Coroner says beating led to death of North Delta senior

directly links an assault on Gerald McDonald to his subsequent death, the people involved in last year’s altercation won’t be charged with causing the 80-year-old’s demise. And no charges of assault in the senior’s beating will be laid. The violence began Sept. 20, 2011 in the 11700 block of 95A Avenue in North Delta, when 48-year-old David McDonald took his three Jack Russell terriers for a walk. A pair of teens Gerald heading down McDonald the road in the opposite direction fanned out, forcing McDonald and his dogs off the road. McDonald said, “Hey, would it hurt you guys to show some common sense and share some of the road?” Soon after, four people appeared at McDonald’s home. to collect full pay from the RCMP after being convicted of obstruction of justice. RCMP Assistant Commissioner Norm Lipinski told a press briefing in Surrey Friday the commanding officer for the RCMP is seeking Robinson’s dismissal, but added Robinson is entitled to “due process.” Lipinski also said in light of the judge’s decision, the Mounties will be launching their own obstruction of justice investigation. A code of conduct investigation is already
underway, and Robinson still faces internal RCMP allegations of disgraceful conduct for operating a motor vehicle while impaired, failing to remain at the scene, and failing to render assistance. On Friday in B.C. Supreme Court in New Westminster, Robinson was found guilty of obstructing justice in connection with a road accident that claimed the life of a young Tsawwassen motorcyclist. Robinson was off-duty when his Jeep collided with 21-year-old Orion Hutchinson’s motorcycle at the intersection of Sixth Ave. and Gilchrist Dr. in Delta on Oct. 25, 2008. Following the accident, Robinson gave his driver’s licence to a bystander and left the scene to walk his two children home. Upon his return, he told police he had downed two shots of vodka at home to calm his nerves.

Coroner: Death a homicide From page 1 McDonald and his father Gerald came out of the home and confronted the group. The family says a 16-year-old girl punched the octogenarian in the face, and he responded by hitting her. And that’s when the bats were turned on him. He was beaten badly on the arms and lower body. Two weeks later, McDonald was dead from a heart attack, and a B.C. coroner makes no bones about linking the two events. Coroner Kate Corcoran listed the cause of death as “homicide.” She also said that “considering the facts of this investigation, it is reasonable to conclude that the September 20, 2011 assault was the cause of the cascading events that led to Mr. McDonald’s demise. “Simply stated: but not for the altercation and resulting physical injuries, Mr. McDonald would very likely not have died when he did.” However, when laying charges, the justice system must rely on an autopsy report, which does not agree with Corcoran’s assertion that the two events were linked. Samantha Hulme, spokeperson for B.C.’s Criminal Justice Branch, told The Leader homicide charges will not be considered because the autopsy report makes no link between the attack on McDonald and his death. Assault charges in McDonald’s beating are Hailey also not being McDonald considered. Through police interviews with witnesses and other evidence gathered, Crown counsel believes it does not have enough evidence to forge ahead with assault charges. However, Gregory Smithies, 52, who was one of the people allegedly involved in the melee, has been charged with assault with a weapon and possessing a weapon for a dangerous purpose after allegedly going after one of the neighbours who was standing near the fight. McDonald’s granddaughter Hailey McDonald said there’s been a terrible miscarriage of justice. She has filed a complaint with the Police Commissioner’s Office against the Delta Police Department. In a meeting with police and Crown, Hailey said she was told her grandfather shouldn’t have gone outside. “Well hindsight is 20/20,” Hailey said. “Obviously, in retrospect, if I could redo that day, obviously he wouldn’t have gone outside. In my mind, it doesn’t justify anything that they did.” The family is trying to get another jurisdiction to investigate the case. “My grandfather didn’t do anything except go outside that day,” Hailey said.

