injunction barring anesthesiologists from a planned job action that would disrupt thousands of elective surgeries this week. The B.C. Anesthesiologists Society (BCAS), which is in a labour dispute with the province, had vowed to reduce service at all Lower Mainland hospitals outside of Vancouver, as well as others on Vancouver Island and in the Interior, starting April 2. The B.C. Supreme Court ruling freezes that strategy until a full hearing can be heard on the injunction request April 18. Society president Dr. Jeff Rains said members intend to fully abide by the judge’s instructions. He would not say whether anesthesiologists will go ahead with the job action if the injunction request is rejected in court later this month. “We’ll have to just see what comes out in the hearing,” Rains said. “From the very beginning our path forward has not been as an end goal to withdraw services from patients,” he said. “Our goal is to improve services to Dr. Jeff Rains patients. “With or without an injunction, with or without service reductions, we still need a process to deal with the issues critical to anesthesia care in this province.” Interior Health president and CEO Dr. Robert Halpenny, speaking on behalf of all health authorities, said the injunction was necessary because urgent and emergency surgeries could have been compromised. He said anesthesiologists created confusion by suggesting they could do all needed procedures, but after regular hours, threatening to delay urgent and emergency procedures that normally get priority at those times.

was sentenced to life in prison last week for the 2008 murder of a Mission couple has also confessed to killing his girlfriend, who vanished in Surrey in 2007. But Jack Woodruff is not facing charges for Karen Lynn Batke’s death. Batke, 39, went missing in February 2007. Last year, when Woodruff was arrested for the Mission murders of Lisa Dudley and Guthrie McKay, RCMP identified Woodruff as a suspect in Batke’s disappearance. Batke’s brother, Lorne Batke, told CBC in an exclusive interview this week that investigators told him while Woodruff was in prison awaiting trial for the Dudley and McKay shootings, he confessed to strangling Karen Batke in their Surrey basement suite.

New schools get the go-ahead

Two elementary schools could be open by fall 2013 by Sheila Reynolds FOUR SURREY school projects announced by the provincial government last Halloween are finally moving ahead. Architects were appointed by local trustees Thursday for two new elementary schools in crowded neighbourhoods and for expansions at a pair of high schools. The projects were among eight announced for Surrey when Premier Christy Clark came to town with considerable fanfare last October. Among them were additions at two crowded high schools: Fraser Heights Secondary, which has 16 portables, and Panorama Ridge Secondary, where there are 14. Also targeted were two new elementary schools in the rapidly growing neighbourhoods of South Newton and East Clayton that will relieve overcrowding at Hazelgrove and Cambridge Elementary schools. The Surrey Surrey District found out last week it could proceed with the building process and within days, appointed the architects. “We don’t fool around on this end. Give us the money and we get the shovels in the ground,” said Surrey Board of Education Chair Laurae McNally Laurae McNally, pointing to the five months it took get the go-ahead from the province. The firm Craven Huston Powers Architects will oversee the two new elementary schools, while Grant & Sinclair Architects Ltd., which designed the original schools, will do the additions at Fraser Heights and Panorama Ridge secondary schools. “Everybody knows time is of the essence. We needed these schools three years ago, so the architects aren’t going to waste a lot of time,” McNally said, adding the elementary schools are being fast-tracked. While a September 2013 opening might be tight, the district is aiming for the elementary schools to be ready sometime that fall. The high school additions, McNally said, are more complicated and may take a bit longer. Four ‘Top 10’ suspects nabbed Three arrested in Surrey and one was found in a Coquitlam casino by Kevin Diakiw FOUR OF the police’s Top 10 Most Wanted car theft suspects have been arrested – two of them having turned themselves in because they couldn’t take the stress of being on the list. On March 15, 43-year-old Mark Winston Berry went to the Surrey provincial courthouse. On March 22, 42-year-old Todd Joseph Savoie also turned himself in at the courthouse. On March 15, 34-year-old Kevin Michael Beech was arrested in Whalley by the Integrated Municipal Provincial Auto Crime Team (IMPACT), The Surrey Auto Crime Target Team and the Surrey RCMP Neighbourhood Liaison Unit. On March 24, 32-year-old Million Gerbe Radia was arrested at the Boulevard Casino in Coquitlam after security staff recognized him from the published Top 10 Most Wanted list. The following men are still at large: • Mark Winston Berry, a 43-year-old wanted by Surrey RCMP for two counts of possession of stolen property. He’s had 25 Criminal Code convictions since 1988. He is considered extremely dangerous. • Lawrence Jordan Brown, 21, wanted by the Penticton RCMP for a breach of undertaking and breach of probation. He is considered violent,

