ner status in the B.C. Liberal leadership race, with at least 10 MLAs backing his bid to replace Gordon Campbell as party leader and B.C.’s next premier. He didn’t roll in on his trademark mountain bike or the excavator he once used to knock down the Coquihalla Highway toll booths. But the Surrey-Cloverdale MLA and former health minister – he resigned the post Monday night – had plenty of human props, including a crowd of more than 100 cheering and clapping supporters at the Tuesday morning announcement at the Surrey Museum in Cloverdale. “It is time for a new generation of leadership,” Falcon said, promising to listen, learn and “lead decisively.”
Criminal cases are being dismissed due to lengthy delays by Dan Ferguson A LACK of resources at Surrey Provincial Court
is causing a backlog of criminal proceedings that is forcing judges to throw out cases for lack of timely prosecution, one judge said last week. “There are not enough judges, court staff or sheriffs in Surrey,” said Judge Peder Gulbransen. “The backlog is so great and the courts so crowded, that in many cases there will be an unreasonable delay should there be even one adjournment on a trial date.” He said the problem has become “chronic.”
Gulbransen made the comments in his written reasons for judgment in the case of a man who was charged with impaired driving and refusing to give a breath sample on Oct. 13, 2007 but never stood trial because of repeated failures to get court time. As the man’s request, Gulbransen threw out the charges on Nov. 22 of this year, issuing a stay of proceedings due to excessive “institutional” delays. The judge said at least 25 months of the three-year wait was because of a shortage of court resources, more than double the acceptable eight- to 10-month institutional wait time allowed under Canadian court guidelines.
See LIBERALS / Page 3
In his written decision, which was published online Thursday (Nov. 25), Gulbransen said the number of days available to handle criminal cases in Surrey has steadily declined over the last five years. He said there are fewer judges to hear longer and more complicated cases because many judges have retired and have not been replaced. There are fewer sheriffs and court staff too, with the result that “it is not uncommon for there to be days when there are not enough clerks to staff the courtrooms,” Gulbransen said. Surrey businesses support higher pay Board of trade members want a higher minimum wage in B.C. by Kevin Diakiw SURREY BUSINESSES are calling for a higher mini-
mum wage in this province. Typically, business groups have opposed increasing the minimum wage, saying market forces determine an adequate wage. However, this city’s businesses are bucking that trend. The Surrey Board of Trade (SBOT) went to its 1,440 members last month and asked if they support raising the minimum wage in B.C. from its current $8 an hour, the lowest in the country. The SBOT membership voted 80 per cent in favour of lifting it to a more livable wage. The membership decided in October that workers deserve a wage more reflective of the cost of living in B.C., according Anita Patil Huberman, CEO of the Anita Patil SBOT. “Right now the minimum Huberman wage is at $8 (an hour),” Huberman said Friday. “We know from the membership poll that we took, that many businesses already pay above that, in the $10 to $12 range.” Huberman acknowledged that the call for a higher minimum wage is partly due to a desire for a more level playing field with businesses that might be getting cheaper labour. “That’s part of the equation,” Huberman said. “It’s about offering a competitive playing field for everyone, so then at least they start from the same basis point.”

Not many other boards of trade have taken a similar stance, except Victoria, which is also calling for a higher minimum wage. Huberman said she knows of no others.
The B.C. government has begun laying the groundwork for the first minimum wage increase in nine years. Labour Minister Iain Black said Thursday he has asked staff to consult with business and labour representatives over the next three months.
B.C. has both the lowest minimum wage and the highest cost of living in the country. New Brunswick raised its minimum wage from $8.50 to $9 an hour on Sept. 1 and will take it to $10 by next summer. Ontario has the highest mini-
mum wage in Canada at $10.25. It’s $8.70 in Prince Edward Island, $8.93 in Yukon, $8.80 in Alberta, $9.25 in Saskatchewan, $9 in Manitoba and Northwest Territories, $9.20 in Nova Scotia, $9.50 in Quebec and $10 in Nunavut and Newfoundland.

When that happens, he said clerks have to be borrowed from other offices, slowing up paperwork outside the courtrooms. Without clerks present to record testimony, file evidence, administer oaths and perform other important functions, a trial cannot go ahead. Gulbransen also released his reasons for staying charges in another drunk driving case in October, where the “institutional” delay was 18 months. Gulbransen’s comments come a few months after another Surrey judge complained the courthouse has been “notorious” for trial delays since 1997. In written reasons released in June, Judge Ellen Gordon said
it takes more than twice as long to get cases to trial in Surrey than other Lower Mainland courthouses. Gordon noted courthouses in North Vancouver and New Westminster are able to find trial dates within five to six months, unlike Surrey, where a routine impaired driving case took 13 months to get to trial. “While it may very well be that Surrey has fewer resources for number of charges sworn than other jurisdictions in Greater Vancouver, the Province has a constitutional obligation to provide those resources,” Gordon declared, pointing to a Supreme Court of Canada decision that states there is a point in time when the court

system “will no longer tolerate delay based on the plea of inadequate resources.” In 2002, the provincial government closed down the Delta provincial courthouse, adding Delta’s 2,000 adult and youth criminal cases to Surrey’s 13,000. That brought the total number of cases above the maximum the Surrey courthouse was designed to accommodate, a problem then-attorney general Geoff Plant said could be overcome through improved efficiencies. At the time the courthouse was closed, Delta Police Chief Jim Cessford warned cases would probably take longer to get to trial.

