A single judge bench of Gujarat High Court (HC) presided over by Justice G R Udhwani, on Tuesday, recused itself from hearing a petition whereby the then Chief Minister of Gujarat and present Prime Minister Narendra Modi is accused of violating the model code of conduct and unduly influencing voters in Ranip area by clicking a selfie holding a symbol of Lotus – BJP symbol – while voting during 2014 Lok Sabha elections. Notably, the same bench had, on September 28, heard the matter and kept it for Tuesday after the Advocate General, appearing for the State of Gujarat, sought time to produce some judgments in support of their case. The petition has been moved
by one Nishant Varma seeking criminal action against Modi for his act which was allegedly in violation of The Representation of the People Act (RP Act), Indian Penal Code (IPC) and Model Code of Conduct (MCC) of the Election Commission of India. According to Varma, on Tuesday, the judge simply recused himself from hearing the case by saying ‘Not Before Me’ when the Public Prosecutor sought a short date since the Advocate General was not available. The three-member committee chaired by former Secretary General of Lok Sabha PDT Achary, in its report submitted to Assembly Speaker Ram Niwas Goel, has favoured a 400 per cent hike in basic salary of MLAs from Rs 12,000 to Rs 50,000 per month. Overall, the
hike recommended has been 138 per cent. In July, a group of AAP legislatiors had demanded a significant hike in salary, arguing their earnings were not enough to run their family and offices. “The committee has recommended to increase the existing salary of MLAs from Rs 12,000 per month to Rs 50,000 per month. Also, total salary and allowances of MLAs have been recommended to be enhanced from the present Rs 88,000 per month to Rs 2.10 lakh per month,” Achary.

The Nathuram Godses of the world are being glorified We have just celebrated the 146th birth anniversary of Gandhi. The Dadri incident is a chilling reminder of the rising tide of intolerance and hate in the country. Of late, communal intolerance has seen a tremendous upsurge. It seems that the poisonous seed that has been sown is bearing fruit. We are sitting on a simmering cauldron of a communal firestorm. India won freedom on August 15, 1947 under the leadership of Gandhi. A galaxy of glorious leaders toiled selflessly for freedom. People from all walks of life joined the long and exacting campaign. The British government used every possible ruse to divide the ranks of the freedom movement and debilitate its vigour in order to perpetuate its misrule. Seeds of communal dissension were sown to create Hindu-Muslim discord, which ultimately led to Partition. Nehru emerged as the natural successor to Gandhi, and became the first prime minister of independent India. It was Nehru’s towering personality, international repute, statesmanlike calibre, immaculate vision, abiding faith in democracy and secular outlook that won him the trust and confidence of the nation. Notwithstanding his stature, the challenges that lay ahead were formidable. The country was partitioned in the name of religion and the communal divide was at its sharpest due to gruesome riots on a monumental scale. The country was bruised and battered when Nehru took the reins and set out to create a republic wedded to the ideals of secularism, rule of law and democracy. The assassination of Gandhi by a fanatic was a body blow. There were fears that the predictions of Winston Churchill and other imperialists were coming true. It’s not that there have been no communal riots after Independence. Mischief mongers and bigoted fanatics did not vanish from our society. There have been numerous communal incidents in various parts of the country but there was no confusion in the policies of the government on the secular character of our state. Pluralism and equality of all religions remained the bedrock of state policy. Governments and political parties would take swift action to weed out lumpen elements to instil confidence in the people. Everybody expected the 21st century to be characterised by communal harmony, mutual brotherhood and greater tolerance. Rajiv Gandhi envisioned an India without communalism, casteism, hatred and violence. As ill luck would have it, he did not live long enough to give practical shape to his vision. Successive governments belonging to varied political formations ruled this country after his death, until May 2014.

Agency | New Delhi The finance ministry on Monday said it expected the overall tax collections this financial year to fall five-seven per cent short of the Budget estimate, largely due to less-than-projected direct tax collections. This is despite the excise duty on petroleum products being raised, sops to the auto and capital goods sector being rolled back and service tax being increased in June. Senior ministry officials were confident that the Centre’s fiscal deficit would be restricted to 3.9 per cent of gross domestic product (GDP) without expenditure cuts, a departure from the past few years. The ministry said it remained confident of GDP growth of more than 7.5 per cent in FY16, though it would be less than the earlier projection of 8.18.5 per cent. “There is likely to be some shortfall in direct taxes at the end of the year but some part of it will be made good by indirect taxes... The shortfall might not be more than five to seven per cent. Against the (Budget) target of Rs 14.5 lakh crore, we hope to achieve at least Rs 14 lakh crore, according to the current estimate,” Revenue Secretary Hasmukh Adhia said at a press briefing.
