The Supreme Court has granted bail to two accused lodged in jail for four years in a criminal case in West Bengal, saying it cannot permit the situation to prevail where a person is kept incarcerated for a long time without a trial. The top court observed that even the first witness of the
prosecution is yet to be examined in the 2018 case relating to the alleged seizure of 414 kg of contraband ‘Ganja’.The court, however, said if the appellants seek to delay the trial, “we permit the trial court to put back the appellants into incarceration”.A bench of justices S K Kaul and P S Narasimha noted that a charge sheet was filed and charges have been framed, but
the case was not proceeding further.“We can’t permit the situation to prevail where the person is kept in incarceration for a long period of time with the trial hardly to commence,” the bench said in its order passed earlier this week.“We are thus of the view that as the period of incarceration is almost four years now and the first witness of the prosecution is yet to be

SUNVILLA SAMACHAR Sc Reversal Of Decision To Publish Snooping Probe Report Adds To Mystery The sudden twist in the Supreme Court stand on the confidentiality of the report of the expertcommittee that probed the use of Pegasus spyware to snoop on politicians and people inpublic life has added more mystery to the imbroglio. The decision to keep the entire contentsof the report in a sealed envelope within hours of outgoing Chief Justice announcing thatsome parts of it would be uploaded on to the Supreme Court website has come as a shock,raising more doubts about whatever has been going on in connection with the scam.A three-judge bench led by CJ NV Ramana had earlier announced that it will make thereport public and upload it on the Supreme Court website. But an order issued by the courtin the evening disclosed that the sealed covers were opened and some parts were read out,but the contents were resealed and kept in the safe custody of the court’s secretary general.It will be made available to the court as and when required, the court said. The case will nowcome up for consideration after four weeks. Although what the report says about the role of the government remains a matter ofconjecture for the moment, the court has already made a startling disclosure that the Centrerefused to cooperate with the probe and that the spyware was detected in at least five of the29 phones that were examined by the committee under the supervision of retired SupremeCourt judge R V Raveendran, who is a domain expert. The other members were Dr NaveenKumar Chaudhary, Dean of National Forensic Sciences University, Gandhinagar;DrPrabaharan P, Professor at Amrita Vishwa Vidyapeetham in Kerala; and Dr Ashwin AnilGumaste, Institute Chair Associate Professor at IIT-Bombay.It is bad enough that the report has been kept away from public gaze as the public has aright to know how their government has been breaching their privacy, which is guaranteedby the Constitution. It is even more damning that the government has refused to cooperatewith a probe instituted by the highest court of the land, indicating the extent to which it cango to cover up its misdeeds. Actually, there is no need for the report to come out to establishgovernment’s guilt. Its responses so far have been good enough to prove the wrongdoing. Ithas more things to hide than reveal.The government silence is killing. It has not even said yes or no to the question whether thespyware was ever bought from the Israeli company. The refusal to rule that out amounts to aconfirmation that the government did buy the offending software and has been using it, notto mention without the sanction of law. It has been committing fraud on the people of thiscountry by continuing to snoop on its citizens stealthily and without authority. The government has been employing diversionary tactics right from the day the matter cameup before the court’s consideration. First, the government tried its best to obstruct theSupreme Court proceedings, by delaying a response to the court’s queries. On the first dayof the case being taken up by the court, the government even failed to send its representative, which meant that the court could not have done anything more at thatjuncture.The government has also been citing national security for its snooping act, but withoutsatisfactorily explaining how its own citizens were a threat to the nation. It is never tired ofequating dissent with treason, which is responsible for many of the Modi government’sdraconian measures, of which there is no dearth. The government has been mixing uppatriotism with party loyalty and is quite unabashed in doing so. This is what lies at the rootof its distrust with people and their privacy.What is even more disturbing is that Prime Minster Modi has so far refused to acknowledgethe existence of such a controversy, which is his own way of dodging inconvenient matters.It is a modified version of this strategy that his government has adopted in the SupremeCourt with regard to the Pegasus Snoopgate.The Pegasus spyware company NSO Group of Israel has said its snooping tool is sold togovernments around world and is intended to target criminals. It is for the Modi governmentto explain to at least the court, if not the people, how such a tool can be used against peoplein public life, who are as patriotic and nationalistic as - Kapilkumar M. Two BSF personnel have been arrested over the rape of a woman who was allegedly trying to illegally enter Bangladesh from India, a senior official of the paramilitary organisation said on Saturday.The BSF assistant sub-inspector and constable were arrested late on Friday night and handed over to West Bengal Police for further legal action, he said.The accused have been suspended and a court of inquiry has been ordered against them, the official of the Border Security Force’s South Bengal frontier said.
