Concerned about your home being sold to fund your future care fees? The Issue
You probably own your home as joint tenants if you are a couple and solely if you are single. For couples this means you own it wholly, jointly and severally. Ultimately therefore you do not own it 50:50 as you might have assumed. You actually own all of it together and when one partner dies the surviving partner owns it solely and absolutely. It is sole and absolute ownership that enables a property to be taken into consideration as an asset by the local authority and puts the property in danger of needing to be sold to fund care.
The Reality
The Law (C.R.A.G - charging for residential accommodation guide) allows local authorities to assess your assets to determine if you need to pay for your own care. Currently if you have assets above £23,250, you are on your own and require care, you will probably have to pay for it all - currently averaging around £800 per week. Savings, cash and income would be used first and then your property would need to be taken into consideration. You would be expected to pay for all of your care until such time as your assets were depleted to below the £23,250 threshold. You would then pay for a proportion of your care until your assets were below £14,000 - at which point all your future care would be paid for.
The Solution
For couples, simply by changing the way you own your property well in advance of any care considerations i.e from joint tenants to tenants in common and by setting up two Trusts within a properly structured Will at the same time will in most cases, prevent your home from being taken into account by the local authority altogether should you ever require care in the future.
The children and/or whoever else is also nominated as Trust beneficiaries for that particular Trust will subsequently have access to that half of the property when the surviving partner dies. The first half of the property then is 100% securely in Trust for the beneficiaries and will not be at risk. As a result of this simple strategy the survivor is protected from having to sell the property to pay for their care should they need it because it is not possible to sell just their half of the property and the Crag guidelines clearly state that the market value of half a property is £0. The second half of the property will then ultimately go into Trust for access by the nominated beneficiaries when the surviving partner eventually dies. The beneficiaries will at that stage have both halves safe and secure in Trust and will be able to share and dispose of the property according to the wishes of the settlors (the original owners of both halves). By leaving 1/2 the property into Trust on first death, the surviving partner can still sell the property to downsize if they wish and are not restricted in any way with regards to what they wish to do to or with the property - it simply means that it is safeguarded and therefore will definitely be able to be appointed to the chosen beneficiaries when the time comes. For sole owners immediately conveying at least half of your property into Trust well in advance of any care consideration and becoming a Trustee and primary beneficiary of the Trust with others nominated to become beneficiaries after your death is usually enough to take away the risk of the property being considered as an asset to be sold if care is required as the property is not absolutely owned by yourself anymore and again it is not possible to sell half a house or force a Trustee to do something that is not in the ultimate best interest of the Trust beneficiaries. For sole owners the process is simply to set up a Trust now and convey at least 1/2 of your property into it which will produce the same result.
The Reasoning
When you own your home as tenants in common you actually own half each. When the first partner dies, they leave their half into their trust. The surviving partner is the Trustee of that Trust and also the primary beneficiary which means that they have complete control over the property and what happens to it.

The Flying Dutchman Inn, at the corner of Howard Road, photographed on 17 May 1970. The Elm Grove Estate, in this area, was laid out in 1853/4 and straight away the inn was built. It is listed in the Brighton Directory for 1855. Here we bring you the latest news from the Hanover and Elm Grove Local Action Team...
HEGLAT - Parking Update
Since the last directory there has been a well attended public meeting for residents in Elm Grove and northwards and another HEGLAT meeting which heard about the Parking working group community-led proposal for a medium touch zone with associated street improvements for most of the Hanover area. Why medium touch?
This would be a unique approach so it means we cannot be bound by the features that come with the council’s standardised heavy touch or light touch schemes. The scheme would allow for restrictions in parking for 3 x 1 hour slots, which people felt would be enough to deter people from leaving vehicles all day but give visitors and carers a 3-hour, a 4-hour and 8pm-till-10am window of unrestricted parking.
The proposal is a compromise between residents south of Southover Street, who strongly prefer “heavy touch” restrictions, and areas closer to Elm Grove that are less keen on controlled parking. It is hoped that the proposal will also give us a chance to improve street design in some places with one-way systems, pinch points and cycle facilities. The area covered by this proposal goes from Albion Hill to Elm Grove, up as far as Queen’s Park Road. It