armed and dangerous. • Christopher John Bursey, 22, wanted by Abbotsford police for possession of stolen property, theft, possession of break-in instruments and unlawful use of ID. • Lawrence Peter Myers, 36, wanted by the Ridge Meadows RCMP for breach of probation. • Michael Allan Deyoung, 25, wanted by the New Westminster police for theft, possession of stolen property and breach of undertaking. It’s his second consecutive year on the Top 10 Most Wanted list. He should be considered violent. • Clint Warren Rose, 35, wanted by Abbotsford police for breach of recognizance and driving while prohibited. • Joshua Trevis Bird, 32, wanted by Surrey RCMP for possession of stolen property, driving while suspended, and failure to appear. The above warrants, except for the breaches, have not been proven in court. IMPACT is once again asking the public to call their local police if they know the whereabouts of any of the six remaining wanted car thieves or to call Crime Stoppers at 1-800-222-8477 (TIPS) if they wish to remain anonymous.

A 70-YEAR-OLD heritage tree in Surrey is one step closer to the saw’s blade. Last Wednesday, Surrey’s Heritage Advisory Commission endorsed a staff report calling for the removal of a Royal Oak, planted near 32 Avenue and 152 Street in 1939 for a king’s visit. The now-15-metre (50-foot) tree stands in the way of road improvements. Reasons cited in the report for recommending its removal include the costly task of moving the tree for $100,000, which would only give it a 50-per-cent chance of survival. Complicating matters is a large fiber optic cable, connecting Vancouver with Seattle, situated near the root ball.

However, the real fuss over the existing tree goes back to its historical roots. Back in 1939, in celebration of the coronation of King George VI, England sent Royal Oak seedlings to all Commonwealth countries, including Canada. Many arrived in Surrey and they were planted along the newly renamed King George Highway. The tree in question is one of them. Instead of moving the Royal Oak, staff are planning to plant a large tree (13-15 centimetres wide at breast height) of the same species nearby. In addition, Surrey parks’ staff have been collecting acorns from the original trees and plan to plant 50 Royal Oak seedlings along King George Boulevard and another 50

throughout the city. The wood from the existing tree will be used to create commemorative sign boards and benches. Jim Foulkes, a former member of Surrey’s Heritage Advisory Commission, said Friday replacements aren’t good enough. Foulkes, also a director of the Surrey Historical Society, notes that the trees won’t be planted in an evenly spaced line like they were in 1939. “It means nothing to me,” Foulkes said. He believes the road could be realigned around the existing tree for a few thousand dollars. The plan to remove the tree will now go to city council for consideration. kdiakiw@surreyleader.com

The health authorities have also warned anesthesiologists that they can be found in breach of their contracts if they withdraw service and they could be sued for any extra costs incurred by the health care system. Health authorities sent out 3,237 letters to patients last week warning their surgeries may be rescheduled, with 1,105 patients in Fraser Health receiving the advisory. Patients most likely to be affected by any future job action are ones awaiting non-urgent procedures such as hip or knee replacements and cataract surgeries. All emergency and urgent surgeries, including urgent joint replacements and cardiac or cancer-related surgeries, will not be affected. The BCAS said its planned slowdown would be comparable to staffing levels health authorities deal with at Christmas holidays. Anesthesiologists are trying to pressure the province to allow their

society to bargain separately, rather than under the umbrella of the B.C. Medical Association, which they say does not represent their interests. The BCAS, which represents some but not all anesthesiologists, gave notice three months ago of its threat to withdraw service if the dispute was not settled. The society had said most of the 250 anesthesiologists in the Lower Mainland or on Vancouver Island were poised to cut their hours 30 per cent, affecting all Fraser Health hospitals. Health Minister Mike de Jong previously accused the group of holding patients hostage in a bid to win higher wages. The province says anesthesiologists make about $340,000 a year with almost none of the overhead expenses of other doctors, and that their pay levels have climbed 36 per cent over the past decade, compared to 22 per cent for general practitioners. De Jong called the threat of a service withdrawal “unprofessional” and referred the matter

