Two persons were today arrested in connection with alleged smuggling of illicit liquor in Jammu district, police said. A police team laid a surprise checkpoint at Khour Bazar in Akhnoor belt of the district and intercepted two pedestrian Kamal Kishore and Nikka Singh today, a police official said. During their search, they recovered 214 bottles of illicit country made liquor, he said. Both of them were arrested, he said, adding that a case has been registered in this connection and investigation of the case is on.

The defence services have set up cyber emergency response teams to prevent and react to cyber attacks, government told the Rajya Sabha today against the backdrop of hacking of the defence accounts website. Govt blinks in tax tussle with foreign investors

The revenue department will not act on demands for minimum alternate tax (MAT) it has already slapped on foreign portfolio investors (FPIs) nor will it make any fresh MAT claims, the government said on Monday, offering relief to FPIs in an ongoing dispute that has rattled the markets. The embargo will prevail until a committee headed by Law Commission chairman A.P. Shah submits its report to the government on the applicability of MAT on foreign investors, an official circular issued by the tax department said. Not only will this provide a respite to FPIs and long-term investors like private equity and venture capital funds, it also signals a climbdown by the revenue department. The instruction follows finance minister Arun Jaitley’s statement last week in the Rajya Sabha, where he announced the setting up of a committee under Shah, a former Delhi high court chief justice, to look into so-called legacy cases inherited by the National Democratic Alliance government from its predecessor. The central board of direct taxes, in its circular, said the panel constituted by the finance minister is expected to submit its report expeditiously. “In the light of FM’s announcement, officers dealing with International Taxes have been advised that no coercive action be taken for recovery of demand already raised by invoking provisions of MAT in the cases for foreign companies. Issues of fresh notices for reopening of cases as also completion of assessment should also be put on hold unless the case is getting barred by limitation,” the circular said. On Monday, the BSE Sensex jumped 1.5% to 27,507.30 at the close after gaining 1.9% on Friday, having earlier erased all its year-to-date gains over MAT worries and concerns about corporate earnings. “A lot of FIIs who have not received notices so far have been quite concerned and anxious to know if and when they will receive a notice and how they should approach the matter given the uncertainty on the MAT issue,” said Rajesh H. Gandhi, a partner at Deloitte Haskins and Sells Llp. “FIIs should therefore be relieved to know that no further notices will be issued till the committee issues its report,” he added. The income tax department had started issuing notices to foreign investors for levy of MAT on capital gains accruing to them from sale of shares, citing a August 2012 order by the Authority for Advance Rulings in the case of Castleton Investment Ltd that MAT is applicable on both domestic and foreign companies. MAT is a tax levied on profit-making entities that don’t pay corporate income tax because of exemptions and incentives. Foreign investors opposed these notices, arguing that MAT can be levied on book profits of companies and that they do not maintain book of profits in India.

However, the request was opposed by defence counsel Naina Bhatt, who argued that there is no provision to identify accused persons on the basis of their photographs. Special prosecutors put their foot down and cited a Supreme Court order allowing identification of a dead man through his photograph in the December 13, 2001, Parliament attack case. Defence lawyers, however, did not agree with applicability of this order in this situation since the accused are all alive. The court had to adjourn the hearing when prosecutors sought time to file an application demanding permission to put old photographs of 78odd accused without their names and identities before witnesses for the purpose of identification of a particular accused from the heap of pictures.
