The 10 per cent quota for Economically Backward Communities (EBC) announced on Friday by the state government is a first for a prosperous state like Gujarat where the political verdict over the last two decades has been powered by the dominant agrarian community– the Patidars. That it is a political gamble and smacks of tokenism by the BJP to woo the Patidars who have been agitating for
inclusion as OBCs, is obvious from the fact that the decision was taken by the core group of the BJP led by national president Amit Shah along
with Gujarat Chief Minister Anandiben Patel and Gujarat BJP chief and cabinet minister Vijay Rupani. Legally, there will be problems given
the Supreme Court’s 50 per cent cap on reservation. But Rupani’s statement that the government is willing to fight right upto the apex court for
the sake of the EBC quota, is already a disclaimer of sorts. Currently in Gujarat, Other Backward Castes (OBCs) have a 27 per cent quota, the Scheduled Castes (SCs) quota is seven per cent and Scheduled Tribes (STs) get 15 per cent reservation. The ordinance on the EBC quota will be issued on May 1, Gujarat’s foundation day, to be applicable for an annual income cap of Rs 6 lakh — Rs 50,000 per month –for ‘upper-caste’ people excluding the OBC/ ST/SC. This upper cap is likely to include a large chunk of upper-middle class from the upper
castes which also forms a core vote bank of the BJP. It remains to be seen how the ordinance will define ‘upper-castes’ and, if the upper cap income of Rs 6 lakh per year will also apply to people from other religions like Muslims and Christians. The immediate reason for the decision is the Patidar quota stir led by Hardik Patel who remains in jail on sedition charges even as five of his colleagues who were part of the agitation, were set free on bail, on Thursday. Sedition law brings only disrepute to governments that brandish it
Hardik Patel is about to complete 200 days behind bars. The government has put him away for the better part of a year for sedition, because of the ostensible gravity and repeatability of his “offence”. Since these qualities remain unaltered, does it follow that his right to liberty stands suspended for all time? The continuing incarceration of Patel highlights yet again the absurdity of retaining Section 124A of the Indian Penal Code, which governs sedition, on the statute books. By all accounts, the young activist has demonstrated an appetite and enthusiasm for disturbing the calm, but criminal law is armed with numerous other provisions for dealing with such challenges. The demand for reservations raised by his Patidar Anamat Andolan Samiti is political. Its methods are scarcely above reproach, but governments should engage with it politically, without reaching for magic bullets left over from the 19th century, like the sedition law. In this case — as is usually the case — the government’s response is completely out of proportion with the provocation, a video clip in which Hardik Patel is heard exhorting a supporter threatening suicide to kill some policemen instead. The strength of the police force was not thinned as a result, so this was just a case of Patel shooting his mouth off. But it was read as part of a “conspiracy” against the state, to “attempt to excite disaffection”. By that logic, a bunch of students grousing about the government would be seditious too. And so they were deemed to be. The arrest of Kanhaiya Kumar and his fellow travellers at JNU has been reviled as a direct attack on campuses and dissent. It has backfired, turning the student union leader into a celebrity of sorts, with an instant book deal thrown in. And yet, the government persists in believing that the charge of sedition is a handy cut-out switch to cow down inconvenient people. None of the celebrated sedition cases of recent years brought any credit to government. It failed to discredit Binayak Sen, Arundhati Roy and S.A.R. Geelani. Earlier this year, Ashis Nandy, who does not enjoy the material support of any political organisation, was forced to offer an apology for painting the Gujarat government in a poor light. But the government gained nothing by harassing the noted academic. It should appreciate that besides being colonial rather than democratic, Section 124A offers no tactical returns either. It is a loser on all counts.

This is precisely where Matthew Brown’s movie on the mathematician, The Man Who Knew Infinity, seems to ring false, especially after Gnana Rajasekaran’s Tamil biopic on the genius, Ramanujan, had been seen in 2014. Rajasekaran had ably captured the intimate nuances of the Tamil Iyengar community. He had brought alive quite vividly the mood and essence of Ramanujan’s period, the stifling prejudices and so on. Despite having implemented the highest number projects, Gujarat lagged behind states like Maharashtra, Madhya Pradesh and Karnataka in terms of investment realised through implementation of industrial entrepreneurship memorandums (IEM) from January 2015 to March 2016. The state implemented 117 IEMs, the highest in India, but the investment stood at just Rs 8,474 crore. As against this, Maharashtra executed 82 IEMs worth Rs 53,438 crore followed by MP and Karnataka with 35 and 37 IEMs entailing investments of Rs 17,490
crore and Rs 15,581 crore respectively. IEMs are filed by compani es and industrial units with the ministry of commerce expressing their intention to either set up new units or expand existing ones. They also have to inform the ministry about commencement of operation. When it comes to investment, the other states which are
doing better than Gujarat might have got 2-3 big ticket projects. “But in terms of implementation we are way ahead. More IEMs mean more people are coming to set up projects in Gujarat,” said state’s finance minister Saurabh Patel.He further said that the conducive industrial environment in the state continues to attract people and projects.
Flipkart Challenges E-Commerce Entry Tax in Gujarat High Court

Gujarat High Court Thursday issued a notice to the state Government on a petition filed by the online retail major Flipkart against the entry tax in the state on the goods bought through the e-commerce portals. The division bench of Chief Justice R Subhash Reddy and Justice V M Pancholi scheduled the next hearing for June 9. Flipkart has claimed the tax is discriminatory, because no such tax is imposed on the goods brought into Gujarat through other modes of sale. It moved the HC after the Guja-
rat Government amended the law to levy entry tax on goods purchased through e-commerce portals, apparently to provide a level-playing field to the traders and retailers
in the state. The Gujarat Tax on Entry of Specified Goods into Local Areas (Amendment) Bill, 2016, was passed on March 31. Now 15 percent entry tax is levied on the online purchases. Flipkart’s contention is it does not sell any product itself but only provides an online platform to manufacturers/traders, so the tax is unjustified.
Amreli Lok Sabha MP and BJP leader Naranbhai Kachhadia has got relief from the Supreme Court. Kachhadia had challenged the High Court order and sought his conviction in lower court to be rejected. The Supreme Court has rejected the three-year jail term ordered to him by the Sessions court in Amreli and asked Kachhadia to pay Rs 5 lakh compensation to victim. Kachhadia was facing disqualification from the post of member of parliament after 3-year
term in criminal case ordered by the sessions court. However today’s decision by Supreme Court to reject conviction itself has given relief to Kachhadia. It should be mentioned that when Kachhadia challenged
the lower court verdict in Gujarat High Court, his arrest was stayed but conviction was not rejected. Kachhadia had therefore gone to Supreme Court to get conviction rejected in a bid to avoid disqualification.

Rare albino cobra rescued in Rancharda

A rare albino cobra was rescued by snake lovers from Rancharda on the outskirts of Ahmedabad. The snake, which suffers from albinism just like humans, has lost its pigmentation and comes across as a white snake. This is the second such snake spotted in the state in the past three years. On Monday morning, snake rescuer Mukesh Bhatti and his team spotted the albino snake and informed the forest department after rescuing it. The snake was caught from the bungalows in the area and was then brought to the forest department rescue centre in Ahmedabad. The albino snake rescued earlier was from Saurashtra region and it is now a resident of Kamla Nehru Zoological Garden.