to the B.C. College of Physicians and Surgeons for possible disciplinary action. Rains said any attempt by the province to intimidate or punish anesthesiologists would only backfire by worsening surgery waits and making new anesthesiologists less likely to move to B.C. “Removing people’s licences? Crown: Did not approve charges From page 1 According to police, Woodruff claimed he attacked and killed the 110-pound Batke in selfdefence after she swung a bat at him and that she died from her injuries. He then reportedly concealed her body such that her remains would never be recovered, said police. With only Woodruff ’s confession – five years after Batke’s death – and no evidence or witnesses, Crown prosecutors were not convinced they could win a murder or manslaughter conviction and did not approve charges. “While the Crown might have proceeded on a charge of offering an indignity to a human body, the Crown chose not to pursue such a charge,” Crown spokesman Neil Mackenzie told CBC. Sgt. Jennifer Pound, spokesperson for the Integrated Homicide Investigation Team (IHIT), said despite the lack of charges following Woodruff ’s confession, the investigation into Batke’s death remains open. Lorne Batke said he and his family have lost faith in the police and justice system, Sgt. Jennifer adding feels his sister’s life has Pound been deemed worthless. System fails victims

T

here are many cases before the courts that leave one flabbergasted at the lack of justice being meted out. Child sexual abusers receiving mere months in jail for ruining lives; house arrest for dangerous driving causing death. Then, there are those crimes that will never see the inside of a courtroom, such as drunk driving charges being tossed due to trial delays, or no charges being pursued despite a confession of murder (in which Jack Woodruff told police he strangled Surrey’s Karen Batke). The power of these examples to infuriate is just as great as impotent punishment. Such is the situation involving 80-year-old Gerald McDonald. Last year, the North Delta grandfather died just two weeks after a vicious attack at his home. The octogenarian was badly beaten with baseball bats wielded by a group of people intent on inflicting property damage following a verbal altercation with McDonald’s son. Two weeks later, McDonald was dead from a heart attack and a B.C. coroner makes no bones about linking the two events. Coroner Kate Corcoran listed the cause of death as “homicide.” She also said that “considering the facts of this investigation, it is reasonable to conclude that the September 20, 2011 assault was the cause of the cascading events that led to Mr. McDonald’s demise.” So those responsible for the assault will be held accountable for the results of their actions, right? Wrong. According to the B.C. Criminal Justice Branch, only the findings from an autopsy can be used to consider homicide charges. In McDonald’s case, the autopsy report makes no link between the attack on the senior and his death. This alone would be extremely difficult for McDonald’s family to come to terms with. But then this sucker punch: Assault charges in McDonald’s attack are also not being considered. Apparently, Crown counsel does not believe it has enough evidence to win a conviction. Bats, a beating, and a black-and-blue victim. What other evidence would be required? An often-used legal quote (attributed to Lord Chief Justice Hewart) notes that “justice should not only be done, but should manifestly and undoubtedly be seen to be done.” For Gerald McDonald, our system has failed miserably on both counts. – Black Press

Conservative leader John Cummins made a bold prediction that he would have party status before the general election in May 2013. That’s four seats, and it wasn’t based on an unlikely sweep of the Chilliwack-Hope and Port Moody-Coquitlam by-elections, now set for April 19. He hinted he was getting calls from MLAs looking to join up, after a November Angus Reid poll showed a sudden surge to 18 per cent for his resurgent brand. We now know that one of those callers was Abbotsford South MLA John van Dongen. I asked Cummins on Friday if he is still confident about three more. “Hopeful, let’s put it that way,” he replied. Van Dongen’s explosive departure was arranged, with Cummins’ help, for maximum damage to Premier Christy Clark. Van Dongen notified the B.C. Liberal caucus that he was quitting. Then, in a questionable use of legislature privileges, he launched a broadside on Clark’s integrity.

