BY MONA SHAH In a new exhibit, “PhotoCollages,” thoughtful and perceptive works of artist by Sculptor Carla Moss will be displayed at the Phantom Art Gallery in Milpitas. Her work can be highly abstract, incorporating kinetic arts, moving wheels, and industrial elements or a tiny bronze fawn lying in ivy. Moss’ largest sculpture to date is two flying bald eagles, 17-feet tall and her smallest, a pair of wood ducks standing 2 inches. Although born in San Francisco, Moss grew up in northwest Montana surrounded by the natural beauty and grandeur of Glacier National Park, a
bit of a tomboy. She says, “I grew up riding a neighbor’s horse at age six and later, at eight, got my own horse, Knobby, an ancient cow pony. My dad had three girls before he finally had a boy so he had to practice on us by teaching us fishing, hunting, sports, swimming, skiing, and being able to survive in the great outdoors. We all loved it and it has been useful in my career and what I love to do for my ‘down time’.”
Moss attended Montana State University graduating with a degree in Art Education and Design. Following graduation, she
worked at Glacier Art Gallery in Kalispell, Montana and a major bronze casting foundry, learning casting and metalwork. INDEX It’s a date . . . . . . . . . . . . . . . 3

Those who have visited Milpitas City Hall have most likely seen two of Carla’s one-of-akind projects: The Flute Player, a life size little girl sitting on a rock in the pond playing a little tin whistle and Cartwheels, the three figures of children on the front lawn. Currently, while maintaining her art and design studio, Moss is a substitute teacher for Milpitas Unified School District as well as the Berryessa School District. She is also an instructor for Young Rembrandts and will be teaching at Silver Creek Academy in Milpitas.

The book selected for 20102011 is “Hot, Flat, and Crowded: Why We Need a Green Revolution – And How it Can Renew America.” The “hot” is global warming; the “flat” is the rise of the middle class; and “crowded” refers to the growing population around the globe. These three mega concerns are explored in this extraordinary best seller by its Pulitzer Prize winning journalist/author Thomas L. Friedman. Read it, think about it, and talk about it with fellow citizens in a discussion session. Book discussions were held in November and December of 2010; two more are scheduled for the upcoming months. On Thursday, January 27, Leta Stagnaro, Associate Vice President, Newark Center for Health Sciences and Technology will lead a discussion at Ohlone College, Newark campus from 3:30 p.m. – 4:30 p.m. and Florence Silver, AAUW member and Evening Literature Chair, will conduct the last meeting on Tuesday, February 22, from 7 p.m. - 8 p.m. at Temple Beth Torah in Fremont.
All discussions are free and open to the public; you do not have to read the book to attend. One Book, One Community Reading is a community action project led by American Association of University Women Fremont Branch (AAUW) in collaboration with Fremont Main Library, City of Fremont, and Fremont Unified School District. Michigan man’s defensive weapon for the birds AP WIRE SERVICE MENDON TOWNSHIP, Mich. (AP), Jan 08 - A southwestern Michigan man says a birdhouse on a pole became his weapon of choice - or at least necessity - to ward off an attacker. WWMT-TV reports Friday that Travis Lux from St. Joseph County’s Mendon Township agreed to help a man who came to his door claiming to have car trouble. But as the two walked outside on Thursday night, Lux says he was struck in the back of the head with what felt like a rock. Lux says he saw his nearby birdhouse and pushed its pole as hard as he could into the attacker, and then hit him in the face with it. The man ran to a waiting, working vehicle. Lux described him as about 5-feet-10-inches tall, in his mid-40s with a gray goatee. —Information from: WWMTTV, http://www.wwmt.com

HSSV offers microchip special to reunite lost pets with owners SUBMITTED BY KELLY GRANT Joy and relief washed over Faye as she received the amazing news from an animal shelter that her beloved cat Ted had been found. After two long years of waiting, worrying, and wondering where Ted was, her
prayers were answered. He was safe and sound! All thanks to the microchip implanted into his neck that listed Faye’s current contact information. If someone finds your lost pet and brings him to a shelter or a veterinarian’s office, animals can be scanned for a microchip.
Humane Society Silicon Valley (HSSV) wants to help reunite lost pets with their owners. That’s why during the month of January HSSV is offering discounted microchip implant services at $30 per microchip (regular price is $45). Combined with a spay/neuter
surgery, microchip implants are just $25 all year long! It’s fast and easy. Walk-in service is welcome at HSSV’s Medical Center (901 Ames Ave., Milpitas) between 9 a.m. to 6 p.m. Monday through Friday and 9 a.m. to 5 p.m. on Saturday. No appointment is
necessary. Microchips are provided by HomeAgain Microchip, the nation’s largest microchip database. For more information, visit www.hssv.org or call 408-2622133 x108.