does not at this stage include Elm Grove, the triangle of roads bounded by Carlyle Street, Queen’s Park Road and Elm Grove, nor any roads north of Elm Grove or east of Queen’s Park Road, as at present the surveys suggest residents in these areas do not want controlled parking.
More surveys are planned in Elm Grove and northwards, in the Carlyle Street triangle and in the Pankhurst Avenue area, to see if there is any interest in joining the suggested Hanover zone. There is also a parking improvement plan for Elm Grove. Residents are to be consulted on this and also asked if they are willing to incorporate it in the medium touch Hanover scheme to make funding the works more possible.
The community plan wants to meet the needs of businesses in the area. As well as doing a questionnaire for businesses, there is a follow-up meeting for local businesses on Monday 2nd March, 8pm, at The Hanover pub, Queen’s Park Road. A Seriously Inconvenient Truth, Time We Face It?
Cowspiracy film, shown at The Hanover pub in January, promotes veganism as answer to climate change, ‘If you are a reasonably informed person, you’re probably aware of the overwhelming evidence in support of human-caused climate change... Maybe your average day starts with a super short shower. You switch the water off while lathering up and resist the temptation to stand for an extra ten minutes… You pop into your favourite fair trade coffee place to grab one of their scrummy free range bacon sarnies… You do what?! Right, well you may as well have slept under a full flowing power shower and driven to work in a tractor. OK, so I haven’t fact-checked this statement. Fortunately, Cowspiracy’s calculations are more considered. Raising cattle uses more greenhouse gases (18%) than all cars, trucks, trains, ships and planes combined (13%) when you factor in methane emissions. Yes, that’s cow farts. According to NASA, methane has a global warming power
86 times that of CO2. Livestock production is the leading cause of species extinction, deforestation, greenhouse gas emissions and water shortage on the planet today!
‘There is some really uplifting stuff at the end but, more importantly, there’s a clear answer to the questions posed. It remains to be seen whether we are ready to hear that answer.’ 1 But can we reduce meat and dairy products on our tables to roll back the damage to our environment?

Here is a summary of what we have been up to in the last seven months...
Whilst befriending your local independent pays dividends, we are likely to find ourselves floundering in the supermarket wine aisles at some point. So, before we lose our heads and plump for a dud, how to choose wisely?
There has been a meeting with Washington Street Foster Gardeners to discuss how to start greening their street! I met a resident who wants a community café. Would you be interested? There are at least 10 residents who want to get involved and they will gather together soon to discuss how to make it work. We held a drawing competition in the Level to listen to children and their parents. We are looking forward to doing more of these activities when it gets warmer! Some residents at Whichelo Place have said they would like to see more wildlife in the reservoir owned by Southern Water. What do you think?
Many residents have mentioned they are worried about elderly people in the area feeling isolated. Do you know any of your elderly neighbours? Some generic rules first. It is always wise to steer clear of ‘humorous wine labels’ - you are not (I assume) a teenager trying to outwit the cashier. But don’t play it too safe - instead of familiar Rioja, Chablis and Sancerre, opt instead for Tempranillo or Sauvignon de Touraine. Consider the occasion: an old world Syrah or lighter Burgundy perhaps for a traditional dinner party, or gutsy Malbec for a meaty barbecue.
Supermarket premium labels can be very good as chosen specifically to flash a little wine-buying flair. And think price. Generally the ‘sweet spot’ is around £6-£10, but avoid the tempting half-price offers - in my experience there is usually a reason for this and it is rarely a good one. Finally, columns in weekend newspapers often recommend supermarket wines worth a punt. Not infallible, but they can offer useful pointers and, as every savvy consumer knows, ‘every little helps’! hanover The latest in the musings of Hanover Dad...
Hanover Dad... Whilst the Cat was Away About three months ago my lovely wife came home from the pub at about midnight after a mums’ night out and declared to me, “I’m going to Morocco,” then staggered off to the bathroom to be sick. Through my sleep-addled mind I weighed up the facts. These were - it’s midnight, my wife has just woken me up to tell me she’s going to Morocco. Does she mean now? Does she mean for good? Have I done something to make this happen? – I needed more information.
Turns out I needn’t have worried. Basically my wife and a few mates had decided to have a long weekend in Morocco to have some girly time away from the kids and me. Although it baffled me as to why she would want to do that, what with all my continual witty banter, my obsession with West Ham United and my children’s increasing noise levels as they get older? Well, before I knew it, the weekend arrived and, with the sashay of a mini-suitcase and a lingering whiff of fake tan, she was gone. I closed the front door and turned to see my two little children staring back at me with hope in their eyes. They said, “What are we going to do whilst Mummy’s away, Dad?” – and you know what, I hadn’t actually thought about it? First things first, I took them to the pub. I declared this a strategic planning meeting to decide what we fancied doing for the weekend. After two pints, two apple juices and three bags of crisps, we dismissed the idea of Disneyland, Harry Potter World and going to Morocco to surprise Mummy, and settled on swimming, Pizza Express and a bike ride.
You know what, the weekend was great, we had loads of fun and solo parenting (on a temporary basis) wasn’t that tough. All right, the kids stayed up a bit late, didn’t wash as much as they should’ve, and my