His aw-shucks friendly-grandpa modesty precludes speculation, but he did allow it’s “maybe a comment on the state of affairs in the Liberal caucus.” Reporters started surveying government MLAs after Falcon and Abbott kept their options open for 2013. For the record, fellow ministers Terry Lake, Shirley Bond, Pat Bell, Mary Polak, Rich Coleman and Stephanie Cadieux all said they are firmly on Clark’s election team. Independentminded backbenchers Bill Bennett and Kevin Krueger also saluted the B.C. Liberal banner. Randy Hawes allowed that he’s 65, so if he leaves it will be for the golf course. As I was talking with Cummins, B.C. Conservative advisor Randy White was assuring the Abbotsford News that more defections are coming. Cummins has people for the dirty work. We got rid of the architect of this catastrophe, Gordon Campbell, and now his mini-me clone Falcon has seen the writing on the wall as well. All I can say is it’s a good start. No need to feel sorry for any of them. With all the favours they have given business over the last decade, they will one and all without a doubt slither seamlessly into a lucrative corporate gig where they can lick their wounds, and drown their sorrows with martinis, contemplate where they went wrong, and wait till the voters’ brief and selective attention span can absolve them of all their sins and boondoggles. Then they will reinvent themselves and come bouncing back into political life to save us from the evil socialists once again. Isn’t politics grand?

Sending a message JOHN VAN Dongen, the brandnew Conservative MLA from Abbotsford-South, did not use political double-speak when giving his reasons for leaving the B.C. Liberal Party. He pointed his finger of recrimination directly at Christy Clark for her incompetent attempt to play the role of a provincial premier. Meanwhile Kevin Falcon and George Abbott are now musing aloud about not running in the next election. But both are being calculatingly careful not to offend any Clark supporters. Their sudden disenchantment with politics seems opportunistic. Not long ago they were running for the leadership of the B.C. Liberal Party. Unfortunately for them (and the party), they ended up second and third respectively behind Clark. Both Falcon and Abbott are using political double-speak to send the same message to the Liberal back room powerbrokers: Get rid of Clark and I’ll stay, because I want to be the next premier of British Columbia. Leader, March 27. Does the depth to which the criminal justice system in this province sinks know no bounds? Not only are the individuals (with at least one girl amongst them) not going to be charged with manslaughter, but they’re not even going to be charged with assault. Am I missing something here, or does the system really stink that badly? Then to add insult to injury, the granddaughter of the deceased was told that he shouldn’t have gone outside when the rabble appeared on his property and proceeded to vandalize two cars with baseball bats. That was hardly the activity of anyone not bent on criminal intent. I’m assuming that it’s still a crime to vandalize someone else’s property. They certainly couldn’t claim that they were on their way to a baseball game and mistook the vehicles for large baseballs. All I can say is that the vandals involved in that bit of criminally sociopathic activity can thank their lucky stars that I’m not in charge of criminal justice in this province. Cloverdale Learning Centre can’t believe a popular, successful job training program for at-risk youth is coming to an end. Last week, a few of them joined participants and supporters of the Baristas Skills Link Program as they gathered for a final farewell at the Guildford Youth Resource Centre. It’s an untimely wrapup for an award-winning program that was held up as a model by B.C.’s business community and helped brew job success for hundreds of youth in Surrey, Cloverdale and Langley over the past decade. Offered through Pacific Community Resources Society and Starbucks Coffee Canada, the Baristas Skills Link Program was a unique partnership between a social services agency, the private sector, the Surrey School District and the federal government. The agency is at a loss to explain why the federal government has decided it will no longer support the program. It was designed to give students like Cloverdale’s Paige Ferguson, 18, and Langley’s Dain Leguerrier, 17, a foot in the door of the labour market by helping them overcome barriers to employment. They completed the program last week as part of the final intake. Both are disappointed to learn the program won’t be continuing. Participants go through an intensive, sixweek life skills program, followed by a nine-week, paid work placement at Starbucks, where they are treated like any other employee and held to the same expectations. “We are trained and treated like any other barista,” Leguerrier said. Now that he’s completed the program, he’s re-applied to work at Starbucks while he continues his studies at Cloverdale Learning Centre. “I think I look at myself and others in a completely different way,” he said. “I have a new outlook on life, my goals, self-definition, selfdiscipline, and how to go about getting employment.” Susan Johnson, the career development facilitator at Cloverdale Learning Centre, said the baristas program went

The society receives roughly 70 to 80 applications per session. With only 10 seats available at a time, some 195 youth are turned away each year. “It’s frustrating,” Pires said. “There’s going to be a lot of people looking for services that just aren’t available now.” She praised Starbucks for standing up for the community’s youth and sticking with the program over the years. “Starbucks just provides a really open, non judgmental environment for them to learn. That’s been huge. They’re really working with our youth. A lot of employers aren’t willing to take a chance.”