Protest water rate increase The Alameda County Water District is again proposing to raise the rates by 8 percent this year. The rates have been raised every year since 1999, including an 8.8 percent hike last year. The reasons given for this increase are less usage of water, escalating salaries and 20 percent more for employee pensions. We are always urged to conserve water and then penalized with increased rates when usage declines. It seems the Water District is not aware in this recession that many people are unemployed or their salaries are cut with no raises. Yet the Water District union has negotiated 4 percent raises through 2013. This
is unconscionable. Those of us on Social Security have had no increases for two years. In addition to yearly water rate increases, there is an additional $11.62 service charge on each bill. Please contact the Water District immediately and voice your objection to the annual rate increase and exorbitant $11.62 service charge. Their employees should feel the pinch in this economy as well as the rest of us. Their phone number is (510) 668-4299 and address: 43885 Grimmer Blvd. Fremont 94538. Peggy Gerling, Fremont
BY PAUL ELIAS ASSOCIATED PRESS SAN FRANCISCO (AP), Jan 18 - The America’s Cup regatta is nearly two years away, but the planning and hyping of yachting’s most prestigious event have already begun. Newly appointed San Francisco Mayor Ed Lee said Tuesday that he has created a committee of city officials to bring off the 34th race for the cup in late 2013. Lee said hosting the America’s Cup, which San Francisco was awarded last month, has the economic magnitude of several major sporting events because each racing team will set up a base along the San Francisco Bay many months before the weeklong event.
“It is several Super Bowls put together, strung out over time,” said Lee, who put the city’s Office of Economic and Workforce Development in charge of the municipal committee. “This is not just a one-day event.” Lee said during a news conference on one of the city piers that will be taken over for the race that he expects the event to boost the local economy by $1.4 billion and create 9,000 new jobs. Officials are planning on using nine city piers and one two-acre lot, which could lead to the eviction of as many as 80 current tenants. Officials with the Port of San Francisco, which serves as landlord to 600 businesses, said they are working to relocate the evicted continued on page 28

Mail theft is a significant problem that is often preventable. Avoid becoming a victim of mail theft by following these tips: • Don’t leave outgoing mail in an unlocked box. Take it to the post office or a retail mail service store. If you don’t have a choice and must leave outgoing mail in your mailbox, do this immediately before the letter carrier arrives. • Avoid leaving mail out in your mailbox on Sundays and holidays, when letter carriers don’t provide services.
• Consider replacing your current mailbox with one that has a locking device. • Never raise the mailbox flag. The red flag sticking up is an open invitation to thieves. • Have a trusted friend or neighbor pick up your mail when you are out of town. • Arrange to pick up newly ordered checks at the bank instead of receiving them by mail. • Use gel pens to write and sign checks. The ink in gel pens is resistant to chemicals used in check washing schemes. • Check your bank statements frequently. • Always shred your personal documents and credit cards before discarding them.
Fremont Crime News SUBMITTED BY DETECTIVE BILL VETERAN, FREMONT PD Shooting A woman was driving near Mission Blvd and Hwy 680 north when a window of her car was shot out. Police found a witness on Mill Creek Road who heard shots coming from up the hill just prior to the victim’s call. East Bay Regional’s helicopter assisted in the search and located three vehicles and six persons near 5003 Sheridan Road. Police discovered that these people were shooting rifles earlier. It appears likely that a stray round was responsible for the incident. While the investigation was in progress, a pit bull secured in one of the suspect’s trucks escaped and charged several officers; K-9. Sergeant Epps was forced to shoot and kill the dog as a result. No persons were hurt and no buildings were hit. Multiple rifles and shotguns were seized and a complaint is being sought on four of the suspects. Bank Robbery On Tuesday, January 18 at about 9:35 a.m. Fremont Police responded to a robbery alarm at US Bank located on Fremont Blvd. and Beacon Street. Responding units observed a possible suspect vehicle leaving the area and attempted to stop it at Fremont Boulevard and Mowry Avenue. The suspect vehicle accelerated in an attempt to evade pursuing officers. Pursuit continued northbound on Highway 880 into Union City. The suspect vehicle traveled through Union City and continued northbound on Mission Blvd. into Hayward. Several Fremont Patrol units were involved as well as officers from Union City and Hayward PD. The suspect vehicle crashed in Hayward in the area of Mission and Industrial Boulevards. Two suspects were immediately taken into custody; a third suspect fled into a residential neighborhood. The outstanding suspect was later found hiding in the neighborhood. The suspect vehicle crash was a solo accident. Currently all three suspects are in custody. There were no injuries to any officers, citizens, or the suspects. Personnel from Fremont PD, Union City PD, Hayward PD, Alameda County Sheriff’s Office, and the California Highway Patrol assisted.

