Centre’s “Against Coercion” In 2020 vs BJP’s Population Bills 2021 India is “unequivocally against coercion in family planning” and data shows “couples, on average, do not want more than two children”, the centre told the Supreme Court in a December 2020 affidavit signed by an Under Secretary in the Union Health Ministry’s Family Planning division. The affidavit - filed in response to a PIL by BJP leader Ashwini Kumar Upadhyaya seeking reintroduction of the mandatory two-child norm or the framing of an equal new law - emerges as two BJP-ruled states - Uttar Pradesh and Assam - and several party MPs have proposed controversial population control laws, which include blocking access to government benefits for couples with more than two children.

Speaking at the Indo-US Joint Summer Conference on Indo-US legal ties, Supreme Court judge Justice DY Chandrachud has said that the anti-terror law should not be misused for quelling dissent. Justice Chandrachud said, “Criminal law, including antiterror legislation, should not be misused for quelling dissent or harassment to citizens. As I noted in my judgement in Arnab Goswami vs the State, our courts must ensure that they continue to remain the first line of defence against the deprivation of liberty of citizens.”The Supreme Court judge said, “Deprivation of liberty for even a single day

The government said on Tuesday the predictions about a third wave of the coronavirus pandemic should be taken seriously as it warned that the gains made so far will come to a nought if people continue to violate Covid-19 appropriate behaviour. The comments by Lav Agarwal, joint secretary in the health ministry, came amid reports of thousands of people flocking to hill stations and flouting Covid-19 norms. Agarwal, while addressing

coronavirus pandemic in the country, said people have failed to understand that adherence to Covid-appropriate behaviour will prevent or cause any future waves of the coronavirus pandemic. “We would like to request to everyone -- when we talk about the third wave, we are taking it as a weather update and not understanding its seriousness and our responsibilities associated with it,” Agarwal said. Agarwal said that approximately 73.4 per cent of the new Covid-19 cases reported so far in July were from Kerala, Maharashtra, Tamil Nadu, Andhra Pradesh and Odisha. He added that 55 districts across the country reported a positivity rate of more than 10 per cent in the week ending July 13. adds 1,478 Covid ‘backlog’ deaths to tally The additional deaths came to the fore after the government on June 26 issued a letter to all district authorities urging them to report any deaths till June 30 which were not added so far on the government’s ‘Sarthak’ portal. Agency News: Kangra Madhya Pradesh on Monday added 1,478 ‘backlog deaths’ from the second wave of the pandemic till June 30 to its existing record taking the Covid-19 death toll to 10,506 from 9,027 deaths reported in the state until Sunday. The additional deaths came to the fore after the government on June 26 issued a letter to all district authorities urging them to report any deaths till June 30 which were not added so far on the government’s ‘Sarthak’ portal. The exercise was started after Chhavi Bharadwaj, Mission

director of National Health Mission, issued an order. During the second wave of Covid-19, all the positive cases, total deaths and recovery rates are uploaded on Sarthak through Form 3A by district administration. However, according to senior government officials, the deaths which mostly took place in private hospitals or of those patients under home isolation were left out from the Sarthak portal. It was these deaths that were identified following the

letter of June 26. The issue of the left out deaths that were added to the state’s tally was also discussed in a review meeting held by Chief Minister, Shivraj Singh Chouhan on Tuesday. Madhya Pradesh has been facing allegations of underreporting Covid-19 deaths. Bhopal alone was 109 while the three Covid-19 designated crematoriums and one graveyard had carried out over 2,500 cremations — far outnumbering the state’s tally for the month of April.

