The past year has been a rollercoaster for most of us. Increasing oil prices, global financial crisis and various property markets around the globe were feeling the effects of the global financial crisis to varying degrees. While property values in most European markets decreased and stock markets lost dramatically Thailand still proves are save haven for investors. Despite all those negative conditions the resort property markets in Thailand were and are still on the rise. Prices are constant or continue to increase and we see a much more sophisticated market developing. Resort properties are still in great demand by overseas investors and the wheat is sorting from the chaff. Quality developments are still proving successful and investors are seeking for opportunities to diversify their portfolio from tumbling stocks to more substantial investments into real estate.

I expect a full recovery of Thailand’s economy and stabilization within the next 6 months and positive signs from the new Thai government with regards to foreign investment into Thai real estate such as extension of the leasehold period or changes in the foreign quota for condominium projects. We also pursue our proposed THAILAND SECOND HOME PROGRAM which aims at privileges for foreigners in terms of health care, immigration, property financing and more. W

hen investing in resort properties there is generally one golden rule - “location, location, location”. However, especially in a buyer’s market with an oversupply of property, the developments need to differentiate from their competitors creating “unique selling propositions” and making themselves stand out from the crowd. Thailand’s resort markets competition is growing and it is not enough to attract certain target groups (retirement projects, investment properties) or differ with the inclusion of certain facilities or services within the project. A determining key factor is branding. With various hotel chains diversifying into resort properties, branding of developments has reached a new level. Only Phuket features a myriad of internationally branded resort properties such as Jumeirah’s Barama Bay project, Sheraton, Dusit and Banyan Tree – all of which are located in the Laguna area. With Outrigger hotels and resorts, another international brand came to Phuket to manage West Sands and Serenity Terraces, two exclusive beachfront projects. The famous Amanpuri resort still stands as a benchmark for resort properties on Phuket. There are local, national and regional brands that are stirring up the Phuket property market and offering a good alternative to the international chains. Those established names include Richmond Group’s very own resort management, Trisara’s 5-star luxury resort development, the newly built Andara resort, Laguna, and villa developments such as Sri Panwa, Ayara and Baan Thai Surin Hills which are all reputable resort projects. With this article we are focusing on the advantages of resort projects, but also examining the disadvantages and trying to point out what reasons there are for investing in branded resort properties. Beyond that we will advise for which buyers group it is more suitable to invest in locally respected brand names and who should invest in international chain properties.

Despite more and more international hotel management companies moving into Thailand’s resort markets and especially Phuket, various local brands shake up the market. The likes of Ayara, Richmond Group or Two Villas have gained market share and excellent reputation for quality developments and great investments for owners. With prices far below what one would pay for an international brand these brands offer great value for money. Property values increased above average and resales in those developments are much sought-after. Beyond that these projects have a very successful marketing base (e.g. co operations with travel agents) to rent out the units for owners. It is hard to judge whether to buy into an international branded resort development or to go for a local brand. Often it is dependent on the budget one wants to spend or the time to spend in the property.

international brands Branded resort properties enjoy a number of advantages from both, buyers and guest’s point of view. International hotel brands have the highest service standards that each hotel property has to adhere to. Staff have to be fully trained and must show the level of professionalism and dedication that guests know from visits to the brand in other countries. The same counts for facilities such as restaurants, pool areas and fitness, but to name a few. The attention to detail and quality is very high as a renowned brand has an image that has been built up for years. Peace of mind for the customer is a key factor when buying into an international brand.

It all started in the 90’s when Amanpuri sold its hotel villas to private owners. All of which were snapped up within a year’s time. Today, Amanpuri is the leading resort on the island and whenever a villa comes on the market for resale it is snapped up quickly by buyers from the waiting list.

