BRIGHTON MARATHON SUNDAY 12TH APRIL This year’s Brighton Marathon has its Mass Start in Preston Park at 9.15am, with the elite runners starting in Withdean Park.
If your tennis ability is club or Brighton Parks League standard and you are interested in joining, please come along to a club session which take place on the Astrocourts on Monday and Friday evenings throughout the summer. Our first club session is Monday 30th March starting at 5pm (May to August we start at 6pm). The subscription for a season’s membership is £40 (half adult rate for juniors under 18). Benefits of membership include a full summer of 53 sessions of tennis with all balls and court fees included, entry to the club knockout tournaments for Men’s & Ladies’ Singles and Men’s, Ladies’ & Mixed Doubles, and also entry to at least two American Doubles tournaments.

The official race starter in Preston Park will be Jo Pavey, the women’s 10,000m gold medal winner from last year’s European Championships. A new feature this year for spectators in Hove will be a “Find Your Strong” giant screen at mile 23, with music, commentary and spectator seating. This will be outside the Connect gym on Basin Road South in Shoreham Harbour. The race will end at Madeira Drive, with the first of the elite runners expected to finish at around 11.25am. There will be a Beach Village on the beach adjacent to the finish line, containing charity marquees, bars, food, giant screens and a chill-out zone. HOVE PARK The monthly update from The Friends of Hove Park...
SPRING IN HOVE PARK As Easter approaches, Hove Park is bursting into flower. Drifts of daffodils and snowdrops are scattered throughout the park, and mauve, yellow and white crocuses encircle many of the trees. The beech trees, which still retain their dry golden brown autumn leaves, provide a contrast. The buds of the unusual foxglove trees in and near the playground are already prominent and will be followed by spectacular flowers. The formal beds now require more maintenance and anyone wishing to help with the Friends’ gardening session on the second and fourth Thursday afternoons of each month will be very welcome. The Friends’ 2015 programme of events commences at Easter. Following last year’s successful Easter Egg Trail, we are back again for a second year. The trail will be held on Easter Monday, 6th April, starting from our stand outside the Hove Park café. It will begin at 11am

BUY-TO-LET PROPERTY OWNERSHIP Brighton & Hove is awash with buy-to-let property ownership. A common question is how should the rental property be owned - personally or via a limited company? The headline attraction of owning rental property via a limited company is rental profit is subject to corporation tax of 20%, rather than potential income tax of 40% or 45%. However, subsequent extraction of the company profit gives rise to an income tax charge and this generally means that the overall rate of tax is similar to personal ownership. A limited company works very well if you do not need to access the rental profit, but instead use the profit to acquire further property. Effectively, more of the profit can be reinvested! Alternatively, profit can be rolled up within the company and extracted when your marginal rate of tax might be less. Consideration must also be made to the tax implications of selling the property. An individual has an annual exemption (2015/16: £11,100) each year on which no capital gains tax is payable. Gains exceeding the annual exemption are subject to a maximum capital gains tax

