A man was booked for allegedly ferrying pilgrims on his injured horse to cave shrine of Shiv Khori in Jammu and Kashmir’s Reasi district, police said today. Zalim Singh was booked under Cruelty to Animals Act yesterday, a senior police officer said. He was booked following a complaint by a pilgrim when he saw the horse limping and his leg badly injured, he said. The man along with the horse were brought to the police station and he was asked to ensure treatment for the animal, the officer said.

PIL in India : Not always in the public interest

The Supreme Court’s rejection of the PIL (public interest litigation) petition that sought stopping security for the separatists cannot be faulted legally or constitutionally. The apex court has rightly said that security and facilities for separatists is a political decision and not for the courts to take. The court was of the opinion that this is not a judicially manageable proceeding and hence, it did not wish to enter this arena. The larger point made was that of the indiscriminate use of PIL petitions. Such petitions need to serve the interests of the public. In many cases, PIL petitions are filed as obstruction tactics or on utter baseless grounds. Such is the extent of frivolity that’s there in some of such petitions that when Amartya Sen got the Nobel Prize for economics, there was a petition challenging the award because economics was not mentioned in the will of Alfred Nobel, after whom the prize is named. The petitioner was let off with a stern rebuke. In this day and age, when courts are already overburdened with cases, there should be a way to delineate what constitutes public interest and what doesn’t. In the case of the one regarding the separatists, the court refused the petitioner’s premise that funding separatists was akin to spreading unrest in the Valley. While the apex court itself signalled its feeling that the separatists while undermining the writ of the state were not averse to the benefits extended by it, it indicated that it was difficult to arrive at the truth behind the allegations made in the PIL. Also, it said that when it came to law and jurisprudence, nobody could be described as a ‘separatist’ on the basis of judicially established principles since there was no law that calls anyone a separatist. And from common knowledge it is known that there are opinion differences among the separatists and all of them cannot be tarred with the same brush. Most importantly, it is the duty of the State to provide security to its citizens and if there is a threat to anybody’s life and property, the first and foremost duty of the government is to step in. This applies to all citizens of the country. Hence any denial of security to the separatists would have meant that the law was keeping them beyond the pale of citizenship. This would have had implicit meanings detrimental to the country’s unity and integrity. Besides, separatist leaders are often put under house arrest, which presupposes being under the watch of security persons. The court’s refusal to entertain this PIL will also serve as a precedent for other such efforts where emotion or mischief rather than merit is behind seeking judicial intervention in an issue. The Supreme Court on Friday refused to entertain a Public Interest Litigation (PIL) questioning the sacrifice of animals on Eid al-Adha or ‘Bakra Eid’ and the validity of a provision of the Prevention of Cruelty to Animals Act. While withdrawing the petition, the petitioner sought liberty to approach the Delhi High Court which the apex court granted. The plea had challenged Section 28 of the Prevention of Cruelty to Animal Act that exempts animal sacrifice under religious practices. The petitioners challenged the May 6, 2016, judgment of the Bombay High Court, which while upholding the ban imposed by the state government, allowed the consumption and possession of beef brought from states that allow slaughter of cattle.

For, apart from Lively, there are only three things which carry more weight in the film: a seagull that gives her company and earns the nickname ‘Steven Seagull’; Lively’s pert posterior; and her bosom that gets a lingering shot when she is zipping them tight into surf wear. No, even the shark doesn’t get as grand an

That is not to say that the lovely Ms Lively doesn’t shoulder her first solo effort well — even when given the lame backstory of a dead mother and a father who wants her to move on and finish medical college. Driven by grief and anger, Nancy (Lively) has come to a “secret beach” (Australia, passing off for Mexico), where her mother came 25 years ago while pregnant with her, along with a friend. The friend never makes an appearance, dismissed away as “down

with a hangover”. So Nancy comes to the pristine beach with its bluegreen water, clear-blue sky and flock of seagulls all alone, armed with a cellphone, sunscreen and some fruits. There are only two other people there, both men, surfing, but that doesn’t deter her. Nor does the fact that she has no means of going back. Jokingly, she tells the man who has given her a lift to the beach, that she will “Uber” when she wants to return. Whether that’s a product placement or not, there are plenty others, including for the Sony phone, the Casio watch, and the surf wear. A few beautiful shots of the three youngsters surfing the waves or just sitting dangling their feet in the water follow. But before long, the shark appears.

Agency | New Delhi Terming GST reform as a “game changer”, Cabinet Secretary P.K. Sinha today said the government is working “overtime” to implement the indirect tax regime from April 1 next year. The Constitution (122nd Amendment) Bill, 2016, for introduction of the GST in the country was accorded assent by the President on September 8 and the same has been notified as the Constitution (101st Amendment) Act, 2016. “GST is the biggest game changer. But it is also a challenge. We are working overtime to make it happen from April 1, 2017,” Mr. Sinha said at the Chief Secretaries’ Conclave organised by industry chamber PHDCCI here.

Agency | London The memory of a heart attack gets stored in genes through epigenetic changes -- chemical modifications of DNA that turns our genes on or off, a study has found. Cardiovascular diseases (CVDs) which are the leading causes of death worldwide are influenced by both heredity and environmental factors. CVD includes all the diseases of the heart and circulation including coronary heart disease, angina, heart attack, congenital heart disease and stroke. The study examined epigenetic changes -that can lead to the development of various diseases -- in people who have had a previous heart attack. “During a heart attack the body signals by activating certain genes. This mechanism protects the tissue during the acute phase of the disease, and restores the body after the heart attack. It is therefore likely that epigenetic changes are also associated a heart attack”, said Asa Johansson, researcher at the Uppsala University in Sweden. The results of the study showed that there are many epigenetic changes in individuals who had experienced a heart attack. Several of these changes are in genes that are linked to cardiovascular disease.

Andhra Pradesh has emerged on the top among all other states in attracting industrial investments in 2015-16, pushing the previous year’s topper Maharashtra to the third spot. Andhra Pradesh attracted an investment of Rs 21,914 crore out of the Rs 1,38,700 crore gross investments across India, the state govern-

ment said in an official release today, quoting a report by the Reserve Bank of India. This was 15.8 per cent of the total investments of over Rs 10 crore each unit. In 2014-15, AP’s share in the country’s investments was 8.1 per cent. Gujarat retained the second place attracting 14.5 per cent of investments, up from 9.5 per cent in 2014-15 while

The driver of a car, which was “carrying two calves” when it met with an accident three days ago in Anandnagar area of Ahmedabad, died on Friday at V S Hospital due to severe injuries. He was also assaulted by unidentified people after the accident on September 13. Another man who was with the victim in the car has told police that they were being chased by a group of gau rakshaks or cow vigilantes, but investigators disputed his claim, saying CCTV footage from nine major traffic junctions showed “nothing suspicious”.
