MEET LOCAL COUNCILLOR DENISE COBB Denise was re-elected in May as a Conservative councillor for Westbourne. She is a former Mayor of Brighton & Hove and is currently Opposition Spokesperson on the council’s Licensing Committee. Do you live in West Hove? I recently moved from West Hove to Portslade. What is your background? I was born in Brighton but have also lived in London and the United States; I have two adult sons, a granddaughter and four grandsons. I am currently self-employed as a Massage, Sport Massage, and Beauty Therapist, and a part time teacher of Swimming and Aquatic Exercise. I am also a qualified Badminton and Gym Instructor. Previous employment has involved coaching a variety of sporting, recreational and leisure activities, including leisure management, and working with young adults who had profound multiple learning difficulties and severe physical disabilities. I have experience of working with young people and the long term unemployed, training and helping them find voluntary and paid work. I have been employed in the local hospitals as a Theatre Sterile Services Supervisor and as a qualified Phlebotomist. In the public sector I

have been a customer service advisor. In a voluntary capacity I have been an Instructor for the American Red Cross, helped to raise funds for children’s sport, life-guarded for youth group trips and taught fun exercise sessions for all ages. Politically I was first elected in 1999 and subsequently in 2003, 2007, 2011 and 2015. I started as a back bencher and have been a councillor both as a member of the opposition and as the party of administration. I have served on most committees, and as Deputy Leader of the Council from May 2008 – May 2009 and as Deputy Leader of the Conservative Group from May 2011 – May 2013. I was the Mayor of Brighton and Hove from May 2013-May 2014. What is your proudest achievement as a councillor? I am now in my 16th year as a councillor and my proudest achievement was becoming Mayor of this wonderful city. What issues are you currently working on in the Westbourne area? I frequently assist residents with personal and neighbourhood issues. Refuse and/or recycling problems are ongoing; missed collections, location of communal bins and fly tipping. Currently I am working on problems relating to an outbreak of Dutch elm disease, resulting in the loss of 10-15 mature elm trees. The recent concept of ‘Pay by Phone’ parking has brought a small flood of complaints, however the council have stated that at least one existing pay and display machine will be left in every street. I have also been helping people with issues relating to local planning enforcement and applications. How can people contact you? I hold an advice surgery on the second Friday of every month from 5-6pm at Hove Museum, New Church Road. No appointment is necessary. ALDRINGTON HOUSE The Lady Chichester Hospital, New Church Road, in its early days in 1921. Aldrington House, which occupies the wholearea between Westbourne Gardens and Rutland Gardens, was built in the late 1880s and was in private occupation for 30 years. It was taken over for use as a hospital around 1920 and continued until 1988. It is now used by the Sussex Partnership NHS Foundation Trust. LOCAL NEWS... Here is news of another blue plaque in our area...
BLUE PLAQUE UNVEILED AT ALDRINGTON HOUSE TO DR HELEN BOYLE A blue plaque was unveiled at Aldrington House, New Church Road, in September by the Mayor of Brighton & Hove, Councillor Lynda Hyde. The plaque commemorates Dr Helen Boyle, who led the treatment of women with mental illness at the Lady Chichester Hospital there for many years (see this month’s old photo). The ceremony was attended by members of Helen Boyle’s family and the Ambassador of Serbia, where she saw active service as a doctor during The First World War. Helen Boyle was born in Dublin in 1869 and was the first woman GP in Brighton & Hove, having set up a general practice in 1898 with Dr Mabel Jones at 3 Palmeira Terrace. She and Dr Jones were subsequently cofounders of the Lewes Road Dispensary for Women and Children in Islingword Road, Brighton. The dispensary was moved in 1905 to Roundhill Crescent and Dr Boyle added a 12-bed hospital for the treatment of “nervous disorders” – the first such hospital in England. In 1912 this became The Lady Chichester Hospital and was moved to Aldrington House around 1920 when more space was needed. The hospital was very popular until its closure in 1988 and Helen Boyle was the first woman president of the Royal Medico-Psychological Association. She died in 1957 aged 88.

News of a project to brighten up Boundary Road...
BLOOMING BOUNDARY CAMPAIGN As a local elected representative, it’s great when you stumble upon an issue where everyone agrees. The improvement of Boundary Road is a case in point. We see public cash being lavished on traffic and pedestrian schemes in central Brighton but little in West Hove and Portslade, yet there is so much that could be done to better the situation for shoppers and traders alike on Boundary. Rather than just accept the situation as it has been for years, my colleague Cllr Garry Peltzer Dunn and I have got straight to work on getting things moving. With a dedicated group of residents, including local whirlwind Karen Young, we have formed the Blooming Boundary campaign to raise money to bring some extra colour to our local shopping street. The first step is to get some big planters on the pavements. Mayberry Garden Centre will be helping here, as will volunteers from Tesco and our friends at the Secret Garden. Tesco will also be providing benches if all goes to plan. Many of the traders have offered to help with funding and, indeed, watering when the time comes.