T
he human mind is complex. We need constant encouragement to continue doing things that we said we were going to do. There are times when our strength is not enough to complete idealistic goals we make as New Year’s resolutions. Perhaps it was the smaller size sleepwear I received for Christmas that hinted at my weight gain. I had put on a few pounds – okay, about 25 lbs., but I was doing really well blaming holiday food intake in a desperate attempt to sound festive. I knew I had to do something about it. Why is January 1st special? What makes us think we are better equipped than the year before? And what happened to my resolutions anyway? I realized that most items on my list are not working out for me after a few weeks into the year. Could I set up foolproof New Year resolutions? Sure, if I had someone I trusted to push me daily in pursuit of my targets. The television program, The Biggest Looser, attains such great results with obese people only because competitors are provided with daily professional trainers, in-house chefs, immediate medical attention, and great cash prize in-
WHAT’S HAPPENING’S TRI-CITY VOICE
centives. But I depend only on myself to achieve my goals. By observing my own actions, I discovered that my New Year’s resolution list lacked potential for success, unless the protagonist –me, was totally responsible for making it happen. You see, most of us fail at completing goals and immediately attribute fault to bad weather, or the eight hour day jobs we hold. For me, it is the lack of sleep – even though I continue to watch late night television. When I am tired and lack chocolate energy, my mental strength is not at its peak, and I begin to hold trivial circumstances responsible to escape from blaming myself. Goals that I made while toasting sweet champagne at midnight in celebration of New Year’s began to be kicked to the curb. This was my Eureka moment; are you ready? It is absolutely necessary that I make myself liable, important, and in charge. By making me fully and completely responsible for working toward a goal, it becomes attainable. The target was not the goal, it was me. Who would I disappoint if I failed to loose weight this year? Me! Who do I hurt by smoking smelly cigarettes? Me! – I put that in
Page 7
there for sensory effect, I am not a smoker. Anyhow, whose health should I worry about? Mine! Who looks bad if I quit my promises? I do! Who should criticize me if this article does not result in weight loss for readers? Me! Wait a second, not even me! Saying that I matter, changes a goal completely for me. Reacting any other way turns goals into vicious cycles of failures. By putting my good reputation on the line and choosing the lead position –I became the goal. Respect, integrity, honesty, accomplishment, and sweet success followed. I need to first commit to myself, rather than a difficult goal. In my last year’s resolution list I committed me to writing a book. I had never written a book of any kind before and the project took ten months to finish. During the process, I kept telling myself how crazy I was to even think I could do this; convincing me that I could do it was the key to my 5000 piece puzzle. I could have ended the project as I grew tired of it by the sixth or seventh month, but the commitment to my reputation became stronger and the book became real. I then began the proud process of telling others of my plans.
Use my Eureka moment and continue striving to do your New Year’s resolutions. Write your name on top of the list followed by the goals you want this year. Commit to you first. Success and achievement of goals will follow you. A prayer or two should help too!