With a variety of international chains coming to the market and offering units for sale prices for those properties are beyond the average selling prices of units in an area. International brands always command a surcharge as it represents confidence from buyers as well as guests’ point of view. “Brand consciousness is a global phenomenon and we have seen this within regards to the hospitality industry with fashion brands such as Armani, Bvlgari and Versace branding hotels down to names such a Trump adding value through the use of their name and image.” says Bill Barnett, from C9 Hotelworks, a Phuket-based consulting firm that specializes in advising hospitality clients in Thailand. local brands However, there are also a number of reasons to decide for local brands instead of international ones. Local brands are generally more flexible with their contract terms. Especially, ownership models can differ from internationally branded resorts and contracts can be adjusted to be more buyer-friendly. Sale-and-lease-back models can be less strict and owners can choose to stay in their property longer than a set period of 30 or 45 days as often compulsory in internationally branded resorts. Usually expenses are less for local brands as the costs for international marketing, operations and human resources are lower. That also determines the net return of the property for the owner as branded resorts can cut off up to 60% of the gross returns for marketing and operations which decimates the net return for the investor/owner. Higher costs can occur for international brands when meeting design standards of the brand. Local brands are not that strict with those regulations as they define their own branding standards, nonetheless can offer the same quality. Local brands also sell their products for a fraction of a global brand. Often the higher costs for bringing an international name in can add up to 30% to the selling price for a property. It is balanced by the fact that returns are generally higher in absolute terms.

Buying property in Thailand is safe and easy as the applicable laws are quite clear and well settled. However, a property purchaser should always conduct a due diligence on the property prior to entering into contractually binding agreements in order to safeguard and protect his or her interests. Such due diligence should be provided by a professional legal advisor to be appointed. Your real estate agency can introduce you to reliable and professional local or international law firms possessing solid backgrounds and experience in this specific field. Your legal advisor will help you to understand the different ownership structures, and shall assist in or perform all the necessary acts required to make your property purchase sound, solid and fully legal. Your legal advisor shall perform the necessary due diligence on the property to assure that it is safe and appropriate for purchase; he shall draft or review the requisite legal documents needed to facilitate the transaction. A Condominium Unit purchase is the most straightforward way to acquire property in Thailand and is relatively simple to complete. Currently, under the law, foreign buyers are allowed to purchase freehold up to 49% of the total sellable area in any particular Condominium building, the remaining 51% of the units must be owned by Thai nationals or Thai companies. A purchase of a Condominium unit is generally paid for by remittance of the purchase price in foreign currency into the Thai Baht account of the seller in Thailand, and the submittal of relevant documentation evidencing such international money transfer to the Land Department on the day of registration of title transfer into the buyer’s name. Upon completion of the Condominium and registration of the project as such with the relevant authorities, every single buyer will receive a title deed evidencing his freehold title to his Unit. Even though the foreign freehold quota of 49% may have been sold out in a particular Condominium building, a Unit forming part of the 51% Thai quota may be acquired by a foreigner through a long-term leasehold structure similar to an Apartment lease as described below, or through the incorporation of a Thai company by the foreigner which can itself purchase the particular Unit. In regard to use of such Thai company, it must be considered that this requires strict compliance with the applicable laws (same as under other jurisdictions) including but not limited to accounting, tax and legal regulations. Apartment Lease

Freehold ownership is the most comprehensive and complete interest in property that a person can possess. Freehold ownership allows the owner full ownership rights to the property to the extent permitted by law. This is similar to the full ownership rights a foreigner would have if he were to buy and own property in his own home country. However, the first thing all foreigners must understand is that foreign buyers, with limited exceptions, cannot acquire freehold interests in land in Thailand. Nevertheless, several ownership structures have beendeveloped and exist in Thailand which fully allows foreign buyers to purchase property in Thailand whether for residence or investment. A summary of these property structures follows:

Another viable option for foreigners for property purchase in Thailand is an Apartment lease. Such leases are generally issued on a long term basis comprised of a 30 year lease period and two additional options to renew for 30 years each. This provides a total of 90 years right to the Unit. Under the current laws of Thailand a lease may have a maximum of 30 years term and legally be registered with the relevant authorities. Therefore renew options giving additional 30 years plus eventual further extension(s) of term are offered and widely used in Thailand. Sophisticated developers have sweetened the deal and have implemented legal structures which allow Apartment lessees to acquire share interest in the company that owns the project land and the Apartment building. Under these structures, the holder of an Apartment lease together with the other lessees in the project, are in effect joint-lessors of themselves who can participate in the management of the Apartment building and assure renewal of the lease terms for additional 30 year periods upon expiration of the first term.

Legal I ARTICLE government has brought laws into effect that allows also foreign nationals or entities to acquire freehold title to land under certain conditions and restrictions. Additionally, land can be purchased under the name of a Thai company having foreign shareholders and/ or directors, provided that the applicable laws in this context have been strictly followed. Such land purchase through the use of a Thai company should be discussed with your legal advisor and may only be recommendable under certain conditions. Freehold restrictions aside, a foreigner may acquire an interest in land through a lease, whereby such leases basically follow the same rules as the Apartment leases described above: maximum period of 30 years with renew options giving a total right of 90 years to the plot. Additionally, a purchase option can be agreed between the landowner and the lessee providing that the lessee shall have a right to demand title transfer upon change of the applicable laws allowing foreign national to hold freehold title to land.

Villa or House

It’s important to know that full ownerships rights to buildings can always be acquired by foreign buyers, although not to the land itself. This separation of ownership of building from the land is contrary to the methods of most of the western jurisdictions. However, in Thailand, the purchase of a long term lease of land (including purchase option) in combination with full ownership of the Villa or building sited upon it has been established as a popular ownership structure for foreign property investors in Thailand.

Land titles A title search should be completed by your legal advisors prior to purchase of any interest in land. Such title search can be supported by a title search report which will identify whether the land has been encumbered by lien or mortgage, and to show if access to the land is secured.

Re-Sale Every property investment must be checked thoroughly in regard to its suitability and capability for a potential re-sale. Therefore, a long term lease subject to rental advance payments should be examined regarding the following points: • • • • •

Lessee friendly termination clauses; Unrestricted assignment and transfer rights for lessee; Protected right of renewals; Protected inheritance of lease rights; Secured access and use of common areas (if applicable)

The highest attention should be paid to the correct application and submission of Foreign Exchange Transaction Forms or other relevant documentation (FET) issued by the receiving bank upon remittance of foreign currency into a Thai Baht bank account in Thailand. At a minimum the FET should clearly designate the purpose of the transfer of funds into Thailand (e.g. Condominium Unit purchase, land and/ or house lease and house purchase) and the name of the transferor/ buyer. Such FET must be provided to the authorities in the event of Condominium Unit purchase, land and/or house lease and house purchase, and the FET can also be used as evidence as to the original source of monies to be later repatriated out of Thailand in case of resale, or as evidence for actual payment of the purchase price if any kind of interest shall be registered against the property with the relevant authorities. Additionally, all taxes and regulatory requirements should be considered to ensure that all funds occurring from a re-sale could be taken out of Thailand and transferred back to country of origin.

Legal Documentation Normally the real estate agent will introduce a buyer to his seller who will ask for the execution of a Reservation Agreement to secure the property. The main purpose of such Reservation Agreement is to reserve the chosen property for a certain period of time, usually 30 days upon signing, and the buyer giving commitment to the sale. Therefore, under such Agreements, payment of a reasonable monetary deposit is usually requested. Subject to the parties negotiations, such deposit can be refundable in the event the rendered due diligence has a negative outcome or the seller cannot provide reasonable main agreements to be entered into by the parties within the reservation period. Upon signing of the Reservation Agreement, your legal advisor will be provided with the main agreements as well as other important documentation i.e. building permit, master plan, licenses if applicable or company documents of involved corporate bodies. The provided legal documentation shall be reviewed by the buyer and its legal advisor within the reservation period, and due diligence shall ideally be completed prior to the expiration of the reservation period. However, a seller should not object to reasonable extension of the reservation provided that issues have occurred which justify such extension and the delay has not been caused by the buyer.