As the team grows, ideas flow. We don’t see the campaign as time-limited. We ultimately want to see Christmas lights here and a better link between the two sides of the street. The history of Boundary Road (and I use the term loosely) is interesting and perhaps explains why it hasn’t received as much council attention over the years as it should have done. With Station Road and Carlton Terrace, it straddles the boundary between two towns – Hove and Portslade (once governed by two different councils). It incorporates three council wards and seven individual councillors. The ultimate aim has to be for the street to self-govern. The creation of a Business Improvement District (BID) has been raised recently and discussions are ongoing. Traders need to be won over if this is to take place. However it’s done, a traders’ group will one day be essential. In the meantime, we – as local residents – will continue to raise cash from anybody who has a stake in improving our area. Before the election, I pledged to run the Brighton Marathon – the Blooming Boundary campaign seems the perfect local cause. Fourteen trees in the Westbourne area have had to be cut down after elm disease spread from a pile of logs nearby.Brighton & Hove City Council’s arboriculture team is asking residents to be vigilant when buying logs.
Saturday 31st October, 4.30pm – 6.30pm Visit us this Halloween – if you dare – behind St Leonard’s Church, New Church Road, through the spooky graveyard, crunch up the gravel path and meet some scary Secret Garden volunteers. Themed activities such as making your own creepy beeswax candle, apple bobbing and spider finder await you. Amazing pumpkin carvings in our woodland walk. (Flickering flames inside, so watch those flowing costumes – we don’t want any accidents.) There will be ghoulish treats and monster tricks, plus a competition for the best Halloween decoration to hang in the Secret Garden – all entries receive a treat so get out those scissors and glue sticks and get creating. A small donation would be appreciated.
Brighton & Hove is home to the National Elm Collection which is under constant threat from the voracious disease spread by the elm bark beetle that lays its eggs beneath the bark of unhealthy trees. The arboriculture team’s efforts to curb the spread of the disease have won international acclaim but infections, linked to elm tree logs, continue to occur. Ian Brewster, the council’s Arboricultural Manager, says, “It is imperative that residents take responsibility for their actions when purchasing logs. If in doubt, always ask the log merchant what species of wood they sell. If elm is mentioned then don’t take them.” Even healthy, fresh cut elm wood can attract the elm bark beetle. TABLE TENNIS...I lOVE IT !! I have discovered a new sport. Table tennis. OK, so I didn’t invent it and obviously it’s not really a discovery as it has been well known and in existence for ages. What I mean is I have now started playing and I love it. It was an accidental and serendipitous find. A group of friends were bored one day in the presence of a substantial wooden bench/table, various bits of plastic, foam and a pound shop child’s golf set. So naturally we built a table tennis set. Having made our own bats, net, and commandeering the plastic golf ball, we set to work. Turns out I’m pretty good. Well maybe “good” is too grand a term. Let’s say I wasn’t as bad as I assumed I would be. Now that a few months have passed we have progressed to real paddles (see, I’m even calling them the real name now) and actual balls (not un-round pound shop 12-packs any more). I have yet to make my way to the free play full-size tables that are dotted around Brighton and Hove, but if I ever do I will be much better I’m guessing as the table will not be knee height and will have a proper net and it will be wider than the current 1.5 x 5ft bench. Currently I am the reigning round robin winner-stayson champion with a hefty eight games in a row victory
streak. It seems my strength lies in mirroring my opposition and returning everything until they get bored and go for the smash which invariably fails so they lose the point. Another points winner is my uncannily fluky knack of hitting the very edge of the table thus rendering a return impossible. Though I have been informed if it keeps hitting the edge it can’t be fluke, I still maintain it is. I find it very therapeutic and soothing especially when we just do an easy rally or when I bounce the ball from paddle to paddle with one in each hand when the others aren’t about to play. Even when playing a real match I find it calming as I’m not competitive so don’t mind if I win or lose. The simple act of to and fro-ing is enough. In the garden... OCTOBER 2015 Lawns cope remarkably well with a huge range of conditions: drought, frost, waterlogging, weeds. If the weather is dry enough, this is a good month to invest some time in lawn care... As the weather cools off, the rate of grass growth slows so your lawn will need cutting less often. The final cut of the year is usually around late October, early November, but I remember a few years back, we were still cutting the grass in December! To start your autumn care, mow the lawn but do not cut it too short. Using a spring-tine rake, rake the lawn vigorously to remove dead grass and moss. This scarifying is hard work and it will soon get your heart rate up so take frequent breaks or do it over a few days. The next stage is aeration. The surface of the lawn becomes compacted through constant use and the amount of air in the soil is reduced so the grass plants cannot thrive. Using a garden fork, aerate the lawn by pushing the fork into the soil to about 15cm depth at intervals of 15cm, all over the lawn. It’s best to work systematically so that you don’t miss anywhere or go over the same area twice. Finally, spread a thin layer
Physalis flowers (1cm) of top dressing all over the lawn and brush it in, to keep the aeration holes open. Top dressing is a mixture of soil, compost and sharp sand which can be made at home or bought commercially but it must be of a fine consistency and dry. If there are any bare patches in the lawn, grass seed can also be mixed with the top dressing. Unfortunately, after all this hard work, your lawn will look a mess but you’ll be surprised at how much better it will look next year. Concerned about your home being sold to fund your future care fees? The Issue
You probably own your home as joint tenants if you are a couple and solely if you are single. For couples this means you own it wholly, jointly and severally. Ultimately therefore you do not own it 50:50 as you might have assumed. You actually own all of it together and when one partner dies the surviving partner owns it solely and absolutely. It is sole and absolute ownership that enables a whole property to be taken into consideration as an asset by the local authority and puts the property in danger of needing to be sold to fund care.