rate of 28%. Whereas, if the property is owned via a limited company, corporation tax is payable on the gain and then income tax or capital gains tax is payable on the subsequent distribution. Effectively, a doubletax charge! Limited company ownership does not lend itself well to a short-term investment strategy. Other considerations would include risk mitigation, borrowing costs, stamp duty and inheritance tax planning. As with most tax planning, there is no one-size-fits-all advice and you need to apply all the issues to your own personal circumstances. Introducing the next in a series of observations written by Sir Patrick - a literate Lhasa Apso...
MUD, GLORIOUS MUD Poor old Hove Park has been hammered with rain this winter. Now large swathes of it are brown rather than green, the swards having bald patches which turn sludgy with each footprint. The pitches are pitted with the studs of football boots and the sides to the paths have been shredded by vans which, it seems, can drive wherever they please so long as they have an official-looking logo on their sides. Given these conditions I am resigned to the unpleasant fate of being dipped into the utility room sink after each walk then attacked by the Female brandishing a hair dryer. When she mutters, “Why do you have to get yourself so dirty?” I say nothing; I mean, some questions are so fatuous they don’t merit an answer. However, I have to admit that not all dogs get as muddy as I do. The lhasa, together with my half brother, the shih-tzu, is singularly prone to looking like a bedraggled rat after only a short exposure to mud. It isn’t just our proximity to the ground, I mean look at the smoothhaired dachshund, he can emerge from a walk looking as shiny and smooth as a newly barbecued sausage. It must have something to do with our wavy hair. Spaniels, labradoodles and wheaten terriers suffer the same af-
fliction: a coat which doesn’t repel but seems to invite any damp surface material to spring up from the ground and attach itself to the legs and belly. Then finally, one has to take into account a dog’s general awareness of filth, or lack of it. The breeds I’ve just mentioned are among those who tend to charge through a puddle rather than round it. I’ve seen owners watch with awe and despondency as their beloved pet stampedes into black and turbid water. I’ll never forget one female looking on helplessly as her labrador vigorously rolled in a puddle, sending plumes of blackened water into the air. A sleek and sparkling Jack Russell, as I remember, walked daintily and disapprovingly round him. Unfortunately, I seem to be in the dirt-friendly camp which means that for the next couple of months every walk will end up with a dip in the sink and the whirr of a hair dryer. But then, think of those Crufts doggies; they get sinks and hair dryers all year round with none of the joys of mud. These observations were made by Sir Patrick, a Lhasa Apso who has his own dog-walking blog, doggytalkdalkey.blogspot.co.uk. The Female is local resident Sheena Vernon.

HOVE PARK PAST... OLD SHOREHAM ROAD In the mid-1920s this was still little more than a country road with a few buildings on the north side. In 1930 this row of houses was built on Clark’s orchard at the same time as Park View Road and when Nevill Road was merely a chalk track leading to the Greyhound Stadium. In 1967, by now the busiest east-west road in the district, widening was in full progress and part of the front gardens had been sacrificed, as seen in this photograph of December 1st 1967.