Comcast-NBC merger protects consumers, competition and innovation Settlement gives California authority to provide oversight on $30 billion telecommunications joint venture
SUBMITTED BY MICHELLE QUINN California Attorney General Kamala D. Harris announced, on January 18, a settlement that places conditions on the $30 billion joint venture of Comcast and NBC Universal to safeguard innovation and protect consumer choice. The state reached this settlement in conjunction with the U.S. Department of Justice and the state attorneys general of Washington, Texas, Florida and Missouri.
“This settlement will preserve the right of consumers to enjoy the best content at the best prices and encourages a competitive environment where innovation can thrive,” Harris said. “With these protections, this settlement strikes the right balance between protecting consumers and ensuring a fair playing field without preventing economic development.” Comcast, based in Philadelphia, is the largest cable television company in the nation. It is the dominant cable provider in several California markets,
including the Bay Area, Sacramento and Fresno. Comcast also offers Internet and telephone services to homes and businesses and owns several popular cable channels, including regional sports channels and the E! Entertainment channel. The combination would give Comcast ownership of NBC Universal’s programs, local stations, production facilities, cable channels including MSNBC, CNBC, Bravo and USA Network and a major film studio. continued on page 30

Hand Therapy Restores Function for Everyday Activities

hether you’re a weekend warrior who just overdid it or are recovering from a serious injury or illness, the Washington Outpatient Rehabilitation Center can help you get back on your feet. Highly trained physical and occupational therapists develop individualized treatment plans so that patients can improve their physical abilities and get back to their lives. “We help people with everything from minor sports injuries to major physical impairments that are causing pain or limiting physical ability,” said Sharmi Mukherjee, a physical therapist and manager of the Washington Outpatient Rehabilitation Center. “Our therapists focus on building strength and mobility and improving function.” The rehab center helps people who are suffering from pain or mobility problems due to an injury or illness, including arthritis, tendonitis, repetitive-stress injury, and bursitis, according to Mukherjee. It could be due to a sports or work-related injury, or surgery. “We see a lot of people who have had hip surgery, a knee replacement, or spine injury,” she added. After a thorough evaluation to determine pain levels, strength, and range of motion abilities, therapists and their assistants work with rehab patients to help reduce their pain and increase their strength and
Sharmi Mukherjee, physical therapist (pictured left) and Mark Neves, occupational therapist (pictured right) are part of a highly trained team of therapists at the Washington Outpatient Rehabilitation Center. All patients at the center receive individualized treatment that is designed to get them back to their previous level of strength and mobility. flexibility. They use ultrasound, electrical stimulation and other methods to reduce pain, swelling, and scar tissue, in addition to guiding patients through a physical routine, Mukherjee explained. The exercise routines use a variety of equipment, including recumbent and upright stationary bicycles, an upper body exerciser, therapeutic exercise balls, and a treadmill, as well as other stretching and strengthening equipment.
“We provide a course of therapy designed to get people back to their previous levels of functioning,” she said. “That might mean being able to return to their sport or job, or just being able to perform some of the tasks of daily living like getting dressed.” Restoring Hand Function People who suffer from hand, wrist, or elbow pain due to a traumatic injury like a fracture, repetitive-strain injury such as carpal tunnel
syndrome, or diseases like arthritis could benefit from hand therapy. “Our goal is to restore function in the hands so patients can get back to their everyday activities like working or caring for their children,” said Mark Neves, an occupational therapist at the Washington Outpatient Rehabilitation Center. “About half the cases I work on are the result of a work-related injury. I do see some weekend athletes and young people who
come in because they fractured their wrist or arm due to a sports injury or fall off a skateboard.” Depending on the injury, treatment might include hot packs to loosen joints and tendons or cold packs to reduce swelling, as well as splinting, according to Neves. “First we need to address the symptoms,” he said. “We create custom splints for fractures of the forearm, wrist, and finger that help with positioning.” When patients are physically ready, Neves starts them on hand exercises designed to improve flexibility, range of motions, and dexterity. These might include exercises using rubber bands or pliable rubber balls that can be squeezed and manipulated with the hands. “For hand therapy, it’s not really about improving strength like other forms of physical therapy,” Neves said. “It’s more about improving the motor skills in the hands so they can function as well as or better than before.” While the average course of treatment for occupational or physical therapy is about eight sessions, it can vary widely depending on individual circumstances, Mukherjee said. Patients must be referred to the Washington Outpatient Rehabilitation Center by their doctors. The rehab center is located at 39141 Civic Center Drive, Suite 120 in Fremont.