Watts wants Alexa’s Bus in Surrey Vehicle would provide roadside bloodalcohol tests on suspected drunk drivers by Kevin Diakiw MAYOR DIANNE Watts
wants Surrey to be the first community with a mobile blood-alcohol testing bus named after Alexa Middelaer. In May 2008, fouryear-old Alexa was killed by an impaired driver while the toddler was feeding horses roadside in Ladner. The tragedy galvanized a community against drunk driving. Alexa’s parents, Michael and Laurel, are spearheading an initiative to get five of the buses up and running in B.C. at a cost of $1.25 million. Watts said she wants Surrey to be the first city with Alexa’s Bus, a vehicle that will allow roadside testing of blood-alcohol levels. The cause is personal for Watts. Laurel is a principal

Alexa Middelaer at Southridge School, where the mayor’s daughters attend. “The kids at the school and the families really support the Middelaers
in everything that they’ve gone through,” Watts said Monday. Watts has committed $10,000 from this year’s Mayor’s Gala charity ball to go toward the cost of the buses. Laurel Middelaer told Black Press earlier this year the buses are a crucial addition to policing to ensure drunk drivers are caught and convicted. “We need to enable police with the best items they possibly have so they can collect the best evidence... to the letter of the law,” said Middelaer. Carol Berner, the impaired driver that caused Alexa’s death, received a jail sentence of 30 months in prison and a five-year driving prohibition. She was released on bail Friday while her lawyers appeal the conviction and sentence. kdiakiw@surreyleader.com

WEATHER
Winter: Get used to it
RAESIDE
L
ast week’s brush with snowy, cold weather was a stark reminder that despite living in the most temperate climate in Canada, the Lower Mainland is still a part of a wintry country. And we’re not very good at it. The chaos that ensues after a snowfall makes us the butt of jokes in the rest of the snow-encrusted country. Last week, weather forecasters warned in dour, doom-filled tones this was coming. As S-Day neared, they issued warnings, first for two to four centimetres, then five to 10. TV news crews rushed to local garages to interview mechanics booked to capacity installing snow tires. They descended upon works’ yards to shoot impressive mounds of sand and salt. Merchants in malls and shopping centres rubbed their hands in anticipation of an appropriately seasonal feel to the start of the Christmas shopping rush. And we responded, as anyone who popped into a grocery store for a loaf of bread may have witnessed from their spot 10 people deep in the checkout line; people were stocking up to hunker down and ride out the storm. Somewhere in Calgary, where it was minus 15C last Saturday with a foot of snow already on the ground, someone’s chuckling at our expense. Mother Nature gave us a pass last year. But climatologists say this is a “La Nina” year with a very active jet stream bringing us cold temperatures from the north and moisture from the Pacific Ocean. When they combine, that means snow. So we’d better get used to it. Meanwhile, in Toronto it was 14 degrees C and raining on Monday. Hmmmmm. – Black Press

hatchet job. Sloppy. That was the initial reaction from Kootenay East MLA Bill Bennett to my column last week on his noisy departure from the B.C. Liberal cabinet. Reviewing those events with Bennett and other sources, I realize I not only made a factual error, I missed a significant story about the end of Gordon Campbell’s leadership. Why did Bennett publicly break with Campbell, first to criticize his sweeping reorganization of resource ministries, and then to call for Campbell to go? Was he upset about losing responsibility for mining? Was this another hot-tempered lapse in judgment, like his insulting e-mail to a local critic that prompted Bennett to resign as minister of state for mining in 2007? No. It was a calmly calculated rebellion, a solo effort to push Campbell out before it was too late for the B.C. Liberal Party. I called Bennett a “political suicide bomber.” He prefers “change agent.” Step one was a carefully timed call to Vancouver Sun reporter Jonathan Fowlie to blast