ergy To Defeat Bjp In Uttar Pradesh Polls

Yogi Adityanath Government in Uttar Pradesh has launched massive assaults on democracy and the constitutional values in the state to retain power in the next assembly elections scheduled in February/March 2022. In its bizzare actions, Yogi and the Sangh Parivar are getting full encouragement from the Prime Minister Narendra Modi and the Home plus Cooperation Minister Amit Shah. Only seven months are left for the announcement of the assembly elections in Uttar Pradeshalong with four other states Punjab, Goa, Uttarakhand and Manipur. UP is most important as the assembly is the largest in the country with 403 seats while the seats for the Lok Sabhaare fixed at 80. The Lok Sabha elections are due in April/May 2024 and in all probability, the outcome of the assembly poll will have big influence on the campaign for the Lok Sabha pollin the state. Prime Minister knows the probable full impact of the UP assembly poll results on 2024 general elections and that is why he has taken complete charge of the UP strategy for thecoming assembly polls. PM and Amit Shah are working in tandem with PM playing a biggerrole while in 2017 assembly elections, it was all a show of Amit Shah and he excelled in that. But this time, after the disastrous defeat at the hands of Mamata Banerjee in Bengal,Narendra Modi has taken over the job of the prime strategist for the UP polls as he has afeeling that Shah’s strategy failed in Bengal and the BJP cannot afford another failure in astate like Uttar Pradesh. As of now, countless meetings have been held at the highest level of the government, both at the Centre and in the state to do a makeover of the Yogi government. The tussle which was there earlier between Yogi and the PM has been temporarily taken care of and the PM is bent on spending lot of time in the coming months before poll to continue finetuning thepoll strategy in consultations with his advisers to extract maximum results from the poll. LikeBengal, no holds are barred in this battle against the Samajwadi Party led opposition alliance but there is one advantage that in fight against Mamata, PM-Shah could use only central agencies, but for UP polls, with Yogi as Chief Minister, the state agencies are also availableto harass the opposition leaders before the poll. That way, it will be a twin attacks against theopposition in Uttar Pradesh by the agencies of both Centre and the state.Narendra Modi and the Sangh Parivar are battle ready for the polls in Uttar Pradesh. They have lot of weapons in their armoury and they will use these in the campaign, when needed. As against this, what is the state of preparedness of the opposition? That is pathetic. Themain party Samajwadi Party led by former Chief Minister Akhilesh Yadav has still notreached a position where they can challenge the BJP on an equal footing in the 2022 elections. Yes, seven months are still left and many developments may take place in the intervening period. But knowing Modi-Shah, one may say that they are preparing to leave the worst period of governance in UP behind and working for corrective actions to brighten the image of the Yogi government and the ruling BJP before the polls. The core issue is how far the opposition parties Samajwadi Party, the Congress and the other smaller parties have campaigned enough to take advantage of the governance failure and sought to emerge as an alternative. The SP despite its huge organizational base covering all districts, has not yet been able to generate that type of anti incumbency feelingwhich is needed to translate into anger against the BJP regime in the polls. As the ground reports tell us, there is seething anger against the Yogi government for so many issuesincluding the gross management of pandemic, but this did not get the due outlet due to lacko trust in opposition.Congress has started some noises against Yogi Government but its impact is so limited thatthe state BJP cares little for it. The state party with Priyanka Gandhi Vadra in charge, isholding some workers meetings but there is no adequate - Kapilkumar M. Hirpara response to the moves.

SC clears way for appointment of 1,500 teachers in 11 non-scheduled Jharkhand dists Hearing a Special Leave Petition arising out of the HC order, the Supreme Court said “there was no reservation therein for locals/domicile of non-scheduled districts” and “the subject matter…relates to appointments from the scheduled districts of Jharkhand” Agency News: Ranchi More than 1,500 teachers, whose appointment to secondary schools in 11 nonscheduled districts across Jharkhand was obstructed due to legal hurdles, have been given relief by the Supreme Court. The appointment process, advertised in 2016, ran into trouble after several petitions raised questions citing a district-based domicile quota in vacancies in 13 scheduled districts. The High

Court stayed the appointment and later a three-member High Court bench on September 13 last year ordered to quash the government advertisement in scheduled areas, stating that it would deprive the candidates of other districts. However, the bench had emphasised that “the selection process was never stayed by the court in the non-scheduled districts”. But despite the order, the Department of Personnel and Administrative Reforms, in its order on February 18, said that after getting advised by Advocate General’s Office, the Jharkhand government had decided to stop the appointment process. Hearing a Special Leave Petition arising out of the HC order, the Supreme Court said “there was no reservation therein for locals/domicile of non-scheduled districts” and “the subject matter… relates to appointments from the scheduled districts of Jharkhand”. A bench of Justices Navin Sinha and R Subhash Reddy noted.
