Gujarat anti-terror Bill is a replica of POTA....? The BJP government in Gujarat passed the contentious Gujarat Control of Terrorism and Organized Crime Bill (GCTOC) on March 31. Rejected on three earlier occasions by two Presidents (President Kalam and President Pratibha Patil) for violating basic principles of justice, this bill is a modified version of the 2003 law that originated during Modi's regime as chief minister. Before this issue degenerates into the typical either/or debate: Either we protect our people from terror or we protect our most cherished principles let me state this unequivocally that this is a false choice. Here's why. It would be pertinent to note that in 2004, the central government headed by BJP's very own Bharat Ratna Atal Behari Vajpayee, had sought the return of the bill back to Gujarat government, asking for 'major changes'. The Congress-led UPA government later on, continued with position taken by the previous NDA government and when the bill was passed this time around, in the Gujarat Assembly yet again, the Congress abstained from voting. The BJP has a majority in the Gujarat Assembly and hence the bill sailed through, notwithstanding the boycott by the opposition and the larger questions on legality and constitutional propriety, that remain unaddressed! The bill in question has Modi's fingerprints all over. Modi not only pioneered this law but pursued it as an article of faith and that saw Gujarat government pass the law four times in 12 years- 2004, 2008, 2009 and 2015! In all these instances, despite the reservations expressed by the President, the Gujarat government continued to push with provisions in the bill, that prima-facie seemed ultra vires the constitution and violative of fundamental rights and civil liberties. The current bill is old wine in new bottle and in many ways worse than POTA and TADA which had been repealed. The worrying provisions continue to remain in the bill. The bill seek to give police far reaching powers to make arbitrary arrests, present confessions in custody as evidence as per clause 16 which is currently inadmissible as such and to even intercept phone calls as per clause 14! The bill provides for extending the period of investigation from the stipulated 90 days to 180 days. It makes offenses under the bill non-bailable. It also grants, vide section 25, immunity from legal action to the state government and its officers against suits, proceedings and prosecutions for anything they do in 'good faith in pursuance of the Act'. This bill will only alienate scores of minorities who have in the past, as per hard data and records, been at the receiving end of illegalities of such bad laws. It will hurt the trust quotient and social cohesion in our society that is essential to fight terrorism.While introducing this law, the Gujarat Home Minister said this bill was the "need of the hour" to fight terror especially with " Pakistan become the epicentre of world terror ". It betrays the sense of fear and communal politics that has driven the passage of this bill. Fighting terror cannot happen with laws that curb our freedoms and damage our own social fabric. We don't have to settle for this bill, which is essentially a replica of "POTA with saffron lipstick". We don't have to settle for a law that sacrifices our liberties or our safety. We can have one that secures both. This one does neither.

From April 1, museum, zoo tickets to turn cheaper, air travel costlier Agency : NEW DELHI Entry tickets to museums, zoo and tiger reserves would become cheaper, while business class air travel, investment in MFs and chit funds would become expensive with some of the service tax proposals announced in the Budget coming into effect from tomorrow. Finance Minister Arun Jaitley had come out with a host of proposals last month to rationalise service tax, which is levied at an effective rate of 12.36 per cent. These also include raising the rate to 14 per cent, but that will come into effect from a date to be notified later by the government after the passage of the Finance Bill by Parliament. However, the proposals which will come into effect from April 1, 2015, include tax exemption granted to services like admission to a

museum, zoo, national park, wild life sanctuary and a tiger reserve. Similarly, life insurance scheme Varishtha Pension Bima Yojna, ambulance service, retail packing of fruits and vegetables, too will not attract service tax levy. On the other hand, air travel will become expensive as service tax will now be levied on 60 per cent of the value of the ticket as against 40 per cent now. “At present, service tax is payable on 40 per cent of the value of air transport of passenger for economy as well as higher classes, for example, business class. “The abatement for classes other than economy is being reduced and service tax would be payable on 60 per cent of the value of such higher classes,” said the memorandum to the Finance Bill, adding that the proposal will come into effect from April 1, 2015.

This is a case in which the law is self-admittedly harsh. Gujarat high court has dropped charges of criminal negligence against a school principal after four-year old Adit Patel, a student of Saraswati International School near Valsad, fell from a hole on the floor of his school bus and got crushed to death under the wheels in 2010. The court recently concluded that criminal liability cannot be fixed on the principal for the kid's death. The school, however, can be held liable in a civil suit. The court admitted that it was not easy to come to the conclusion. Justice J B Pardiwala wrote, "Dictating this judgment was a very painful experience.The very thought of a four-year old child getting crushed beneath the tyres of his own school bus makes my heart bleed with pain and agony . I can also imagine the pain and agony the parents of the deceased must be undergoing even today ." "However, such thoughts should not allow the mind of

Big Income Tax defaulters: 11 of 18 are from Gujarat Agency : New Delhi The Income Tax department of India on Tuesday took to the strategy of ‘naming and shaming’ of some large tax defaulters as it published names of 18 entities who owe over Rs 500 crore tax to the exchequer. “The step is aimed to publicise and put these names in public domain so that the common man can come forward to help the department in knowing the whereabouts of these. The step is to enhance public awareness against these entities who are acting against law. These names were put up on the department’s website earlier,” a senior I-T officer said. Newspapers on Tuesday carried the names of the tax defaulters and the data published was quoted to have been published by the Principal Chief

Commissioner of Income Tax (Administration) based in the national capital here. Adopting an aggressive approach, government had for the first time gone public with names of 18 tax defaulters, including Goldsukh Trade and Somani Cements which, according to I-T, have turned wilful defaulters. In a bid to force these entities to pay their dues, the Central Board of Direct Taxes (CBDT) had asked the I-T department to post on its website, few days back, the names of 18 defaulters, of whom 11 are based in the western Indian state of Gujarat. “Defaulters are advised to pay tax arrears immediately,” said the notice. “This is the first time the department has put in public domain a list of those wilful tax defaulters who have a tax liability of Rs

10 crore and above,” a senior tax official had said, adding that in many cases the assessees were not “traceable”. “The department, in the public notice, has provided the PAN number and the last known address of these defaulters for the public to know,” the official added. The official said periodically the department has been proposing “naming and shaming” of wilful defaulters and the step has now been taken on the last day of the current financial year on Tuesday. The companies in the list include Somani Cement with tax arrears of Rs 27.47 crore, Blue Information Technology (Rs 75.11 cr), Appletech Solutions (Rs 27.07 cr), Jupiter Business (Rs 21.31 cr) and Hirak Biotech (Rs 18.54 cr).

The cyber forensics department at Directorate of Forensic Sciences (DFS), Gandhinagar have received 11 laptops and eight pen drives seized by Enforcement Directorate (ED) in connection with multi-crore betting racket busted near Vadodara earlier this month. According to DFS sources, the agency had earlier given more than 15 mobile phones for forensic analysis

in connection with the same case. "Many of these computers have passwordprotected content and interconnected material, e.g. records present in pen drive or computer and vice versa. On the basis of the investigation, we would be able to establish the usage of these electronic devices for betting racket," said sources. Sources added that to establish the racket as international, the agency would require details of

transactions that are suspected to be recorded in the devices. The agency had already seized mobile phones used by key accused from the spot. Cops expect to get clues from the call details and other persons involved in racket.On March 20, ED had raided a farm house near Golden Chokdi in Vadodara and had caught Kiran Mala and Tommy Patel, suspected to be involved in the betting racket.