got involved. Bennett said the intermediary was told some MLAs were prepared to sit as independents when the house resumes in February if Campbell was still premier. When Campbell announced he was stepping down, he gave no date. Bennett says he and other fed-up MLAs became concerned that Campbell might stay until the HST vote next fall, or longer. The party has since scrambled to reschedule its convention, change its voting structure to give rural areas a chance (Bennett says that too was his initiative, last July) and select a new leader on Feb. 26. Mission accomplished. • Correction: I wrote last week that Bennett prematurely disclosed a revenue sharing offer for the Prosperity mine. Provincial negotiators had made that offer privately more than a year earlier. My apologies. Donation Serving as MLA ‘for the right reasons’ honours a kind act RE: HE’S NOT the real Bill Bennett (B.C. Views,
TODAY I MADE a donation to the
Surrey Food Bank, partly because it is the time of year for giving but mostly to honour two people I don’t even know. On Monday Nov. 22, I lost my wallet with all the important cards and information we all carry with us each day. It was a stupid mistake on my part and very distressing when you think about identity theft being so prevalent today. Tuesday was spent cancelling cards and acquiring new ones, including a driver’s licence. It’s a big chore and difficult when you don’t have much to identify yourself with. Wednesday was a normal day, came home, ate dinner and went to bed early. My wife woke me at 10:15 p.m., there was an RCMP officer at the door and he needed to see me. He had my wallet, it had been turned into their office by an unidentified lady, he just needed to be assured that I matched the face on my licence. The wallet was completely intact, including the small amount of cash I was carrying. Though I don’t know who these two people are, I hope they will see this letter. I can’t say how much their good deeds mean to me but today I am paying forward their efforts by honouring a couple of outstanding Surrey citizens with this donation to the food bank. Thank you so much. My family and I wish you a very merry Christmas.
Nov. 24). Tom Fletcher’s hatchet job on Independent MLA Bill Bennett has no basis in reality. I am the past president of the Kootenay East B.C. Liberal Constituency Association and have worked on all three of Bill Bennett’s successful election campaigns. Fletcher obviously didn’t bother researching the 2009 election results. Bennett won not with a “slim margin” but with a 51 per cent margin, higher than some candidates in the Fraser Valley, plus he defeated the leader of the B.C. Conservative Party. And before he reluctantly took this job on 10 years ago, this was a solid NDP riding.
As for “parliamentary tradition,” Fletcher ought to know that tradition supports the concept that premiers are first among equals, not kings among subjects. Bennett is in public life for all the right reasons. We ought to know. He lives in our community and is our neighbour and friend. Bennett has always had the courage of Bill Bennett his convictions and this latest speaking out is what we expect from him. We didn’t hire him to be a lemming. We agree with our MLA that Premier Gordon Campbell has done many good things for B.C., but he’s
stayed too long and was jeopardizing the survival of the B.C. Liberal Party. As for Bennett’s comments about Mr. Campbell’s style of leadership, we support our MLA’s right to say publicly what he has learned to be the truth. The fact his colleagues are silent is more of a reflection on them than on Bill Bennett.

A generous holiday gift THIS HOLIDAY season, while you
are out buying gifts for your family and friends, consider the gift of blood donation. Blood donation is always needed and is a priceless way to give to others. We would like to take this moment to remind everyone
that there is an ongoing need for new blood donors. Angela Poon, British Columbia and Yukon’s spokesperson for Canadian Blood Services states, “about 10, 000 units of blood are needed over the month of December to keep up with hospital demands in B.C.”
Although about one in two Canadians are eligible to give blood, only about one in 60 actually do. Your one-time contribution can save up to three lives. According to a study done in 2009 at McMaster University, the working age population is the least

City crew thanked I WOULD LIKE to say thank you to all the snow plow and sander truck drivers in the City of Surrey. You all have done such a great job to keep our streets safe and clear. likely to donate blood. Speculation is that time constraints and access to clinics contribute to the lack of donors in this demographic. Other reasons for not donating include fear of needles, fear of contracting infectious diseases and potential donors mistakenly thinking they are not eligible. Healthy adults aged 17 and older and weighing at least 110 pounds are eligible to be screened for donation. Staff at Canadian Blood Services are highly trained to ensure that donations are received with extreme care and minimal pain. The use of sterile equipment and competent staff guarantee the procedure is completely safe. Canadian Blood Services assures donors that there is no risk of contracting a transmissible disease through donation. The blood donation clinic in Surrey is open Wednesday to Saturday (and Sundays every eight weeks) and is located at #10-6830 King George Blvd. The process of giving blood, including screening, donation and recovery, takes about an hour. By generously taking this time out of your busy schedule, you can give the gift of life to someone in need. Secondary suites are here to stay RE: “CITY’S BUILDING codes ignored,” Letters,
Nov. 24. F. Oliver made some valid points about illegal secondary suites, but I respectfully take issue with the broad-stroke criticism of Surrey. For years, municipal councils throughout Metro Vancouver have struggled with this thorny issue, as both proponents and opponents of secondary suites and laneway housing express strong opinions. As a proud Surrey resident and member of Mayor Dianne Watts’ housing task force that
reviewed secondary suites, I believe this form of housing provides affordable, ground-oriented accommodation to budget-conscious renters, and to family members such as grown children or grandparents who value their independence. Homeowners, too, benefit as suite revenue helps to pay the mortgage. Mayor Watts, council, senior staff and community stakeholders are all dealing with this issue in a responsible, conscientious manner. They should be commended, not denigrated, for their efforts.
Love ’em or hate ’em, secondary suites are here to stay, so let’s make sure they are built in full compliance with the building code and municipal bylaws, including safety, permits and inspections. And, of course, there must be consequences for builders, renovators and homeowners who flout the law. Peter Simpson President and CEO Greater Vancouver Home Builders’ Association