Taxes and Fees Please consider that property transactions in Thailand may be subject to payment of certain taxes and fees, however, the individual responsible for these taxes and fees is subject to negotiations between buyer and seller. Registration of transfer of ownership rights to buildings, land, and Condominium Units may be subject to several taxes (i.e. income tax, withholding tax, specific business tax) and transfer fees as well as stamp duties, whereby the detailed amounts can be verified prior to closing with the relevant authorities by your legal advisor. Registration of lease interest or mortgage against land is also subject to registration fees. Also please note that property ownership itself as well as the income generated therefrom i.e. rental proceeds may be subject to annual and ongoing taxes and fees payable to the authorities. Your legal and/or tax advisor will also assist you in this matter.

Summary Whenever purchasing property under a foreign jurisdiction, the same basic commercial and legal principles that apply to every reasonable property investment anywhere in the world should be considered, i.e. a comprehensive due diligence completed and a broad market analysis undertaken, fair and balanced contracts, and the consummation of a successful transaction and a promising investment assured.

Zen Space Kamala has seen quick development of projects in the lower price range that proved extremely successful. The 64 units in the Trees were sold out within months after launch due to its low pricing of below 3 million Baht and good range of facilities. The following project called Zen Space was just as successful and its 60 units are nearly sold out as well. Located just above the site of the Trees the units allow partial sea views and communal facilities such as swimming pool, fitness, squash and tennis can be used by the residents of both projects. With square metre prices between 40,000 and 52,000 Baht it shows an immense demand for affordable lock-up-and-leave units with a number of facilities for vacationers or longer-term residents.

Kamala Paradise Just recently launched an interesting development is Kamala Paradise, a private villa development only a few hundred metres away from a tranquil beach. With spacious rooms, 3 ensuite bedrooms and modern Asian interiors this exquisite development is very private and yet centrally located in town. Each villa has its own swimming pool and offers great views over the mountainous backdrop of the village.

Andara On the other end of Kamala lies the famous Millionaire’s Mile. Starting with Andara, a luxury villa development and passing the hip restaurant Rockfish you come to an area of secluded villa project in the multi-million dollar range. These established projects such as Waterfall Bay, Leamson Villas or Ayara Kamala have been sold a few years back and seen dramatic increase in property values. Stunning sea views, often private beach access and the size of villas and land plots make those few resales that come to the market not being unsold for very long.

Andara, a prestigious Allan Zeman project, is nearing completion of its first phase of villas that all have been sold for US$ 2.5 million and up. Completed villas have seen capital appreciation already and rental rates are high. A second project phase comprises 37 luxury apartments with 2 – 4 bedrooms. – which market is for who? Thailand is still one of Asia’s foremost holiday destinations with over 10 million visitors every year. Over the last years Thailand’s holiday resorts converted more and more into markets for property investments. Regular visitors to Thailand and international and local investors alike saw the potential that the resort destinations had to offer. But there are significant differences between all the markets and often a prospective buyer is wondering “Which market should I invest in?” Thailand Estates Property Guide is looking into the pros and cons of the Phuket, Pattaya and Samui property market and identifies who should invest where.