Dillon concluded Robinson knew he minimized the amount of beer he had consumed at a Halloween party prior to the crash; he initially told police he had a couple of beers, and later admitted to drinking five. Dillon said Robinson’s actions were “willfully designed” to set up a drinking-and-driving defence he had learned in police training. During the eight-day trial, which concluded Feb. 22, defense witness Dr. Paul Sobey testified Robinson had “severe” alcohol dependency at the time of the collision and his use of alcohol after the accident was consistent with alcohol dependency. But Dillon said she found Dr. Sobey’s medical evaluation unreliable and gave his report “little weight” in her conclusions. The final decision was met with an outpouring of emotion from Hutchinson’s family. “This doesn’t bring my son back, Judith but there is definitely a sense of Hutchinson satisfaction just hearing that very strongly worded word ‘guilty,’” Orion’s mother Judith Hutchinson told media. “At this point we can go forward knowing that he will be held accountable, at least somewhat, for his actions, which hitherto has not been the case. “If he had walked away and the verdict had been not guilty, in terms of just emotional survival, I Orion don’t know if I could keep going,” Hutchinson she added. Judith would not comment on her hopes for the sentencing, but said she would like to see Robinson stripped of his RCMP badge. “The RCMP should immediately suspend him without pay and then terminate him, and do an internal investigation of their own – which should have been done two years ago.” At the Surrey press briefing, the RCMP’s Lipinski took time to apologize to the Hutchinson family. “I can only imagine how difficult this process has been for the family of Orion Hutchinson,” Lipinski said. “On behalf of the RCMP, I wish to express our sympathy and sorrow for what they’ve gone through and what they continue to go through.” Crown prosecutor Kris Pechet said he is hopeful the conviction gives some comfort to the Hutchinson family. He would not comment on sentencing. Pechet said there is a potential for jail time, and the maximum penalty the law allows for an obstruction of justice conviction is 10 years. But he will have to review the judge’s decision before taking a position. “The factors will include, of course, the fact that he is a police officer and in some respects in a position of trust,” Pechet said. A sentencing date will be scheduled on April 4.

spent six times as much as its opposition party on its run for city council last November, and it paid off. Surrey First won all nine seats on city council. By contrast, the Surrey Civic Coalition (SCC) spent just $103,230 on council candidates in the last civic election. The figure works out to $12,903 per candidate. The SCC did not run a mayoral candidate, so there were some cost savings there. SCC poured most if its financial resources into four candidates – Bob Bose ($29,920), Stephanie Ryan ($23,486), former Surrey councillor Gary Robinson ($17,626) and Doug Elford ($17,446). SCC candidate Rina Gill outperformed all party colleagues except for Bose, yet the SCC spent just $4,826 on her campaign. And candidate Steve Wood received more
votes than Robinson, for a cost of only $2,476. SCC’s per-candidate funding for council was less than what the party spent trying to get an SCC member on the Surrey Board of Education, perhaps because some of the incumbent seats for school trustee were up for grabs. The only successful SCC candidate was Charlene Dobie, who rang up $22,020 in expenses. That’s 26 per cent of the $82,699 the party spent seeking school board seats. The party that almost swept school board – Surrey First Education – spent $55,110. Candidates in last November’s election had until March 19 to report their campaign contributions and expenditures. Only Gill 22, who is in jail, failed to file his disclosures. As The Leader reported last week, Surrey First spent $676,283 in total on the civic election. Tunnel vision needed
A
s if commuters needed a reminder, the traffic chaos in and around the George Massey Tunnel earlier this month emphasized that action needs to be taken to relieve congestion on that route. Built more than 50 years ago, the link under the south arm of the Fraser River is a major irritant to those making the daily drive during peak hours. It’s also a safety concern as large volumes of vehicles – about 85,000 – travel along the four lanes each day. And when an accident or two – like the pair during the March 13 morning rush hour – disrupts the flow, it has serious ramifications. Traffic came to a virtual standstill along Highway 17 for about an hour. The back-up stretched nearly as far as the 56 Street intersection. Much of that crawling along the highway was composed of container trucks, which speaks to lost productivity and the need for the South Fraser Perimeter Road. But that route is not scheduled to come into use until 2013. Even then, the commuter traffic heading to the tunnel, from Highways 17 and 99, is not expected to decline drastically any time soon, meaning line-ups will more than likely continue to be the norm. Therefore, suggestions such as installing a right lane on the north side of the tunnel in Richmond where a visitors’ information booth now stands is one worth a serious look. It may just help funnel the streams of vehicles a little quicker through the “tube” and ease congestion a bit. Right now, that’s the only alternative, given the provincial cupboard is bare and money for another crossing over the Fraser River from Delta is unlikely in the near future. Sure, there’s talk of tolling many routes across the Lower Mainland to help pay for improvements. And while that may gain a foothold with the travelling public weary of daily traffic snarls, it would have to be a fair and low-cost figure with the assurance of a tangible future benefit. That may just be the light at the end of the tunnel. But right now, its colour is too often red. – Black Press