SUBMITTED BY PAUL DUNN PHOTO BY ED OHYE Irvington High’s JV Lady Vikings soccer team started the week with a Tuesday game against the Newark Memorial High’s Cougars in Newark. Both teams had won all of their previous games this season, so a close and exciting game was guaranteed. Irvington’s supporters were not disappointed as the Vikings midfield of Molly Cory, Sarina Utamsing and Rhian Dunn took control of the middle of the field early on in the first half. This allowed the Vikings to press forward and play the majority of the game in the Cougars’ half. However, it was not going to be Irvington’s day as they could not put the ball past the Newark keeper and the score remained 0-0. In the end only a leaping save by Vikings keeper Andrea Hanna in the final seconds of the game saved the Vikings from an undeserved defeat. Final score: 0-0. Two days later, Thursday, Jan. 13, the Lady Vikings went up against the Mission San Jose High Warriors at Tak Fudenna Memorial Stadium. The Vikings

versity East Bay Lady Pioneers hoops team recorded its first victory of the season — a 10point, 65-55, home win over
Cal State University Los Angeles on Saturday, Jan. 15. “It’s great to finally get that first win,” said East Bay coach Suzy Barcomb. “This was a total team effort.” Four East Bay (1-13, 1-9 CCAA) finished in double figures scoring, led by freshman Sarah Finlay, who netted 16 points to go along with her
team-leading seven boards. Kristina Lin (14), Marlene MacMillan (12) and Azizi Dotson (11) were the other Lady Pioneers in double digits. But the most glaring statistic for the East Bay win — one in which they paced themselves well, leading 30-26 at half before topping LA 35-29 in the second — was the rebounding
edge. Led by Finlay’s aforementioned seven boards, CSUEB out hustled LA to the loose balls 14 times, snatching 41 rebounds to CSULA’s 27. Out of East Bay’s 41 rebounds, 16 were offensive, leading to multiple second-chance points. continued on page 15

BY GARY VAN DEN HEUVEL PHOTO BY DON JEDLOVEC Both local junior colleges had mostly positive results in their early season conference schedules. Chabot College men’s basketball team bounced back from their loss last week to Ohlone by whipping visiting Foothill College 69-54. The potent Gladiator offense spread the wealth around, with four players scoring in double digits: Jourdan DeMuynck (16 points), Kurtis Ong (14), Howie Manzo (10) and Jacob Noisat (10). Chabot’s women’s team suffered their first loss in Coast Conference North play, falling 69-66 to Foothill College at home. Stellar offensive performances by Karina Caines
weren’t enough to put the Gladiators over the top, and at week’s end, Chabot is at 2-1 in conference play, 12-7 overall. Ohlone College men’s team had an up-and-down week, starting off the week with a vic-

“We did outstanding work on the boards tonight,” Barcomb said. East Bay did well on the boards in their only other game of the week — Thursday, Jan. 13, at home against Cal State University Dominguez Hills. However, despite grabbing 48 rebounds (to CSUDH’s 34), Dominguez Hills won a tough CCAA road game, 4942. MacMillan was the only Lady Pioneer to show up, pulling down 16 rebounds to go with her 14 points in the losing effort. torious road trip to Las Positas College in Livermore. Lavon Gray led the Renegades with 23 points in their 63-59 win. Geoff Hartman kicked in nine in the win. Unfortunately, Ohlone’s three-game winning streak in the conference was snapped later in the week (Jan. 14) with a 78-64 loss to City College of San Francisco. Ohlone College women’s team rebounded from their first conference loss (a Jan. 8, 70-54, defeat at the hands of CCSF) with two straight wins – a 42-41 squeaker on the road at De Anza College, and a 58-49 home victory over Mission College. Coach Julia Allender’s squad sits at 31 in CCN play. Chabot and Ohlone’s men and women hoop teams played on Wednesday, Jan. 19. Results, however, were unavailable at press. ble headers: Jan. 13 vs. Dominguez Hills; Jan. 15 vs. Los Angeles. No. 7 ranked Dominguez Hills blew out the Pioneers 70-52, while CSULA squeaked by East Bay, 67-63, to give the Pioneers an eight-game losing skid. Will Freedman and Roshun Wynne led the way for the Pioneers (2-12, 0-10 CCAA) in the loss to Dominguez Hills, scoring 16 and 14 respectively. Wynne was the leading scorer against LA with 19; George Toyama chipped in with 14 in the losing effort. In other East Bay athletics during the week, the Lady Pioneers swim team hosted San Jose State on Friday, Jan. 14, before heading to Reno, Nev., to take on the University of Nevada on Saturday, Jan. 15. In two
losses, East Bay showed some signs of breaking out. Rachel Knowles finished second in both the 50 yard breast and 400 IM. Tristan Kennedy-Donohue finished third in both the 50 free and 100 back. Lindsay Miller, Murphy Wimer, Sara Bonino, Jenni Perez, Heidi Reddig and Rebecca Stratton all performed admirably in placing against SJSU in the loss. The Lady Pioneers went to Nevada on Saturday and got more impressive runs by the aforementioned swimmers, but fell to UC Davis and Nevada-Reno in the trimeet. They will be back in the pool on Jan. 22 against Azusa Pacific. For a complete list of upcoming CSUEB games, log onto the Tri-City Voice Sports page, http://sports.tricityvoice.com.

