Salman Khan acquitted in chinkara poaching cases

(H.S.) | New Delhi Actor Salman Khan has been acquitted by the Rajasthan High Court in the 1998 chinkara poaching case. Salman Khan’s sister Alvira arrived in Rajasthan High Court with their lawyer. Khan and seven others were accused of killing a blackbuck and chinkara in two separate incidents. Khan had earlier appealed before the High Court challenging the lower court’s verdict that had handed him one and five years’ impris-

onment in the two separate cases of poaching. The verdict in the blackbuck poaching case is still pending. In February 2006, Salman Khan was convicted under the Wild Life Act for poaching a Chinkara at Bhawad near Jodhpur during the shooting of film Hum Saath Saath Hain in September 1998. Salman Khan was sentenced to one-year imprisonment and was slapped a fine of Rs 5,000. Besides Salman Khan, actors Saif Ali Khan, Sonali Bendre, Tabu and Neelam were also charged in the poaching case. In 2007, Salman was sentenced to five years in prison by the Rajasthan High Court for hunting a blackbuck during the shooting of Hum Saath Saath Hain.

Godhra riots at Viramgam : Three people had been killed

The division bench overruled a trial court’s 2011 verdict that had acquitted three of the seven and convicted the remaining four for lesser offences.

Bharwad. Last month the HC had convicted them under sections 302 (murder), 307 (attempt to murder), 323 (voluntarily causing hurt) and other sections of the IPC. The trial court in its order in 2011 had convicted four of them for lesser offences and acquitted three others. Of the ten people accused in the case then, the trial court

awarded life term to two, lesser punsihment to four and acquitted the other four. On June 28, the HC convicted seven persons of murder and rejected the revision petition of two accused who were already given life sentence by the lower court. Of the four who were acquitted, the High Court upheld the acquittal of only Devabhai Bharwad.

It found other three guilty of murder. The case dates to February 28, 2002, a day after Godhra train fire incident. A mob of around 40 people had attacked a Muslim locality in Viramgam and tried to demolish a dargah. When Muslim residents tried to stop them, the mob attacked them, which resulted in the death of three persons.

Justice Khehar read out the findings in the report to Attorney-General Mukul Rohatgi, who was summoned to assist the court in the case. The doctors had concluded that the pregnancy was 23 to 24 weeks old. It said that continuance of the pregnancy would involve “grave danger” to the life of the pregnant woman. Mr. Rohatgi clarified that though The Medical

Termination of Pregnancy Act, 1971 mandates against abortion after pregnancy crosses the 20-week threshold, there are exceptions. “If the mother is in danger, there is no time limit for conducting an abortion. If you have to save life, you need to cross the limit of 20 weeks,” Mr. Rohatgi submitted. The victim had challenged Section 3 (2) (b) of the 1971 Act, which allowed abortion only if pregnancy was under 20 weeks old and done on the advice of at least two registered medical practitioners, who should certify that the pregnant woman was risking “grave injury to her physical and mental health” or there was a danger of the child being born with a severe mental or physical handicap.

The recent violence against Dalits in Gujarat is a fallout

Though atrocity against the Dalits is a perennial affair, the incident in Gujarat on July 11 adds three new dimensions to the phenomenon. One, unlike in the past, the Dalits from the tanner community were accused of cow slaughter and beaten up by the gaurakshaks not only in their village, Samadhiyala, but also taken to Una town, more than 30 km away where they were tied to a car opposite a police station and flogged brutally. The cow vigilantes also forced a Muslim boy to thrash the Dalits to prove that Muslims are anti-beef. The video of the incident circulated on social media to give a message that those who do not follow the gaurakshaks diktats will be punished in the same manner. Second, generally the cases of atrocities in the past — and even today— used to be related to economic issues related to land, wages, water, housing and/or the practice of untouchability. This time, the central issue was a willy-nilly resistance of the Dalits to follow the neo-Brahminical nationalist cultural practices conceived by Hindutva champions. Various outfits of the Sangh Parivar tell people what to eat, drink, dress and monitor their behaviour. The self-styled gaurakshaks keep a watch on cow slaughter. Four months ago, they organised a demonstration in Rajkot and gave a memorandum to the collector demanding that the cow be declared rashtramata. They also demanded a complete ban on the sale of beef in the country. As a part of this campaign, they have been asking tanners to give up their occupation. Third, the protest against the incident and demand for justice by the Dalits is unprecedented. For the first time in Gujarat, as many as 20 young Dalits attempted suicide to express their anger and get justice. It showed their sheer helplessness. Moreover, for the first time in recent history, not only all the Dalit castes but also many OBCs, Muslims, and human right groups joined the protest. The state government took the Una incident as a routine matter for the first eight days. This government has a tendency to ignore Dalit problems, or for that matter, the problems of the deprived communities. For example, in 2003, the government of Gujarat declared before the Supreme Court that the state was free from manual scavenging. But a study carried out in 2006 shows that there were 2,456 households and 4,333 persons engaged in manual scavenging. Half of them clean public toilets and remove night soil from roads. Nearly 20 per cent of the manual scavengers still carry human excreta in baskets, buckets or handcarts. On an average, more than 15 scavengers die every year of carbon monoxide poisoning while cleaning sewage blockages. The extent and nature of untouchability in different spheres in rural Gujarat has not declined significantly since the formation of the state. In fact, the practice has made its way to new sites: Primary schools, drinking water facilities and public transport. In as many as 96 per cent villages, the SCs do not have access to the village burial grounds and in nearly every other village, the SCs do not get access to common grazing land. On the basis of a study of more than a thousand villages, Navsarjan, a civil society organisation, demonstrated, in 2006, that the extent of untouchability varied from 10 per cent to over 50 per cent villages in public health centres, public water facilities, mid-day meals, sitting arrangement in government schools and panchayat offices.

Agency | Washington Lately, NASA announced that it is all set for the construction of its next Mars rover. The American space agency is ready with the final design of the Mars 2020 rover.
