Extraordinary attack on Judiciary: Congress

“In my 18 years as an MP, I’ve never heard anyone criticise the 1973 Kesavananda Bharati judgment of Supreme Court. In fact, legal luminaries of BJP like Arun Jaitley hailed it as a milestone. Now, Chairman of Rajya Sabha says it was wrong. Extraordinary attack on the judiciary!” Ramesh said. The reaction comes a day after the VicePresident insisted on Parliamentary supremacy. Vice-President Dhankhar on Wednesday reiterated that the power of Parliament to amend the constitution and deal with legislation is not subject to any other authority and all constitutional institutions — the judiciary.

College student held for smuggling firearms in Bihar’s Arwal

Agency News: New Delhi

A female college student was arrested on charges of smuggling firearms on Thursday in Bihar’s Arwal district. Mohammad Kasim, the Superintendent of Police (SP) of Arwal confirmed the incident. The student was travelling with two youths, including her boyfriend Ranjit Kumar on a bike. The arrest was made during the vehicle checking campaign on NH 139 under the Kinjar police station.

“The accused was travelling with two youths on one bike.

The SHO of the Kinjer police station, who was also patrolling the road, suspected something

fishy as they were travelling at a high speed and did not stop the vehicle after policemen signalled them for checking. Our officers suspected that the accused probably kidnapped the girl and therefore were driving at high speed,” Kasim said. “The SHO and other police teams chased the bikers. After a brief chase, the two youths including Ranjit Kumar managed to flee from the spot while the girl failed to run. She was carrying a bag. When our cops opened the bag, they found four country-made Kattas, a magazine of a pistol, cash Rs 13,240, a smart phone, a button phone and an Apache bike,” Kasim said.

The two-part BBC documentary, India: The Modi Question, through claims of having investigated certain (missing) aspects related to the 2002 Gujarat riots, has tried to project the riots and then-chief minister in a poor light. Reacting quickly, the Ministry of External Affairs has trashed the documentary as a “propaganda piece” that lacked objectivity and reflected a “colonial mindset”. The central government has also clamped down on it with a ban and asked social media platforms to remove videos and website links to the film. While the government’s move to ban the documentary has been criticised by the opposition, especially the Congress and Trinamool Congress (TMC), the government has received support from unexpected quarters. Congress veteran and former Defence Minister A. K. Antony’s son Anil Antony has slammed those using the BBC documentary as a stick to beat the BJP with. A day after his social media post on the documentary, he resigned from the party alleging “intolerant calls to retract a tweet”. The Modi Question raises more questions than it seeks to answer. Going by the content, intent and the timing of the documentary, the BBC seems to be rushing on a path where angels would fear to tread. According to the channel, the first part reportedly tracks Modi’s ascendancy to power in Gujarat and the 2002 riots. If the BBC had obtained previously unpublished reports from the British Foreign Office as it claims, more serious questions arise on the nature of the documents and the timing and manner in which they have been publicised. The 2002 riots were investigated by a Special Investigation Team followed by the Supreme Court upholding its closure report.

Eyeing 2024 polls, BSP launches ‘Chalo gaon ki ore’

Agency News: Lucknow

The Bahujan Samaj Party (BSP) has launched ‘Chalo Gaon ki Ore’, a mass outreach programme to consolidate its base among voters at the grassroots level. BSP national president Mayawati has directed party leaders and senior functionaries to start visiting villages to interact with voters. A party functionary said, “The state government’s ‘goof-up’ on OBC reservations for the urban local body polls has given the BSP an opportunity to reach out to voters and expose the BJP’s anti-reservation mindset”. ‘Chalo Gaon Ki Ore’ has been designed by the party to hammer on the issue. The BSP’s campaign has OBCs as the target audience though the party has not ruled out reaching out to others.”When we go to villages, we find a mixed

audience. But we know what we have to talk about. It is how the state government is not serious about OBC reservations,” said party national spokesperson Dharamvir Chaudhary. The OBCs and the most backward among them are on the priority list of political parties for the 2024 Lok Sabha elections.

