There are concerns that lenders have had to take large haircuts on firms that go through the Corporate Insolvency Resolution Process or CIRP under the Insolvency and Bankruptcy Code or IBC. The unease over low recoveries resulted in the National Company Law Appellate Tribunal, or NCLAT, ordering restarting of a concluded resolution process of Videocon Industries in January this year. Revisiting commercial decisions taken by the Committee of Creditors (CoC) increases uncertainty in the IBC process. While anxiety about low recoveries from the IBC may be valid, we should revisit how large the haircuts are and investigate the factors that drive this outcome. Improvements in recoveries are more likely to result from systematic fixtures to overall policy environment as opposed to revisiting individual cases. The NCLAT ruling on Videocon mentioned earlier ordered the re-opening of a resolution plan that was accepted by a CoC majority even though only 4.15 per cent of the admitted claims were recovered. It is understandable that the court is concerned over low recoveries. However, this decision seems to go against a Supreme Court ruling, which said that “the adjudicating authority or the appellate authority cannot sit in an appeal over the commercial wisdom of CoC.” The decision also seems contrary to the IBC, which intended to reduce the scope of such judicial discretion. Ultimately, the question of what the alternative to the 4.15 per cent recovery was, is best understood by members of the CoC themselves. There may be merit in trusting the commercial wisdom of stakeholders, even if, in particular instances, it goes against our notions of fairness. We may be overstating the impact of haircuts lenders see in the IBC. When a firm gets into trouble and anticipates that it will not be able to repay its loans, it typically seeks to restructure its debt obligations with the lender. A lender makes a decision based on a judgement about the firm’s business, and the impact it can have on its provisioning. By the time a firm comes to the IBC, one can assume that the restructuring process has not worked. While we don’t have adequate data for whether restructuring became more effective because of the potential threat of the IBC, conversations with industry - Kapilkumar M. Hirpara players suggest that it did.

‘Salaam Venky’ actress Aahana Kumra: ‘I am so overbored with thrillers and propaganda films, I want to be a part of light-hearted films’ Be it socially-relevant movies or family dramas, actress Aahana Kumra has carved a place of her own in Bollywood and on the OTT. And, after playing a pilot in India Lockdown, she will be seen as a journalist in her new movie, Salaam Venky. The movie is directed by Revathy and stars Kajol and Vishal Jethwa in lead roles. A popular face on the OTT, the actress in an exclusive interaction with The Free Press Journal gets candid about enjoying the digital world, teaming up with Revathy for Salaam Venky, her latest release, India Lockdown, and more. We shot the film between the first and the second lockdown. It was a 26-day schedule. I play a pilot in the film but didn’t require any technical training. I represent urban India. It was a different story as to what happens to working people at home. The only brief I got from Madhur is that he doesn’t want that typical Aahana Kumra. Also, my physicality kind of resonated with the character. My look and styling too are different in the film than usual. She is just like one of us, very friendly, pally, and rare. It is difficult to find someone like her. She is protective of everyone on the sets. The reason why this incredible cast has come together for the film is because of her. I am so fortunate to be a part of this film. I am so overbored with thrillers and propaganda films, I want to be a part of light-hearted films... Films which have repeat value, which you can watch with your family. don’t think so. Today, no one knows what is working and what is not. But I strongly believe that if the story is good then people will come to theatres. Recently, Uunchaai worked and it doesn’t have any action or so, it’s a simple story of friendship and family. We had one scene and it is so nice to work with him again. I so wish that there will be a season 2 of Marzi but it is unlikely. It was a great show and, sadly, it didn’t get season 2. I love his energy and would like to work with him again. I had to safeguard myself when I was working with him since there were so many girls behind me with the hope to meet Rajeev through me.

in the US. Malaika opted for a casual look in a sky blue shirt and matching shorts and wore a cap. Malaika couldn’t stop smiling as Arbaaz and Arhaan hugged each other. A paparazzo account on Instagram shared the video of their

Writing to you on behalf of Ajmera realty infra India ltd, Listed entity, having established itself for over 52years. Enclosed below is the perspective by Mr. Nitin Bavisi, Group CFO at Ajmera Realty & Infra India Ltd. on RBI Monetary Policy announcement. “The RBI’s decision to hike the repo rate by 35 bps is on the much-expected lines with the primary goal of keeping inflation in check. Although this will lead to a marginal rise in lending rates, it may not be of much deterrence for the real estate industry backed by the positive sentiments of homebuyers and strong demand influenced due to

the price rise of Indian real estate in the days to come. The current stance on the repo rate will have lower impact on the mortgage rate, as the pace of hike has been moderated and hence perceived positively by the home buyer. Inflation has been moderating as RBI has been keenly focused on the evolving changes and taking real-time corrective action in the best interest of economic growth as it continues to float above 4 per cent in the next 12 months. With the growth forecast positioned at 6.8% and manufacturing services PMI for India in November amongst the highest in the world, we are hopeful of a positive turnout.”
