently do not come under Sebi's direct regulatory purview and the new norms would also include a 'code of conduct' for them while mandating more disclosures and greater transparency while including or excluding a stock from the indices. "The broader equity indices traded at Indian stock exchanges are owned and managed by separate legal entities or subsidiary of stock exchanges. As a re-

sult, these entities do not come under the purview of any specific regulation or ambit of regulations," a senior official said. "Therefore calculation, maintenance and management of Indices are carried out at the discretion of Index providers and no regulatory oversight is presently available," he added. Accordingly, Sebi has decided to put in place a regulatory framework for the index providers and their activities. Among others, the major indices on the NSE are managed by India Index Services and Product Ltd (IISL), a NSE group company, which maintains over 80 equity indices comprising broad-based benchmark indices, sector indices and customised indices. Earlier, rating agency Crisil had a stake in IISL, which it exited in 2013.

Airtel Zero: Another blow to net neutrality

Agency : NEW DELHI Airtel has launched 'Airtel Zero,' a platform through which it will offer users free access to certain mobile apps. These apps will be from developers who have signed up with the company. Through the scheme, app developers and internet content service providers (or over-the-top content providers) will be able to make some part of or their entire mobile app free for customers. This implies that users will not have to pay data charges (or get usage allowance deducted from their data packs) when they access these apps via Airtel's mobile data network. It's worth pointing out that Airtel

Zero violates the principles of net neutrality as the company will offer an advantage to certain players in terms of cost of access and will even promote them. These players will most likely shell out a fee to get this favourable position. While Airtel will get an additional source of revenue, for service and app providers, it will be an additional expenditure just to ensure that they don't lag behind their competitors. Airtel claims the platform is similar to providing toll-free numbers for customer care and says Zero is 'an open and non-discriminatory marketing platform for all developers in India - irrespective of the size of their business.'

Agency : New York If you have cut down on the amount of content you share on Facebook or Twitter even as your lists of friends and followers grow, you are not alone. A study co-authored by an Indian-origin researcher suggests that although more and more people are participating in social networking, a smaller percentage of users are actively creating and sharing content. The findings to be published in the journal Management Science pointed out that the cheaper and easier it becomes to reach large numbers of people via

social media, the fewer “content creators” choose to participate and the more cluttered the networks become. “Social communication incentives diminish even as the reach or the span of communication increases,” said study authors Ganesh Iyer and Zsolt Katona from University of California, Berkeley – Haas School of Business. Industry reports estimate that just 10 percent of Twitter users broadcast 90 percent of the network’s tweets, while only a tiny fraction of the 55 million users who blog post daily, Katona noted.

Officials of the Gujarat Secondary and Higher Secondary Education Board (GSHSEB) are scrutinizing the results of the past three years of Jay Somnath High School situated in Khokhara. This school is currently under investigation after the Class XII, Semester IV, biology question paper was leaked. GSHSEB officials suspect that someone from the board and the school staff had joined hands to leak papers. It has been alleged in some quarters that papers had been regularly leaked by the school staff for the past three years. The board is now trying to find out how many students from the

school had got more than 80% marks. Board officials said that investigation by the police is yet to get to the bottom of the paper leak incident. A peon of Jay Somnath High School is among those arrested for leaking the biology question paper. A complaint in this regard was lodged earlier by Ahmedabad district education officer Ashok Rathod with Khokhra police against five persons for leaking the

question paper on March 20, the day the exam was held across the state. According to official procedure, a government employee carries the papers to a school in sealed packets of 30 papers each. The packets are then sent to the respective examination halls. The invigilator opens the seal of the paper in the presence of two students from the class and gets their signature.

Gujarat government’s Institute of Seismological Research (ISR) is all set to come up with an earthquake early warning and prediction system to avoid loss of lives and property during such a calamity in the state. Gujarat had witnessed one of the most horrific earthquakes on January 26, 2001, taking the toll of more than 10,000 lives, in Kutch and a loss of the properties worth in crores, which was the main reason to come with this idea of early warning system. “We are setting up an early warning system that

can predict earthquake when it takes place at its epicentre and with its help we can give an alert around 30 seconds before the tremors reach other places,” Director General at ISR, B K Rastogi. “By developing this system, we can save lives of people at the time of earthquake and also we can generate alerts to the industries including major nuclear plants and hazardous chemicals units so that no lethal leakage will take place,” added Rastogi. The idea to develop earthquake early warning system was conceived considering the

fatalities that the state had witnessed during the major earthquake on January 26, 2001, said Rastogi. The epicentre of that earthquake was Bhachau in Kutch district, which is considered as the major faultline and we cannot deny the probability of such major earthquakes in future also, he said. According to Rastogi, ISR’s earthquake prediction and early warning system will be the country’s first such full fledged centre. “There was a plan to set up an earthquake prediction centre in Noida on outskirts of Delhi and it got sanctioned also. However, work has not started, but we have already started developing softwares and hardwares for our system,” Rastogi said. “We have imported hardware and software systems from some foreign universities, while the research to develop the technology have been based on faultlines and seismic waves,” added Rastogi.