Lowry and Anne MacKenzie denied the convictions appeal after a short hearing Wednesday, ruling the trial judge did not err in considering the testimony of four witnesses as similar-fact evidence. A date for the sentencing appeal has not been set. The penalty was imposed last March after a jury found Greenhalgh guilty of three counts of sexual assault and one count of breach of public trust, following a trial in which three women testified he touched them inappropriately during strip searches he conducted in a men’s washroom and other places. A fourth woman said she was made to strip, but was not touched. The incidents occurred in 2007 while Greenhalgh was on duty, and involved victims aged 19 to 30. Wednesday, Greenhalgh’s lawyer Derek Birch argued the fact that all four women’s evidence was considered as similar-fact “resulted in an unfairness to Mr. Greenhalgh in the trial process.” He noted one witness was impeached at trial, after conceding she hadn’t been truthful about discussing her evidence with a friend – who was also a witness – between the preliminary hearing and the trial. Crown Susan Brown disputed the arguments, arguing the trial judge “very thoroughly” addressed the issues, and that the jury wasn’t asked to consider the two women’s testimony together. Bennett noted the trial judge found the evidence of all four women “reasonably capable of belief.” Throughout the trial, Greenhalgh maintained his innocence. His lawyers at the time described the penalty – which also included three years probation, a 10-year firearms prohibition, a $400 victim surcharge and an order to provide a DNA sample – as “stiff ” and said Greenhalgh would apply to have the verdict overturned. Greenhalgh has served nine months of his sentence. Released on bail in December, he was remanded Wednesday before the hearing, and will remain in custody pending his sentencing appeal. tholmes@peacearchnews.com

100 on March 28. But the longtime City of Surrey employee hasn’t felt better in his life. Last Wednesday, Wilson gave his 100th pint of blood at the Surrey clinic of Canadian Blood Services. Always wanting to give back to his community, Wilson, 57, started donating blood more than 35 years ago. The Eagles, who split the first two games in Powell River – they won Game 2 by a 2-1 score Wednesday – dropped Games 3 and 4 at South Surrey Arena on the weekend, losing Friday 4-3 and Saturday 2-1 in overtime. They trail the series 3-1. Game 5 was played Monday night in Powell River after press deadline. Surrey had the chance to even the series 2-2 Saturday, after forward Sean McGovern scored with just 3:03 left in the third period, tying the game 1-1, and sending it into overtime. But the extra period ended quickly, as Kings’ Cohen Adair scored the game-winner just 1:12 into extra time. J.P. Villeneuve scored Powell River’s first goal of the game, at the 2:09 mark of the first period. Powell River netminder Sean Maguire was the headliner for the visiting squad, turning away 48 Eagles’ shots. His counterpart in the Surrey net, Andrew Hunt, made 34 saves. A day earlier, the Eagles nearly pulled off a successful comeback after falling behind 4-0 after just 20 minutes. Spring is upon us, the Northern hemisphere is tilting towards the sun, blossoms are bursting, bulbs are erupting, and we look forward to our first real holiday since Christmas. Like spring, Easter celebrates rebirth and renewal, and all things sweet and chocolate. Everywhere you look there are colorful eggs, bunnies, marshmallow chicks and spring flowers. Hard to believe but about ninety million chocolate bunnies and 16 billion jelly beans are produced for Easter each year. Here are some more things you may not have known about our favorite spring holiday. The tradition of giving eggs at Easter time has been traced back to Persians, Egyptians, Gauls, Greeks and Romans, to whom the egg was a symbol of life and rebirth. Easter is named after Eastre, an Anglo-Saxon goddess. The symbols of the goddess were the hare and the egg. The traditional act of painting eggs is called Pysanka which origininat from the Ukranian word pysaty, meaning, to write. Easter is a truely movable feast and has different dates each year, but always falls between March 22nd and April 25th, on the first Sunday following the full Moon (the Paschal Full Moon) after 21st of ...continued March.