HOVE PARK Update from the Friends of The Three Cornered Copse...
IN THE COPSE - ENVIRONMENTAL ART IN THE STYLE OF ANDY GOLDWORTHY During the recent school half term holiday, the copse was treated to environmental art in the style of Andy Goldworthy, by a father and his daughter. Artist Andy Goldworthy creates artwork in a natural landscape setting, using natural materials. These are temporary landscape constructions of artwork. (Further details on Andy’s work can be seen on the internet.) If you missed the artwork please enjoy the pictures above. Unfortunately, the copse has suffered some more ‘flytipping’ where a few selfish residents have been using the copse as a dumping ground for green garden waste. Our Ranger has already attached a number of notices about ‘anti-fly-tipping’ and ‘anti-graffiti’ so there is a clear visual reminder of the problem. If you are aware of who is involved, please contact Brighton and Hove City Council as there is a maximum fine of £5,000 for those found guilty. Secretary, Morwenna, will be retiring from the role. In order to make the role more manageable, the job will be divided into three new roles:- (1) Minutes (2) Membership (3) Website Liaison. Therefore if you are interested in helping with any of these positions or joining our friendly committee, please come along or get in touch. The Friends Group will meet up again on Saturday 25th April 2015. The workday starts at 10.00am until 1.00pm, always gathering at the bench at the bottom of the green slope, just in front of the grove of silver birches. Planned projects for workdays include laying wood chippings, creating habitat piles, removing wire (which formed the original boundary line), planting any remaining poppy and meadow mix seeds, plus clearance work on the lower twitten. In future, when funding allows, we hope to erect a new rustic bench near the top of the copse following the popularity of the existing bench we installed. Concerned about your home being sold to fund your future care fees? The Issue
You probably own your home as joint tenants if you are a couple and solely if you are single. For couples this means you own it wholly, jointly and severally. Ultimately therefore you do not own it 50:50 as you might have assumed. You actually own all of it together and when one partner dies the surviving partner owns it solely and absolutely. It is sole and absolute ownership that enables a property to be taken into consideration as an asset by the local authority and puts the property in danger of needing to be sold to fund care.
The Reality
The Law (C.R.A.G - charging for residential accommodation guide) allows local authorities to assess your assets to determine if you need to pay for your own care. Currently if you have assets above £23,250, you are on your own and require care, you will probably have to pay for it all - currently averaging around £800 per week. Savings, cash and income would be used first and then your property would need to be taken into consideration. You would be expected to pay for all of your care until such time as your assets were depleted to below the £23,250 threshold. You would then pay for a proportion of your care until your assets were below £14,250 - at which point all your future care would be paid for.
The Solution
For couples, simply by changing the way you own your property well in advance of any care considerations i.e from joint tenants to tenants in common and by setting up two Trusts within a properly structured Will at the same time will in most cases, prevent your home from being taken into account by the local authority altogether should you ever require care in the future.
The children and/or whoever else is also nominated as Trust beneficiaries for that particular Trust will subsequently have access to that half of the property when the surviving partner dies. The first half of the property then is 100% securely in Trust for the beneficiaries and will not be at risk. As a result of this simple strategy the survivor is protected from having to sell the property to pay for their care should they need it because it is not possible to sell just their half of the property and the Crag guidelines clearly state that the market value of half a property is £0. The second half of the property will then ultimately go into Trust for access by the nominated beneficiaries when the surviving partner eventually dies. The beneficiaries will at that stage have both halves safe and secure in Trust and will be able to share and dispose of the property according to the wishes of the settlors (the original owners of both halves). By leaving 1/2 the property into Trust on first death, the surviving partner can still sell the property to downsize if they wish and are not restricted in any way with regards to what they wish to do to or with the property - it simply means that it is safeguarded and therefore will definitely be able to be appointed to the chosen beneficiaries when the time comes. For sole owners immediately conveying at least half of your property into Trust well in advance of any care consideration and becoming a Trustee and primary beneficiary of the Trust with others nominated to become beneficiaries after your death is usually enough to take away the risk of the property being considered as an asset to be sold if care is required as the property is not absolutely owned by yourself anymore and again it is not possible to sell half a house or force a Trustee to do something that is not in the ultimate best interest of the Trust beneficiaries. For sole owners the process is simply to set up a Trust now and convey at least 1/2 of your property into it which will produce the same result.
The Reasoning
When you own your home as tenants in common you actually own half each. When the first partner dies, they leave their half into their trust. The surviving partner is the Trustee of that Trust and also the primary beneficiary which means that they have complete control over the property and what happens to it.

TO VACCINATE OR NOT? An occasional challenging consult room conversation is the necessity of vaccination, either driven due to the fear of vaccine-related side effects, the reduction in prevalence of the diseases we vaccinate for, or due to people believing it’s just a money-making exercise for the vets.

Firstly, legitimate vaccine reactions are very low at around 0.05%. An independent study performed by the world famous Animal Health Trust could not find statistical evidence that vaccinated dogs suffered more ill health. When reactions occur, they are generally mild such as a short-lived fever, and often these are due to a concomitant illness. Occasionally we see more serious vaccine reactions like anaphylaxis, but these are very rare. We do see less cases of what we vaccinate for, so the threat is lower, but this is partly due to vaccination being an accepted necessity. (General better health and nutrition of our animals nowadays influences these statistics as well.) But outbreaks of parvovirus and distemper are still seen where large numbers of dogs are not protected. An additional component of our routine vaccination protocol is leptospirosis protection, which is “caught” from the environment, as it is spread by rats’ urine. Thus its prevalence and threat cannot be heavily affected by vaccinating. Plus we can become infected through exposure to our own dogs, so yearly vaccinating is essential.

As for vaccinating being a good income for vets, I would have to agree, the need to vaccinate does add to our footfall. But it is during these routine vaccinations that we pick up other unnoticed ailments such as heart murmurs, dental disease, skin tumours etc, and we answer general health and nutritional questions. It is not often that an owner doesn’t get their money’s worth from the consultation. Vaccinating your pet is essential. Please speak to your vet for more advice.
