News Brief Odisha flood situation improves Agency | Bhubaneswar

The flood situation in Odisha slightly improved today with the rains relenting even as the state government asked collectors of five north and coastal districts to remain watchful of the IMD report on the impact of cyclonic storm ‘Komen’. Though the water level in the Baitarani and Budhabalang rivers was receding, the flood water continued to flow above the danger level in the Subarnarekha river, Special Relief Commissioner sources said.

The caller, identified as Nim Bahadur from Nepal and currently staying in Goa, was picked up from the Panaji-Margao highway, 10 kms away from the capital city.

Kalam and Memon: Does India hate Muslims?

‘Commute death penalty of Yakub to honour Kalam’s principles’ Kalam’s compassion is the reminder of what we denied Memon, While one worked to build the country, the other wanted to leave it in ruins Agency | New Delhi Former West Bengal Governor Gopalkrishna Gandhi has appealed to President Pranab Mukherjee to reconsider the mercy petition of death row convict Yakub Memon as a “fitting tribute” to former President APJ Abdul Kalam whose “conscientious opposition” to capital punishment is widely known.

In his appeal to the President, Gandhi said Kalam had, as recently as earlier this month, expressed his opposition to the concept of capital punishment. “He expressed this opinion to the Law Commission, which has been holding deliberations regarding the desirability and efficacy of the death penalty. It would, I suggest, be a fitting trib-

Implementation of India-Bangladesh Land Boundary Agreement to Start Tomorrow Agency | New Delhi

Ending more than four decades of wait, India and Bangladesh will start the exchange of 162 adversely-held enclaves from tomorrow, marking the start of implementation of their landmark Land Boundary Agreement (LBA). While India will hand over 51 enclaves, comprising 7,110 acres to Bangladesh, the neighbouring country will give India 111 enclaves comprising around 17,160 acres. Bangladesh and India will implement the LBA of 1974 and the enabling Protocol of September, 2011, in a phased manner over the next 11

months. According to an estimate, around 37,000 people are living in Indian enclaves in Bangladesh while 14,000 people are staying in Bangladeshi enclaves in India. India and Bangladesh have already completed an exercise in July to ascertain the views of the residents in the enclaves whether

they would like to take Indian or Bangladeshi citizenship. None living in Bangladeshi enclaves in India wants to shift to that country, as per a joint survey. However, an estimated 600 people want to migrate to India. The Centre has already sanctioned a Rs. 3,048 crorepackage for rehabilitation

Overwhelming evidence that Gurdaspur attack had Pak link: Govt Agency | New Delhi

Government on Thursday asserted that the Gurdaspur attack had Pakistan connection, saying there is “overwhelmingly conclusive” evidence that the three terrorists had infiltrated from there to carry out the strike. Home minister Rajnath Singh, who made a statement in Rajya Sabha on Monday’s attack amid din created by Congress members, said the terrorists had sneaked in possibly because of the “difficult terrain coupled with recent heavy rains, resulting in excess flow in the rivers and canals along the border.” He said the government will do everything possible to prevent cross-border terrorism and “any effort by the enemies of our nation to undermine India’s territorial integrity and security or imperil

of the people affected by the exchange of enclaves under the LBA implementation. Between July 31, 2015 and June 30, 2016, the entire process, including physical exchange of enclaves and land parcels in adverse possession along with boundary demarcation, is expected to be completed. India and Bangladesh will print, sign at plenipotentiary level and exchange the strip maps of un-demarcated sectors. Both governments will facilitate “orderly, safe and secure passage” to the enclave dwellers along with their “personal belongings and movable property” to Bangladesh or India through proper “travel documents”, according to a letter exchanged by the two countries.

ute to the humane legacy of President Kalam to grant Yakub Memon his life, for which course there are also other compelling reasons,” Gandhi wrote. President Mukherjee had last year rejected Yakub’s mercy plea. Underlining that he was writing this appeal as matter of urgent, general and public interest, the former Governor cited a case of 1997 when the then President Shankar Dayal Sharma reversed earlier decision and commuted death penalty of two boys from Andhra Pradesh on the appeal of Mahashweta Devi and other eminent citizens on the eve of their scheduled execution.

Gandhi said it established “the supreme constituent power of the President of India under Article 73 of the Constitution, to reverse his earlier decision, and heed voices of conscience to commute a death sentence.” “Yakub Memon submitted to Indian jurisdiction, when he may quite easily have evaded justice. A respected officer of Indian intelligence has spoken of his cooperation with the law, thus rendering the death penalty completely inappropriate in this case. Former Supreme Court judges have openly said that his execution would be unjust,” he said.