Phuket As one of the most developed resort markets Phuket is still the benchmark for all resort destinations in Thailand. Fully recovered from the 2004 Tsunami the island’s property market is a shining star for the international clientele. Since property developments on Phuket’s west coast started as early as beginning of the 90’s is it logical that there is hardly any beachfront land is left in the high-density area between Laguna in the north and Kata in the south. This area has been the property hotspot for the past years but now developers are launching more and more projects elsewhere due to the aforementioned reason of land scarcity. Still seen as the top locations on the island, properties in Surin, Kamala’s Millionaire’s Mile and in the Laguna area command top prices. Amongst the various high-end villa developments that have resale units there is an increase in condominium developments in this area. The north-west with Naithon, Nai Yang and Mai Khao seems an interesting hotspot for new developments. With Trisara being the first luxury resort in this area (which also has villas

for sale) new developments seem all in an upper to high end segment. Malaiwana, Istana and Pearl of Naithon are the first projects that proved successfully in this less developed area. Further north, in Mai Khao, the megaproject West Sands is rapidly gaining shape with the first units nearing completion. Over the coming months it is expected that further developments will be launched in this area. The east coast is becoming increasingly interesting for buyers due to its ideal conditions for boating with several marinas and Phang Nga Bay just minutes away. Cape Yamu with its high-end developments such as “The Cape”, “The Yamu” designed by Phillippe Starck and Baan Yamu seems a favourite spot as well as Jumeirah’s private island development Barama Bay or Royal Phuket Marina. With a total of 3,712 units on the market and a take-up rate of approx. 46% (1,708 units) there is a sign of oversupply in the market. The 10-30 million Baht segment shows the biggest supply of approx. 2,194 units (approx. 59%) and a take-up rate of 43%. Overall the market is still balanced in terms of supply and demand.


Property Comparison I EDITORIAL

Royal Phuket Marina is Phuket’s most desired marina development with property prices of up to US$ 10 million.

Overall a positive development is expected with a consolidation in 12-24 months.

Who should buy? If you look for ultimate luxury and prestige properties then Phuket is definitely the right market for you. A sophisticated clientele with a desire for a private home in a resort with good infrastructure will always come to Phuket. There is no comparable place in Southeast Asia. This has driven prices for high-end properties so far and these prices will remain/increase further.

The Village Coconut Island is a tropical hideaway with villas for sale just off the east coast of Phuket.

The total condominium supply in Phuket is approx. 2,035 units (55% of total supply). With an average square metre price of around 95,000 THB Phuket condominiums are amongst the priciest in Thailand. The average price for a condominium unit in Phuket is 13.1 million Baht. With around 45% of the total supply (1,677 units) the villa market shows a take-up rate of 55% (917 units). This is a good sign for a vigorous market development as currently most projects are still under construction or off-plan. The luxury segment shows the strongest take-up rate for properties between 70 and 100 million Baht with over 70% sold. Especially beachfront properties on the west coast – if they come on the market - command premium prices of US$ 5 and more.

The average price for a villa is 33.8 million Baht.

Summary: Phuket still commands the highest property prices in the all the resort areas in absolute terms and in average. Top end properties command up to US$ 10 million and people are willing to spend this money for ultimate luxury or privacy and a unique property (e.g. private beachfront). Affordable units can be found in less desirable location further away from the beach or inland. West coast properties are still amongst the most sought-after but new areas offer better value for money.

Families with the wish to permanently relocate can find a top international school and facilities here. But also for buyers of holiday homes Phuket is the right choice offering good-value-for-money properties. However, prospective buyers should bear in mind that these properties can be located further away from the beach.

Insider tip: The islands in Phang Nga Bay develop rapidly. Koh Lanta and the sister islands Koh Yao Yai and Koh Yao Noi still offer true island lifestyle and there is plenty of beachfront land for sale. Coconut island – just 650 metres off Phuket’s east coast – offers a private resort with beachfront and 2nd line beachfront villas with all facilities. All year round living is possible but the resort will manage rentals too and attractive returns can be gained.