Sanjeeve would have graduated from the school. He was riding in a Chevrolet Malibu that slammed into a BMW SUV in a Newton business district. A 16-year-old boy from Surrey was at the wheel of the Malibu with two passengers – Sanjeeve and an 18-year-old who was also from Surrey. The driver of the Malibu was reportedly driving erratically before he hit the BMW, then slammed into a light standard. The 16-year-old driver and 18-year-old passenger in the Malibu escaped with what are described as minor injuries. So did the three occupants of the SUV. So far no criminal charges have been laid, but father Sanjay Sharma is suing the driver of the Malibu and his family. The court action also names the driver of the BMW SUV and accuses them both of driving contrary to the restrictions on their licences. The Sharma family has also launched a public campaign to call for better enforcement of the rules that require new drivers to have an adult supervisor sitting beside them who is at least 25 years old and has a valid driver’s licence. Those regulations would have applied to the 16-year-old who was driving the Malibu Sanjeeve was riding in.

Former Delta bureaucrat possessed child pornography by Dan Ferguson
on
KIP GAUDRY, the former
Delta municipal director of engineering, has pleaded guilty to one charge of possessing child pornography. Gaudry made the plea Nov. 22 in Surrey Provincial Court. A pre-sentence hearing has been scheduled for Jan. 13. The 59-year-old Gaudry, now a White Rock resident, will remain free on bail in the meantime. He made no plea on a second charge of accessing child pornography, which will likely be stayed by the Crown prosecutor. In March 2009, Gaudry quit as Delta’s director of engineering after police searched an office at the municipal hall and a house in North Delta as part of a child pornography investigation. Gaudry was allowed to go free on $10,000

ing” policy that allows for neighbourhoodby-neighbourhood size restrictions to prevent so-called “monster homes.” After Gaudry resigned, Delta’s chief administrative officer (CAO) told The Leader he personally did not learn the nature of Gaudry’s criminal past until he received an anonymous tip via e-mail, apparently from someone in eastern Canada. When Delta Police investigated, they confirmed Gaudry had a record of sex offences, the CAO said. Gaudry also faces trial on a charge of indecent assault on a female in connection with a 1973 incident in Winnipeg. The Winnipeg Police Service (WPS) Sex Crimes Unit said the case concerns “a historical sexual assault involving a child.” Court records show he was taken into custody on a Canada-wide warrant by the Delta Police Department on Sept. 14 and ordered held in custody by a Surrey Provincial Court judge until a WPS detective came to escort Gaudry back to Manitoba on Sept. 16. Gaudry was granted release on $3,000 bail and allowed to return to his B.C. home after he appeared before a Winnipeg judge on Sept. 21. He paid $2,500 in cash, the court record shows. Judge Wanda Garreck imposed several conditions, including an order that forbids Gaudry from contacting the alleged victim. He is also banned from being in any area where children under the age of 14 might be, like swimming pools, school grounds, daycare centres or playgrounds. He is never to be in the company of someone under 14 without another adult present. Gaudry can’t own “any device capable of storing, receiving, or transmitting photographic material or movies,” and he is not allowed to use the Internet. The alleged offence occurred between June 1 and Aug. 31 in 1973. The Manitoba court file lists the matter as a “domestic violence” case. Gaudry’s next court appearance in Winnipeg is set for Dec. 14.

Man facing sex crime charges Victims drugged, assaulted by Kevin Diakiw A MAN DRUGGED,
robbed and sexually assaulted several women in Surrey and Langley, police say. Surrey RCMP have arrested Steven Beszedes in relation to a series of sexual assaults in both cities. Last summer, police became aware that a male was sexually assaulting victims after they were allegedly drugged and robbed. Numerous victims were identified in Surrey, as well as one in Langley. The victims were determined to be a specifically targeted group who were engaged in a high-risk activity. Police suspected Beszedes, 45, who was already in custody on an unrelated matter.
PARADISE IS ON SALE
As he was in custody, and no longer a threat, police focused on locating further witnesses. On Nov. 18, Beszedes was charged with six counts of administering a noxious substance, four counts of sexual assault, one count of robbery and one count of assault. The investigation into this matter is ongoing and police anticipate recommending further charges. They believe there are further victims who have not reported their assaults to police. The Surrey RCMP encourage anyone with further information in this matter to call the Child Abuse and Sexual Offences Unit at 604-599-0502.