oth NDP leader Adrian Dix and his education critic Robin Austin have recently tried to sell the media a fictitious story about the party’s successful history of negotiations with the B.C. Teachers’ Federation. With the ritual combat between the BCTF and the B.C. government flaring once again in early March, Dix bragged to reporters that the last time he was involved in teacher talks, it resulted in a 0-0-2 wage settlement. That was in 1998, when Dix was working for then-premier Glen Clark. The real 1998 story is useful, because then as now, the B.C. government was in a financial squeeze and looking at a huge set of negotiations with government unions in health and other sectors as well as education. Glen Clark, an ex-industrial union organizer, was known for pushing negotiators aside and taking control of hot files. The premier’s office took the lead in teacher talks, trying to set a strong precedent for low wage settlements similar to today’s

ince replaces staffing level bargaining with “an equivalent process of good faith consultations or negotiation, then the legislation might not be an interference with freedom of association….” Bill 22 was written with this decision in mind, reasserting the government’s control over the payroll with a $165 million fund for special needs and a mediator to demonstrate those “good faith consultations.” University of Victoria business professor Ken Thornicroft noted last week that ceding control over class size to the union amounts to delegating authority over spending to someone who is not elected. The legality of that will no doubt be examined in the BCTF’s next courtroom assault on the provincial treasury. It’s an important comparison for voters. Which party is better able to represent the public interest in hardball negotiations with 300,000 unionized employees? BCTF statements misleading THE B.C. Teachers’ Federation is a
belligerent union. It continues to mislead the public with outlandish pronouncements and demands. Let’s take the issue of mediation in the current dispute. When it became clear to the BCTF that the government isn’t going to budge from its net zero decree, it started asking for a mediator. A mediator’s job and success is measured by coming down somewhere in the middle to conclude an agreement. When the government agreed and it became clear to the BCTF that net zero still applies, they started ranting against this mediation. Why should BCTF be exempt from net zero when other major public sector unions have signed on? The province cannot afford more than net zero under the reality of its deficit. The province, i.e. the taxpayers of British Columbia, are making interest payments on the borrowed money. The government wants to pay off that debt first. Do you like making interest payments on your credit card? If getting a wage increase is so important to the BCTF, they can trade in some of their less used, but ample benefits. Also, as for wage hikes it is not that no teacher is going to get a wage hike. All those on the step scale will automatically be getting wage hikes. I respect teachers. I understand the majority of the public does too. I submit that the BCTF, with its constant war-like stance, is not doing itself any favours. But the BCTF views respect differently. One, the BCTF wants the government to meet its demands for wage and benefit hikes, and two, it wants to have the sole control of education policy. Regional tolls would be unfair SURREY MAYOR Dianne Watts’ vision for
broader tolls is, if we were to be realistically speaking, unfair in itself. Mayor Watts makes a good point about needing to avoid penalizing a certain region by making them pay the most tolls to cross a certain improved bridge. However, tolling bridges across the region is hardly fair and equitable. Tolls re-finance the capital costs of a road expenditure project such as a road or a bridge; they are not a revenue source for anything else. If they were a revenue source for anything else, the toll booths on the Coquihalla Highway would still be standing. If we were to toll, say, the Second Narrows
Bridge to pay for new bridges that just so happen to be links from Surrey and area but have regional importance, that would be unfair for those in the region. Because I’m willing to bet that a large amount of the traffic crossing the Second Narrows Bridge also does not cross other bridges in Surrey. People in Vancouver and elsewhere would be paying for a bridge that they would not use often and does not significantly benefit them in any way. That would be unfair. I would rather see more creative ways of raising money to recoup the capital costs of the new bridges that may tower over Surrey over the next few years.
For example: Mayor Watts should be advocating for decreased tolls for local vehicles entirely and increased tolls for commercial vehicles and goods movement. If the need to accommodate increased regional goods movement – such as through the South Fraser Perimeter Road (in the case of the Pattullo Bridge) – is one of the big reasons we need to construct new bridges, then those parties responsible for goods movement should be paying more to re-finance the capital costs of the new bridges than the citizens of the communities nearby.

