Hit And Run Case : Bail, no jail for now

Salman case puts question mark over legal process

The Bombay High Court’s order suspending the five-year imprisonment given to the 2002 hit-and-run case convict actor Salman Khan is bound to raise many eyebrows.

that common in India. Even high profile politicians such as RJD chief Lalu Prasad or AIADMK supremo J Jayalalithaa had to cool their heels behind bars before being granted bail in the

fodder scam and the disproportionate assets cases respectively. Convicted of corruption in teachers recruitment scam, 80-year-old INLD leader Om Prakash Chautala still continues to be in Ti-

har Jail in Delhi while his appeal is pending before the Delhi High Court. According the National Crime Records Bureau (NCRB), over 2.78 lakh undertrials, many of them charged with not so seri-

Agency, Aligarh In May last year, the Supreme Court acquitted all six men accused of the blast at the Akshardham Temple, Gandhinagar, Gujarat, in 2002. Among the six was Mufti Abdul Qaiyum Mansuri, who

was in Aligarh on Thursday. Students of AMU felicitated him for his courageous fight to prove his innocence. Qaiyum said he was extremely proud of the Indian judiciary he had spent 11 years of his life in jail, but at the

end his innocence was proven, he said. “I had faith in the judiciary. What is noteworthy is that all the people involved in delivering justice to me were non-Muslims, from judges AK Patnaik and V Gopala Gowda to lawyers KTS Tulsi, A Saran and Kamini Jaiswal,” Qaiyum said. Qaiyum is now author of “Gyarah Saal Salankhon Ke Peeche” (Eleven years behind bars), set to be released on May 8 in New Delhi. Published by JamiatUlema-I-Hind, the book has proven a nightmare to Gujarat police. On April 16, as a discussion of the book was on in Gujarat,

police interrupted proceedings, claiming the audience would turn antagonistic to the administrative machinery. On May 16, Qaiyum will be celebrating a year since he was released from jail. “Muslims should not be viewed with suspicion. They will always be with the country. No innocent man should be charged with being a terrorist,” he said. Reminiscing over his time in jail, Qaiyum said, “The toughest day in the 11-year jail term was when I was taken for what could easily later have been termed an ‘encounter’. The policemen tried to scare me by firing five bullets.

ous crimes, continue to languish in various jails across India. Maharasthra alone has about 20,000 undertrial prisoners. While lakhs of undertrials - who can be legitimately presumed innocent till proven guilty – are kept like sardines in overcrowded barracks, a man convicted of culpable homicide not amounting to murder for running over poor people sleeping on a pavement roams free. The trial court found that Khan did not have a driving licence; was drunk; and was on the wheel on the fateful night. This was sufficient to conclude that he had knowledge that his act could put innocent lives at risk. “Once knowledge that it is likely to cause death is established but without any intention to cause death, then jail sentence may be for a term which may extend to 10 years or with fine or with both,” the Supreme Court said converting the 1999 BMW hit-and-run case convict Sanjeev Nanda’s from rash and negligent act (Section 304A IPC) to culpabale homicide not amounting to murder (Section 304 Part-II). Those comparing Khan’s case with that of Alistair Pereira are not factoring in that State never sought enhancement of threeyear sentence given to the convict. Had they done so, Pereira would have got a longer jail term. “For an offence like this