Black Press HE WAS FOUND lying in the middle of 135A Street.
On Thursday, Nov. 25, 2010 at approximately 11:05 p.m., two RCMP Lower Mainland District Emergency Response Team members were on patrol in the North Surrey area. While driving northbound in the 10700 block of 135A Street they saw a male lying in the centre of the roadway. Both officers exited the vehicle to render assistance. Once the officers approached the male, they discovered the male was suffering from obvious life-threatening injuries. The officers called for an ambulance and paramedics assessed the male and determined he was deceased. The area was immediately secured as a homicide scene and the Integrated Homicide Investigation Team (IHIT) was called in. Police have not conclusively identified the victim, but suggests he is 43 years-old. Surrey RCMP Serious Crime Section attended the scene and began conducting inquiries throughout the neighbourhood. Investigators learned there was an altercation involving several males near the corner of 135A and 108 Avenue. Police are looking to speak to four men seen in the area at around the time of the incident. Anyone with information is asked to call the IHIT tip line at 1-877-551-IHIT. optimistic about the opportunity the changes will give him to regroup and rebuild, he is frustrated and saddened at what he sees as an even bigger loss – children will no longer be able to see the animals. Where Oliver used to take baby alligators, snakes and the like to classrooms and even hospitals, much of his education work will now be done through videos and puzzles, as the facility becomes more of a nature centre, he said. “It’s not the destiny I wanted to go with the animals, but I didn’t get the help and circumstances dictated the whole thing,” he said. “More than anything, I feel so sorry for the children of B.C. I think they’re being neglected their rights to see these animals.” Oliver said opportunities to see animals up close teach children respect for the world around them, and can even guide their future. “I was a kid and somebody came into my classroom and that’s what inspired me to work my whole life with animals. A lot of them… may never get the inspiration to do that.” Drever noted Oliver will be better able to care for his charges. “Moving forward, he’s going to have animals at a manageable number,” she said.

Local cities had been told they had to approve some method by the end of this year to deliver their $400 million share of the Evergreen Line costs before the provincial government puts the project out to bids. But Bond – who previously hinted Victoria would force a solution if the mayors voted down the funding – will now wait and consider other options. “We will work alongside the mayors’ council to try to find a way to a potential solution that is not confrontational,” she said. “It’s worth the brief delay to try to make this happen in a more positive way than what was going to ultimately happen in December.” It gives both sides more time to consider everything from road pricing to a vehicle levy or other mechanisms not currently available to TransLink ahead of a possible new vote, perhaps in early spring. Bond cautioned she’s not certain sufficient work can be done by then on some options, such as a vehicle levy, but said she and her staff will try. “I’m not sure anybody understands the impacts of a vehicle levy and the costs it would bring to families in Metro Vancouver,” she added. Nor would she speculate what new sources could be before the mayors next year. But Bond repeated assurances the Evergreen Line will proceed. Regional mayors’ council chair and Langley City

Mayor Peter Fassbender said Bond’s move averts an unnecessary showdown in December with area mayors. “This is a major step on the minister’s part,” said Fassbender, who requested the delay. “She has been very receptive.” Fassbender said delaying the vote on a new financial supplement to spring will allow a more clearheaded decision with new information on possible revenue streams and more political stability, after the swearing in of a new premier and cabinet. The issue was also to be debated Friday (Nov. 26) by the Metro board, where a senior staff report recommended mayors reject the tax-hike plan. Most mayors had already staked out a firm stance against increasing property taxes further for TransLink expansion, although Fassbender and Bond both said that will still be an option under consideration in the Shirley Bond new year. “It provides breathing room,” added Coquitlam Mayor Richard Stewart, who said he feared a no vote would be seen by the province as the mayors breaking their three-year-old commitment to share in the Evergreen Line costs. Stewart said he’s relieved the region and province won’t be forced into a confrontation. “It isn’t good public policy to be making decisions because of artificial deadlines,” he said. “Time and dialogue will hold the possibility of much better solutions that show better respect.” Stewart said he hopes TransLink gets access to half a dozen or more new revenue sources. His favourite is a site-specific development cost charge that would put a good portion of the cost of new rapid transit lines onto property owners who stand to profit in defined benefitting areas. TransLink had contemplated a vehicle levy instead this fall, which would have charged every registered vehicle $15 to $55 a year, depending on the carbon footprint, but concluded there wasn’t enough time to property consider and implement the idea. Surrey Mayor Dianne Watts has said “fair tolling” – where bridges are tolled equally rather than just in one part of the region – must also be on the table. TransLink had said it needed to raise annual revenues by $39 million a year to generate a $465-million contribution to the Evergreen Line and phase one of the North Fraser Perimeter Road. But the TransLink board urged mayors to approve an even bigger $800-million package of upgrades that also included expanded bus service and SkyTrain station upgrades, requiring annual revenues rise $68 million a year. That would have meant committing to a bigger tax hike of $61 a year for a typical home ($8.91 per $100,000 of assessed value.) Mayors had been told the property tax hike would act as a backup and only kick in if other alternate sources could be found next year. But many mayors weren’t willing to trust that the province would deliver new sources after they sign off on a tax hike.

