Triple talaq is not an essential religious practice in Islam, Centre tells Supreme Court

Govt opposes triple talaq, polygamy in SC (H.S.) | New Delhi

The centre is opposed to the Muslim practice of triple talaq, it has informed the Supreme Court, describing it as “misplaced in a secular country.” The constitution allows Muslims, the biggest religious minority group in the country, to regulate matters such as marriage, divorce and inheritance through their own civil code. The Supreme Court has been examining how much it can interfere in Muslim laws governing family-related issues as it hears a plea to end the practice which permits Muslim men to divorce their wives by saying talaq three times. The top court had asked the government to weigh in on the debate as to whether

intervening in the law would violate the Muslim community’s fundamental rights. The centre today said “gender equality and the dignity of women are not negotiable” and told judges that “even theocratic states have undergone reforms in this area of law” which reinforces that these practices cannot be considered an integral part of practice of Islam. Women’s rights activists have long called

for reform of the Muslim personal law which they say discriminates against women. What they want instead is a well-defined law that criminalises polygamy, unilateral divorce and child marriage. Campaigners say the “triple talaq” practice - which allows Muslim men an instant divorce with Muslim women being divorced via Facebook,

Skype and text message - is unconstitutional because it violates the right to equality. Earlier, the top decision-making body for Muslims in India, the All India Muslim Personal Law Board, said the court cannot interfere in the religious freedom of minorities and “rewrite personal laws in the name of social reform”. The petition being considered by the Supreme Court also seeks an end to polygamy and ‘halala’, which mandates that if a woman wants to go back to her husband after

a divorce, she must first consummate her marriage with another man. “Triple talaq is not valid as per the Koran, which stresses mediation and reconciliation before the decision to divorce,” said Zakia Soman, co-founder of Bharatiya Muslim Mahila Andolan (BMMA), which campaigns for Muslim women’s rights and is a co-petitioner in the case. In a 1985 landmark judgment, the Supreme Court granted divorcee, Shah Bano, alimony for life. But following protests

The petition, which was mentioned through senior advocate Rajiv Dhavan and advocate Keshav Mohan, urged the apex court to stay high court order, quashing the government notification to ban liquor. However two days after the high court quashed the order on prohibition, Bihar government on Gandhi Jayanti came out with a

new law banning liquor with harsher provisions like arrest of all adults in the event of recovery of the contraband in their house. In its notification, the government notified the Bihar Prohibition and Excise Act, 2016 to ensure that the ban on sale and consumption of alcohol including Indian Made Foreign Liquor (IMFL) as well spiced and domestic liquor, continued in the state.

(H.S.) | Jaisalmer India will completely seal the border with Pakistan by December 2018 by using all effective means including technological solutions, Union Home Minister Rajnath Singh said in Jaisalmer on Friday. Speaking to media after reviewing the security situation on border with ministers and officials of four States,

Mr. Singh said India is planning to seal the entire border with Pakistan by December 2018 and a proper monitoring mechanism would be in place at the central and state government levels for it. He also mooted setting up a border security grid for which suggestions have been invited from all the concerned stakeholders including the States which share border with Pakistan. “It is a new concept. We will be framing guidelines after getting suggestions from all stakeholders,” Mr. Singh said.

Making sense of Santos winning Peace Nobel

The Nobel committee’s decision to award this year’s Peace Prize to Colombian President Juan Manuel Santos may have taken many by surprise. The decision comes a few days after the Colombian people rejected an agreement Mr. Santos’s government signed with the guerrillas of the Revolutionary Armed Forces of Colombia (FARC) in a referendum, throwing efforts to end the country’s 52-year-old civil war into uncertainty. Media had speculated, after the referendum results, that Mr. Santos and FARC chief Timeleon ‘Timochenko’ Jimenez were off the list of Peace Prize contenders. Still, the committee’s decision, unlike some of its controversial choices in the past, is in sync with reality. True, the future of the peace process is still hanging fire after the referendum. But taking a country from the middle of a war to the brink of peace itself is quite an accomplishment, and Mr. Santos and Mr. Jimenez could take credit for the same. When Mr. Santos took over as the country’s President in 2010, FARC’s organisational strength was considerably weakened, mainly due to the brutal war the previous administration fought with help from the United States. But the rebels were not defeated yet. They still had 6,000-7,000 soldiers, guerrilla infrastructure built deep in the jungles and support among people living in Colombia’s countryside. Mr. Santos saw FARC’s weakness as an opportunity for peace. It is never been easy for Indians to take the Nobel Peace Prize too seriously. The greatest modern practitioner of non-violent political protest, Mahatma Gandhi, was never given the prize despite having been nominated five times. After he was assassinated the committee declined to award him on the grounds that it preferred not to give the prize posthumously – only to abandon that principle for just one time in 1961 when a fellow Scandinavian, the United Nations Secretary-General Dag Hammarskjold, was killed. Inevitably, given that almost no one in the world will ever command universal admiration for all his or her actions, the peace prize is the most controversial of all the Nobel awards. Its decisions are always coloured by politics, at times the obscure and whimsical politics of the Norwegians who make the decision. This year’s award to Colombia’s President Juan Manuel Santos will be no different. The most obvious reason: The Prize seems to have been given less for his accomplishments than as compensation for his failure. The peace agreement between the Colombian government and the FARC guerrilla movement for which Mr Santos is being felicitated is now on life support after it was voted down in a referendum. In theory, Mr Santos can press ahead with the agreement and so far the ceasefire between the two sides is holding, but it is now bereft of legitimacy. Mr Santos, if anything, deserves a fair amount of criticism rather than a reward for deciding to put the agreement to the popular vote rather than just getting it passed through the legislature. The Nobel Peace Prize has been given in the past to help provide moral support to peace-makers still weaving together a nest of olive leaves for political doves to find a home. The Arab-Israeli conflagration has received a few such prizes without any sign that the faultline has disappeared.