Calif. state parks buy new 535-acre redwood tract AP WIRE SERVICE
SAN JOSE, Calif. (AP) Two land trusts have sold a 535-acre tract of redwoods in the Santa Cruz Mountains to the state parks system, under a deal that they also provide staff and maintenance to help the cashstrapped department. Palo Alto-based Peninsula Open Space Trust and the Sempervirens Fund have created a $1.3 million endowment for improvements and maintenance at the park, called Little Basin Redwoods State Park. Little Basin used to be a retreat for Hewlett Packard employees. A nonprofit company will take reservations and staff the park, meaning the state will not have to hire new rangers. There are 36 camp sites, 14 cabins and a fishing lake at the park. The deal is a new economic model for the state parks system, which has reduced hours and has a $1.2 million maintenance backlog. —Information from: San Jose Mercury News, http://www.sjmercury.com

hop into year 4708 for people born under the sign of rabbit. Rabbit babies are private, introverted and withdrawn. Or quietly charismatic, thoughtful
and calm? It is hard to generalize a destiny using a centuriesold system based on natural elements, marked by fixed colors and assigned a dozen animals as they correspond to the hour, date, month and year of birth. One thing is clear, said Elizabeth VanderVen, an assistant history professor at Rutgers University in Camden, New Jersey, and a specialist on Chinese and eastern Asian culture: “Rabbits are considered to be especially lucky financially.” She said, noted that some believe rabbits are the luckiest of all signs in the Chinese Zodiac. That, VanderVen said, could be especially true this year because the 2011 rabbit year corresponds with the element of metal, symbolizing great wealth. This we can make easy sense of: American baseball superstar Alex Rodriguez is a rabbit, incredibly wealthy from his sport. Other rabbits are movie stars Johnny Depp, Angelina Jolie, Brad Pitt, Charlize Theron, Drew Barrymore; pop music singer-
Page 17
songwriter Enrique Iglesias; British author George Orwell; Frank Sinatra; Albert Einstein and Leon Trotsky. In Vietnam, the rabbit is not a rabbit at all but a cat, which failed to make the top 12 in China, according to legend. The rabbit comes fourth in the zodiac’s 12-year cycle. Rabbit years include 1927, 1939, 1951, 1963, 1975, 1987 and 1999 on the more international Gregorian calendar, as opposed to the lunisolar Chinese calendar that pegs 2011 as 4708. The major holiday in Asia shifts somewhat over January and February. This year it starts Feb. 3 and always lasts for 15 days. The Chinese calendar not only follows the 12-year cycle but characteristics within the cycle are touched by the influences of fire, earth, metal, water and wood, each with a yin (female) form and a yang (male) form. To make leap year adjustments, the colors of white, black, green, red and brown also are assigned. This rabbit year is white
yin metal, likely making the precious metal of silver prominent, so watch for lots of silver souvenirs. “The 2011 rabbit will obtain wealth if s/he works hard and diligently,” VanderVen predicts. Her personality list for rabbits: honest, sensitive, tactful, stylish, sophisticated, virtuous and modest, but they also are viewed as snobbish, standoffish, self-righteous, oversensitive and a little unpredictable. Boston’s Brittany Falconer, 23, is a rabbit. Is she more an impish old-time cartoon bunny Bugs than the impish cartoon sexpot Jessica? “I can’t make a rabbit face like Jessica,” Falconer said, “but I guess I’m somewhat rabbit-like: quiet, observant and capable of sneakiness!’’ Much of last year was not fueled by rabbit luck for Falconer. She graduated from college in 2009 and could not land a full-time job until September. “I do think I’ve been very lucky in enjoying an uptick in complimentary drinks,” she said.

