An all-India judicial service will ensure transparency

After striking down the National Judicial Appointments Commission (NJAC) as unconstitutional in 2015, the five-judge constitution bench of Justices JS Khehar, Jasti Chelameswar, MB Lokur, Kurian Joseph and Adarsh Kumar Goel explored alternatives to make the Supreme Court’s collegium system, which appoints judges to the nation’s constitutional courts, transparent. The court sought suggestions from the public and the response was overwhelming. There are many who have questioned the SC’s decision to ask for suggestions, but what is significant is that the issue of transparency in judicial appointments is finally being debated across the country. While it is no longer possible for nepotism and favouritism to sneak into judicial appointments, vested interests are still trying their best to promote their own since there are vacancies in the Supreme Court and high courts (nearly 40%). They are trying to push the agenda of the old non-transparent appointment process through the collegium system. This should be stopped by the Supreme Court. Vacancies might be affecting the criminal justice system but pendency and vacancies cannot justify non-transparent appointments. Even when there were fewer number of vacancies, the performance of the judiciary in clearing outstanding and pending cases was not extraordinary. While it is important to ensure that we have a mechanism for speedy disposal of cases, the most important thing is to ensure a transparent appointment mechanism of the higher judiciary. This mechanism must be thoroughly examined and a proper procedure should be first put in place before any appointments are made. To avoid wrong appointments, the government in consultation with the chief justice of must introduce an all-India judicial service. This will go a long way towards attracting the brightest and the best talent available in the country. This is a five-decade-old demand but it has not been implemented on account of vested interests both in the political and judicial systems. Their intention is to perpetuate nepotism and favouritism in judicial appointments. This goes against objectivity, fairness, sensitivity and professional approach to the judiciary’s working. Several people have asked the Centre and Supreme Court for such a service but it appears that the judiciary is taking advantage of a divided Parliament to push its agenda of perpetuating judicially-sponsored appointments.

The 50-share NSE Nifty broke below the crucial 7,500 level and settled lower by 78.15 points or 1.04 per cent at 7,460.60. Intra-day, it shuttled between 7,545.20 and 7,452.80. Of the 30-share Sensex pack, 22 ended with losses while NTPC ended flat at Rs 127.30. Shares of Lupin melted the most, falling 7.59 per cent to Rs 1,726.60 after the company received nine observations relating to inadequacy and adherence to operating norms for its manufacturing plant in Goa from the US Food and Drug Administration.

transfer him to any other prison. A petition was filed by Deputy Jail Superintendent V D Patil in the court of principal district and session judge Geetaben Gopi in this regard today. The court is likely to hear the matter on March 21. Jail superintendent R M Pandey said that the step has been taken mainly because of his ill behaviour. The petition has mentioned five points

prominently as a ground for the transfer of the PAAS leader to another jail. It includes his alleged misbehaviour with the jail authorities and the doctor, the recovery of mobile equipment and Rs 1000 currency note from his barrack and his baseless allegations against the jail authorities. To a query Mr. Pandey also said that Hardik had went to the court yesterday bare-footed at his own. ‘The jail authorities just checked his foot wear as a routine check to see if something was hidden in it or not and he got angry. Court rejects Satish Verma’s plea seeking Ishrat case charge sheet

A special CBI court here today rejected the application moved by IPS officer Satish Verma seeking supplementary charge sheet filed before the court in connection with the encounter case of Ishrat Jahan and three others. The court rejected the application stating that it was not in a position to provide the charge sheet as it had not taken cognisance of the charge sheet sought by the officer, who had probed the case. Verma had moved the court on Friday seeking the copy of the supplementary charge sheet so that he could initiate legal action against the

accused named in it. Verma, as a member of SIT, had investigated the encounter case of Ishrat and three others. CBI counsel R C Kodekar said. that the court rejected the application moved by Verma on the ground that it had not taken cognisance of this charge sheet. “The court stated that the charge sheet had not come on its record and also that Verma being the third party in the case could not ask for the copy,” he said. Advocate Manish Oza, appearing on behalf of the Verma, said he had filed the application for certified copy of the charge sheet which was sent to the court concerned which sent it back.