Agency, Mumbai It’s an irony that the trial court took 13 long years to nail the culprit and the High Court freed the convicted actor within hours. “Not only must Justice be done; it must also be seen to be done.” The HC’s order saving Khan from incarceration appears to go against this age-old principle followed by courts. 2 / Dt. 09-05-2015, Saturday Editors’ Picks SATURDAY, MAY 09, 2015 Salman Khan is out on bail, but here’s some crucial lessons from the actor’s verdict There were many who gloated over Salman Khan’s conviction by a Mumbai court. Such happiness is not because they feel justice has been done to the victims involved in the incident. It appears essentially as a glee that follows from seeing the fall of a controversial superstar who was strutting across Bollywood like a colossus. Not to mention, the actor frequently got into trouble due to an exaggerated notion of his status. In my view the fiendish delight of many who celebrated Khan’s misfortune is essentially an Indian trait. I am not here to defend Salman. From the facts put out by the press over the years, he has possibly been rightly convicted for his utter rashness and negligence. I am happy his heroic attempt to cover up his misdeed did not succeed. At the same time we should not grudge him all the privacy and legal assistance he is entitled to as a citizen. There is also the relevant question as to whether he got his desserts only because he was a celebrity. A lesser person may have got away from the crime. It is the experience in most of India that traffic accidents are about the most easily manipulated by dishonest police officers acting to save a moneyed offender. A wronged victim ( many either poor or from the middle class) is very often presented to the court as a negligent pedestrian who brought the misfortune upon himself. The rough sketch of the scene of accident is often wantonly wrongly drawn up in the very first instance so as to bail out a rash driver. The introduction of his driver, made to accept responsibility for Khan’s fault, is a tactic normally employed by many car owners to save themselves. It is not very difficult for a judge to see through the game. To punish Salman’s driver for perjury is, in my opinion, totally unfair. When many in society’s higher echelons are eminently purchasable, it seems unjust to penalise a lowly driver whose options were obviously limited. Very often this subterfuge leads to such a lot of confusion that the judge hearing the case is inclined to give the totally undeserved benefit of doubt to the offender. If this did not happen in the Salman case it is because of the enormous publicity that the case had received and the hawk-like media attention that was involved. Let us now leave Salman alone. With the Bombay High Court order today, he has to fight his case in the court without much public glare and battle for survival in the film world too. But what are the lessons drawn for the future? The first positive outcome in my view would be greater caution on the part of the rich and famous urban road users and their wards who imperil our lives zipping across in their fashionable Audis and Lamborghinis. Many of them ignore the age-old advice that they should avoid driving while under the influence of liquor. For some time to come they may be rightly expected to behave themselves. Only for some time. Whether they will be able to enforce similar discipline in their children is a matter of doubt. Many of the latter are allowed to drive even before they had received their licences. In such cases it is the parent, who also happens to be the owner of the vehicle, who deserves a more stringent punishment. However, such a course of action rarely ensues.

“There is no proposal under consideration of the government to introduce reservation for Scheduled Castes/Scheduled Tribes/Other Backward Classes for recruitment in the armed forces,” - Defence Minister Manohar Parrikar told the Lok Sabha in a written reply

Allu Arjun’s ‘S/O Satyamurthy’ enters list of all-time top ten moneyspinners

Agency : Mumbai : At fourth position in the list is ‘Race Gurram’;, which was the biggest blockbuster of last year, collecting a share of over Rs. 57 crore. ‘S/O Satyamurthy’, which is directed by Trivikram, has so far grossed over Rs. 80 crore at the box office in three weeks. The film opened to mixed reviews, earning equal share of brickbat and bouquets from audiences and critics alike. However, the masses lapped it

up, especially the family audience. If the successful run of ‘S/O Satyamurthy’ continues for a couple of more weeks, it might even make it to the top three in the list. Other films in the list include ‘Attarintiki Daaredhia’, which holds the first position with a whopping distributor share of over Rs. 75 crore. At second position is Ram Charan’s ‘Magadheera’ with a share of about Rs. 73 crore, while Pawan Kaly-

an’s ‘Gabbar Singh’ with a share of around Rs. 60 crore holds the third position. At fifth and sixth positions are Mahesh Babu’s ‘Dookudu’ and ‘Seethamma Vakitlo Sirimalle Chettu’ with shares of Rs. 56 crore and Rs. 52 crore respectively. Other four positions are held by Prabhas’s ‘Mirchi’, Ram Charan’s ‘Yevadu’, ‘Naayak’ and NTR’s ‘Baadshah’ in the range of Rs. 45 crore to Rs. 50 crore.