Mayawati has asked her leaders to mobilise the voters at the booth level. Four booths will be organised into a sector and a public meeting will be held at the sector level. She has also asked her party members to keep the interaction more personal and direct.

money for ads published from its CMs too: Sisodia DIP issues recovery notice of Rs 164 cr to Kejriwal

Agency News: New Delhi

Hours after the Directorate of Information and Publicity (DIP) served a recovery notice of Rs 164 crore to AAP chief Arvind Kejriwal, Delhi Deputy Chief Minister Manish Sisodia on Thursday asked whether the BJP will recover money from its own CMs whose ads were printed in the national capital.

“The newspapers of Delhi are full of advertisements of CMs of BJP and Congress. Will the BJP get the Information Secretaries there to send notices to the CMs there?”, he asked. Dy CM Sisodia said that there can not be a bigger example of illegitimate control over officers. It is wrong to target the elected government by misusing the officers. All the governments give out advertisements. “The BJP has exercised unconstitutional control over the officers of the

Delhi Government through the Centre. The notice sent to Arvind Kejriwal is an example how BJP is misusing it for political interest. The notice has been issued that Rs 163 crore will be recovered from Arvind Kejriwal for the advertisements given by the Delhi government outside Delhi in 2016-17. If not given in 10 days, legal action will be taken. This is not the language of the officer, it is the language of the BJP. BJP is occupying the service department for this misuse”, Sisodia told.

Agency News: New Delhi

The Directorate of Information and Publicity (DIP) has issued a recovery notice of Rs 164 crore to Delhi Chief Minister Arvind Kejriwal. The amount has to be paid within 10 days. The notice comes after Lt. Governor (LG) V.K. Saxena on December 20, 2022, had directed the Chief Secretary to recover Rs 97 crore from the Aam Aadmi Party (AAP) for political advertisements which it published as government ads. The L-G in its order had directed the Chief Secretary to implement the order dated September 16, 2016 of the Supreme Courtappointed Committee on Content Regulation in Government Advertising (CCRGA) and the pursuant order of Directorate of Information & Publicity (DIP), GNCTD, directing the AAP to pay Rs 97,14,69,137 plus interest, to the state exchequer,

for political advertisements that got published/telecast in the garb of government advertisements. The three-member CCRGA vide its order directed, “the main purpose and objective of the guidelines framed by the Supreme Court of India was to prevent misuse of Government funds for the projection of image of the politician or the political party in power”. “Since the same has happened even after the judgement, the only way it could be reminded is to make the political party. the main beneficiary in the process of violation to pay for the expenditure incurred by the government.

necessary measures to ensure that the scheme is executed smoothly throughout the state. Dass said that the recipients who received approval for dwellings in the past week will soon get the first instalment, allowing them to begin construction.

Already two FIRs have been filed on this count, first at the Lake Police Station and the second at Hare Street Police Station. CCTV footage from the local areas have also been procured by the sleuths of Kolkata Police, which clearly shows two masked men pasting those posters on the wall of Justice Mantha’s residence as well as the adjacent places.Although city police sources have claimed that their sleuths are trying to track these miscreants from the clues in the CCTV footage recovered, questions are automatically raised on why the police are taking so long in pinpointing and arresting them. The opposition leaders in the state have alleged that the delay is deliberate on part of the police since the actual masterminds behind this slanderous postering are the ruling Trinamool Congress leaders. Even the retired Indian Police Service (IPS) officers

like the former additional director general of West Bengal Police, Nazrul Islam have questioned the efficiency of the existing forces and intelligence in the matter. On early morning of December 9, these posters slamming Justice Mantha were seen pasted on the walls of the latter’s residence and adjacent places at Jodhpur Park in South Kolkata. In the posters, it was alleged that Justice Mantha was acting in a biased manner in favour of Suvendu Adhikari. In the posters Justice Mantha was also slammed for his recent verdict removing the shield of cohesive action by Enforcement Directorate (ED) against Maneka Gambhir, the sisterin-law of Trinamool Congress’s national general secretary and party MP, Abhishek Banerjee. From the same day a group of lawyers of the Calcutta High Court, known to be close to Trinamool Congress started boycotting Justice Mantha’s bench.

