Concerned about your home being sold to fund your future care fees? The Issue
You probably own your home as joint tenants if you are a couple and solely if you are single. For couples this means you own it wholly, jointly and severally. Ultimately therefore you do not own it 50:50 as you might have assumed. You actually own all of it together and when one partner dies the surviving partner owns it solely and absolutely. It is sole and absolute ownership that enables a property to be taken into consideration as an asset by the local authority and puts the property in danger of needing to be sold to fund care.
The Reality
The Law (C.R.A.G - charging for residential accommodation guide) allows local authorities to assess your assets to determine if you need to pay for your own care. Currently if you have assets above £23,250, you are on your own and require care, you will probably have to pay for it all - currently averaging around £800 per week. Savings, cash and income would be used first and then your property would need to be taken into consideration. You would be expected to pay for all of your care until such time as your assets were depleted to below the £23,250 threshold. You would then pay for a proportion of your care until your assets were below £14,250 - at which point all your future care would be paid for.
The Solution
For couples, simply by changing the way you own your property well in advance of any care considerations i.e from joint tenants to tenants in common and by setting up two Trusts within a properly structured Will at the same time will in most cases, prevent your home from being taken into account by the local authority altogether should you ever require care in the future.
The children and/or whoever else is also nominated as Trust beneficiaries for that particular Trust will subsequently have access to that half of the property when the surviving partner dies. The first half of the property then is 100% securely in Trust for the beneficiaries and will not be at risk. As a result of this simple strategy the survivor is protected from having to sell the property to pay for their care should they need it because it is not possible to sell just their half of the property and the Crag guidelines clearly state that the market value of half a property is £0. The second half of the property will then ultimately go into Trust for access by the nominated beneficiaries when the surviving partner eventually dies. The beneficiaries will at that stage have both halves safe and secure in Trust and will be able to share and dispose of the property according to the wishes of the settlors (the original owners of both halves). By leaving 1/2 the property into Trust on first death, the surviving partner can still sell the property to downsize if they wish and are not restricted in any way with regards to what they wish to do to or with the property - it simply means that it is safeguarded and therefore will definitely be able to be appointed to the chosen beneficiaries when the time comes. For sole owners immediately conveying at least half of your property into Trust well in advance of any care consideration and becoming a Trustee and primary beneficiary of the Trust with others nominated to become beneficiaries after your death is usually enough to take away the risk of the property being considered as an asset to be sold if care is required as the property is not absolutely owned by yourself anymore and again it is not possible to sell half a house or force a Trustee to do something that is not in the ultimate best interest of the Trust beneficiaries. For sole owners the process is simply to set up a Trust now and convey at least 1/2 of your property into it which will produce the same result.
The Reasoning
When you own your home as tenants in common you actually own half each. When the first partner dies, they leave their half into their trust. The surviving partner is the Trustee of that Trust and also the primary beneficiary which means that they have complete control over the property and what happens to it.