Karan Johar who will be presenting the project is associating with the director for the very first time. Although, news is that Karan Johar does not one but a two film association with Rajamouli. The producer turned director and now actor (Bombay Velvet) will be teaming up with the ace

director on another project. Karan will be presenting Rajamouli’s next outing Baahubali 2 as well. Made on a magnificent scale, Baahubali is the first ever Indian film that transcends regional boundaries and has a pan-India appeal. Both of Karan and Rajammouli are developing a great working relationship and it would be interesting to see these entities join hands again on another project.

Happily single: Trisha confirms broken engagement

Agency : Putting quite a number of rumours on her breakup to rest, actress Trisha Krishnan has finally confirmed her split with industrialist Varun Manian after an engagement of three months. Trisha posted the news on her Twitter account on Thursday. Trisha got engaged to Varun Manian in Chen-

nai on 23 January, but the rumours of their split started coming in soon as the actress walked out of Varun’s production company’s film. It was almost confirmed that they called off their engagement as Trisha did not attend Varun’s sister’s wedding. The actress was seen attending parties in Chennai with her favourite bunch of friends those days.

The ‘happy, single and thankful’ actress has two films in her kitty, one with Kamal Haasan and another with Jayam Ravi. She will be seen sharing the screen with Telugu actor Balakrishna in his May 13 release Lion. The actress was last seen in her 2015 hit film Yennai Arindhaal starring Ajith Kumar.

in body language.) Put a grouchy, old, constipated man, his extremely rude daughter and complaining relatives together at a dining table, and you’d expect some emotional drama and fireworks. At Piku’s table, though, there is only one conversation: on constipation. How to get satisfactory potty is the subject of every kind of drama here and it’s amazing how director Shoojit Sircar pulls off a 125-minute film, circling around small, daily arguments. Whether it is sperm in Vicky Donor or “motion” in Piku, Sircar and his writer Juhi Chaturvedi are relentless in their focus upon their characters’ obsessions. The old, constipated man introduces himself simply as “Bhaskor Banerjee, Bangali”. And like a true Bengali, he is proudly critical of anything and everybody. As he puts it, he is “brutal and honest.” So much so that he doesn’t believe in respecting his 30-year-old single daughter’s privacy to ward off a suitor. He

bluntly tells the doomed suitor that Piku is “sexually independent”. In fact, this liberated side to Piku is the most intriguing ingredient in her characterization. She looks at sex purely as a “need” and her friend and colleague Syed (Jisshu Sengupta) has an interesting role to play here. The casualness with which the subject is treated, dismissed and not explained in the writing itself, adds a wonderful, unspoken and unseen element that laces this celluloid jhaalmoori. While Piku is aware of her father’s demanding and selfish need for her to be around forever, she resigns herself to living a single daily drama of her Baba’s major problem — that of achieving the nirvana of a perfect bowel movement. All she asks him daily is, “Hua?” He touches his paunch gingerly and the expression says it all. Piku’s immediate outlet for her frustration is the cab she takes to work everyday. This results in perpetual taxi wrecks. Somehow, not too convincingly in the screenplay, the wretched owner of the cab company, Rana Chaudhary (Irrfan) finds himself in a nightmarish situation of driving the quarrelsome, weird father and weirder daughter from Delhi to Kolkata. The road trip is accompanied by a big wooden chair with a potty hole in the centre.

