NJAC verdict: Judicial review is a constitutional affair

The last week was a mixed one for the ruling regime. The Supreme Court (SC) expressed constitutional disappointment at the lack of progress towards a Uniform Civil Code and goaded action towards fulfilment of Article 45 of the Constitution. But in the Sanjiv Rajendra Bhatt case, the SC refused to constitute an SIT in a situation that it found conflated party politics with citizen and judicial activism; in remanding Bhatt to stand criminal trial, it continued to issue “clean chits” to the prime minister and the president of the BJP for the Gujarat 2002 events. And yet, in the same week, an enriching 1,053 pages a 4:1 decision nullified the National Judicial Appointments Commission (NJAC) amendment and act on grounds that it violated the basic structure of the Constitution, thus invalidating the very first constitutional amendment and law sought by the current regime. The three decisions, read together, establish one simple fact: Judicial review is a constitutional affair where decisions are not given for political but juridical reason. Some may be palatable to the regime or political class, others may not be. When the justices decide, it is according to the discipline and traditions of constitutional interpretation. They may sometimes be wrong, but when the SC so rules, it becomes binding law under Article 141. In the NJAC decision, they followed past precedents abundantly in arriving at the conclusion that the independence of the judiciary is an essential feature of the basic structure. All distinguished justices agreed with Justice J. Chelameswar, in his lone learned dissent, that there was no “difference of opinion between the parties… regarding the proposition that existence of an independent judiciary is an essential requisite of a democratic republic”, nor any difference regarding the “proposition that an independent judiciary is one of the basic features of the Constitution of India”. The difference concerned only whether in enacting the NJAC, Parliament violated any essential feature or basic structure; Justice Chelameswar was not able to persuade his brethren that the NJAC was constitutionally valid. The majority opinion penned by Justice J.S. Khehar ruled that “consultation” in Articles 214, 217 and 222 always meant an independent judiciary and primacy of the chief justice of India in the process; and Justice Madan Lokur, in the long concurring opinion of about 300 pages, even went to elaborate its pre-constitutional virtue. If this is so, no Parliament may amend the constitution so as to take away, abrogate, or destroy this aspect of the basic structure.

The Sweden-based drug firm Recipharm has entered into an agreement to acquire a majority stake in Nitin Lifesciences Ltd, a sterile injectable company for an estimated Rs 671.2 crore. “Recipharm will acquire 74 percent of the shares (of Nitin Lifesciences) for an estimated purchase consideration of Rs 671.2 crore on a cash and debt free basis,” Recipharm said in a statement. The acquisition is expected to be completed in Q1 of 2016 once FIPB approval comes through, it added. The National Human Rights Commission (NHRC) joint registrar Anil Kumar Parashar Monday said 99 per cent of its recommendations are complied by all states but Gujarat. However, the state government said it had complied with the NHRC recommendations. “The case of 238 workers who died due to silicosis in Dahod, Khambat areas is still pending with the government of Gujarat even after five years of the recommendation to pay compensation of Rs 3 lakh each their kin. Now, the NHRC has approached the Supreme Court. All other states — Jharkhand, Rajasthan, Tamil Nadu and Pondicherry – have paid victims in similar cases except Gujarat,” said Parashar citing an exam-

Denying charges, state commissioner health J P Gupta said, “Though I am not aware of the 238 workers compensation case, Gujarat is among the best states when it comes to NHRC compliance and healthcare services.” These and other similar issues would be raised during the public hearings on Right to Healthcare organised by NHRC and Jan Swasthaya Abhiyan (JSA), a civil society network, in association with the Ministry of Health and Family Welfare. The hearings will held in Mumbai on November 18 and 19 for Gujarat, Maharashtra, Rajasthan and Goa. For the first

time, NHRC will take up complaints from private healthcare providers as well. In a new twist of events, Karnataka and Gujarat have lifted the ban on manufacture and sale of Maggi noodles, paying way for its return. The announcements by the two states came after a clean chit was given by three government-approved laboratories to Maggi noodles, which was banned by central food regulator FSSAI and various state-level watchdogs in June for high levels of lead and mislabeling regarding MSG. Last week, Nestle India confirmed that all 90 samples of Maggi cleared tests conducted by three laboratories, as mandated by the Bombay High Court. The company is now planning to relaunch the product soon. Few days ago, the front page of a leading newspaper showed off a clutter breaking adver-

The Congress-led Karnataka government decided to allow manufacture and sale of Maggi noodles in the state as it decided to withhold the Centre’s directive banning it, claiming it lacked clarity.

Gujarat Public Service Commission (GPSC) is facing unprecedented embarrassment for its recent exam for class I and II officers, where it granted ‘grace’ marks for 27 questions, to which it had not provided the correct answer among the options. Gujarat high court on Monday sought another report from GPSC on this issue and asked to name the source of the answer options provided in the written test by consulting its experts. The recruitment body was asked to explain the blunder by October 26 and further hearing is scheduled for October 28. This happened after petitioner candidates brought out 28 other questions to the court’s notice where the answer options were either faulty or ambiguous. Justice Sonia Gokani refused to grant GPSC

They have also challenged the clearance of 2,860 candidates for 470 posts with a 6:1 ratio.