If you always wanted to improve your local area but never knew how, here is your answer...
Long live the bottom up spirit of community activism in Queen’s Park says Cllr Geoffrey Bowden The essence of the Queen’s Park Local Action Team (LAT) is community safety in the ward, as well as grass roots activism to safeguard the integrity of the neighbourhood – particularly its heritage assets. Last month Queen’s Park Living carried a feature on how the Local Action Team had prompted a citywide scrutiny on ‘party houses’; this month we look at two other examples of bottom up activism supported by the LAT. Faye Bridgwater is a Queen’s Park mum, who has recently moved into the ward from close-by Hanover. She has been leading the charge to get the council to install a pedestrian crossing on Freshfield Road. Faye’s son goes to St Luke’s School in Queen’s Park Rise. It’s a brilliant community primary school, whose head teacher Jonathan Cooper is always driving forward initiatives, particularly those that introduce the children to environmental issues. No wonder pupils are eager to get there in the morning – there is always something to excite young enquiring minds. However, arriving in time for the start of the school day can be a hair-raising experience – especial-
ly if parents and children have to run the gauntlet of vehicles using Freshfield Road as a rat run. Surprisingly, there is no pedestrian crossing on the road and this shocked Faye and her neighbours. At the time of going to press her petition on the council website had attracted more than 600 signatures, including mine and fellow ward councillor Stephanie Powell. Of course, there are numerous requests to install zebra crossings across the city all equally deserving support, but in my view this one deserves prioritising in the council’s transport programme of planned road improvement projects. The next example of community activism – this time to safeguard a heritage asset - was the recent Friends of the Pepperpot clean-up day. It attracted adults and children all keen to see this iconic landmark, surrounding gardens and tram shelter kept in tip-top condition. Armed with shears, saws, brooms and a jet washer, a team of volunteers removed graffiti and algae, cut back overgrown bushes, picked up litter and weeded. In three hours the site was transformed. A clean-up such as this is the cement that bonds a local community and is a demonstrable proof that people really do care about their local environment. Study after study reinforces the connection between neglected neighbourhoods, crime and the fear of crime, which is why the LAT takes such a keen interest in this kind of local activism. Spring into action with CSV LifeLines Would you like to do something different, take up a new hobby or volunteer to help older people be more active? Then come and join us at LifeLines. We run a programme of free activities ranging from art classes to tea dances and Tai Chi. We also help people with basic IT and our Activity Partner scheme helps people who feel isolated get out and about. Most of our activities are based at Patching Lodge in the Queen’s Park area. Three exciting new activities starting this spring are: Celebrate Your Life (in writing) - monthly writing workshops with Mary Deacon Basic cookery for men with Clive Goodwin Talking About Loss with Eve Miller. Here are a few words about why Eve decided to volunteer with LifeLines and why talking about loss is so important. “I decided to offer my services as a volunteer group facilitator with the theme of loss, in all its many
forms, eg loss of a person, pet, job etc. I have worked for many years as a grief counsellor, helping families going through loss. I also worked at a funeral directors and experienced the many faces of grief. “We all experience loss and the different reactions this can cause. These reactions can be bewildering, frightening, depressing and anxiety-provoking, and sometimes we doubt that we will ever get through this. “One of the main experiences of a grief reaction can be isolation. A loss group is a way of getting people together to hear each other, and experience the comfort gained by hearing that others are trying to cope with similar reactions to loss.” Eve Miller

Bag it, bin it, flick it, hang it on a tree... What’s a responsible dog owner to do? I was intrigued to read a letter in The Argus recently about the ongoing problem faced by many people on streets and in parks – how to effectively manage problem dog poo. The letter-writer queried who at Stanmer Park was responsible for bagging up dog poo from paths, only to then throw the tied bag and its contents into the woods where it will take an age to be reabsorbed by the land. What interested me was where the writer also mentioned that the advice in the New Forest is to use a ‘stick to flick’. Having looked into this I found there’s a group of dog owners in the New Forest working together to develop a dog-owners’ code. This code advises people to bag up dog mess at car parks and picnic areas, and elsewhere to use a stick to flick poo from paths into the undergrowth, where it will naturally biodegrade in a few days. Whilst clearly we don’t have woodland spaces the size of the New Forest, I feel this kind of approach could potentially work very well for our own large open spaces, particularly where dog mess bins have all been removed from inner park areas and all but the largest car parks over recent years (I can only assume due to the all-encompassing budget cuts). I also don’t understand why people bag up their dog’s doings and then throw it into the woods or, worse, hang it from a tree. Perhaps these owners intended to pick it up on the way back but forgot. Whatever the reason, I’d be really interested to see our own dear council look into a similar campaign. The other aspect of the New Forest code that interested me was the mention of designated picnic and seating areas. Aside from a sorry looking bench and

table at Sheepcote Valley (now fenced into the sheep enclosure) I can’t recollect any such designated picnic areas in our larger parks. At Stanmer and Sheepcote Valley in particular this could be a great way to help everyone better enjoy the parks. At the moment anyone wanting to have a picnic in the park must lay a blanket down on the floor and hope for the best, and that’s before being visited by a stream of inquisitive dogs. If we can afford miles of new fencing for the sheep at Sheepcote, I’m sure we can find a few pounds for some signs and picnic benches for people too.