The Reality Today
The care Act 2014 introduced in April 2015 allows local authorities to assess your assets to determine if you need to pay for your own care under the new charges and assessment of resources regulations. Currently if you have assets above £23,250, you are on your own and require care, you will probably have to pay for it all - currently averaging around £1,000 per week. Savings, cash and income would be used first and then your property would need to be taken into consideration. You would be expected to pay for all of your care until such time as your assets were depleted to below the £23,250 threshold. You would then pay for a proportion of your care until your assets were below £14,250 - at which point all your future care would be paid for after any relevant income was taken into account.
The Solution
For couples, simply by changing the way you own your property well in advance of any care considerations i.e. from joint tenants to tenants in common and by setting up two property Trusts either immediately or within a properly structured Will at the same time will in most cases, protect the integrity of your home should you ever require care in the future, so long as avoiding care fees was not a primary motivating reason behind the implementation fo the strategy - i.e. you should be looking to protect your half of your property should your spouse remarry after your death, or you should be looking to ensure that your children would not lose 50% of their inheritance should they be made bankrupt or divorce or for example you should be looking to prevent a generational inheritance tax burden in the future. These are all sound reasons for implementing this strategy which in themselves are not deliberate deprivation of assets, but the implemantation of which protects the integrity of the property.

21 For sole owners the process is simply to set up a Trust now and convey your property into it which will produce the same result again this must be well in advance of any care considerations and the motivation must not solely be for the purpose of preventing your home being used to fund your care.
The Reasoning
When you own your home as tenants in common you actually own half each. With our Post death Property Protection Package when the first partner dies, they leave their half into their Trust. The surviving partner is the Trustee of that Trust and also the Primary Beneficiary which means that as they own half and are Trustee of the other half they have complete control over the property and what happens to it. The children and/or whoever else is also nominated as ultimate Trust Beneficiaries will have access to that half of the property when the surviving partner dies. The first half of the property then is 100% securely in Trust for the beneficiaries and will not be at risk. As a result of this simple strategy and because it is not possible to sell just the survivor’s half of the property, the integrity of the property is protected. While the ‘’market value” of half a property is negligible, The Care Act 2014 guidelines do allow for this half to have a charge placed on it under a deferred payment arrangement for care fees which is why this package includes a Lasting Power of Attorney grant for Property and Financial affairs which will enable a pre-appointed Attorney to act on behalf of the survivor should they be unable to themselves and negotiate with the Local Authority for the property to be rented out and a percentage of the income given to the Local Authority instead of a charge being placed. The second half of the property would then ultimately go into the Trust for access by the nominated beneficiaries when the surviving partner eventually dies. With our Whole of Life and Post Death Complete Property and Family Protection Package both halves of the property are conveyed into Trust IMMEDIATELY. This means the whole property is protected straight away and not just after the first party dies. The benefits of this package are that it then protects the property even if both parties go into care before the death of either. It also means that if the survivor goes into care the property does not have to be rented but if it is 100% of the income goes directly into the Trusts for the benefit of the survivor or any of the other Trust Beneficiaries and does not have to be given to the Local Authority. The most important benefit of this package though is the property can be sold at any time and the resulting proceeds be fully protected for the whole family within the Trusts and no negotiation with the Local Authority is required. Sole owners and couples who have immediately conveyed their properties into Trust well in advance of any care consideration and not solely for the purpose of preventing their home being used to fund their care (deliberate deprivation of assets) secures the integrity of the property (so long as entry into care is not within 6 months of setting up the strategy) as the property is not absolutely owned by an individual anymore and it is not legal to force a Trustee to do something that is not in the ultimate best interest of the Trust Beneficiaries. STONEHAM NEIGHBOURHOOD PLANNING WORKSHOP Some twenty local residents participated in the inaugural meeting of the Stoneham Neighbourhood Planning Workshop, held at the Stoneham pub at the end of June. It was organized by the Hove Station Neighbourhood Forum, the body authorized by Brighton and Hove City Council to prepare the Hove Station Neighbourhood Development Plan (NDP). Mark Drayton, a community worker from the Trust for Developing Communities (and local resident) chaired the discussion. The Hove Station NDP Co-ordinator, chartered town planner Professor Mike Gibson, explained that the purpose of the workshop is to enable the residents and businesses in the part of the Neighbourhood Plan Area west of Sackville Road to be fully involved in the production of the NDP. This area is bounded by Sackville Road, the railway line, Portland Road and Bolsover Road. The area is changing, and will continue to change, in the face of mounting development

