Opposition Parties Have To Be Ready To Firm Up Their Views On The Issue Now that the Narendra Modi government is firmly in saddle, it has re-opened the issue oflinking Lok Sabha and assembly elections as was the practice till 1967. The argumentadvanced in favour of linking both elections are in these lines. It is argued that one of themajor factors impending growth, development and implementation of policies is the fact thatthe nation is perennially in an election mode, witnessing more than five state assemblyelections every year.Simultaneous elections, by definition, means voting to elect representatives of the LokSabha and and state assemblies on one particular day. Historically, Sukumar Sen, the firstChief Election Commissioner, conducted the first elections in 1951 to the Lok Sabha and allstate assemblies at the same time and this practice continued till 1967 when the system gotdisrupted.The inability to hold simultaneous elections gives rise to several serious problems. TheElection Commission’s model code of conduct restricts implementation and execution ofgovernment policies and development programs in poll related states which affectgovernance..…Expenditure incurred both by union and state governments as well as bycandidates and political parties are astronomical and increasing day by day upwards. Morethan Rs. 50,000 crore was spent in 2019 Lok Sabha elections in 2019. Further frequentelections lead to corruption and black money. Then the argument is that security forces are engaged for prolonged periods during electionwhich impedes them from discharging their regular duties. Apart, there is a disruption ofnormal public life such as traffic jams during rallies and the problem of noise pollution. Divisive issues are highlighted and freebies promised to voters which adversely affectdevelopment and finances. Most importantly, the continuous elections cycle seriously affectsgovernance and stable policy making.On the other hand, the holding of simultaneous elections has the benefit.. It ensures moreparticipation of voters and political convenience and popular demands do not takeprecedence over public interest. Further, narrow vote bank politics can be avoided as is themushrooming of regional political parties, thereby promoting national perspective. Thevotaries of simultaneous elections say that this provides stability both at the centre and thestates allowing them to take difficult and harsh decisions in public interest.Amendment will be required in the statutory framework to achieve the above purpose ofsimultaneous polls. The biggest challenge, however, would be to implement the idea of`simultaneous elections for the first time. Apart from necessary amendments in the law, aprocedure of one-time extension, or curtailment, as the case may be, to ensure of thevarious state assemblies has to be drawn up. After the system is introduced, the next challenge would be to ensure that Parliament andstate assemblies complete their full five-year tenure and any changes must be adjusted vis-a-vis the representatives already elected.Those who are against Linking Lok Sabha election and assembly election say this notfeasible for two reasons. First there will be situations in which mid-term elections areinevitable, and these would desynchronize the election cycle. Second, any mechanismdevised to ensure that there is no mid-term election would go against the design ofparliamentary democracy, and thus, of our constitutional structure.The argument against linking both Lok Sabha and assembly elections runs on theses lines.Let us see how we can synchronise the elections cycle to the Lok Sabha. In that case, allassemblies that are completing their terms will have elections in 2024. The term of someassemblies (those ending before 2024) can be extended beyond usual five years, while forothers (current term going past general elections) can be curtailed. This would require aconstitutional amendment, which can be done, if there is a broad consensus across partieson the issue.The problem arises after this. How does one ensure that the electoral cycles stay in sync?After all, the first elections were held in 1952, and elections were held at the same timeacross states for the initial 15 years. After that, as there were mid-term elections in thecentre, as well as in states, the current system of frequent elections evolved. Is there a wayto prevent this?Let us take an example. Assume that there are three significant parties in a state, none ofwhich can ideologically align with each other two. Say they get 40%, 30% and 30% of seatsin assembly elections. There is no way to break the stalemate except with another round ofelections. This is not a remote possibility—we have seen such - Kapilkumar M. Hirpara situations after the Bihar.

Nearly 25K homebuyers hit as Supertech goes bankrupt Agency News: New Delhi Realty major Supertech Ltd faced bankruptcy and insolvency proceedings Friday after failing to repay dues to the Union Bank of India (UBI).The National Company Law Tribunal (NCLT) started proceedings in accordance with the Insolvency and Bankruptcy Code-2016 against Supertech Ltd in response to UBI’s plea seeking its dues from firm. NCLT heard UBI’s case on March 17 and had reserved its opinion for Friday morning.

A group of 100 homebuyers had also filed insolvency cases against Supertech in NCLT.NCLT also appointed Hitesh Goyal as an interim resolution professional (IRP) at Supertech and current chairman RK Arora and managing director Mohit Arora will cease to have decision-making powers. The IRP will also seek resolution plans from developers who may want to take over the debt-ridden firm and revive it.Besides UBI, many homebuyers had also filed insolvency and bankruptcy cases before the NCLT, seeking justice

after the realty company failed to deliver the flats. The homebuyers need not panic because a new developer will revive the company. Supertech has got adequate assets and homebuyers just need to follow the process and file claims. A Swan Energy-backed special purpose vehicle (SPV) is moving closer to take over the debt-ridden Reliance Naval after submitting a resolution plan worth close to ₹3,000 crore under the insolvency law, said two officials close to the development.The company’s resolution plan which includes payment of around ₹2,100 crore to the lenders and another ₹900 crore for working capital, operating expenses, capital expenditure and payment of dues to workers has been accepted by the committee of creditors (CoC) for Reliance Naval, according to people familiar with the development.The corporate insolvency resolution proceedings (CIRP) of Reliance Naval are underway at National Company Law Tribunal (NCLT), Ahmedabad.The E-voting on the resolution plan was concluded on March 17 and
