In Gujarat, Night Curfew Eased In 36 Cities Amid Drop In Covid Cases Gujarat Covid Cases: Chief Minister Vijay Rupani made the announcement regarding the revised curfew timings after a cabinet meeting in Gandhinagar. SUNVILLA SAMACHAR Debate Can Wait, But Not Oxygen For A Gasping Lung It is certainly not a happy situation as the courts are seen increasingly overstepping the boundaries between the Executive and Judiciary to the extent that there is probably need to redefine the relationship. The debate on whether the courts are right or wrong in what they are doing can go on, but the sad fact is that the situation is the result of a void that has been created by the utter failure of the government, and at times a criminal abdication of responsibility on the part of the government. We have had situations when faced with no help forthcoming from the government, even hospitals had to approach the courts for vital supplies of oxygen and medicines and the courts obliged. Otherwise, we would have seen even a greater tragedy. This is not to say that the tragedy that Indians have endured was any less severe. At least six high courts, including Delhi, Allahabad, Bombay and Calcutta, have effectively intervened in handling Corona-related emergencies and issued directives to governments, sometimes overturning prevailing government orders, and ordering immediate action, whether relating to the supply of oxygen, dysfunctional medical equipment, including ventilators, and even lockdown of cities in the worst affected Uttar Pradesh, where the state government was deemed to have miserably failed to handle the situation. The courts also posed the all-important question whether it was not the government’s constitutional duty to ensure proper medical care for the citizens, The Kerala high court went to the extent of asking why the Centre was shirking its responsibility to provide free vaccinations to every Indian and enquired why it was not possible to utilise the surplus dividend of Rs 53,510 crore received from the Reserve Bank of India for administering free vaccination, at least for the poor. The Delhi high court even issued a contempt of court notice against the Modi government for its failure to fulfil its fundamental obligations of protecting the fundamental rights of citizens, which the courts have always upheld. The Allahabad high court had observed that the condition of medical and health infrastructure in small towns and rural areas of Uttar Pradesh was Ram Bharose’ as the state government had no effective control over the situation. At the receiving end of strictures by various courts, the government has approached the Supreme Court, complaining the high courts are issuing impractical orders and then initiating contempt of court proceedings for failure to implement those orders. The government got a big reprieve when the apex court asked the high courts to exercise restraint in passing orders and desist from considering issues such as oxygen supply, vaccination and right to healthcare, which have national and international dimensions. Solicitor general Tushar Mehta suggested that the Supreme Court ask the chief justices of high courts to head the benches dealing with the Covid management cases and related PILs to bring in uniformity and judicial experience for passing orders that are capable of being implemented. The court has appointed senior advocate Nidhesh Gupt as amicus curiae to study the larger issue of the high courts tending to cross the limits and passing orders having pan-India ramifications When people see no light coming from anywhere, particularly in the face of a complete vacuum being created by the failure of the government to come out with proactive measures, they are bound to approach the courts, which in the interest of solving the immediate problem at hand, may have crossed their limits. “The need for oxygen is now,” the Delhi high court had told the Centre when its attention was brought to an order that restricted the use of oxygen for industrial purposes from a future date. It is the timing that is most important under such critical conditions and the patient gasping for breath cannot wait for policy issues to be settled. In this respect, the high courts cannot be blamed for crossing their limit because any delay in providing medical supply could be life-threatening. It is clearly the insensitivity of the government that is to be blamed for creating such situation, which prompted the western media to remark that the Modi government seems to have melted away in the face of the ravaging second wave of Covid. Someone had to step in to salvage the situation and that is what the courts did. It was no time for hair-splittin arguments about who is supposed to do what. The debate can wait, but not the oxygen that can bring someone back to life from - Kapilkumar M. Hirpara the otherwise last breath.

The health ministry on Wednesday informed that over 2.08 lakh fresh cases of

COVID-19 have been reported in India in the past 24 hours. The addition of the fresh cases has taken the COVID-19 case tally past 2.71 crore. The ministry also informed that over 20.06 crore COVID-19 jabs have been administered so far. Of it, over 20.39 lakh people were

vaccinated on Tuesday. India has already surpassed Brazil in terms of cases. It is now the second-worst hit nation due to the coronavirus pandemic after the US 3.11 lakh deaths due to COVID-19 Also, 4,157 COVID-19 related deaths were reported by the ministry during

this period. The addition of the fresh fatalities has taken India’s death toll due to the deadly virus to 3,11,388. Previously, the death toll had touched 4,529-mark on May 19. Of the over 2.71 crore coronavirus cases reported so far, over 24.95 lakh are active cases of the virus. It is 9.19 per cent of the total caseload. Interestingly, over 2.43 crore cases have recovered from the viral infection so far. Thus, the country’s recovery rate stands at 89.66 per cent. The recovery rate had marginally dipped for the first time on August 27, 2020, because of the surge in active cases. It again dropped marginally on September 7, 10 and 11, and on November 25, 26 and 27 due to a surge in cases.

Farmers protesting against the Centre’s three farm laws at Delhi borders are observing Wednesday as a ‘Black Day’ to mark six months of the agitation. Farmers, mostly

from Punjab, had arrived at Delhi borders on November 26 to stage a sit-in protest against the controversial farm laws. In a few days the protests grew as thousands of farmers from Haryana, Uttar Pradesh and other states joined in. The

farmers have been protesting since November at Singhu, Tikri and Ghazipur borders. According to Sanyukt Kisan Morcha officials, the farmers will be burning effigies of the government at Singhu Border. In coordination with farmers from across the country, there will be similar protests in states including West Bengal, Rajasthan, and Maharashtra. Earlier this year, the government had agreed to put the laws on hold for 2.5 years subject to changes suggested by an expert panel.

The farmers had rejected the proposal, reiterating their demand for a complete repeal of the laws. The protests came under criticism after a farmers’ march on Republic Day turned violent.The Uttar Pradesh government had even issued an ultimatum to the farmers to vacate the Ghazipur site. However, an emotional appeal by Bhartiya Kisan Union Convenor Rakesh Tikait revived the movement, triggering large scale rallies and demonstrations in UP and bordering states.

remarks of the yoga guru a “criminal act” under section of 499 of the Indian Penal Code, the notice demanded a written apology from him within 15 days of its receipt, saying a compensation of ₹ 1,000 crore will be demanded from him at the rate of ₹ 50 lakh

per member of the IMA if he failed to do so.The notice has also asked Ramdev to make a video clip contradicting all his allegations and circulate it on the social media platforms where he had uploaded his earlier video levelling them. It further asked the yoga guru to withdraw a “misleading” advertisement from all platforms endorsing “Coronil kit”, a product of his firm, as an effective medicine for COVID-19, failing which an FIR and a criminal case will be lodged against him by the IMA. At least 577 children orphaned in the second wave of COVID-19 : Smriti Irani

At least 577 children across India were orphaned after their parents died in the second wave of COVID-19, according to Union women and child development minister Smriti Irani. The figure cited by the minister is based on reports of states and union territories for the period between April 1 and May 25. She asserted that the Narendra Modi government is committed to protect and support these vulnerable children who unfortunately lost their parents due to the viral infection. Smriti Irani also clarified that these children are not abandoned and under the protection of the respective district authorities.