Perhaps Mr. Minter can write a column on how to encourage healthy moss growth – although, I assume the opposite of everything he suggested for grass would help. With moss, one need not worry

If government has decided to audit the books of TransLink, then perhaps they should turn their attention to this incredible waste of taxpayers’ money in one of their own departments. To be gushed at so effusively for a career which ended 16 years ago makes me wonder why. Is it because they are running scared after the passage of Bill 22? Are they looking for support from the tens of thousands of us who make up a large percentage of voters who actually vote? Whatever the reason, this mailout is a criminal waste of money for a provincial government which is supposedly watching its bottom line and makes me even more determined to be at the polls in 2013. Delta road improvements money well spent RE: “DELTA’S spending hurting
pocketbooks,” Letters, The Leader, March 8. The author of this letter should have done more research on this issue. This road alignment project has been in the pipeline for a while. All residents in the vicinity have been kept informed by Delta’s engineering department. It was long overdue and something
needed to be done for the safety of pedestrians, children and cyclists. More than 10,000 vehicles race through this intersection – 72 Avenue and 116 Street – every day, thereby making it the most dangerous and unsafe intersection in North Delta. These vehicles are mostly from Langley, Cloverdale and Surrey. They speed, run red lights, block the intersection and in rush hour,
these drivers illegally use bus lanes to jump the line-up. It is the responsibility of our council that residents have a safe and secure way of crossing the roads, driving, cycling and maintaining road infrastructure. That is why municipalities have capital expenditure budgets. If the letter writer has the energy, I suggest she lobby council and start a movement to stop re-
zoning of these ugly mega-homes that are sprouting up in North Delta on almost every corner. These homes are so big that several families live in them with several cars and illegal renting of the suites. The homes have also brought crime to North Delta, which soon will look like Newton.

for Surrey’s new expanded corrections centre. B.C. Minister of Justice and Attorney General Shirley Bond said the 216-cell expansion at Surrey Pretrial Services Centre will be complete, on time and on budget, in 2013, and it will be the largest corrections centre in the province. The $90-million expansion will create between 200 and 250 jobs during construction and will provide 130 new corrections positions upon completion. During a stop at the construction site Thursday morning, Bond said that new stateof-the-art security systems mean the facility will provide a safer operating environment

Rabbit relocation wraps up Delta bunnies moved from municipal hall area to Ladner Harbour Park by Christine Lyon LADNER HARBOUR Park has
close to 275 new cotton-tailed residents that have moved in under the municipality’s feral rabbit management plan. “We’re just wrapping the program up now,” Chief Administrative Officer George Harvie told The Leader on Wednesday (March 21). “There’s a notable reduction (in rabbits) here in the civic precinct,” he added. In January, Delta council approved the rabbit management plan that saw the population of bunnies in the municipal hall area – originally estimated at 500 – captured, sterilized, identified and released at Ladner Harbour Park. Municipal staff hoped the $60,000 program would put an end to the property damage, and health and safety concerns posed by the fast-growing rabbit colony – a result of generations of abandoned pets.