eflecting on the first decade of the 21st century, we can see the ups and downs and a tumultuous economy. But we can also look to the future and see the path towards recovery. Despite the tumultuousness, families pulled together and did more with less. Likewise, here at the county, we were still able to accomplish a lot, despite diminished resources. I wanted to take a minute and reflect on some of the great things we put in place in 2010 to benefit residents of Santa Clara County, thanks to your support. Highway 101 Corridor Improvements I hope you got my email from last month, announcing the pending construction of Highway 101 at Tully Road. If you travel Highway 101, you may have seen the construction equipment appearing around Tully interchange. I am very excited to see this as it is the realization of almost a decade of hard work and perseverance. Since I was first elected in 2001, I have fought tooth and nail to upgrade this interchange. This project will dramatically increase motorist and pedestrian safety. Also, it will begin to ease the traffic congestion on this vital road. But the fight isn’t over. Just before Christmas I met with state leaders to develop a strategy for securing the remaining funds to update the Yerba Buena and Capitol Expressway interchanges. The projects are already designed; all that is needed now is about $31 million to complete the construction. This is my number one transportation goal and hopefully I’ll have good news for you in late spring 2011 on securing the funds. I am also working to plan a celebration of the groundbreaking of the construction work. For more information on the project or the celebration, please contact my office at 299-5030 or rabia.chaudhry@bos.sccgov.org. District 3 out in the community I strongly believe in the power of communities. In 2010, my office and I participated in dozens of local events put on by neighborhood associations and community organizations to show support and help connect residents to county services. Also last

year I co-sponsored the First Annual Day on the Bay: A Multicultural Festival in Alviso with the Santa Clara County Parks and Recreation Department. This festival allowed residents from across the county to learn about services and resources available to them as well as enjoy free live entertainment, free food, free kayak rides at the Alviso
Marina and free pumpkins. My staff and I are already planning this year’s events and I hope to see you at one of them. A greener Santa Clara County In order to ensure our community’s survival, we must make it sustainable. With that in mind, I’ve focused a great deal of time on greening and making sustainable not only county operations but the community, too, including supporting the creation of a County Office of Sustainability. This office will further the goals of the environment, economic stimulus and equity. To put it simply, the office will help the county ensure that all its residents have a healthy place to live and a chance for good jobs.

No more young minors in Juvenile Hall Last year was a significant year for social justice in Santa Clara County. After studying the issue and taking public testimony, I asked the Board of Supervisors to approve a resolution to no longer place any child 12 years old or younger in Juvenile Hall – and the Board unanimously agreed. Children this young need one-on-one, highly intensive intervention – and Juvenile Hall is not setup to do this. Young offenders are now being placed in highly trained parental care-like settings, where they can receive the attention and care needed to rehabilitate and re-enter the world. Studies show that 97% of these kids will not re-offend. A cost efficient and rehabilitative criminal justice system In an effort to make the criminal justice system fairer, while at the same time saving taxpayer dollars by easing the burden on the courts, my office has been working with county staff on how to divert certain low level offenses away from the judicial process. Such “diversion” programs have been successful in many other jurisdictions because they allow non-violent offenders to correct their offense while not taking up valuable time in the courts. Last December, the Board approved the first diversion method – giving infractions (as opposed to misdemeanors) for certain low level vehicle offenses. These are just a few of the changes that I worked on last year. I have more ideas for this coming year, but I know you have many other great ideas. To that end, I led in the creation of a whistleblower hotline for county employees and residents to make anonymous tips and suggestions to help us create a more efficient and accountable county government. Suggestions can be made online at www.sccgov.org or by calling 888-302-7743. All information will be kept private. I look forward to serving you as the President of the Board of Supervisors this year. My office is always available to you to answer questions or connect you with services. Please do not hesitate to contact me at 408-299-5030 or dave.cortese@bos.sccgov.org.

