Oxford landlords & tenants, don’t get caught out by MEES! Bill Cooper, co-author of The Oxford Property Blog and managing director of Martin and Co, Oxford

IT seems a long time ago now that the Minimum Energy Efficiency Standards Regulations (MEES) passed into law. So long in fact, that many Oxford landlords have forgotten about it. In this article we consider the following questions: What is MEES? Which of Oxford’s rented homes might be affected? And, what should Oxford landlords do now?

What is MEES? MEES regulations apply to both residential and commercial property. The legislation aims to improve the energy efficiency of the most inefficient properties i.e. those with an energy performance certificate (EPC) rating of ‘F’ or ‘G’. Which Oxford rented homes are affected? In practice, MEES compels

landlords of all Oxford properties with an EPC below ‘E’ to carry out works to raise the EPC to a rating of ‘E’ or better. From 1 April 2018 it will be illegal for landlords to grant new tenancies to new or existing tenants where the property has an EPC below an ‘E’ rating. It is the landlord’s responsibility to ensure that the property is brought up to that standard. In most cases, it will also be illegal to let a property without an EPC. Some Oxford properties may be exempt, for example listed properties, but the landlord must demonstrate that she/he has implemented all cost effective energy improvements available for the property, or that the required improvement to achieve the ‘E’ rating is either inconsistent with the listing restrictions or that

they would devalue to property. It is clear, however, that Oxford landlords should not assume that their listed property is exempt. Civil penalties of up to £4,000 will be imposed for breaches. After 1 April 2018 properties below an ‘E’ rating will not be allowed to renew a tenancy agreement to existing tenants (irrespective of their desire to stay) nor grant a new agreement to new in-coming tenants. What should Oxford landlords do now? Every rented property should have a current EPC. If your Oxford property does not have a current EPC you should have the property assessed by a qualified assessor immediately. Where the current or new EPC confirms the property has a rating below ‘E’ (i.e. ‘F’ or ‘G’) the property

must be assessed to establish what actions are required to bring the rating to ‘E’ or better. This applies for listed and non-listed properties. Often this involves relatively straight forward and inexpensive measures e.g: • Fitting dampers to open chimney enabling the flue to be mechanically closed when not in use • Adding an insulation jacket to the hot water cylinder • Changing lightbulbs to LED’s • Adding insulation to loft spaces Only once all measures available to a landlord have been exhausted, will owners’ of listed Oxford properties be able to apply for an exemption.