James still won’t say which new cash streams she would give TransLink to finance rapid transit expansion over the long term. She weighed in Friday on the transit funding debate, repeating a past pledge to initially redirect $60 million in carbon tax revenues earmarked for corporate tax cuts starting Jan. 1 to Lower Mainland transit and climate change initiatives instead. “Even without this additional tax relief, we will have the secondlowest corporate tax rate in the country, James said. “I don’t believe we need to be the lowest necessarily to remain competitive. The Opposition leader took the government to task for inflaming relations with local mayors, who threatened to vote down proposed property tax hikes to finance the Evergreen Line until transportation minister Shirley Bond agreed to put the decision on hold. “We’re again at a

The man suffered non-life threatening injuries and was taken to hospital for treatment. deadlock when it comes to TransLink and moving ahead with projects, James said, but declined to specify which new revenue sources ought to be provided beyond a share of the carbon tax. “I believe everything has to be on the table, she said, adding that includes everything from road pricing or a vehicle levy to New York’s tax on cellphone bills for transit. “All of those things have to be discussed seriously. James said the province appears to favour property taxes, calling that unreasonable.
She said the province must provide the necessary money to start Evergreen Line construction right away and called on the government to put elected directors back in charge of the TransLink board. Metro Vancouver directors voted Friday to call on TransLink to pursue vehicle fees or other transportation user or transportation emissions-based revenue sources. Continued property tax hikes are not sustainable in the long run, according to a report by Metro chief financial officer Jim Rusnak.

Inside Track ...with Dan Jukich For Edmonton harness racing fans, it was the perfect lead-in to Grey Cup weekend. With the Montreal Alouettes and Saskatchewan Roughriders ready to do battle at Commonwealth Stadium Sunday, quite a few football fans wandered over to Northlands Park to watch the sulkies Friday night. And those CFL fanatics visiting from Vancouver could relate to the 8-5 favourite in Friday’s $100,000 Western Filly Pace ďŹ nal since Mystic Maiden had become a household name at Fraser Downs this year. Driven by Dave Hudon and trained by 19-year-old Justin Currie, Mystic Maiden made amends for her seventh-place ďŹ nish the week before by beating River Lass (Kelly Hoerdt) in a stirring stretch drive in a ďŹ nal time of 1:56. The win was worth $50,000 for owners Barry MacFarlane and the Crimson Racing Stable. Mystic Maiden now has a 20-for-22 lifetime record. MacFarlane was back at The Downs for last Sunday’s card and spent a lot of his time shaking hands and accepting congratulations from people he knew and people he’d never met. “I wasn’t sure who was going to have the ďŹ rst heart attack, me or Brettâ€?, MacFarlane said in describing Friday’s dramatic ďŹ nish. (Brett Currie is Justin’s father). The previous Friday on a snowy night at Fraser Downs there was a 28-year-old native of Australia making his North American driving debut with his entire family watching via the internet feed. Allan Molloy drove Sharp Cam to a thirdplace ďŹ nish in a $4,000 claimer. Molloy obtained his driving license as a 16-year-old and arrived at Fraser Downs with 78 wins to his credit from the Australian and New Zealand scene, including major victories at Harold Park in Sidney and Ackland. He comes by the horse business honestly, his father and brother having large stables of thoroughbreds in Australia and his grandfather having been a jockey. The young man is double gaited as he shoes thoroughbreds during the summer months and now has his own one-horse stable in winter. Don’t look for Molloy to add more horses to this stable in the short term. “I’m happy to deal with Sharp Cam for now,â€? he says.“As for taking catch drives, I’m open to offers.â€? Metro votes to keep AirCare Decision now turns to FVRD, province by Jeff Nagel AIRCARE SHOULDN’T
be tossed on the scrap heap, according to Metro Vancouver’s board. Directors voted unanimously Friday to extend the Lower Mainland vehicle emission testing program until at least 2020. The endorsement mirrors the recommendation of a multi-agency review that found the air quality benefits justify continuing the tests. AirCare has had less
impact as new cars get steadily cleaner. But the review’s report found air pollution and the resulting health impacts could worsen significantly if the program is dismantled. It also determined newer vehicles do become worse polluters as they age – more so than had been projected. “An end to AirCare would result in more local air pollutants and greenhouse gases in the airshed, which in turn would degrade air quality and worsen health
impacts,” said Surrey Coun. Linda Hepner, vice-chair of Metro’s environment and energy committee. Metro also wants the AirCare program to be overhauled to also target emissions from big trucks that can belch out large amounts of diesel particulate. There’s already a provincial governmentrun AirCare on Road program for heavy-duty vehicles, but officials at the regional district say it could either be toughened or rolled into the

passenger vehicle testing program. The $45-million annual cost of running AirCare testing centres is entirely borne by motorists through fees, so killing the program would not save TransLink or the government any money. Nearly half the vehicles in the region are exempt from testing because they’re less than eight years old. Most of the cars that are tested are charged $45 every two years and pass with flying colours. But 115,000 – 13 per cent of those tested – failed in 2007. Vehicles that fail are denied insurance until they get a tune-up and a re-test. The Fraser Valley Regional District’s environment committee considers the report Dec. 7 ahead of a board vote Dec. 15. A final decision is expected to be made by public safety minister Rich Coleman in the weeks ahead. If extended, the AirCare program would also add new tests to detect liquid leaks from gas tanks and fuel lines.