youngest covered his face in temporary tattoos, due to a slight lack of parental supervision, but they scrubbed off eventually. What it has also done, is inspired me to do the same. My wife doesn’t know this yet, but I have a dads’ night out planned next week, and I can’t wait to roll in at midnight, wake her up, and start singing the Vengaboys classic, “I’m going to Ibiza!!”

The Gourmet Girls – The Constant Service
A Tuesday evening at The Constant Service proved to be the BEST night we’ve had since the Hanover Gourmet Girls began. We experienced a very warm welcome from the lovely landlady Elisa and settled down on a corner table to catch up over drinks.
Tom the chef surpassed himself, cooking up an array of the most amazing food – hot, fresh and promptly served. We chose Battered Cod, Battered Halloumi, Chilli Nachos, Macaroni Cheese, Sussex Egg and Chips (gorgeous home-made Scotch egg), Garlic and Chilli Chicken Kebab, Chicken Chorizo, Spinach Potato and Cheese Melt. It was unanimously agreed that it was all absolutely delicious. There was a lot of sharing and oohing and arrhing going on! The portions were very generous and reasonably priced from £7.95 - £9.50.
The Constant is part of the Harveys group and is a very popular local. They play classic and contemporary vinyl, serve an array of cask marqued ales, have regular live music, a heated award-winning garden,
lovingly cared for by Elisa’s father – Eyup. It’s child and dog friendly, and has an open fire, board games and two screens showing sporting events.
Home-made pies are available all week, with a Pie and Pint deal on Mondays for £10.00. Make up your own combo of pie, mash and gravies. An extensive imaginative selection of roasts is available on Sundays, served between 12 and 6pm with veggie and vegan options. Prices from £9-£10. Comments from the girls about the Constant:
Warm and welcoming pub, very friendly and the place to be. Top marks for food and atmosphere. Particularly loved the nachos, and the batter on the fish was so light, crispy and delicious it must surely have been calorie-free?! Chicken and Chorizo Melt was to die for. The Friends of Tarner Park
The Friends of Tarner Park is a small, friendly community group, dedicated to improving the park and encouraging more people to use this beautiful green space in Sussex Street.
If you‘ve lived in this area for a while, you’ll probably remember the park as a graffiti-covered urban wilderness, which many people considered a ‘no-go’ area. However, since 2007 we have worked with the council to change this, and we’re proud of our many achievements. Over the last seven years or so, the park has had a complete makeover, with new playground equipment and a ball court. We’ve worked with local artist David

