to pay Rs 30 crore each within three months and the money deposited with the Delhi government could be utilised appropriately. The civil liability of compensation in this case was decided by the Supreme Court in 2011. It had ordered Rs 10 lakh each for the next of kin of victims above 20 years of age, and Rs 7.5 lakh for victims under 20 years. The Ansal brothers, who owned Ansal Theatre and Clubotels (P) Ltd which ran Uphaar cinema, were asked to pay 85 per cent of the total compensation award-

Nation-states and religion are the only two ideologies that both regulate and consecrate the meaning of death. This also makes them competitors. The ultimate exercise of sovereignty by the state is its claim to determine the conditions under which death is permissible. It also decides what forms of dying can be given public meaning — death for the nation-state is valorised. Any other attempt to determine the conditions under which we die is a usurpation of sovereignty, and other public meaning or consecration of forms of dying need to be eviscerated. Even the difference between what is religious and what is secular is not an antecedently given distinction; it is a distinction internal to the exercise of sovereignty. The state decides what is religious and what is not; it even decides what is essential to religion. These decisions sometimes wear the garb of neutrality. But the state’s own view of dying and death often carries unconscious theological baggage it regards as neutral. Certainly the IPC has traces of a Christian view of life and dying. It cannot even contemplate alternative modes in which that event in life has been imagined. It is not surprising, therefore, that in Nikhil Soni vs Union of India, the Rajasthan High Court has concluded that the Jain practice of santhara or sallekhana shall be considered a criminal offence under Section 309 of the IPC, which provides for punishment for attempted suicide, and Section 306, which provides for punishment for abetment of suicide. Sallekhana is the Jain practice of withdrawing from taking food, under some very special circumstances, as a way of subduing all passions that cause himsa and preparing for a purified passage into the death state and beyond. The theological issues are complex. There are varieties of santhara, from a willed long fasting to a short-lived ritual withdrawal from food under conditions of extreme distress. It is often now used in a token sense to give significance to the last moments of cancer patients at the edge of death. The conditions under which it can be undertaken and the forms of supervision for this practice have also evolved historically. Some of this is wonderfully captured in Shekhar Hattangadi’s documentary on the subject. The existential pathos and struggle of trying to subdue all passions prematurely was brilliantly dramatised in Ship of Theseus. The court, in a remarkably perfunctory treatment, has dismissed this practice. It claims, dubiously, that it is not essential to Jainism. The subduing of all desire is the central thread of Jainism; this is merely one expression. The “essential practices” test is a piece of contorted chicanery. It implies that if a practice were “essential” but morally wrong, it could not be regulated, and it takes away the believer’s autonomy to decide what is essential.

Glenmark receives USFDA nod for oral contraceptive drug Agency | New Delhi
Glenmark Pharmaceuticals on Wednesday said it has received final approval from the US health regulator to sell oral contraceptive — drospirenone and ethinyl estradiol tablets — in the US market. “Glenmark Pharmaceuticals Inc., USA has been granted final approval by the United States Food & Drug Administration (USFDA) for Drospirenone and Ethinyl Estradiol tablets USP, 3 mg/0.02 mg,” the company said in a BSE filing. The product is generic version Bayer’s Yaz tablets. Glenmark said it plans to commence shipping of drospirenone and ethinyl Estradiol tablets immediately. Citing IMS Health sales data, the company said for the 12 months period ending June, “the Yaz market achieved annual sales of approximately $170.1 million”. Glenmark’s shares were trading at Rs1,213.65 apiece, up 4.62% from their previous close on BSE.

Gujarat high court has restrained Rajasthan-based tea manufacturer from using the trademark ‘Sher Bakri’ after Ahmedabad-based ‘Wagh Bakri’ tea producer alleged infringement of its trademark rights. After hearing the case, Justice Akil Kureshi of the high court ordered Bhagaram Ganchi not to sell his product under ‘Sher Bakri’ brand until final disposal of the case. However, the judge also stayed operation of his order till September 15 so that the aggrieved party can move the Supreme Court. According to case details, Bhagaram Ganchi has been selling his tea under the brand name, ‘Sher Bakri’, since late 1996. He even got it registered as
trademark of his product. When the owners of ‘Wagh Bakri’ — Gujarat Tea Depot Company and Gujarat Tea Processors & Packers Ltd — came to know about this, they first objected to registration of the trademark. They argued that this was an infringement of their trademarks rights as they too had ‘Wagh Bakri’ name and logo registered as ‘Sher Bakri’ (translation of Wagh Bakri in Hindi.) Last year, Wagh Bakri tea owners had moved a city court requesting it to stay Ganchi from selling his tea under the brand name that was similar to theirs. But the court refused to order a stay on the ground that Ganchi had been selling tea since 1996 and Wagh Bakri owners had obtained registration of ‘Sher Bakri’ trademark in 2004.

An FIR was filed against the two accused at the Godhra A division police station and the case was transferred to Dahod police under whose jurisdiction the crime was committed. The accused, Nashirbhai Pathan and his unidentified accomplice were yet to be arrested. The Godhra police said that the accused were booked under sections 420 and 114 of the Indian Penal Code (IPC) as well as the section 7 (A) of the Drugs & Magic Reme-
dy Act, 1954. The police claimed that this was one of the rare instances when the 1954 Act was invoked against the persons practicing “black magic” to mislead innocent victims. The Act makes the practice of using medicines without proper reference, support and safety a cognizable offence and a jail term of up to six months, as such practice could be harmful to the health and well-being of the victim. As per the case detail, a woman, Janiben Baberia was bitten by a snake at
her residence in Bandibar village in Dahod taluka and was taken to a government hospital in Dahod where she died. When her dead body was lying in the post mortem room of the hospital, her husband brought in two quacks who claimed to make her live again though the use of occult practices. The accused duo performed “magic” on the dead body of the deceased, using incense sticks and other materials, well inside the post mortem room of the government hospital.