Nearly 275 feral rabbits have been relocated in Delta. “It’s gone extremely well, and we’re probably about half of our budget used,” Harvie said, adding about 10 of the captured bunnies have been adopted out through the Delta Community Animal Shelter. But one South Delta resident is concerned about the
welfare of the rabbits in their new environment. Tsawwassen’s Ursula Easterbrook says she has heard reports from other residents who claim to regularly see dead rabbits at the side of the walking path. She says the deaths don’t appear to be the result of predation. “If a coyote had attacked them, they wouldn’t be there,” Easterbrook said. “And eagles wouldn’t drop them like that.” She says some community members believe rabbits are dying as a result of the relocation. “They’re starving. And if they’re not starving, they’re having extreme stress because rabbits get very, very stressed,” Easterbrook said. But Harvie said municipal staff visit Ladner Harbour Park at least twice a day and have not seen dead rabbits. He said the rabbits have been receiving outside food, but are being gradually cut off so they forage for themselves.
“I’ve been there myself on the weekends. You see very few (rabbits). They’ve adapted very well to the natural harborage there,” he said. Harvie said staff have received many letters from people asking why the rabbit population wasn’t simply culled. “But we really believe our recommendation, in support by council, was the right thing. And we had a tremendous amount of emails from all over the world with regards to supporting what we did,” he said. Harvie said the relocation plan has been well received by parents at Ladner Leisure Centre, who worried about their children chasing rabbits into the nearby parking lot and street. If any rabbits return to the civic precinct, Harvie said they will be picked up and taken to the animal shelter for adoption. reporter@southdeltaleader.com

The juice is supplied by a 24 kW-h (kilowatthour) lithium ion battery (made of 192 individual cells) under the seats, which should have the car run anywhere from 100 to 160 kilometres under regular conditions. To save power, there are accessories such as heated front and rear seats and a heated steering wheel to reduce the need to use the car’s heating system. He also programs the heat in the vehicle to turn on every weekday at 7 a.m. “That’s using the power from my house, not the power from my battery,” he explains. Carmichael uses an iPhone app called CARWINGS to remotely manage and control the vehicle’s charging and check its status. There’s little maintenance to do: Tire rotations every 12,000 kilometres and a general check-up every year, along with a change of brake fluid. (The only other fluids are water used in the interior heating system and windshield washer fluid). Carmichael says he’s calculated the cost of eventually replacing the battery when it starts to wear down in several years. There are 50 kilograms of lithium in it that can then be recycled and sold, perhaps taking the sting off of the cost of a new battery, which could exceed $7,000. Carmichael will be on hand on a couple of evenings and during the weekend at the Vancouver International Auto Show at B.C. Teachers to vote on strike action by Tom Fletcher THE B.C. Teachers’
Federation is going back to court to challenge the legislation that has put an end to its latest strike action, but teachers will be back on the job now that spring break is over. At a news conference in Vancouver Wednesday, BCTF President Susan Lambert announced that union members will take part in a province-wide vote on April 17 and 18 to decide if they will withhold voluntary extra-curricular duties to protest Bill 22. The legislation gives the provincial government the authority to impose heavy fines for strike action during an imposed six-month cooling-off period. A second member vote would have to be held with majority support before the union approves any strike action that would defy Bill 22 and trigger fines of $1.3 million a day for the union and $475 a day for individual teachers. Year-end report cards will be completed to allow students to apply for scholarships and post-secondary education, Lambert said. Lambert appeared to rule out any further work-to-rule action as students return from spring break, but she left the door open for individual districts to begin immediately withholding voluntary extracurricular duties such as coaching that are done outside of school hours. “We’re a federation of autonomous locals, and yes, they will be making their own decisions,” Lambert said. Bill 22 goes beyond forcing an end to the strike that has had teachers refusing to complete report cards or meet with administrators since last September. It reimposes restrictions on class size and special needs support that a B.C. Supreme Court decision last year ruled were done without adequate consultation. Lambert said that will be a focus of new legal action. Education Minister George Abbott returns this week from a visit to China promoting educational exchange. Surrey Eagles advance to Coastal Conference final

