Marriage Laws in Gibraltar Introduction Marriage is the sweetest thing that most couples and love birds dream about. In the eyes of the law, marriage is a legal union of two people who’s legal status changes by imposition of certain mutual obligations such as parenting, ownership of properties, inheritance and exclusive right to sex.
Marriage Law in Gibraltar Gibraltar marriage law stipulates that this should be a union between one man and one woman. Section 13 of the act provides that both residents and non residents can get married on the rock. This gives
many foreigners and Spaniards, alike, the opportunity to get married in one of the most beautiful and renowned British colonies.
Marriage for Residents For Gibraltar residents wanting to get married in church, marriage notice must be given to a registered minister and this must be done 21 days before the wedding to allow room for publication of marriage banns and exhibition of notice. Marriages for Non Residents Many couples outside this region have already been married in Gibraltar. Civil marriages on the rock are provided for by the special license granted under section 13 of the marriage act. This law allows non residents to get married in this region without the need to adhere to complicated statutory requirements.
Conditions of Marriage Before marriage by special license, one must complete the necessary affidavits before a commissioner of oaths and the notary public. Each partner must prove that they are free to marry. Widow and widowers must provide a birth certificate and a spouse death certificate. If the death certificate does not have the name of the widow or widower, a marriage certificate must be provided. People who have been previously married will need to provide a birth and divorce decree. National identification cards, passports and birth certificates must also be provided. In addition, the couple must prove that they will be staying, in Gibraltar, for at least one night by showing the booking certificate. Conducting of the Ceremony
The provisional booking for the ceremony can be done by contacting us Sweet Gibraltar Weddings by either telephone or email. The ceremony must be held before two years after the booking. According to the law, marriages can only occur at the Registry Office or at approved locations. These locations include The Caleta Hotel, The Mons Calpe Suite, The Dell at the Botanical Gardens along with a few more. Marriage at the Registry Office takes place on weekdays between 10.00am and 2.00pm but exclude public holidays. Marriages are also not held between the last 2 weeks of December and the first 2 weeks of January. Marriage at other locations (as mentioned above) can take place any day excluding Sundays from 10am to 6pm.
Other Requirements After booking, the couple must attend the offices before 10.00am of any working day to show their original documents and swear affidavits so that the special license is granted. This can be done a maximum of 3 months in advance or at a minimum, 24 hours before the ceremony. Immigration documents such as visas are also required
for non EU nationals. Upon certification of documents, fees are paid for the special license, ceremony and registration as well as the marriage certificate (these fees are paid by Sweet Gibraltar Weddings when our services have been chosen).