QUOTE “India has decided to completely seal its winding OF THE border with Pakistan by December 2018,” - Home Minister Rajnath Singh said on Friday a new concept, “Border Security Grid”, “Tension DAY between India and Pakistan has increased, countrymen should trust security forces and stand by them,” Angry Akshay Kumar to fellow Indians: First think about jawans and their families, argue later

(H.S.) | Mumbai Ever since 19 Indian soldiers lost their lives in the dastardly Uri attacks, the nation has remained on a boil. Adding fuel to fire is the multiple newsroom debates where Indians are arguing amongst themselves. And to make matters worse, there is the political call to ban Pakistani actors. Evidently angry at the turn of events in India post the attacks, an angry Akshay

Kumar spoke his mind through a video message posted on his Facebook account. Said Akshay, “I am not talking to you as a star or celebrity. I am talking to as an army man’s son. I have been noticing since long that in news and newspapers our own countrymen are arguing with each other. Some are asking for surgical strikes proof. Some are demanding that artists be banned. Some are scared of whether a war

will happen or not. Gentlemen, please argue later. First please think about those who have laid down their lives for you at the border. 19 jawans attained martyrdom in Uri attacks. One 24 -year-old soldier Nitin Kumar sacrificed his life in Baramulla. Are their families and every other army family concerned about whether a film will release or not or will an artist be banned or not? They have just one worry, just one concerntheir future. We should be see to it that their present and future should be correct and secured. They are there guarding us and that is why I and you are alive today. If they are not there to guard us, Hindustan will not be left. Jai Hind.”

Ajay Devgn has become the first A-list star to openly confess that he won’t work with any Pakistani artiste at the moment. During his interview with CNN News 18, the actor used honest logic gave his explanation as to why he wouldn’t work with Pakistani stars. “We all want peace, lekin taali ek haath se nehi bajti (you can’t clap with one hand). I heard some people saying talks are the only way to continue but talks have been going on. You keep talking to people and they come and kill you then you still continue your dialogue. (H.S.) | New Delhi “Et tu, Brute! (You too, Brutus),” says a wouldbe-bride’s drunk father. But the woman is far from reconciling and a silent war brews between them. Neither is the winner and the person pulling the strings is hidden in the background. Two school kids in Jodhpur are inseparable. The rich girl isn’t concerned about the boy’s humble roots and both are happy until a tragedy tears them apart. They meet again in Udaipur after

some years – now as princess Suchitra (Saiyami Kher) and horse trainer Aadil (Harshvardhan Kapoor). Suchi’s marriage with Prince Karan (Anuj Choudhary) is impending, and it’s going to be a saga to remember, filled with rage, grief and romance. With Mirzya, Gulzar is back to screenplay writing after 17 years. He chooses to depend on a ‘sutradhar’ (the narrator). Sometimes, it’s a voiceover, sometimes it’s a group of tribal women. The wom-

en wear colourful clothes and dance to songs reflecting the protagonists’ mental states. Add to it Shankar Ehsaan Loy’s music that reflects the ecstatic pain of love and takes the narration forward. Director Rakeysh Omprakash Mehra creates a surreal world. He experiments with time warp and appears confident about the technique – having used it effectively in Rang De Basanti and Bhaag Milkha Bhaag. And he is willing to add more drama. Like a stage play. Amidst colour blasts and oiled bodies, where super-slow motion shots frequently feature. You don’t mind if Gulzar’s couplets cover almost the entire film. They are beautifully written and fantastically captured by the cinematographer Pawel Dyllus.