third time’s the charm. The Surrey Eagles certainly subscribe to that cliche after a 3-2 overtime win over the Cowichan Valley Capitals Saturday night in South Surrey. Brandon Tanev’s marker, on a three-on-two rush at 3:42 of overtime, gave the Birds a 4-3 series win and a date with the Powell River Kings in the BC Hockey League Coastal Conference finals, which begin today (Tuesday). Saturday’s win was the Eagles’ third straight attempt to eliminate Cowichan. On Thursday in South Surrey, up 3-1 in the series, the Matt Erhart Eagles lost 2-1, and Friday in Duncan, with another chance to ice the series, they lost in overtime when goaltender Andrew Hunt - who’d been brilliant throughout the series - mishandled a puck that Caps’ Vinny Muto deposited into the net, giving Cowichan life for another day. Surrey had much better luck Saturday, although some of the 1,000plus Eagles fans in attendance could be forgiven for thinking the game might slip away. As they did in Thursday’s loss, Surrey nursed a one-goal lead for much of the game Saturday, but it only held until the final minute when Cowichan’s Brett Knowles tied the game 2-2 on a shorthanded goal, and sent the visitors into the

But the guys
weren’t worried. There was nobody saying, ‘oh, no, Game 7.’ They were excited for it, and to be playing at home,” Erhart said. “But the series was what I expected it to be, because both teams are so close. Even when we were up, I didn’t feel like we had
total control of it. “With overtimes, some bounces, some good goals, great goaltending… over seven games, this was quite a series.” Hunt was again the story for Surrey, earning first-star honours in the series-clinching win after
stopping 42 shots on net, including one big stop early in overtime. He finished the series with a 3.13 goals-against average – a number inflated due to small sample size and by allowing five goals in the Eagles’ 7-5 Game 4 win. “You don’t win in the playoffs without great goaltending. Over the course of a long series, there’s always a goal or two you’d like back, but he gave us a chance to win every single night,” Erhart said. Alex Hagen, who’d been held to a single assist in the first six games of the series, scored the Eagles’ other two goals. Steven Iacobellis scored Cowichan’s first, near the end of the second period. In Friday’s loss, Eagles’ rookie defenceman Devon Toews led the way with his first career hat-trick, and finished the series as the team’s leading playoff scorer with eight points in seven games. “He’s been really good for us, especially the second half of the season and into the playoffs. Even at 17, I think he’s one of the best defencemen in the league,” Erhart said. “Him and (Steve) Koshey, as a pair, played some big minutes for us. They were both great.” The Eagles only had two days to prepare for their next opponent, Powell River, who won the other Coastal semifinal 4-2 over the Coquitlam Express. The Eagles travel to Powell River for Game 1 tonight. Game 2 will be played in Powell River Wednesday, and the series shifts back to South Surrey for games on Friday and Saturday. This will be the second year in a row Surrey and Powell River have faced off the Coastal Conference finals. Last year, Powell won the series in six games. “There’s about 10 guys still here from last year, so this has a bit of a rematch/revenge feel for them, and we’re looking forward to getting after it,” Erhart said.

has agreed to join the University of Fraser Valley Cascades (UFV) men’s basketball team next season. The six-foot-eight post player will join the Cascades and play in the CIS (Canadian Interuniversity Sports) next fall. This past season, Dhaliwal averaged 15.8 points per game while pulling down nine rebounds per game and shooting 48.1 per cent from the floor, helping the Wildcats to a 10th place finish at the B.C. High School Championship tournament earlier this month. Fraser Valley placed second in the Canada West Conference, qualifying for the CIS national championships in Halifax two weeks ago, where they won one of three games.