Watson to bring some art into the park to replace the graffiti, including giant conkers under the trees, a recycled glass ‘doormat’ for the After School Club building, and some fantastic benches made from recycled wood, plastic and tyres. There are also mosaics created by local children, and some mosaic fishponds in the quiet garden area. We even have a camera obscura in the tower, built by David Watson from recycled materials as part of a Same Sky project, which gives a fascinating alternative view of the park. The tower itself is a Grade II listed folly built in the early 1800s by Edward Tilbury. Legend has it that it was used by Edwin Tarner as a viewing platform to spot his ships returning from the Americas, though this is probably untrue! The tower is now crumbling a bit, and one of our main aims for the future is to secure funding to have it restored.
We run a number of events throughout the year, and try to include activities for everyone – over the years we’ve had music, woodcarving, bat box making, gardening, different sports activities, children’s crafts and much more. We also serve delicious homemade cakes and drinks, and open up the tower for people to have a look.

We are keen to get more people involved with the Friends group, so that we can continue improving the park. Everyone is welcome, even if you’d just like to make the tea! We meet in the park every six weeks or so to discuss plans – we know attending meetings isn’t for everyone, but we’d still love to hear from you if you have any ideas about the park or would like to get involved in any way at all. The Church of the Annunciation
To mark its 150th anniversary, the Church of the Annunciation in Washington Street opens its doors to host a festival of art, music, and drama. Father Michael Wells, aka Spike Wells, renowned jazz drummer, and Brighton diva Marcia Bellamy, Festival Artistic Director, invite you to discover what is happening at the Annun, the secret heart of Hanover. Lady Day at the Annun
Lady Day, which falls on 25th March, is the traditional name for the Feast of the Annunciation, the day on which the Angel Gabriel appeared to the Virgin Mary to announce the coming of Christ. Naturally, this festival is celebrated annually at the Annunciation Church in Hanover. It has always been an important day in our calendar.
J M Neale, the famous hymn-writer, who penned, among many other favourites, the lyrics for Good King Wenceslas, preached to a large congregation at the first ever Lady Day at the Annunciation in 1865, shortly after the church was opened. It was Lady Day that the founder of the Annun, Arthur Wagner, always chose to mark significant milestones for the church, including its formation as a separate parish in 1881 (formerly it had simply been a mission from St Paul始s West Street to the poor in Hanover). In this our 150th anniversary year, we will be continuing the tradition of inviting prominent speakers to preach on Lady Day. We are delighted to welcome the Bishop of Chichester, Martin Warner, to preach and celebrate the feast with us. His visit comes hot on the heels of the Chichester Cathedral Choir who sang so memorably to a full church a few weeks ago. News of a new album by a local band..
‘We Are Your Friends’ by Duke of Burgundy
The last five years has seen an album release every year with my band the Casual Friends. ‘We are your friends’ is an end product of all the music and influences we’ve taken on board over the past year.
The fun thing about releasing music through your own label is that you can put out whatever you want without a Simon Cowellian-type dark overlord insisting on a cheesy rap or synth brass solo. A few bands, all beginning with C, have really influenced this album. I’ve been a big fan of The Clash for some time. Joe and the guys stood out for experimenting with reggae, punk and funk, and their album “Sandinista” from 1980 is the high point for me; I especially loved the reggae dub journeys of this album. Caravan were a very English psychedelic rock band from the late 60s, more humorous and fun than their contemporary, Pink Floyd. Their first two albums really charmed me - it’s real sunshine psychedelia.
The last guys are German psychedelic rockers Can, a band that by the 70s shared a similarity with The
Clash in their love of funky, dubby sounds. Their albums Flowchart and Can are simply cosmic sounding and also a lot of fun; we have to try and forgive them for a rather dodgy cover of the Can Can. After listening to these three legends a lot, it’s no surprise there’s a reggae rock feel to our new album, mixed with dubby psychedelic effects. Our favourite mixmaster Allan Goodey is back at the mixing desk, spacing out the mix and firing the dub effects off. Brighton’s a special place and has people from all over the world happily living here. We hope this album supports this diversity; I think Joe Strummer would have approved.