For instance, when there are devastating injuries that result in an ongoing disability preventing the injured party from obtaining gainful employment, we generally will encourage the client to set up a structured settlement in order to protect the client against depletion of the settlement funds. There is great Æexibility as to the terms of the structure. Often there will be an initial lump sum payment followed by a stream of monthly payments. Payments can be a Åxed monthly amount or indexed over time to allow for inÆation. The monthly payments can continue until the client reaches 65 years of age or continue for the client’s entire lifetime. They could also continue for a Åxed number of years and be made payable to the client’s dependants or heirs should the client pass away during that time. In addition, there is a signiÅcant tax advantage to be gained by entering into a structured settlement because the periodic payments are not taxable as they are not considered to be income. In appropriate cases Stephens & Holman will arrange for the very best structure for our clients in order to protect their future.

B.C. championship high school tournaments under way today
Fraser Valley title for Falcons by Rick Kupchuk A PERFECT RUN through the playoff round has the Surrey Christian Falcons headed to the B.C. Senior AA high school volleyball championships as Fraser Valley champions. The Falcons defeated the Hatzic Crusaders in the quarterfinal round to qualify for the provincial tournament, then pushed aside the Holy Cross Crusaders in the semifinal and the M.E.I. Eagles in Saturday night’s final to become Fraser Valley champions. All three matches were 3-0 wins for Surrey Christian. Katy Klomps of the Breakers was the tournament’s Most Valuable Player, while teammate Krista Hogewoning was a first-team all-star. Lisa Verveda, head coach of Surrey Christian, praised Kim Dejager for “playing at the setter position and performing very well all weekend.” The Breakers will be at the provincial tournament in Kamloops, which begins this morning (Wednesday) and continues through to the championship game Saturday night. Also qualifying for the tournament were the Pacific Academy Breakers, the third place team at the Fraser Valley tournament, and the fourth place Holy Cross Crusaders. Q A pair of Surrey schools are B.C. Junior high school volleyball champions. The Pacific Academy Breakers won the girls championship, while the Fraser Valley Firehawks are the new boys champions following provincial championship tournaments last weekend. The Breakers swept Kelowna Christian in their championship match Saturday night. The Breakers, losers of just one match all season, topped Kelowna 25-12, 25-17 to become the firstever sports team from Pacific Academy to win a B.C. championship. Pacific Academy’s Rachel Funk

Provincials postponed
Make this your best holiday season ever for you and your family!
Snow wipes out high school soccer tournament by Rick Kupchuk AFTER TWO MONTHS
of league play and zone playoff tournaments, 16 Senior AAA boys high school soccer teams will likely wait another five months to participate in their provincial championship tournament. Last week’s heavy snowfall shut down the Burnaby Lakes Sports Complex, forcing the B.C. Secondary Schools Soccer (BCSSS) Commission to postpone the annual three-day event until the spring. “Option C was to try and do it all in one day,” said BCSSS commis-

sioner Don Moslin. “But we made the decision Friday night to go to option D, which was to play it in the spring. Fourteen of the 16 teams decided to endorse it.” The 16 teams, which included representatives from Princess Margaret, Enver Creek and North Delta secondary schools, were scheduled to start play with two games last Thursday. Play was to continue all day Friday, with all teams playing a final game Saturday morning. But snow kept the fields closed, forcing the cancellation of the annual event.
“The soccer commission has done their best to try to make the best of a bad situation,” said North Delta Huskies coach Gurpaul Sohal. “The boys are disappointed about the field closures, but understand that the integrity of the tournament and safety of the players are the first priorities.” Moslin said the BCSSS commission will be looking at the availability of soccer fields in the Lower Mainland next spring, and will announce a new date in the new year. A concern is the five teams from outside the Lower Mainland, which
had spent their travel budget traveling to last week’s postponed event. “It’s not just travel, it’s the cost of accommodation,” said Moslin. “And it’s a long trip for some of the teams. From Cranbrook, it was a day and a half, Quesnel was an eight or nine hour drive, and Salmon Arm was at least six hours.” “One or two teams said that they might not be able to return in the spring,”said Sohal. “In my opinion, that does diminish the integrity of the tournament. But it is a far better option than having no tournament at all.”

