TDA Testifies Before the Texas House Committee on Public Health TDA Council on Legislative & Regulatory Affairs Chair Dr Richard Black of El Paso testified on behalf of TDA before the Texas House Committee on Public Health on April 3, 2013.

• TDA Board of Directors Approves Website Redesign • Texas Dental Program Medicaid/CHIP • TDA Smiles Foundation - Register for the Healthy Smiles Golf Classic

Dr Black testified in support of House Bill 1480 (HB 1480) by Representative Senfronia Thompson (D-Houston). HB 1480 defines the role of Dental Support Organizations (DSOs), gives the state clear oversight of DSOs, and holds DSOs accountable for their actions.

The committee also heard testimony from Health and Human Services Office of Inspector General Deputy Inspector General Jack Stick, Texas State Board of Dental Examiners (TSBDE) Executive Director Glenn Parker, and paid consultants representing numerous DSOs, including Heartland and Pacific Dental Services.

Dr Black’s testimony emphasized that, although DSOs have a place in Texas providing support services to many dentists, safeguards must be in place to ensure DSOs limit their role to supporting licensed dentists and in no way influencing the care provided to patients. Additionally, the testimony highlighted the TSBDE’s lack of authority over DSOs and the fact that the board does not know how many DSOs operate in Texas, where they operate, who owns them, how many patients receive care at them, how many dentists work for them, etc. TDA Council on Legislative and Regulatory Affairs Chair Dr Richard Black testifies on behalf of TDA before the Texas House Committee on Public Health in support of House Bill 1480 by Representative Senfronia Thompson (D-Houston) on April 3, 2013.

TDA Elections Held at the Annual Session American Dental Association 15th District Planning & Review Committee Alan B. Moore, DDS

On Friday, May 3, 2013, at 5:15 PM, the divisional caucus meetings will occur at the TDA annual session to nominate statewide officers and ADA delegates and alternate delegates. The TDA has 4 regional divisions: northeast, southeast, southwest, and northwest. Each year a new director is nominated to serve on the TDA Board of Directors. Also, this year the president-elect of the TDA will be nominated from the northeast division. Along with the officers of the TDA Board, the divisions nominate ADA delegates and alternate delegates to the ADA House of Delegates. These caucus meetings are open to all members of the TDA and offer a unique opportunity for members to be involved in the election process to decide leadership for the association. The TDA House of Delegates votes at its last meeting of the annual session for these positions as well as the editor, speaker of the house, and treasurer. Please know that the ADA 15th Trustee District also needs to fill council and committee seats at the national level. If you are interested in serving, please contact the TDA central office or a representative of your division.

President’s

P R O S E

Michael L. Stuart, DDS, TDA President The final TDA Board of Directors meeting for which I presided was held the first weekend of April. Your Board has had an incredibly successful year. It is a group of dedicated, very hard working individuals who truly have our members’ best interests at heart. Many significant decisions were made in the recent meeting, and I want to highlight one of the most important.

TDA MEMBER

SPOTLIGHT

We are going to have a new website! For many of our members, that is very welcome news. Our present website was designed prior to the development of many of the technologies available today, and, because of that, we were limited on the ability to implement needed changes. Now, with the Board of Directors’ decision to authorize the expenditure for a new website, we will have the ability to present timely information in an easily navigable format.

David J. Heinrich, DDS • Fredericksburg, TX What’s on your bucket list? Chances are skydiving is one of the items to cross off. Dr David Heinrich of Fredericksburg has completed that life adventure … almost 4,000 times!

So, be on the lookout! We should be up and running sometime this summer. Read the TDA Today for updates and see the article on page 2 of this issue for more information.

ED

itorial: Thoughts from Your ED Aaron Washburn, TDA Executive Director

Since I started at TDA, I have kept a pretty busy travel schedule. TDA President Dr Michael Stuart invited me to attend component meetings with him, and I have already had the opportunity to visit 12 of the 26 components, and more scheduled soon. Those trips gave me the opportunity to see some of the diversity that exists in Texas. Some society meetings have been very formal. Attendees wore suits and ties, dined on upscale foods, and enjoyed a wine reception. Others were less reserved: casual clothes, food, and atmosphere. Each event has seemed to fit the unique personality of the doctors attending and the distinctive character of the area in which they live and serve. Regardless of where I have been, the members have shared their love of their profession. They have shown their dedication to this organization and have confirmed their devotion to their patients. It is a great reminder of what a great organization TDA is.

Dr David Heinrich of Fredericksburg skydives in a tandem jump with his niece Diana Heinrich in March 2013 through Skydive San Marcos. Diana is the daughter of Dr Robert Heinrich of New Braunfels, also a TDA member.

Dr Heinrich is a United States Parachute Association (USPA) Accelerated Free Fall and tandem skydiving instructor at Skydive San Marcos. Every weekend, he makes the almost 70-mile drive from Fredericksburg to San Marcos. There, he teaches skydiving students who call him “Dr D” and are completing their bucket and “to do” lists, and he’s adding to his jumps, one at a time. “It’s a thrill a minute and pretty expensive to do,” Dr Heinrich says of the fall, which tops out at 120 mph and clocks out at 5 minutes, making it a quick adventure. Dr Heinrich has experienced trouble opening his parachute 11 times, and these malfunctions add to the excitement of it all, he says. “One time I couldn’t find the handle, and another time I had to pull out my pilot chute in tow. You don’t have much time, so you have to think quickly.” Dr David Heinrich celebrates yet another skydiving jump in March 2013. He is a general dentist in Fredericksburg and a USPA Accelerated Free Fall and tandem skydiving instructor at Skydive San

I hope you feel the pride of being a TDA member. I hope you share that pride with other members and even more with those who are not members. There is no better recruiting program than active members actively seeking to engage new active members. The ADA has resources available through its Member-Get-A-Member campaign to help you recruit new members. You can find out more about that program at ada.org/mgam or by contacting TDA.

inator Dentistry, so she is familiar with the dental profession and has probably met many of you before. And, if you have ever placed a classified or display ad in the Texas Dental Journal, you likely spoke with Lauren to coordinate it. An integral part of the communications team at TDA, Lauren designs the Association’s newest publication Smart Mouth and the TDA Today, starting with this month’s issue. She hopes you enjoy its new look! Where did you grow up? I grew up in the small town of Terrell (home of actor Jamie Foxx), 30 miles east of Dallas. I moved to Austin in 2005 for college.