Sunny Leone’s sex comedy ‘Kuch Kuch Locha Hai

Kuch Kuch Locha Hai, which stars Sunny Leone and Ram Kapoor, released today. It is a sex comedy. In the movie, Sunny Leone has been paired opposite popular TV actor Ram Kapoor. The film was shot in Malaysia. Kuch Kuch Locha Hai is a ‘spicy’ sexy comedy in which Ram Kapoor and Sunny Leone present never-before-seen avatars. The situations and the jokes are unique and are expected to have the audiences in splits. It is a hilarious fun ride. Contrast is glaring in the film. For instance, Sunny Leone is in her element sporting a pink bikini, flaunting her voluptuous figure and on

Kolkata’s jhaalmuri is no ordinary bhelpuri. The flavour is tangy, spicy and mouthwateringly addictive. The secret is the pungent mustard oil. One has to acquire a taste for the texture and the strong smell. Piku (Deepika Padukone) is like that hot and tongue burning spicy jhaalmuri and her father, Bhaskor Banerjee (Amitabh Bachchan) is double dose of mustard oil. Difficult to digest or even like initially, but by the time he has properly bulldozed his way into your life, you’ll find yourself longing for that rasping holler of “Pikuuuu!” This quarrelsome duo never talk. He snarls, she yells. They fight and they scream. The only time they smile together is when they sing a Bengali song. When the two get drunk, expect the time of your life. (The famous Amar Akbar Anthony drunken scene will be forgotten forever. If that was about Amitabh Bachchan’s slurred dialogue delivery, the Piku scene with him dancing in the bedroom is a masterpiece

Nine held for betting in IPL match Agency : A gunman opened fire on Friday outside a school in northeast Nigeria’s city of Potiskum, seriously wounding 12 students in an area repeatedly targeted by Boko Haram, a police officer and witnesses said. “We have evacuated 12 people with serious gunshot wounds to hospital from the scene of the shooting attack,” said the officer, who requested anonymity. Multiple students at the College of Administrative and Business Studies (CABS) in Potiskum, Yobe state, said the attacker with explosives strapped to his body blew himself up when he ran out of ammunition, but the blast caused no other casualties. Following a wave of attacks in the city, including on schools and colleges, students at CABS must pass through secu-

The gunman fired on a crowd waiting at the gate to be screened, witnesses said. “We had just started a class when we heard gunshots coming from the direction of the gates and we instantly realised we were under attack which made us to rush out of the class,” student Tijjani Musa said. According to another student, Mustapha Umar, the gunman managed to pass through the gates amid the chaos that broke out after he began shooting. “He kept firing sporadic shots,” but was chased by a group of students who were frantically trying to subdue him, said Umar. “When he ran out of ammunition he detonated the explosives under his robe, killing himself but no one from the crowd,” Umar told AFP.

Sunvilla News, AHMEDABAD The Applet Tribunal of Electricity (Aptel) has advised the state power distribution companies to refrain from excessive procurement of solar power to cover the shortfall in fulfilling renewable power obligation (RPO) as it would unnecessarily burden the consumers. The suggestion from the Tribunal assumes significance as the Comptroller and Auditor General of India (CAG) last year had criticized the Gujarat government for putting additional burden of Rs 473 crore on consumers by allowing excess purchase of solar power. The suggestion was made by Aptel while hearing an appeal by Indian Wind

Power Association challenging Gujarat Electricity Regulatory Commission’s order on revision of RPO of Gujarat discoms. “Solar energy is more expensive, therefore, distribution licensees should refrain from excessive procurement of solar energy as it would unnecessarily burden the consumers,” the Tribunal order stated. It further observed that in initial phase of implementation of RPO Regulations there may be some variations in different sources of renewable energy which the GERC can set off with excess solar energy purchase. It cautioned that “this should not be made as regular practice and the State Commission should

ensure that the distribution licensees do not deliberately try to alter the technology specific RPOs to defeat the purpose of giving separate RPOs to solar and non-solar RPOs.” Every power distribution company has to purchase electricity from renewable energy sources (solar, wind and bio-mass), at a defined minimum percentage of the total consumption of its consumers. This minimum percentage was decided by GERC from 2010-11 to 2016-17. For example for the year 2013-14 minimum quantum of purchase from renewable energy sources was 7 per cent (1% from solar and 6% from non-solar) of the total power purchase.