Samui Samui is often compared to Phuket as its smaller “boutique sister island”. However, with its natural beauty, a laid-back lifestyle and the history as a backpackers destination it attracts very a different clientele than Phuket. Over the past few years Samui property market has suffered due to some “cowboy developers”, and bad press about land encroachment, fake land titles, to name but a few. This has put a bad light on the whole real estate market from which it has recovered over the years. The announcement of several 5-star hotel chains coming to Samui and reputable developers behind those projects, which often offer units for sale, have changed investor’s views towards Samui. The likes of Four Seasons, Conrad Residence, W Retreat & Spa and Banyan Tree are showing that Samui is now catering towards a much higher end market to offer these outstanding projects to.

Even the smaller-scale projects are now showing a much more professional setup and are bringing in added benefits for the peace of mind of purchasers. Professional legal advice, escrow accounts, financing options, often land title insurance ensure that customers are getting what they pay for. The condominium market is developing further, making up 19% (approx. 350 units) of the total supply now. The take up rate is 47% (167 units) although most projects are being sold off-plan or are currently under construction. With approx. 1,200 units, the villa market makes 67% of the total supply. The market here differs a lot from affordable units from as low as 1.8 million Baht to high-end properties of up to 200 million Baht.

The average unit price for both condo and villa is approx. 14.8 million Baht. It is expected that the market will consolidate over the next 2-3 years and quality projects will increase in value whilst low quality projects with insufficient marketing and/or property management will remain stagnant in terms of both, rental income and resale value.

Summary: The Samui property market has a great deal of potential and is still booming. Lacking of on island infrastructure slows this development but with brand names coming to the island there is an upwards trend in sight. The market shows stronger development towards condominium units and prices are expected to increase in conjunction with higher quality of developments and branding.

Who should buy? Samui is still an affordable market with averages prices much more attractive than in Phuket (average price per unit in Samui 43% of Phuket properties). Therefore it is a good entry-level market with prices of villas below 2 million Baht.

Samui offers more private estates for nature lovers. Less density in construction has preserved the island in far parts unspoilt and naturally beautiful and it is still affordable to purchase beachfront properties for below US$ 1 million.


Property Comparison I EDITORIAL Summary: Pattaya is an attractive permanent residence destination with its city lifestyle and full range of facilities, entertainment and shopping. With many big Bangkok-based developers having projects there the level of quality is very high which reflects in the high average price for units. Pattaya can be seen as an interesting investment market with high rental yields and capital gains due to long-term structured lease contracts. Prestigious developments close to the beach command premium prices but will increase in property values over the years.

Who should buy? Investment buyers find an excellent product range in Pattaya. Whether for capital gains Central Pattaya still commands top prices due to the easy access to all facilities.

Insider tip: The south-west of the island is the next place to invest in. Prices are still really attractive compared to the North-east coast and capital appreciation for land is above 15% per annum. Beachfront land in Koh Phangnan is the ultimate tip for investors. Koh Phangnan is the next frontier in resort development and now is the perfect time to start acquiring land there. Prices have increased over the last 12 months already and they are expected to rise further exponentially.

Pattaya Pattaya is fastly becoming one of the more sought after holiday resorts now catering for the now high-end clientele. Driven by local tourism – mainly Bangkokians and the close proximity to Suvarnabhumi Airport Pattaya noted the highest rate of tourism arrivals in all resort destinations in Thailand. What attracts visitor and weekenders and residents alike is that Pattaya offers full city lifestyle in a beach location. It is a watersportsmekka with full array of activities from diving to windsurfing, fishing, boating, and many more. Pattaya is in easy reach of more than 20 top golf courses amongst many other sports activities. There is a great variety of shopping, fine dining and nightlife. Last but not least the easy access from Bangkok makes it an attractive weekend getaway for many Thais and local expats. Most sought-after are the locations in North Pattaya and Jomtien Beach with many refurbished high-rise buildings in central Pattaya. The average square meter prices for condominium units are now at THB 96,000 and are expected to increase further.

Pattaya’s investment market is one of Thailand’s most attractive. For good rental properties yields of 6 to 10% are common. Properties are usually rented on long-term contracts (6-12 months) to expatriates that work on the Eastern Seaboard or retirees.