A day after Vice President Jagdeep Dhankhar insisted about Parliamentary supremacy, Congress leader P. Chidambaram on Thursday said that the Constitution is supreme and the “V-P views may be a warning signal”. “The Hon’ble Chairman of the Rajya Sabha is wrong when he says that Parliament is supreme. It is the Constitution that is supreme,”Chidambaram said. He said this may be a warning ahead, “In fact, the Hon’ble Chairman’s views should warn every Constitution-loving citizen to be alert to the dangers ahead.” He said the “basic structure” doctrine was evolved in order to prevent a majoritarian-driven assault on the foundational principles of the Constitution. “Suppose Parliament, by a majority, voted to convert the parliamentary system into a Presidential system. Or repeal the State List in Schedule VII and take away the exclusive legislative powers of the States. Would such amendments be valid?

“ he questioned. “After the NJAC Act was struck down, nothing prevented the Government from introducing a new Bill. The striking down of one Act does not mean that the “basic structure” doctrine is wrong”.

Vice President Jagdeep Dhankhar on Wednesday reiterated that the power of Parliament to amend the constitution and deal with legislation is not subject to any other authority and all constitutional institutions -- the judiciary, the executive and the legislature -- are required to confine to their respective domains and conform to the highest standard of propriety.

The father identified the body from the red thread on the wrist. We cannot confirm that the recovered body is of the kidnapped and murdered boy,” a police officer in Valsad tod.

“It can be scientifically confirmed if the body is that of the missing boy only after a DNA report. But from the preliminary investigation it seems that the body is of the kidnapped boy from Sayli,” said a police official in DDDNH.

The Gujarat high court on Wednesday said that the authorities pass totally arbitrary orders on the issuing of firearm licences and criticised the state government for not divulging what guidelines are followed to decide on request for firearm licences. The high court was hearing a petition by one Punja Sutreja from Junagadh, after the district magistrate refused to renew his gun licence saying that he had crossed the age of 60 years and there was no threat to his life. The order of refusal also stated that Sutreja could opt for online banking and avoid cash transactions. Sutreja is 65-years old and held a gun licence for 21 years before his request for renewal was rejected. For this, the state government cited a circular issued in December 2017, saying that as many as 65,890 firearm licences were issued in the past 20 years and after looking at the misue of weapons and licences, the authorities were given blanket directions to reassess these cases and not renew them if a licence

was held for two decades, a person had crossed the age of 60 and there existed no threat perception. On hearing this, Justice Biren Vaishnav commented, “The older you get, the more insecure you feel. Why doesn’t a person need a firearm at the age of 65? I have told you (government lawyer) repeatedly to show me what are the guidelines you (state government) are following in deciding on firearm licences. There are completely arbitrary orders passed. Just copy-paste.” The HC quashed the Junagadh district magistrate’s order of rejection with the observation that the high court in various orders rejected the grounds that online banking is an option, and the conclusion of the absence of a perceived threat to the applicant’s life was also misconceived.

LHS 475 b is relatively close, at only 41 light-years away, in the constellation Octans. “These first observational results from an Earthsize, rocky planet open the door to many future possibilities for studying rocky planet atmospheres with Webb,” said Mark Clampin, Astrophysics Division director at NASA Headquarters in Washington, DC.”Webb is bringing us closer and closer to a new understanding of Earth-like worlds outside our solar system, and the mission is only just getting started,” he said in a statement late on Wednesday. The research team was led by Kevin Stevenson and Jacob Lustig-Yaeger, both of the Johns Hopkins University Applied Physics Laboratory in

Although the team can’t conclude what is present, they can definitely say what is not present. “There are some terrestrial-type atmospheres that we can rule out,” said LustigYaeger. “It can’t have a thick methane-dominated atmosphere, similar to that of Saturn’s moon Titan.a Webb also revealed that the planet is a few hundred degrees warmer than Earth. If clouds are detected, it may lead the researchers to conclude that the planet is more like Venus, which has a carbon dioxide atmosphere and is perpetually shrouded in thick clouds. “We’re at the forefront of studying small, rocky exoplanets,” Lustig-Yaeger said.