Where did you go to college? The University of Texas at Austin. HOOK ‘EM!

Dr Heinrich graduated from the University of Texas Dental Branch at Houston in 1984. He received his bachelor of science in microbiology in 1979 from Texas A&M University. He has practiced general dentistry in Fredericksburg for 29 years and has 3 grown children, Melanie, John David, and Patrick. But when Dr Heinrich is away from the dental office in his cozy, quaint little town, he doesn’t think twice about jumping out of a plane more than 13,500 feet in the air.

Dr Heinrich took his first tandem jump on his 42nd birthday in 1999. He says he was hooked the second his feet hit the ground. “Where do I sign up?” he recalls. “I wanted to jump by myself.” So, he received a USPA A-license, which allows him to jump without supervision, pack his own main parachute, engage in basic group jumps, and perform water jumps. He has since skydived all over the U.S. “I’ve jumped in California, Las Vegas, Illinois, Arizona, most of the drop zones in Texas, and Hawaii,” he says. “Each one is different.”

And, Dr Heinrich is different, not quite what one might expect in a skydiving instructor. The low-key and unassuming dentist says hurling himself out of a speeding plane is about the only thrill-seeking trait he has and likens it to … of all things … golf. “It’s a tremendous adrenaline rush, kind of like a hole in one. I’ve come close, but I’ve never had one.” The avid golfer turns 56 this month, and he says his family was not surprised when he fell into both lines of work — dentistry and skydiving. His brother, Dr Robert Heinrich of New Braunfels, and sister, Dr Lisa Heinrich-Null of Victoria, are both dentists, and his great uncle was a World War II paratrooper, whom he admired but never met. And, like father, like sons and daughter. He has passed down his adventuresome spirit to his children. “All 3 have jumped with me. Now … jumping with your family … that makes me a little apprehensive.” However, if you ask him why he jumps out of perfectly good airplanes, he has a pretty matterof-fact-answer that gives a little glimpse into his thrill-seeking side, “Because the door is open!” This recurring section highlights the lives of TDA members outside of the office. If you have an interesting story about yourself, if you are working on a project that your peers might find interesting, or if you have a hobby that keeps you busy, please contact TDA Managing Editor Nicole Scott, nicole@tda.org, 512-443-3675.

TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

In January the Texas State Board of Dental Examiners (TSBDE) adopted new Business Promotion (ie, advertising) rules. These rules will take effect September 1, 2013. This update is the third in a series of articles devoted to summarizing the new rules. Addition to the February TDA Today “TSBDE Update.” The name requirements for advertising and professional announcements do not apply to the dental office’s primary signs used to designate the office location.

Advertising Specialties. A dentist may advertise as a specialist or use the terms “specialty” or “specialist” to advertise professional services in one of the 9 recognized specialty areas of dental practice that are accredited by the Commission on Dental Accreditation (CODA) of the American Dental Association (ADA) and are recognized by a board that certifies the specialty area. To communicate specialization, use “specialist in” or “practice limited to” and limit your practice exclusively to the advertised specialty area(s). You may also state that the specialization is an “ADA-recognized specialty.” You cannot communicate or imply you are a specialist, whether in a general or specialty practice, if you have not received a certification from an accredited institution. Additionally, as the practice owner, it you must clarify and avoid inference that general dentists in the practice are identified as specialists. Advertising as board certified. Dentists may advertise as “board-certified” if you have received a certificate from the specialty board showing you achieved diplomat status, and the specialty board conferring the certification is referenced in the advertisement. Advertising for general dentists. General dentists may advertise that they perform specialty dental services (eg, orthodontics, endodontics) only if the advertisement also includes a “clear disclosure that he/she is a general dentist.” If you are a general dentist, the notations “general dentist” or “general dentistry” must appear directly after your name in a font size no smaller than the largest font used to identify the specific dental services being advertised. For example, a general dentist advertising “orthodontics” must include a disclosure of “general dentist” or “general dentistry” in a font size no smaller than the largest font used for the term “orthodontics.” A general dentist may list specific dental services provided, so long as the listing does not imply specialization. A listing of services provided must be separate and clearly distinguishable from the dentist’s designation as a general dentist. Additionally, any form of broadcast advertising by a general dentist (eg, radio, television, promotional DVDs) must include the general dentist disclosure in a clearly audible manner. Advertising requirements for general dentists do not apply to professional business cards or professional letterhead, or when the signage does not list specific dental services. General dentists only need to make this disclosure when specific dental services are advertised. Advertising credentials earned in dentistry. You may advertise credentials earned in dentistry as long as you avoid any communications that express or imply specialization in an ADA CODA recognized specialty, or specialization not recognized by the ADA. Credentials must be separate and clearly distinguished from your designation as a dentist and they may not be on the same line as your name and designation as a dentist. Abbreviations of these designate credentials must be accompanied by a definition of the acronym immediately following the credential. For example: Jane Doe, DDS, General Dentist FAAD, Fellow Anytown Academy of Dentistry