He is 43 years old. Why does his father always have to come to his rescue? For how long will he keep hiding behind his big, influential father’s name? He is an adult and can pretty much handle his own controversies in show business.” Now, a few days later, Rakesh chose to react to Kangana’s statement, “I am still a working father and I proudly play an active

part in my son’s life. And for those who find that unacceptable, let me say that for parents — children, whether 43 or 83 years old — are still children.” About Hrithik whose Mohenjo Daro crashed at the box office, Rakesh said, “Hrithik has not gone through any hard times. Interviewer Bhupendra Chaubey even directly asked him if he was taking a proBJP stance since the actor had campaigned for the political party in the past, and also his wife, Kajol Devgn have earlier praised one of Prime Minister Narendra Modi’s pet project Swacch Bharat initiative. Ajay Devgn was not the only

furious actor who openly expressed his opinion. On social media, an angry Akshay Kumar expressed his shock that some people are debating the ban on Pakistani artistes at a time when soldiers are being killed in terror attack. A family who has a son or father in the army, fighting in the battle field is least concerned about which Bollywood film released and whether it has Pakistani artistes, he said in a video message.

glish, he does not quite like it. Krishna (played by Prabhudheva) is the protagonist in Tamil director AL Vijay’s maiden Bollywood venture, Tutak Tutak Tutiya that hits theatres on Friday. The movie that also marks the debut of Sonu Sood as a producer, defines male chauvinism: The hero wants to marry a modern girl but when he gets one (well, in parts) he is not impressed. The psycholo-

gy that works behind such storylines and the one that makes films like these work, is a major problem with our filmmaking business. Tutak Tutak Tutiya is supposed to be a light-hearted movie with all the elements of an entertaining, masala film. Krishna is forced to marry Devi (Tamannah), a village girl and plans to hide her in a flat in Mumbai so that none of his friends discover he is married. But there is a twist in the tale. A ghost stays in the flat- Ruby, an aspiring actress who committed suicide when her first film was cancelled. Ruby possesses Devi and uses the latter’s body to fulfil her dreams of becoming a successful actor.

The Hrithik-Roshan-Kangana Ranaut public fight refuses to die down and the latest one to get embroiled in it is the Mohenjo Daro actor’s father Rakesh. Days after Kangana Ranaut questioned filmmaker Rakesh Roshan’s statement on the behalf of his son, he has slammed the Tanu Weds Manu actor. Rakesh had recently said that if Hrithik broke his silence about a certain actress, it will shock the public. Kangana, never the one to mince her words, said at an event why a father needed to speak for his grown up son. Said Kangana, “I want to know why Indian men can’t stand for themselves.

Delhi Dynamos couldn’t have hoped for a better start. They were in the lair of the champions who had put up a fairly good performance in front of a hostile Kolkata crowd against Atletico de Kolkata. Chennaiyin were also looking better than their opponents in the first 20 minutes of the game and it was Delhi’s Santana who was the busier of the two goalkeepers. But Delhi, to their credit, kept at it, defending stoutly and pouncing onto the opposition half whenever they could and in the end, got the reward to show for it. ISL debutant Marcelinho converted from the spot to score on debut. Dudu scored for Chennaiyin just seconds later and it seemed they might repeat what they did in Kolkata,

Change remains a constant in skipper Virat Kohli’s gameplan

Test captaincy from MS Dhoni, through injury or tactical necessity, India have invariably changed their first team. In August this year, Kohli made his thoughts about constant change clear. He emphasised that changes in playing eleven were not an issue for him or his side. “Usually if you see, very few people like change. This team doesn’t think how others would react or what they might say,” he had said. And Kohli has followed this theory to its practical end every time

he has led India on to the field. In the first Test, pacer Bhuvneshwar Kumar was kept out of the playing XI, despite having picked up a five-wicket haul in his previous series in the West Indies. Umesh Yadav had played then, only to be dropped in the second Test to make way for Bhuvneshwar, who surprisingly paid rich dividends, scalping a fivefor. In the third Test, Bhuvneshwar will once again sit out, but this time due an injury. Injury has been the biggest bane for India in the last two Tests of the series. At the top of the order, Shikhar Dhawan and KL Rahul are both absent for the final Test through injury, sealing another Test where India will see a change in combination. Unlike captains of yore who emphasised the importance of a stable side, Kohli has gone in the opposite direction. Change seems to be his biggest asset.

Agency | Washington People who are diagnosed with HIV at advanced stages are more likely to transmit it to others. Since they are unaware about the disease and are not on treatment for a long time, they are at a greater risk of transmitting the infection without knowing it, finds a new research at the University of California. Further, these patients are at an increased risk of negative health outcomes such as premature death, increased risk of HIV transmission, and opportunistic infections such as Kaposi’s sarcoma, Pneumocystis carinii pneumonia and toxoplasmosis. Lead researcher Brandon Brown and his team examined the prevalence and risk factors for county residents who have an AIDS diagnosis within 12 months of their first HIV-positive test. “Although free confidential testing is available throughout Riverside County, more than 30 percent of new HIV diagnoses qualified as late-to-test, that is, they received an AIDS diagnosis within 12 months of a seropositive HIV result,” Brown said. “Earlier diagnosis is a critical component in preventing onward transmission of the virus and represents missed opportunities for treatment,” he added.