Eagles lose to Chiefs after topping Victoria BCHL team beaten in penalty-filled game Friday night in Langley by Nick Greenizan A DAY AFTER edging
the Victoria Grizzlies 4-3, the Surrey Eagles dropped a raucus, misconduct-filled 5-1 tilt to the rival Langley Chiefs Friday at the Langley Events Centre. Friday’s game actually started well for the Eagles, who took a 1-0 lead near the end of the first period when Brad McGowan added to his league-leading point total with a power-play marker, but the Chiefs took the lead in the second frame on goals by Kit Sitterley, Trevor Gerling and Tim Daly. Langley tacked on two more insurance goals in the third period – Trace Strahle scored at the 5:34 mark and Gerling potted his second of the game into the empty net – but with the home side in control, it was a fracas at the 12-minute mark, and another five minutes later, that overshadowed the score. First, Langley’s Darnell Dyck – a former Eagle – dropped the gloves with Surrey forward Daniel
Gentzler, and both received five-minute fighting majors plus game misconducts. In the same incident, Surrey’s Colton Mackie and Langley’s Josh Myers – who also picked up a two-minute interference penalty on the play – were booted from the game, and Chiefs’ forward Kody Dhaliwal also picked up a misconduct penalty. Then, at the 17:11 mark, Surrey blueliner Doug Wedel was whistled for a boarding penalty, and Langley’s Brandon Scholten touched off a melee when he jumped Wedel, and earned a five-minute fighting major, an instigator penalty and a game misconduct. The second period was no picnic, either, and Langley’s Dillon Scholten and Brad McBride were both ejected – Scholten for a hit from behind and Brad McBride after initially being whistled for goaltender interference. The Eagles did not go unpunished either, as defenceman Mitch Jones was tagged with 17

minutes in penalties after receiving a five-minute major, two for instigating and a misconduct after a fight. Thursday’s home game against the visiting Grizzlies – played in front of just 480 fans at South Surrey Arena – went better for the Eagles, as they peppered Victoria goalie Matt Ginn with 46 shots on net, and went two-for-seven on the power-play en route to the one-goal victory. Victoria’s David Morley – no relation to Eagles’ Tyler or Brandon – scored just nine seconds into the game, but Surrey captain Tyler Morley tied the game 1-1 with a power-play goal at 15:21 of the first. The teams traded goals in the second frame – with McGowan scoring for the Eagles – and Jeff Vanderlugt and McGowan, with his second of the game, scored in the third to give the Eagles a 4-2 lead. Grizzlies’ Braxton Bilous scored a shorthanded marker with 10 seconds left in the third period to make it 4-3.
Karel St. Laurent stopped 25 shots to earn the victory for the Eagles, who sit fourth in the B.C. Hockey League’s
Coastal Conference at 16-11-1-1 (won-losstied-overtime loss). The Eagles play tonight (Wednesday)
at home against the Coquitlam Express, and take off this weekend on a tough three-games-inthree-nights road trip
that sees them face a trio of the league’s top teams – the Trail Smoke Eaters, Salmon Arm Silverbacks and Vernon Vipers.

Light up your life
BC Women’s Curling Championship
Museum dazzles with new exhibit until Dec. 23 by Jennifer Lang BRIGHTEN UP a dull November day with trip to the Surrey Museum, where a new exhibit offers plenty of fascinating – and fun – ways to explore our relationship with light. Lighting up Your Life, on display to Dec. 23, looks at light in every form, from the use of candle power and oil lanterns to flood lights and laser beams. Interactive displays give kids and adults hands-on ways to discover more about how humans, and even animals, use light. Ride an exercise bike to see how fast you have to pedal to power a light bulb, or arrange a set of prisms to turn a beam of white light into a multi-coloured rainbow, or spectrum. Use tiny mirrors to bounce a red laser beam onto a Sphinx figurine – not as simple as it appears. No exhibit about light would be complete without the electric light bulb, erroneously said to have been created by inventor Thomas Edison. Turns out, Edison invented the first cost effective, longlived light bulb, merely improving a technology invented by Humphrey Davy in 1809. The latest in light bulb technology is given its due, too. Compare LED technology with low-watt
fluorescents, and gape in awe at the true size of street and traffic lights brought down to street level. One of the original bridge lights from Vancouver’s Burrard Bridge is on display, as is a decorative street lamp from Chinatown, complete with a snarling dragon on the top. The first public street to use gas lamps was Pall Mall in London in 1814. Two years later, they appeared in Baltimore. But it wasn’t until 1837 that Montreal unveiled its first gas street lamps. By the end of the 19th Century, most major cities were outfitted with gas street lamps – just as electric lights were already becoming popular. Lighting up Your Life also looks at the use of light in a cultural context – candles and lamps perform important roles in festivals such as Hanukkah and Diwali. The Surrey Museum is located at 17710 56A Ave. Hours of operation are Tuesday to Friday from 9:30 a.m. to 5:30 p.m. and Saturdays from 10 a.m. to 5 p.m. Closed Sundays, Mondays and Statutory Holidays. Admission fees are $5.50 for adults, $4 for seniors and students, $2.75 for children and youth and free for kids under five. For more information, call 604-592-6956 or visit www.heritage.surrey.ca