GM to shut down manufacturing unit in Gujarat Sunvilla News | Ahmedabad

General Motors (GM) has announced that it will cease its operations in Halol, Gujarat. The American automaker, however, announced plans to invest Rs 6,399 crore in the country, majority of which will go into its plant in Talegaon, Maharashtra. The carmaker was among the first automakers to enter Gujarat in 1996. The carmaker’s decision to move out from Gujarat is opposing to the current trend where

most of the industries are making a beeline to Gujarat. GM’s decision to move out of Gujarat will affect 1,100 employees at its plant in Halol that has a total annual manufacturing capacity of 1.1 lakh units annually. The capacity at its plant in Maharashtra is about 1.3 lakh units now, which will be ramped up to 2.20 lakh units. The company said this would lead to creation of about 12,000 jobs and those employed at Halol would be given

opportunity to apply for jobs here. In 2010, 2011 and 2014, General Motors faced labour problems at its Gujarat plant. The protests were against poor working conditions and pay. Shutting down operations at the plant in Gujarat will be complete by the end of 2016. GM plans to launch 10 new domestically manufactured vehicles in India over the next five years in an attempt to double its market share in the country by 2020.

Inhuman and unconscionable Judicial finality need not necessarily mean that India should hang Yakub Memon. Even in this situation, as his life hangs on the slender thread of a fresh mercy plea to the President, is the irreversible and inhuman sentence of death the only recourse for a democratic government? Carrying out the sentence will only have the appearance of a justice that is retributive and vengeful, not substantial or morally different from the very offence that gave rise to the proceedings. In recent times, we saw the horrific judicial murder of Afzal Guru, who was hanged in secret without a final opportunity for his family to meet him, marking an unprecedented abandonment of morality on the part of the state. It was only in apparent cognisance of this that the Supreme Court ruled early last year that a formal communication to the convict and his family, intimation to the local legal aid centre and a clear gap of 14 days between the communication and the execution were necessary. Further, there are bound to be questions each time someone is hanged or spared. Even in the Mumbai blasts case, the 10 men sentenced to death by the trial court for planting the explosives were given only life terms by the Supreme Court on appeal, while Yakub Memon alone was awarded the death penalty. Such distinctions may seem arbitrary to the layman. As also, the revelation that the Memon family may have been induced to return to India will cast a shadow on the legitimacy of hanging a man who cooperated with Indian agencies. The debate on the need and desirability of retaining the death penalty has been overshadowed by much intellectual exertion on the nature of the crime involved, its gravity, its heinousness and the fatalities it caused. The time has come to end this debate once and for all by ascending to a moral position that there shall be no death penalty on the statute book, regardless of the heinousness of the offence, the circumstances or the number of fatalities involved. Anyone following closely the evolution of the law on death sentences and the clemency jurisdiction in India will understand that the Supreme Court is making it more and more difficult for the executive to carry out death sentences. It has evolved a jurisprudence that limits capital punishment to the ‘rarest of rare cases’, allowed a post-appeal review as well as a curative petition, and made decisions on appeals for mercy justiciable. It has laid down a cast-iron rule against undue delay in disposing of such mercy pleas, and it has humanised the process by repeatedly intervening in favour of condemned prisoners, often at the very last minute. A truly lasting solution to the moral dilemma that each instance of capital punishment poses will be to abolish it altogether and replace it with a sentence of imprisonment for the rest of the convict’s life. The quality of mercy is not strained. The President, under Article 72 of the Constitution, has the power to grant pardon, and to suspend, remit or commute sentences.

While watching the trailer for Dharma Productions’ Brothers, starring Akshay Kumar and Sidharth Malhotra, chances are your first reaction will be amazement at how effortlessly both actors turn into fighters. There’s animosity and violence punching its way through the frames. Especially from Malhotra, who’s usually seen

looking cute and squeaky clean, it’s quite a performance. Based on the Hollywood action film Warrior, Brothers is about two desperate but determined brothers who are pitted against one another in the wrestling ring. The film’s trailer quickly reached almost 8 million views on Youtube. Now we’ve got Brothers’ anthem, composed by Ajay-Atul and sung by Vishal Dadlani. Released on 27th July,

it’s already had more than 80,000 views. The song shows the journey of David Fernandez (Kumar) and Monty Fernandez (Malhotra). who are prepping up for their fights. David appears to have the benefit of a proper gym, equipment and trainers. Meanwhile, Monty is seen working out in a construction site, climbing cranes and using machines that have been fashioned out of rusty spare parts. Dad-

lani’s rough-edged voice matches the energetic beat of the anthem. You’ll be thoroughly revved up to watch these two brothers go at each other. Kumar plays a teacher who gives up his job to train for this fight. Malhotra’s Monty is someone best known for breaking rules, we’re told. Both actors are pretty darn awesome with their physical prowess. Keep in mind Kumar is 47 years old.

