The Allahabad High Court on Wednesday commuted death sentence of 2006 Nithari serial killings convict Surinder Koli to life imprisonment. The order came on a Public Interest Litigation filed by NGO People's Union for Democratic Rights (PUDR) which contended that the period elapsed in disposal of Koli's mercy petition was "3 years and 3 months" and, as such, execution of death sentence would be in violation of the Right to Life granted in Article 21 of the Constitution. A Division Bench comprising Chief Justice

D Y Chandrachud and Justice P K S Baghel held that execution of Koli's death sentence would be "unconstitutional in view of the inordinate delay" in deciding his mercy petition. Koli had also filed a plea challenging the death sentence on the same ground as the one stated in the PIL, which has also been clubbed with it. The death sentence was awarded to him by a special CBI court at Ghaziabad on February 13, 2009. The PIL was filed on October 31 last year, three days after the Supreme Court rejected Koli's recall application.

The death warrant issued by the trial court on September 2 had fixed September 12 as the date of hanging, though its execution was stayed in view of the apex court's decision to hear the recall application. Rejection of the recall application had cleared the decks for

Ahmedabad, Jan28 The state home department today issued a chargesheet against Satish Verma, the Gujarat cadre IPS officer who had assisted CBI in the investigation of Ishrat Jahan case, for remaining absent from duty when he was principal of Police Training College in Junagadh. A senior home department official confirmed the development. Verma, a 1986 batch officer, was transferred to Junagadh in April 2012. However, he allegedly remained absent

for a significant period owing to health problems. Later, he applied for central deputation. On the order of the High Court, he was deputed to the CBI to assist it, as a local officer, in the Ishrat Jahan case. It was during his deputation -2013-14 -- that the CBI concluded that the encounter of Ishrat Jahan, a Mumbra college girl, and three others was fake, and it was a conspiracy of Intelligence Bureau and Gujarat Police. The chargesheet comes a day

after Sharma was superseded by the Gujarat government as all his batchmates were promoted to the rank of additional director general from inspector general of police. In August 2014, the appointments committee of NDA cabinet at the Centre approved his application for central deputation and appointed him as chief vigilance officer of North-Eastern Electric Power Corporation in Shillong, Meghalaya.

BJP, AAP neck and neck in Delhi, hung assembly likely again: Survey The more things change, the more they remain the same. A Survey predicts a dead heat between the BJP and AAP in the Delhi elections, leaving the capital headed for a hung assembly even after a year of President’s Rule. The survey, conducted between January 10 and 19 and then revisited after Kiran Bedi was nominated the BJP's CM candidate, projects 3136 seats for both BJP and AAP, with the Congress seen sliding to between 2 and 7 seats. Delhi votes on February 7, but the results will only be known three days later. BJP's Bedi, her associate-turned-rival Arvind Kejriwal of AAP and Congress's Ajay Maken have been chosen by their parties to lead them in the prestigious battle for the capital. Former chief minister Kejriwal is still the preferred choice for the post of chief minister with 43% people backing him, followed by Bedi (39%) and Maken (12%). Pollsters interviewed a total 7,147 voters across Delhi, roughly half of them women, between January 10 and 19, and went back to 3,146 of them between January 24 and 27 to ask about their CM and party choices after the Bedi anointment. Before Bedi was named the CM candidate by her party, the survey found that AAP was ahead with 34-39 seats, followed by BJP with 29-34 seats and Congress 2-7. As many as 47% of the respondents felt Bedi's induction could be a game-changer in a tight battle. In the 70 member Assembly, with 36 being the simple majority mark, BJP, AAP and Congress had won 32, 28 and 8 seats respectively in 2013 elections. This resulted in the installation of a brief, minority AAP government with Congress support. Despite the close finish expected, the survey shows AAP vote share is going up by 9 percentage points while it’s only five for the BJP and loss of 10 percentage points for Congress compared to the 2013 elections. In the 2013 assembly election, the BJP’s vote share was 33%, followed by the AAP’s 29.4% and the Congress’s 24.5%. Corruption weighs heavily on people's minds with 23% saying it is the most important issue followed by inflation (16%), women's safety (14 %), shortage of drinking water (11%), and high power rates (5 %). In the last leg of the campaign the BJP has decided to get aggressive with four rallies by Prime Minister Narendra Modi to be held between January 31 and February 4.AAP is also not leaving any stone unturned with Kejriwal holding twice as many public meetings as he did for the 2013 assembly elections to try and erase the taint of having quit power in just 49 days in his earlier innings.BJP president Amit Shah was not being facetious when he said Kiran Bedi was fielded from Krishna Nagar because the party did not want her to be tied down to one seat. Hit-and-run case: Salman’s blood not sealed properly A witness of 2002 hit-andrun case, involving Salman, claims that the proper procedure was not followed while collecting blood samples. According to the witness a preservative is added to the blood samples. By following this procedure the exact amount of alcohol in the blood can be determined. One of these preservatives is Sodium Fluoride which prevents fermentation and glycosis in blood. This witness is the doctor who was assigned the duty of checking Salman’s blood for presence of alcohol. Allegedly, Salman had collided with a pavement in Bandra. This accident injured four individuals and resulted in the death of one. After the accident the samples of Salman’s blood were collected. This analyst who is the 20th witness of the case stated in the court of law, “When blood gets

fermented it produces alcohol and the accurate levels cannot be determined.” Earlier during cross examination this witness had informed that Salman’s blood sample contained 62 milligrams of Ethyl Alcohol. These samples were sent to this analyst by the Bandra Police Station after being collected at JJ Hospital. When a general blood test is done 30 milligram of Ethyl Alcohol is found in the blood. For medicated individuals it rises up to 40

milligrams. The analyst said that, “An unsettling quantity of 62 milligram was found in the samples sent to me.” Shrikant Shivde, the defence lawyer in this case told the court, “Potassium Obsolete, an anti-coagulant was the only other substance added to the two vials of blood tested.” When questioned as to why he did not follow the procedure this doctor claimed, that he was a mere MBBS student and did not had a post graduation degree.”

The task can be won by adding all the steps to the ladder and claiming the golden bag hung at the top of the ladder.Challengers have to make the red ladder while Champions have to make the green ladder. There is another twist here. Both teams have been given five ladder steps belonging to the other team. Both teams not only have to build their ladder but try to steal the five steps from the other team while keeping the opponent team’s ladder steps from being stolen. Vodafone case: Government not to appeal against Bombay HC order The government Wednesday decided not to appeal against a Bombay High Court ruling that telecom service provider Vodafone was not liable to pay tax demand of Rs.3,200 crore in a transfer pricing case, Communications and IT Minister Ravi Shankar Prasad said and hoped that the decision would boost foreign investors' sentiment. "The cabinet has decided not to move Supreme Court in this regard. This is an important decision," he told reporters after a meeting here of the union cabinet presided over by

The policy will give a direction to the textile sector and act as a huge

Clothing Manufacturers Association of India (CMAI) president Rahul Mehta said that the c o u n t r y ’s apparel exports are likely to touch USD 17 billion in FY15 as compared to USD 14.7 billion last year. In 2014-15, the growth rate of domestic garment market will be 10 to 12 per cent, while the growth rate of export market would be 18 to 20 per cent, Mehta said. The growth in Indian
