BJP manifesto’s stand on Article 370, 35A adds fuel to fire

When the dust settles after the Lok Sabha elections, and a new central government emerges in May, some poll promises in the Bharatiya Janata Party’s (BJP) manifesto may come to haunt it, should a BJP-led National Democratic Alliance (NDA) forms the government. The Bharatiya Janata Party’s promise to abrogate Article 370 of the Constitution related to Jammu and Kashmir has repercussions for security far beyond that roiled state. So will this promise: “We are committed to annulling Article 35A of the Constitution of India as the provision is discriminatory against non-permanent residents and women of Jammu and Kashmir. We believe that Article 35A is an obstacle in the development of the state.” Trouble may come to pass even if the manifesto, released just three days before the first day of polling, is meaningfully late. As a sharp editorial in Mint pointed out, a possibility is that “the party’s campaign pitch and tenor is already synchronous with its manifesto’s content, leaving no room for dissonance or discord”. That may work fine within the party structure, which now projects a one-man show, but the world outside is of a different construct. It isn’t the first time the BJP has promised to abrogate Article 370. Its manifestos in 2014 and 2009 did so, too. The party is entitled to its ideological belief that a Constitution within a Constitution, which Article 370 provides Jammu and Kashmir, is incongruous, and goes against the spirit of unity. The umbrella of India’s Constitution and its mandated federal structure already provide adequate safeguards. Indeed, using precisely the same logic, officials negotiating with Naga rebels since 2015 have argued against a rebel demand for a separate Constitution for Nagaland. But the incendiary reaction to Bharatiya Janata Party’s recent announcement over Article 370 in Jammu and Kashmir, especially in Kashmir Valley, is indicative of bad timing. It comes in the backdrop of an all-round policy-and-practice failure, particularly since 2016. Kashmir is dangerously on edge. Even moderate leaders in the Valley have openly pointed to an abrogation of Article 370 effectively signifying the abrogation of Kashmir’s accession to India—as one was tied to the other. While this is dangerous talk—and triggered by Bharatiya Janata Party rhetoric—a trickier aspect is Article 35A. Among its various provisions, it grants special rights to permanent residents of Jammu and Kashmir for: “(i) employment under the state government; (ii) acquisition of immovable property in the state; (iii) settlement in the state …” and, of course, defining who are such residents, and who can, therefore, vote locally. A point to consider is that, development or the lack of it in Jammu and Kashmir, isn’t an aspect of Constitutional provisions, but of conflict since at least 1989, whether precipitated and fuelled by Pakistan or sustained by awkward policies and people skills of India. Another point is: What of provisions for other states that mimic Article 35A? Article 371A of India’s Constitution permits for Nagaland primacy of “religious or social practices of the Nagas”, “Naga customary law and procedure”, “administration of civil and criminal justice involving decisions according to Naga customary law”, and “ownership and transfer of land and its resources”. Besides government jobs and such. Article 371C provides for administrative safeguards for the tribal “Hill Areas” of Manipur; while local laws safeguard the land and customary rights of tribal folk. Article 371G applicable to Mizoram is nearly a mirror of the provisions for Nagaland. Special provisions govern the rights of tribal folk and forest dwellers— although the latter is under severe stress on account of policies of the current government—in other north-eastern states - Kapilkumar M. Shah Rukh Khan’s Fauji TV show director Colonel Raj Kapoor dies at 87 New Delhi : The director who introduced Shah Rukh Khan with the television show Fauji, Colonel Raj Kapoor passed away at a hospital here, a family member said. He was 87. He passed away on Wednesday night due to agerelated issues, Ritambhara, one of his daughters, said. “My father died at 10.10 p.m. yesterday. He was in a hospital for sometime, but his death was very sudden. He was otherwise in good health... He went quite peacefully,” Ritambhara, one of his three daughters, said over phone. A Facebook post from Kapoor’s family read: “This is to inform you that our beloved dad, Raj Kumar Kapoor, has left his earthly body to go on a brand new adventure.” Kapoor was cremated here on Thursday. These fishermen are from the state’s Veraval region and were caught by Pakistan coast guard for crossing the international sea borders. They were kept in Karachi jail for over one-and-a-half years before being released on April 8. One of the fishermen said, “Many of us accidentally cross the border while some go to that side knowingly for catching fish. I was in Pakistan for about 17 months. We were always confined in a particular cell and were never allowed to venture out. We were clearly told to stay in the definite cell for our own safety.” Another fisherman, Vikram, said, “I

was caught accidentally while we were sleeping on the boat. The boat accidentally crossed the border.” The fishermen took a train journey to come to Vadodara. Ramesh Kumar, Assistant Director, Fisheries Department said, “These fishermen were released from Pakistan on April 8. Our team had gone to Amritsar to receive them and brought them here by a

Ahmedabad : The chief electoral officer (CEO) of Gujarat, S Murli Krishna, took into his custody 100kg of heroin, worth Rs 509 crore, leaving anti-terrorist squad (ATS) officials astounded. According to ATS officials, the explanation given to them was that the contraband had been seized after the dates for the general election were announced. Gujarat ATS and the Indian Coast Guard (ICG) on the night of

March 27 had seized 100kg of heroin from aboard an Iranian dhow, some 170 nautical miles off the Porbandar coast. According to Gujarat ATS officials, they arrested nine Iranian nationals, including one Ayub Baloch, the alleged mastermind. The officials said the dhow had first left Iran and 100kg heroin was then loaded on to it. The officials said that on the night of March 27, the Gujarat ATS which already had a tip-off, intercepted a

signal and tracked the dhow down. The officials said that the crew members tried to set the dhow ablaze but Gujarat ATS officials and ICG officials managed to contraband and also save the lives of the Iranian nationals on board. About the Gujarat CEO taking custody of the heroin, ATS official had no answer. “We need it to check its quality and for further investigation,” a senior ATS official said.

Ahmedabad : A 45-year-old woman, a counsellor at a private school, on Wednesday filed a complaint with Chandkheda police stating that her husband burned her with a hot clothes iron, when she was ironing clothes at their home in the Motera area of the city on Monday. The complainant who is from Delhi, had married the city-based man in 2014. She has also stated that her husband and in-laws would thrash and demand dowry. On Sunday evening, she was severely beaten by her husband, mother-in-law and father-inlaw and was thrown out of the house. She then went to Chandkheda police and filed an application of complaint against her husband

and in-laws. After filing the application, she returned home late on Sunday night. Her in-laws and husband then got angry about her “roaming about late at night” and thrashed and abused her, the FIR stated. The complainant also stated that her husband told her that if she told the police about the thrashing, he would kill her. When she confronted him about the treatment meted out to her, he took the hot clothes iron and burned her hand and palm. The woman then called the cops. Chandkheda police arrived at the house and registered her complaint under the IPC sections for assault and under the Domestic Violence Act.
