SUNVILLA SAMACHAR Final Status On Control Of Shiv Sena Party Depends On Supreme Court The Thackeray-Shinde feud has split the Nation. While some commentators are critical ofEknath Shinde’s departure, terming it as a subversion of party politics, others find it to be acorrection of Uddhav Thackeray’s departure from the alliance with the BJP in 2019. Thedissension within the Shiv Sena is not uncommon. Grander political parties have sufferedsimilar divorces. However, what will pose an unprecedented challenge is who inherits Sena’slegacy.In 2019 Maharashtra Assembly elections, the BJP emerged with 106 MLAs, the Shiv Senawith 56, the NCP with 53 and the Congress with 44. The majority mark of 145 had beenachieved by the BJP-- Sena alliance. However, at the last minute, the Sena joined hand withNCP and Congress to form the government. This was seen by many as a political andideological betrayal. Political, because the Sena had agreed to a seat sharing arrangementwith the BJP, whereby the latter did not contest from the former’s seats. Ideological becausethe far-right Sena had dumped its right wing compatriot for left wing competitors.While Uddhav Thackeray did capture Jerusalem, his crusade turned a good chunk of hisgenerals skeptical. Ultimately, the 39 “rebels” MLAs led by Eknath Shinde broke away. TheThackeray group petitioned the Deputy speaker to disqualify 16 of the 39 for havingdefected, and the Shinde group, petitioned the Supreme Court for greater time to respond tothe disqualification notices. The Supreme Court refused to stay the floor test. Subsequently,the Shinde Sena resumed its alliance with the BJP, with Shinde becoming the chief ministerand the BJP’s Rahul Narwekar the new speaker. Despite possessing more than two third of Sena MLAs, the Group would invitedisqualification for defection under 10th schedule unless it merged with another party.However, there has been no merger so far. In such circumstances it, would becomeinoperative for the Shinde group to establish itself as the Shiv Sena so that its 39 MLAswould have to neither voluntarily give up party membership under 10th schedule, nor wouldthey have flouted the Uddhav Thackeray control party whip to merit disqualification. The Samyukta Socialist party case (1967) was the first big case of a political split before EC.The SSP was formed as a result of the merger of the Praja Socialist Party (PSP) and theSocialist Party in 1964. But the two parted ways a year later. A year later, Ramashankar Kaushik case allowed S C to elucidate the Test of Majority.The court held that the Ramashankar faction was not the Socialist Party, as there was nocontinuity between the constitution, office bearers and membership of this group and theSocialist party.While the Shinde group commands a majority among SS legislators in the MaharashtraAssembly, the legislative majority as per the Sadik Ali case would be determined on anoverall basis, across all legislatures and corporations. The Thackeray group may yet wieldorganizational majority across the party cadre, especially at the municipal level. Curiously, inThackeray-Shinde, feud the Test of majority may prove inconclusive with the legislativemajority falling to one group and the organizational - Kapilkumar M. Hirpara majority falling to other.

Agency News:New Delhi A bill to provide more teeth to the Archeological Survey of India (ASI) and amend a law dealing with ancient monuments is listed for introduction in the Monsoon session of Parliament beginning Monday.According to a Lok Sabha bulletin, the Ancient Monuments and Archaeological Sites and Remains (Amendment) Bill, 2022 has been listed by the government for introduction and passing.The bill is aimed at rationalising the prohibited area and other amendments. The most significant aspect of the bill is that it will replace

the provision which allows a 100-metre prohibited area for construction activity around Centrally-protected monuments with site-specific limits to be decided by an expert committee. The Ancient Monuments and Archaeological Sites and Remains (AMASR) Act, 1958, was amended in 2010 to declare the 100-metre radius of protected monuments as prohibited areas and the next 300-metre radius as regulated areas.Officials said the proposed amendment would change Section 20A of the Act, which refers to the prohibited area, to rationalise the prohibited and regulated areas.

Oil marketing companies, or OMCs, cut ATF, or fuel used in aircraft and helicopters, prices by ₹3,084.94 per kilolitre to ₹1,38,147.93 per kl - per a notification by state-run retailers.This is only the second time this year that rates have been reduced; prices peaked last month at ₹1,41,232.87 per kl. ATF prices are normally revised on the 1st and 16th of every

month, based on benchmark international oil prices from the previous fortnight.There was no change in July 1 rates. Before that, prices were hiked by a massive 16 per cent, On June 16, ATF prices increased by ₹19,757.13 per kl. On June 1, there was a marginal - 1.3 per cent cut in rates. That was the only exception in 2022, which has seen prices rise steadily. Overall, ATF rates have been hiked 11 times since the start of this year, and had shot up by an eye-watering 91 per cent, or ₹67,210.46 per kl, since January.
