The Centre on Thursday ruled out the age of consent from 18 to 16 years under the Protection of Children from Sexual Offences Act, 2012, to prevent the criminalisation of the consensual relationships between the teenagers. Women and Child Development Minister Smriti Irani stated in the Rajya Sabha that there is no such proposal, in response to a question by CPI member Binoy Viswam. She dismissed the question with a short written answer: “Does not arise.” She further stated that as per the Indian Majority Act, 18 years is the age of majority and the POCSO “clearly defines a child as any person below the age of 18 years.” Only recently, Chief Justice of India Dr D Y Chandrachud had appealed to Parliament to consider concerns on the age of consent, considering teh fact that the “romantic relationships” form a substantial majority of cases under the POCSO Act.

Govt Coming Up With Ex- Christmas-New Year’s Eve: HC cuses to Stop Bharat Jodo restrains hotels, pubs from playing Yatra, Says Rahul Gandhi songs without license fee to PPL Agency News: New Delhi

Agency News: Mumbai

Congress leader Rahul Gandhi on Thursday said the government is coming up with “excuses” to stop the ‘Bharat Jodo Yatra’, days after Union Health Minister Mansukh Mandaviya wrote to him to consider suspending the march if Covid protocols could not be followed. The yatra, which started in Kanyakumari on September 7, has covered Tamil Nadu, Kerala, Andhra Pradesh, Karnataka, Telangana, Maharashtra, Madhya Pradesh, and Rajasthan. “This yatra will go to Kashmir. Now, they have come out with a new idea. They wrote me a letter that Covid was spreading, stop the yatra,” Gandhi said while addressing a gathering in Ghasera village in Haryana’s Nuh district. The Bharat Jodo Yatra led by him entered the state through Nuh on Wednesday after its Rajasthan leg. “Now, they are coming up with excuses to stop the yatra. Wear masks, stop the yatra, Covid is spreading, these are all excuses,” he said. Targeting the BJP, which

The Bombay High Court has restrained several hotels, pubs and restaurants in Mumbai from playing a list of popular film and non-film music during Christmas and New Year’s Eve programmes unless they pay license fees and secure copyright permissions from music licensing body Phonographic Performance Ltd (PPL). The Bharat Jodo Yatra has been going on for more than 100 days and in this people from all faiths, including Hindus, Muslims, Sikhs, and Christians, men, women, and children have taken part, he said. In this, lakhs have taken part, but no one even asked anyone what their religion was, what language they spoke, or from which place they came from. Supreme Court pulls up firm for denial of life insurance The court found that Max Life had issued a letter after the death of the man, pointing to problems in a treadmill test report Agency News: New Delhi The Supreme Court has pulled up Max Life Insurance Corporation for repudiating the claim of a woman in a “mala fide” manner by rejecting the policy taken by her deceased husband. The court found that Max Life had issued a letter after the death of the man, pointing to problems in a treadmill test report, although he had cleared medical exams when he took the policy of Rs 6.24 lakh. “The case at hand shows clear mala fide on the part of respondent No. 2 (Max Life) in the manner they dealt with the insurance policy, after learning of the death of the insured person on intimation from the affected persons. The way the issue was addressed

by respondent No. 2 following the information conveyed does fail, in our opinion, the test of reasonable conduct. “On top of that, to cover up their late reaction, most tellingly, the ante-dated letter under the garb of an unfounded medical reason was dispatched. These in our opinion amount to a clear case of deficiency of service and a non-bona fide conduct by respondent No. 2. The contrary finding in the impugned order do not pass our judicial scrutiny. “We are, therefore, persuaded to conclude that the impugned judgment is unsustainable and the same is set aside. With this order, the appeal and the complaint stand allowed. The respondent No. 2 is accordingly directed to process the complainant’s insurance claim and remit the payable sum,” a bench of Justices K.M. Joseph and Hrishikesh Roy said.

The recent court orders assume significance as it applies to all usage of music, including ones being played in public places on New Year’s Eve, Christmas and any other event or in the background throughout the year, PPL said.

Congress wants to pin Modi down on China issue. It’s holding the wrong end of the stick Rahul Gandhi, who is leading the Bharat Jodo Yatra, has increased the intensity of his attack on the Narendra Modi government for its handling of the border dispute with China. Congress has been accusing PM Modi for not naming and shaming China for its militarybacked border diplomacy. Gandhi and his party leaders including president Mallikarjun Kharge, P. Chidambaram, Manish Tewari, Jairam Ramesh and Pawan Khera are doing their best to provoke Modi and his Cabinet colleagues to engage in the debate, inside and outside Parliament, over India’s border dispute with China. Even Congress’s junior spokesperson Supriya Shrinate is telling Modi to not be scared and speak up before China – “Dariye mat, China ke saamne boliye.” But the Modi government and the BJP have so far refused to take the bait. They are cautious and cleverly diverting the China border issue because they feel they are on a strong wicket visà-vis Congress. A powerful BJP leader told me off the record, “The Congress is so belligerent and severe. Now, expect the reactions too.” Defence Minister Rajnath Singh and External Affairs Minister S. Jaishankar have given statements in Parliament but Congress’ Jairam Ramesh has been pursuing the matter by quizzing the government over lack of certain actions. “In the ongoing session of parliament, Nehru’s memories have come alive. The Modi government is not going to allow China pe Charcha,” said a senior BJP leader, adding, “Modi is not Nehru.” On 12 October 1962, Nehru had told reporters that he had directed the Indian Army ‘to free our territory in the northeast frontier’, which China “misinterpreted” as India declaring war against it. Nehru was drawn into the debate over the border dispute and the Chinese took advantage of it, eventually, and - Kapilkumar M. Hirpara defeated India in the 1962 war.

“It is the court’s decision to release Charles Sobhraj. What can we do? I am definitely dejected with the decision. My team and I had spent hours tracking him down over the years. All of it has just gone down the drain.” This is the reaction of Madhukar Zende, the legendary police officer who arrested Charles Sobhraj in 1986 in Goa, at the release of the serial killer after nearly 20 years in prison in Nepal. Hatchand Bhaonani Gurumukh a.k.a Charles Sobhraj a.k.a Charlie had several other monikers as well. He was called ‘The Bikini Killer’ based on the type of clothing he murdered his victims in or ‘The Serpent’ for the cunning, slimey ways he used to escape from the police several times. Sobhraj is set to be released by the Nepalese Supreme Court on health grounds after being in prison for nearly 20 years in the Himalayan country. He had served 2o years in Indian jails as well. Charles Sobhraj was

accused of murdering more than 50 women across the world and had the police and governments of at least 10 countries, including Thailand, India, Iran, France, and Sri Lanka, on his hot pursuit. “That which cannot be cured must be endured. Sobhraj has spent 43 years in jail in India and Nepal and it is the laws of the land that have released him. He will now go on to live the rest of his life freely with all the ‘bad’ money that he made,” retired super cop Zende tells. Zende, who has still preserved the white-collared red shirt he had worn while arresting Sobhraj at a famous Goan restaurant called O’Coqueiro, feels that courts did not award the serial killer the death sentence he deserved.