Comcast-NBC merger continued from page 9
NBC Universal, based in New York City, is also part owner of Hulu.com, which distributes television programming and other video over the Internet. The settlement prohibits Comcast/NBC Universal from withholding its content from competitors, including other cable companies and Internet providers, who control the “pipes” to consumers. It prevents the joint venture from unfairly raising the price for its content to other cable companies or Internet providers, which could prompt these companies to increase pay-television prices for their viewers. It also prevents Comcast/NBC Universal from restricting or degrading access of its content to other cable companies or Internet providers. Comcast must relinquish all control over Hulu.com and continue to supply NBC content to the website. California will be able to independently enforce provisions in the settlement for at least seven years. Under the terms of the settlement, the court retains jurisdiction that will allow California or any other party to enforce the agreement, modify it and punish violations. For example, California will be able to prevent Comcast/NBC Universal from retaliating against any broadcast TV network, cable programmer, local TV station or video producer for providing video programs to a Comcast competitor. The settlement gives California the power to enforce Comcast’s obligation to provide any online video distributor the same programs it provides to any traditional pay-television system with equivalent terms and conditions. Additionally, Comcast must not restrict the further distribution of its video programs by companies to whom it sells programs. The Federal Communications Commission has also issued an order approving the proposed transaction with conditions. For more information, visit http://oag.ca.gov.

two hours eventually convinced her to put down the gun, which was cocked and ready to be fired. Officer Abbie Serrano, a hostage negotiator and CIT trained officer, continued the dialogue convincing the subject to relinquish the gun. It was later discovered that the woman left a suicide note in her car. As a result of the actions of these two officers, the woman survived this acute crisis, and received mental health care. Police Chief Dennis Graham credits teamwork for the successful outcome of this emergency, stating, “Both Abbie and Mitch played a key role in this situation, and by working together and with the many other officers present, they ensured that nobody was hurt and that the woman involved got the help she so desperately needed.” Officer Serrano became a police officer in Milpitas in July of 2000, and has served as a Crisis Negotiator, Field Training Officer, Field Evidence Technician, and Life Support Instructor. Officer Timko joined the Milpitas Police Department in December of 2001, and has served in Patrol Services his entire career. Officials say when rescue crews arrived Tuesday morning, the boy was standing on his tiptoes, trying to wriggle his frozen tongue free from a stop sign pole across the street from Woodward Middle School. Paramedics were able to help the boy by pouring water on his tongue. Once free, the boy told officials he got stuck after his brother dared him to lick the pole. The boy was taken to a Woodward hospital for treatment. The scene was similar to one in “A Christmas Story,” a 1983 movie adapted from Jean Shepard’s memoir of a boy in the 1940s.

WHAT’S HAPPENING’S TRI-CITY VOICE
Doing real science with NASA
“Oh, man, it’s windy today!” you say looking out your window. But how can you tell? Well, trees and bushes lean over and their branches wave wildly. Leaves, trash, and even trash cans fly down the street. The restless air rattles the windows. Anything that can push trees and trash cans around must have a lot of energy. If only we could grab some and put it to work! We can. For two thousand years, people have harnessed the wind to help with their work. Windmills have pumped water from wells, ground wheat into flour, pressed oil from seeds, and even helped with the laundry. When electric lights came into use in the late 1800s, the windmill was put to work to produce electricity. However, most of our electricity has been made by burning coal or natural gas. Unfortunately, burning these fuels adds carbon dioxide to the atmosphere, and makes global warming worse. Wind does not make carbon dioxide. And it never runs out. So more and more power companies are building wind “farms.” A wind farm is a collection of wind mills, or wind turbines, built in a windy location, such as a mountain pass. A wind farm
may have thousands of wind turbines. Together, they can make a lot of electricity. One wind turbine in a nice, windy location can power around 200 homes. To power 200 homes for one month, a coal-fired power plant emits about 1,000 pounds of carbon dioxide into the atmosphere! Still, in the United States, and over the whole Earth, only a small fraction of electricity is made using clean, renewable energy sources like wind. Let’s give more power to the wind! Over 4,000 separate wind turbines make up this wind farm in the San Gorgonio Pass in Southern California. It provides power for over 400,000 people.