pressures, particularly the city’s need for new housing. The Gala Bingo site redevelopment and the proposed demolition of the YMCA building with the possible loss of community facilities have both been controversial issues. Development proposals are in the pipeline for the Westows site. The purpose of the NDP is to enable local people to have the maximum possible influence on the largescale redevelopment of the unused and underused sites immediately north and south of Hove Station (Development Area 6 in the City Plan) and on the smaller scale developments elsewhere within the NDP Area. So the Forum’s Working Groups are identifying the issues raised by prospective redevelopment, including the type of housing (eg the height of apartment blocks and the balance between social housing and market housing), employment opportunities, the additional traffic that will be generated, the opportunity to improve shopping streets and the need for new community facilities for more than an additional 2,000 residents. The neighbourhood planning policies which will emerge will have legal force and will have to be formally taken into account by BHCC planners when decisions are made on planning applications. The Neighbourhood Plan will have teeth! The progress of the work on the Neighbourhood Plan will be the focus of a third Have Your Say Day in early November. The implications of continuing small scale redevelopment and the opportunities to improve the neighbourhood environment in the area west of Sackville Road will be the focus of the second meeting of the Stoneham Neighbourhood Planning Workshop in late October. City Reads (Brighton & Hove) celebrates being the longest running big read in the UK Celebrating ten years of shared reading, City Reads 2015 (Brighton and Hove) is the UK’s longest running big read. This year’s chosen book is Matt Haig’s The Humans, an accessible, funny and inventive book that asks what it means to be human. People have already started reading the book and the events programme runs between 10 October – 1 November. The concept of City Reads is simple: selecting one book for the whole community to read and discuss in a series of special events. Author Matt Haig said: “I am overjoyed to have The Humans chosen as this year’s City Reads title. I originally wrote the book as a kind of advert for the human race, and I wanted it to be a story that as many people as possible could enjoy.” Matt has recently moved to Brighton so he will be around for quite a few of the events. COUNCIL SEEKS LANDLORDS FOR SYRIAN REFUGEES Brighton & Hove City Council is seeking landlords with properties to rent and is co-ordinating offers of help for refugees from Syria. Earlier this year, the council agreed to accept a small number of households under the Syrian Vulnerable Persons Relocation Scheme – a Government scheme which brings vulnerable Syrians straight to the UK from the countries bordering Syria. The Home Office provides funding to help the refugees to integrate for the first year. No families have as yet arrived and the council is currently working on plans to receive and support those refugees with partners in the NHS and the voluntary sector. This scheme operates on the basis that affordable and sustainable accommodation is found for the refugees in the private rented sector. They will be entitled to seek work and claim benefits when they arrive. A range of support services will be available for the households to help with their integration. We already have experience of receiving a group of refugees in this way. In 2006, 79 people, mostly Oromo from Ethiopia, came to the city on a similar scheme, the Gateway Protection Programme. These people are now British citizens, their children have grown up here and they are contributing to the community in many ways. Following the Government’s announcement, it is likely that the number of people coming into the UK through this scheme will increase and Brighton & Hove City Council will work hard to accommodate additional families, if asked to do so. At this stage, the exact details are not clear. Brighton & Hove has a long history of welcoming refugees from across the world and has an active support sector for refugees and other migrants. The city was recently awarded City of Sanctuary status for its work with refugees and the council is working closely with the local group, Sanctuary on Sea. The council is also collating responses from residents who are making offers of practical support to refugees and asylum seekers that might come to the city as well as those who are already here, and they can point residents towards other partners and agencies who can help.