3 / Dt. 31-07-2015, Friday Dena Bank’s Q1 Profit Plunges 81% to Rs 15 Crore Agency | New Delhi Public sector Dena Bank’s net profit plunged 81.4 per cent to Rs 15.16 crore in the first quarter ended June 30 on a sharp rise in bad loans. The public sector lender’s net profit in the same quarter of last fiscal, 2014-15, was at Rs 81.52 crore. The steep fall was attributed to a sharp rise in non-performing assets (NPAs) and consequently a higher allocation towards provisioning. Its income increased marginally by 3.2 per cent to Rs 2,914.87 crore in the first quarter of 2015-16,

as against Rs 2,824.58 crore in the year-ago period, Dena Bank said in a BSE filing. The asset quality deteriorated further as gross NPAs or bad loans shot up to 6.2 per cent of gross advances during the quarter under review as against 4.21 per cent a year ago. Its net NPAs too rose further to 4.24 per cent from 2.94 per cent of net advances. Thus the provision towards bad loans and contingencies was raised by over 42 per cent to Rs 324.75 crore during the quarter, from Rs 228.06 crore a year ago.

Now that Anurag Thakur is at the helm, one may suddenly find that more players from the north are finding their way into the Indian team.

A Davis Cup tie is never easy. To add to the pressure, it’s a World Group play-off. It’s how the India team coach Zeeshan Ali puts it, “We would rather play a top team

he has played just 18 Tests in five years. In the same period, he’s played 218 ODIs and 44 T20Is. Raina is now looking to nail down the Test spot and for that he is aiming to use domestic cricket as a platform to show that he is good enough for the longer format. “I foresee a lot of matches coming my way in first class cricket and I will certainly work harder to show my calibre and prove (myself) to be a perfect candidate for upcoming Test matches,” Raina. Raina also said that he was disappointed at being overlooked for the Sri Lanka Test series as he had been performing consistently in ODIs, T20Is and also IPL. Raina has averaged just 26.48 in the 18 Tests he’s played so far. He has been in and out of the team since the South Africa tour in 2010 and his last comeback was a horror one — making a return to the Test side after three years, he managed ducks in both innings against Australia at the Sydney Cricket Ground earlier this year in January.

Flood-like situation in parts OBC Status: BJP cites SC ruling of Gujarat, toll reaches 27 Sunvilla News | Gandhinagar

Sunvilla News | Ahmedabad

Heavy rains in north and central Gujarat claimed more lives on Wednesday, taking the total toll in the state to at least 27 since Tuesday. Banaskantha, Patan and Mehsana districts are the worst-affected, besides Kutch. Banaskantha alone reported nine more deaths on Wednesday. As rains eased off a bit, three helicopters from Indian Air Force (IAF) and Border Security Force (BSF), along with 15 teams —

comprising 510 trained NDRF personnel and 180 jawans of the BSF — conducted relief and rescue operations in north Gujarat where hundreds of villages remained marooned due to large-scale flooding. Seven columns of the Indian Army have also been sent to Banaskantha. The NDRF teams, with 57 rubber boats, have been deployed at various flood-affected parts of the state, like Suigam (one team), Deesa (two teams), Hahara (one team), Banaskantha

(two teams), Bhuj (one team) and Ahmedabad (four teams). Further two teams of NDRF are being airlifted from Bhisinia airfields to Gandhinagar and two teams from Pune airport to Ahmedabad. So far, NDRF teams have evacuated 283 persons (including 111 persons at Varun village and 87 persons at Chatara village) from affected areas of Banaskantha district to safer place, stated an official release. Among those rescued include 24 people stranded inside a GSRTC

Taking a stand on the ongoing Patidar agitation over the OBC status demand, the BJP cited Supreme Court ruling of 50 per cent caste-based reservation, indirectly turning down their demand. The party termed the stir by the Patels a “political ploy to disturb peace in Gujarat”. In the party’s Gujarat unit meeting held at its headquarters at Shree Kamalam in Gandhinagar, state president Ranchoddas Faldu said, “There should be representation to the government at the right platform. The peace should not be disturbed.” He was referring to last’s week incident where a bus near Shankeshwar in rally at Visnagar in MePatan district where ris- hsana by Patidar Anamat ing flood waters had sub- Samiti (PAS) — which merged the bus. On the other hand, PAS maintained that the representation has always been done with the government. “After every rally since July 16, we have submitted memorandum to mamlatdar or collector. It is the right platform,” said Hardik Patel of PAS.
