Office of profit: AAP MLAs should resign or get off their high horse..?

The AAP’s defence of its decision to appoint 21 MLAs as parliamentary secretaries rests on shaky grounds. The party has blamed the Centre and Delhi’s lieutenant governor for President Pranab Mukherjee’s refusal to give assent to the amended Delhi Members of Legislative Assembly (Removal of Disqualification) Act, 1997. True, the AAP and the Centre have been locked into confrontation ever since the former swept Delhi in the 2015 assembly election. But that is not reason for Delhi’s ruling party to cry vendetta and conspiracy, especially on an issue of propriety. The fact is the amendment was brought in to offer legal protection to the Arvind Kejriwal government’s appointments — it feared that the parliamentary secretary’s office could be construed as an “office of profit”, which in turn could lead to the disqualification of its MLA holding the post. A series of prior court judgments had deemed the appointment of MLAs as parliamentary secretaries as unconstitutional. Yet the AAP chose to overlook these court rulings. When a PIL was filed against the government on the issue, it sought to amend the Delhi law with retrospective effect. That earlier Delhi governments had made such appointments and a few others like Rajasthan and Karnataka continue to have MLAs in these posts does not make a persuasive case. After all, the AAP’s promise was that it was different, more scrupulous, than the rest. The Constitution makes it clear that an MP, MLA or MLC risks disqualification if he is found to be holding an “office of profit” under the Central or state government, and the Delhi MLA (Removal of Disqualification) Act, 1997, did not include the post of parliamentary secretary as an “exempted post”. When the AAP government made the appointments in March 2015, it sought to override the “office of profit” clause by stating that parliamentary secretaries will not be eligible for remuneration or perks of any kind from the government barring the use of government transport for official purposes and office space in the minister’s office. Three months later, it proposed the to include the office of parliamentary secretary among posts exempted from the definition of “office of profit”. Legislators as aides to ministers could compromise the separation of powers between the legislature and executive — and the principle of checks and balances — as envisaged in the Constitution. The AAP’s defence that MLAs need to be appointed as aides to ministers for better governance is unconvincing. Solutions to institutional inadequacies have to be found within the existing framework. The episode only shows the AAP in unflattering light. Aam Aadmi Party (AAP) is no stranger to controversy, and neither is it the first time that it has blamed Centre for problems plaguing Delhi’s administration. The current confrontation is over 21 AAP MLAs who are appointed as parliament secretaries by chief minister Arvind Kejriwal coming under the ambit of office of profit. Their future is uncertain as President has withheld the amendment Bill passed by Delhi government which aims at providing retrospective exemption to these MLAs. Last year Kejriwal had nominated 21 out of 67 AAP MLAs to the post of parliament secretary with a disclaimer that they will not be eligible for any remuneration or perks from the government in March last year.

A new index to reflect futures price movements in India’s benchmark index – NIFTY 50, has been launched today. In its endeavour to expand the suit of indices representing the Indian capital market, India Index Services & Products Ltd. (IISL), a NSE group company, has designed the ‘Nifty 50 Futures Index’. “It captures the performance of Nifty 50 Futures contracts. The index is constructed using the near month Nifty 50 futures contracts traded on NSE”, said Mr Mukesh Agarwal, CEO, India Index Products & Services Limited (IISL). Nifty 50 is the most actively traded index on F&O segment of NSE. The index will gradually roll over to the next available contract, three days prior to expiry day. The index shall have two versions namely - Price Return and Total Return. The Price Return version of the index shall measure the price returns of Nifty 50 futures traded at NSE. The top three officials of the Goa Cricket Association (GCA) were on Wednesday arrested by the Economic Offences Cell of the Goa Police for alleged embezzlement of funds to the tune of over Rs 3 crore.
